The meeting was called to order by Supervisor Burton
at 3.30 P. M.

The Supervisor stated that the meeting had been
called, pursuant to law, and to a resolution of the Tom
Board adopted at a meeting held December 2 7, 1929, to act
upon a petition duly filed with the Town Board requesting
said Board to extend the present boundary lines of Sewer
District No. I of the Town of Mamaroneck and the Sewer
System therein, as now established, so as to include in
and make a part of said District the territory embraced
within the said proposed extension,, which is described in
said petition.
The Clerk reported that due notice of the time and
place of holding the meeting had been given by posting and
publishing, as provided by law and pursuant to resolution
of the Board.
The Clerk presented and read to the meeting a copy
of the notice , together with affidavits of publication and
posting.
Upon motion, duly seconded, it was
RESOLVED, that- a copy of the notice of the
meeting and affidavits of publication and
posting be ordered filed.
Counsellor Gamble stated to the meeting that the
petition received by the Board had been signed by the owners
of real property within the area of the said District to
be served by the proposed extension to said System represent-
ing more than one half in value of the taxable real property
within such area, as appears by the last preceding completed
assessment roll, and had annexed thereto a certificate of the
Board of Assessors certifying as to the total assessed value
of the property within said proposed extension and as to the
assessed value of the property owned by the petitioners,
and that said petition complied in form, substance, and in
the manner of execution, as far as applicable thereto, with
the requirements of the petition for the establishment hmenu of a
sewer district and stated therein the maximum amount pro-
posed to be expended for such extension or extensions, to wit;
the sum of Five hundred thousand ($500,000) dollars a -nd
that said petition had endorsed thereon the written approval
of all of the members of the Board of Sewer Commissioners
of---- of Sewer District No. I and. that there was presented with
the said petition a map prepared by a competent Engineer,
showing the area proposed to be served by such proposed
extension and such change or changes from the plans shown
by the map and plan attached to the paition for the estab-
lishment of the said Sewer District No. 1 which is prepared
in the same manner as the original map and plan and as approved
by the State Board of health.

The Chairman stated that the Board would hear any
persons who desired to be heard prior to the Board taking
action upon the said petition.
No one appeared in opposition to said petition.
After discussion, it was upon motion, duly seconded,
RESOLVED, that the hearing be closed.
Upon motion by Justice Boyd, seconded by Justice
]'illessersmith, it was
RESOLVED, Whereas a petition signed and acknow-
ledged by owners of real property in a proposed
extension to the present Sewer District No. I
of the Town of Mamaroneck representing more than
one half of the onners and more than one halfin
value of the taxable real property therein, as
appears by the last preceding completed assess:-
ment roll, as- is provided by Sections 230 and
230-A of the Town Law of the State of New York,
has been duly filed with this Board, which said
petition described the proposed extension to
Sewer District No. I and stated the maximum
amount proposed to be expended in the construction
of said proposed extension to the aforesaid Sewer
System; that opposite the name of each petitioner
appears the assessed valuation of the real property
owned by it, him or her in such proposed extension
to the said Sewer District, according to the last
preceding assessment roll; and
WHEREAS, there is annexed to and presented with
and made a part of said petition, a map and plan
of the proposed extension to the said Sewer District
No. 1, and said Sewer System, with specifications of
dimensions and connections and outlet to the sewer-
age Disposal Works and Qutfall Sewer, which has
been prepared by a competent Engineer; and
WHEREAS, said petitioners ask the Town Board to
make an order establishing the Sewer District.
described in said petition and stating the amount
proposed to be expended in the construction of
said Sewer Systems ; and
WF7'REAS, in said petition asking for the wtablish-
ing of a sewer system the petitioners Iikevda.e pray
as provided under Section 230-A that the entire
portion of the system in said proposed extension
designed ultimately to serve the entire proposed
extension to said Sevier District No. 1 shall be
constructed in the first instance , and have des-
cribed the said portion or portions in their pet-
ition and indicated the same on the said map and
plan annexed to said petition and have specified
the maximum amount proposed to be expended in the
construction of said portion or portions of said
system, and said petitioners further ask that the
Town Board may include in its order establishing
the Sewer District a direction that the Sewer Com-
missioners shall construct the entire portion of the
said system in the said proposed extension desig-
nated in the said petition until extensions thereto
shall be authorized as provided by law; and

WHEREAS, the Town Board is satisfied, that the
petitioners are owners of real property in the
proposed extension and represent more than a
majority of the property owners in said proposed
extension and own more than one half in value of
the taxable real property therein, and is also
satisfied that the real property constituted within
the proposed extension is or will be of sufficient
value to pay for the cost of the construction of the
Sewer System in said proposed district or extension
according to the estimated cost thereof as set. forth
- in the petition, and is also satisfied that no-real
property which will not be substantially benefited
by the proposed Sewer System is included in the
proposed extension to the District and that all
pr ovisions of the Law relating to the establishment
of the proposed extension to Sewer District No. 1
have been complied with;
W17REAS9 the Town Board has determined that all
the property, property owners and interested persons
within the proposed extension to the District are
benefited by said extension and the construction
of a sewer system therein and that all property,
or property owners benefited are included therein,
and that no property, property owners or any interest-
ed persons not included in the proposed extension
will be benefited thereby; and
VdIiH`REAS, said proposed extension is described in
said petition aa7 follows:
BTGINNINGat a point on the westerly boundary line of
Sewer District No. 1 of the Town of Mamaroneck as noiv constituted
(which paint is the northwesterly corner of said Sewer District
No.l) on the boundary line between the Town of Yamaronedk and the
City of New Rochelle, and thence 25 feet north of the northerly
side of Forest Avenue at which point Forest Avenue intersects the
aforesaid point, thence northerly and easterly and along the afore-
said boundary line between the Town of Mamaroneck and the City of
New Rochelle to the intersection of said boundary line with the
boundary line of the Torn of Scarsdale , thence continuing easterly
along the boundary line between the Town of Mamaroneck and the Town
of Scarsdale to a point thereon 1020 feet more or less easterly of
the easterly side of `' eaver Street and to the northerly boundary
line of land now or formerly of Aldridge. Thence southerly and
along the easterly boundary line of lands now or formerly of Ald-
ridge, now or formerly of Sackett, a distance of 580 feet to the pdnt
of intersection and to the boundary line of land now or formerly
of Sackett and land formerly of Bill; thence westerly along the
boundary line between the lands now or formerly of Sackett and the
land formerly of Bill to a point distant 500 feet easterly from the
easterly side of Weaver Street and 380 feet southerly from the
boundary line between the Town of Mamaroneck and the Town of
Scarsdale; thence southerly 2800 feet to a point distant. 300 feet
northerly of the north side of Collins Avenue and 200 feet easterly
of the easterly side of Weaver Street (at which point said line
intersects the present boundary line of Sewer District No. I) of
the Town of Mamaroneck as now constituted, thence continuing along
said boundary line of Sewer District NoI of the Town of Mamaroneck
as follows: Northerly and along the easterly side of Weaver
Street as it winds and turns and 150 feet easterly thereof to a
point 100 feet northerly of the northerly side of Ward Lane, thence
westerly and oan,llel with the northerly side of Ward Lane and across
Weaver Street at right angles to a point 250 feetvesterly of the
westerly side of Weaver Street, thence southerly 1,500 feet to a
point 150 feet northerly of the northerly side of Vine Road, thence
westerly 350 feet to a point 200 feet easterly of Knoll-wood Drive,
thence southwesterly 225 feet, thence westerly 25 feet to the point
or place of beginning.

All of which proposed extension to said Sewer District
No. 1 of the Town of Mamaroneck is more specifically shown on a
certain map entitled "Sewer District No. One of the Town of
Ksmaroneck, Westchester County, N. Y. Plan showing proposed
extension to be known as Section ff¢ September 1929, L. F
VanE'tten, Engineer"' and which aforesaid proposed Extension to
said Sewer Distrrct No. 1 of the Town of Mamaroneck joins and
abuts upon Sewer District No. Z of the Town of Mamaroneck as now
established along the northerly boundary line thereof.
Therefore be it
RESOLVED, that the aforesaid petition is
approved by this -board; and be it further
RESOLVED, that the aforesaid described property
and proposed extension be and the ,same hereby
is established, annexed to-, and made a part of
said Sewer District No. 1 of the 'Town of Mamaron-
eck; and be it further
RESOLVED, that. the present Sewer District No. I
of the Town of Mamaroneck as now const-ituted, to-
gether with the extension the eof as herein
established continue to be known anddesignated as
"Sewer District, No. 1 of the Town of Mamaroneck"
and that the said District No. 1 and the exten-
sions thereto, be hereafter bounded and described
as follows:-
BEGLN=I G at a point an the westerly side of Chats-
worth Avenue 110 feet south of the intersection of the southerly
side of Myrtle Avenue and the westerly side of Chatsworth Avenue
at which the intersection of the boundary lines of the Village of
Larchmont and the Town of Mamaroneck converge, running thence
-- southerly and along said westerly side of Chatsworth Avenue ,
which is also the boundary line of said Village of Larchmont and
Town of Mamaroneck. 125 feet to the northerly boundary line of the
Village of Larchmont running thence westerly along the northerly

of intersection of the easterly boundary line of the Town of
Mamaroneck at said point with the westerly boundary line of the

to the southerly line of the proposed Cross County Parkway of the
Westchester County Parkway Commission as now laid out, thence eas-
erly and along the southerly side of the said proposed Cross County
Parkway, of the Westchester County Parkv�ay Commission a distance
of approximately 1350 feet snd to a point 160 feet westerly of the
intersection of said Parkway with the northerly side of Nobles
Avenue , (now Avon Road) which point is also 100 feet northerly of
the northerly side of Mohega.n Road; thence northerly and parallel
with the northerly side of Nobles Avenue (now Avon Road) and at
a distance of 150 feet westerly therefrom to a point 100 feet
westerly of the westerly side of Fenimore Road; thence westerly

FURTHER RESOLVED, that the Sewer Commissioners of
Sewer District No. 1 are hereby directed and empowered
to construct, attain by purchase , agreement or other-
wise in the first instance the entire portion of the
said. sewer system in said proposed extension desig-
nated ultimately to serve the entire proposed exten-
sion to Sewer District No. l as described herein and
as designated in the said petition at a cost of not
to exceed $ 500,000. until extensions thereto shall
be authorized as provided by law; and it is further
RESOLVED, that for all purposes of taxation and
assessments this resolution and the Certificate,
herein authorized to be filed shall take effect
immediately ; and further he it

RESOLVED, that the aforesaid .extension to
Sewer District No.- I herein authorized and
established shall hereafter, for all purposes
be n garded as a part of the original system,
heretofore established, and shall be constructed
and maintained by the Sewer Commissioners of the
said District No.. 1 of the Town of Mamaroneck, and
the cost of construction thereof shall be provided
for by the issuance and the sale of Town Bonds in
the same manner as is provided in the Town Law and
by Chalbter 422 of the Laws df• 1922, by Chapter 594 of
the Laws of 1926, by Chapter 437 of the Laws of 1928,
of the State of New York, (or so much thereof as is
applicable), for the payment of the cost of the
original system, which said bonds shall be a Town
charge and the principal and interest thereof, to-
gather with the cost of maintenance of such exten-
sion or extensions, shall be collected from the
real property within the said District by the afore-
said Sewer Commissioners in the same manner as though
the said extension or extensions had formed a part
of the original system constructed in said Sewer
District No. 1.
The Clerk presented to the Board three letters from the
Board of Sewer Commissioners of Sewer District No. 1 of the Town of
Hamaroneck, advising the Board that the Commission had opened bids
for the construction of sewers under Contract Nos. 104, 105 and 106
respectivelyard that the said cost of construction of said respect-
ive contracts , including Engineer's fees and other necessary
expenses , will be6s follows-. Contract No. 104, $559000; Contract
105, $50,000; and Contract 106, $45,000, and requesting the Board
t.o authorize the issuance and sale of Certificates of Indebtedness
from time to time as payments become due under said respective
contracts in the said sums of $55,0002 $50,000 and 945,000 respect-
-- ively, all of said Certificates to be issued by the Supefivisor as
provided under the provisions of the Laws of the State of New York.
Counsel advised the Board that he was familiar with the
said requests and had discussed the same with the Board of Sewer
Commissioners , and that the same were in proper form, and that the
Town Board was in a position to authorize the issuance of said
Certificates of Indebtedness in said respective amounts so that
the viork under said contract could proceed.
After discussion, upon motion duly seconded, it was upon
roll call unanimously
RESOLVED, TStT,`EREAS, the Board of Sewer Commissioners
of Sevier District No. 1 of the Toren of Mamaroneck
have estimated and reported to this Board the
estimated cost of construction of Contract Nos.
104, 105 and 1062 repectively, determined as
required by Iaw;and
VVIETREAS, pursuant to law the Town Board shall cause
Certificates of Indebtedness to be issued, the same
- to he a Town charge, the proceeds of which Certific-
ates shall be applied in payment of the cost of con-
struction of said part or portion of such Sewer Dis-
trict as is so rea_uested by said Sewer Commissioners;
therefore be it
RESOI,VPD, that the Supervisor be and he hereby
is authorized, empowered and directed in accorl-
ance with the law, to borrow upon the faith and
credit of the Town of Mamaroneck, the respective
stuns of not to exceed 155,009 for Contract No. 104;
$509000 for Contract No. 105 and $ 459000 for
Contract No. 106 respectively, plus interest which
may from time to time accrue thereon,respectively and
to issue temporary Eertificate or Certificates of
Indebtedness respectively in the amount of not to
exceed the respective sums of $55,000'* %50,000 and
--- $45,000 respectively plus interest which may from
time to time respectively accrue thereon, which said-
Certificates of Indebtedness shall bear interest at
the rate of not to exceed six per centum per annum,
payable at such time or times as the Supervisor may
fix, not exceeding, however, eighteen months from the
date hereof, and to sell or dispose of said respective
Certificates of Indebtedness for not less than the
par value thereof; and further

Indebtedness shall be in substantially the following

ledges itself indebted and for value received promises to pay to
bearer hereof, or if the same be registered, to the registered
holder, on

interest thereon from date at the rate of per centum per
annum, both principal and interest being payable in lawful
money of the United States at
This Certificate of Indebtedness is one of an issue of
of Certificates of Indebtedness heretofore authorized
in the sums
of having been hereto-
fore issued, being issued pursuant to the provisions of the
Town Laura constituting Chapter 61 of the Consolidated Laws of the
State of New York, Chapter 594 of the Laws of 1926 and Chapter
437 of the Laws of 1928 of the State of New York, and in strict
compliance with the Constitution and Statutes of the State of
New York and by virtue of a resolution of the Town Board of the
Town of Mamaroneck regularly and lawfully adopted January 22, 193Q
It is hereby certified and recited that all conditions,
acts and things reauired by the Constitution and Statutes of the
State of New York to exist, to have happened and to be performed
precedent to and in the issuance of this Certificate of Indebted-
ness exist, have happened and have been performed, and that the
issue of Certificates of Indebtedness, of which this is one, to-
gether with all other indebtedness of said Town of Mamaroneck is
within its debt and other limits prescribed by the Constitution and
Laws of this State.

RESOLVED, that the Town of Mamaroneck hereby
novenants to pay the principal and interest of
said respective dertificate or Certificates
of Indebtednesx in the amounts hereinabove
provided as the same shall become due, by
levying assessments on property of Sewer

such time or times and in such amounts as may
be necessary therefor.
The Town of Mamaroneck further covenants in case
of a default in carrying out the foregoing coven-
ant, the said Town will raise by taxing all taxable
property in said Town of Mamaroneck from time to
time the sum or sums sufficientt to pay the prin-
cipal and interest of said respective certificate
or certificates of indebtedness as the same shall
become due.
Justice Leeds raised the question of painting the interior
of the Weaver Street Building.
Upon motion duly made and seconded, the matter was
referred to the Special Committee on the Weaver Street Building.
Counsellor Gamble, ireporting for the Special Committee
to which had been referred the petition of the County Transportation
Company in regard to a change in bus routes, said that he believed
a public hearing should be called to ascertain the views of the
citizens of the Town in regard to this matter. He believed it
would be satisfactory to the Town if the Company would give them
permission to modify its Rye Beach line as requested, but thought
that further consideration should be given to the requested change
on the Harmon Drive Route.
Upon motion, duly seconded, it was
RESOLVED, that the Town Board meet at 2 P.M.
on Friday, January 31st to receive a further
report from the Special Committee and consider
these matters further.
Mr. Gagliardi presented a petition signed by Fenimore
Cooper Estates, Inc. , et al. , dated January 2nd, 1930, addressed
to this Board requesting this Board to take such steps and adopt
such measures as may be necessary and proper to improve Avon Road,
Rockland Ague , Dundee Road, Oxford Road, Mohegan Road and
- Winged- -Foot Drive , urhich are shown on the map annexed to said
petition and located within the Larchmont Ridge Subdivision, assess-
ing the cost thereof against the property benefited as by Chapter
549 of the Laws of 1926, as amended.

Re: Westchester Foundation Inc v Town of ;Kamaroneck, et al
My dear Supervisor.
In April 1929 your Town Board referred to this
firm for the purpose of looking after the interests of the
Town the above action which is brought to foreclose certain
tax liens affecting 23 parcels located in the Town of Mamaroneck.
This action has progressed to a point where ahale of
the premises in question is about to take place and the purpose
of this letter is to ask the Town Board for definite instructions
as to its wishes pertaining to the sale.
The judgment of foreclosure and sale directs the Super-
visor and Receiver of Taxes to cancel all taxes and assessments
for school taxes or rights accruing by reason of such taxes for
the payment of which the proceeds of such sale may be insufficient.
This is in accordance with the provisions of Sections 45 and 46 ofthe
Westchester County Tax Act and unless the Town is prepared to bid
at the sale for an amount, equal to the amount of taxes , costs and
disbursements, you will be requested to comply with theterms of the
judgment unless the premises should bring enough to cover the
taxes and the costs in question.
I have computed the amount of taxes outstanding against
the parcels affected by this action and the same aggregate the sum
of approximately $3,900.00 to which there should be added the amount
of costs , disbursements and extra allo-T!ante which have been taxed
at $847.74. Tb said amounts there should be added the sum of
$640.00 for additional allowance of $20.00 for each cause of action
set forth in the complaint. The above amounts are exclusive of
Village taxes.
I should like to be advised regarding the above at an
early date in order that I may know what to do on the sale which
is scheduled for January 24th, 1930.

ing, he said, as a taxpayer, thought the matter had been referred
to Counselor Gamb-le. Mr. Gagliardi said he had received a letter
from the Town Clerk informing him that the matter had been referred

Counselor Gamble , and that the Clerk be and he
hereby is directed to advertise said public hearing
in the Larchmont Times pursuant to Law.
Supervisor Burton announced that he had appointed
J. J. Rossbottom chairman of the newly created Board of Appeals
for zoning, and requested the Clerk to send out notices to this
effect to each member of the Board and to ask Mr. Rossbottom to
call the Board together in order to organize for its work.
The Supervisor further said that the terms of the
members of the Board would expire serially as follows -

and that the Board should decide for itself which terms the
several members should hold; at, the same time the Board should
consider the financial requirements for its work and notify the

the Board that several appeals are now awaiting its consideration.
Supervisor Burton submitted two bills presented by J.
Henry Esser for special legal services in connection with zoning

a form of advertisement for a Public Hearing to be held by the
Town Board in connection with the Tortorella petition for
rezoning on Myrtle Avenue and stated that it would be necessary
for the Board to fix a date for said Hearing.

side Drive on behalf of five residents of Stoneyside Drive ,
requesting the extension of a sewer line from Mulberry Lane to
Rockland Avenue.
The Clerk reported that he had been informed by Robert
H.. Stevens , Chairman of the Sewer Commissioh,_ that plans for this
work had already been completed, that bids had been received, and
that actual construction should start within a few weeks.

Works,- No. 19, urging prompt. action by the Town zT the sale of
$100,000.00 Distribution Bonds and $98,000.00 Central Water Works
Bonds, heretoforemathwiaed by the Town Board and available for

After discussion the following resolution was offered

WHEREAS, pursuant to authority conferred by Chapter 554
of the Laws of 1927,, the Town of Mamaroneck has heretofore caused
to be issued bonds known as Water Distribution System Bonds in the

of the proceeds of which the said Town of Mamaroneck has u

ities to acquire, construct, provide, maintain and operate a water
works system; and
WHEREAS, said Town jointly with the Town of Harrison and
the Village of Yame.rcneck has caused to be formed and organized a
joint water works known and designed as Westchester Joint Water
Works, No. 1; and
WHEREAS, proceedings have been duly and regularly taken
as authorized and required by said Chapter 654 of the Laws of 1927
in order to authorize the Town Board to su-#mit to the electors of
said Town a proposition for the acquisition of a water works systaa
and the issuance of bonds; and
and
WHEREAS, at a special town meeting duly/regularly
