H. Present: Supervisor Burton Justices Boyd, Collins and Messersmith Town Clerk Marvin Counselor Gamble The Clerk read the call of the meeting, a copy of which had been sent to each member of the Board, and upon motion, duly seconded, it was approved. The Clerk presented and read the minutes of the organiza- tion Keet.ing of the Town Board held on Friday, January 3rd, 1930. I Upon motion, duly s-econded, it was RESOLVED, that the minutes of the Organization Mdeting held on January 3'rd, 1930, be and the same hereby are in all respects approved, ratified and confirmed. Justice Boyd presented the following resolution, duly seconded by Justice Messersmith: RESOLVED, that the actions of this Board in the making of appointments of Officials and Commissions of the Town of Mamaroneck and the fixing of the amount of their respective bonds and the fixing of salaries of all Officials, Officers and Commissions, all of which said action was taken by this Board at the Organization fleeting duly called and held on January 3rd, 1.930, be and the same hereby are respectively approved, ratified and confirmed. The foregoing resolution was, upon roll call, unanimously adopted. Supervisor Burton advised the Board that he was now ready to appoint a Board of Appeals under the Zoning Ordinance of the Town of Mamaroneck. He stated in this connection that in his opinion certain amendments should be made to the Zoning Ordin- ance. He stated that he believed that if practicable the Zoning Ordinance should be amended so that the jurisdiction on the matter of Appeals should be lodged with said Board of Appeals without what amounted to a second appeal, i. e. the hearing before the Town Board for its joint consent.. He stated that in his opinion the Zoning Ordinance of the Town was sound and that there were several other minor amendments which dvuld be made. He stated that he thought also that due to the volume of the work that the Town Board should if legally proper, provide a Secretary for the Board of Appeals, who would carry on the correspondence and detail work. He thereupon advised the Board that he had requested the following gentlemen, residents of the unincorporated part of the Town, to serve on the Board of Appeals and that each of them had consented so to act. Me thereupon announced the appointment of the following to serve on said Board of Appeals: Messrs. T. J. Rossbottom Clifford W. Cross G. C. Worth Orson Raynor Fred G. Smith 33 He stated that he would at the next meeting of the Board designate the Chairman of the Board and the terms of Office of the several members thereof, at which time he would ask the approval of this Board of the appointment he had made.. He recommended to the Board that it refer the matter of the amendments which he recommended to be made to the Zoning Ordinance to Counsel, as well as the drawing of the proper resolutions covering the appointment and approval of the members of said Board. On motion, duly seconded, it was RESOLVED, that this Board refer to Counsel the question of making the amendments to the Zoning Ordinance recommended by the Supervisor, as well as such other amendments as Counsel may deem proper, and the drawing of the necessary amendments in connection therewith if practicable , together with the drawing of the necessary resolutions covering the appointment of the Board of Appeals as recommended by the Supervisor. The question of the adoption of the foregoing resolution was put to a vote and it was carried unanimously. The Supervisor 'Left the room and Justice Boyd was upon motion, duly seconded declared temporary Chairman in order that the question of the Supervisorl7s salary might be brought up. Upon motion, by Justice Collins seconded by the Clerk, it was upon roll call unanimously RESOLVED, that the salary of the Supervisor, under the Westchester County Tax Act, for the term beginning January lst, 1930, be and the same hereby is fixed at the rate of $4,.250.00 per year, and it was further RESOLVED, that the salary of the Supervisor under the Highway Law, be and the same hereby is fixed at the rate of $2,000.00 per year. The Supervisor then returned to the room and kesumed the Chair. Protests were received from Mrs. Robert F. Degen and Mrs. B. F. Jenks, both residing on Harmon Drive, putting themselves on record against the proposed change in the bus line operating on Harman Drive. The protests were ordered received, placed on file and referred to the special committee which is considering the proposed change. Two communications were received from Ca ptaro C. D. Bray of the Weaver Street Fire Company, No. 1 and owing to the pressure of other business, it was voted that they lbe held over until the following meeting. The annual report of the Building Commission of the Town of Mamaroneck was received, spread upon the minutes and placed on — file. January Ef 1930 Supervisor, Members of the Town Board of the Town of Mamaroneck Mamaroneck, N. Y. Gentlemen:— We herewith submit our annual report for the year 1929: b myPy-I} V Your Building Commission has held 51 official evening meetings and various members have attended Zoning hearings and taken care of the Building operations in the unincorporated part of the Town. A total of 186 plans have been filed of which 182 have been granted, the balance of four having been denied. We have one appeal case pending in court and a second case has just been decided by Judge Young in favor of the Town. We have no cases decided against us. Simpson, 5 Courtland Avenue, Mamaroneck, on behalf of the Build of the Larohmont Avenue Church, requested permission to use the Weaver Street Building on Monday,.afternoon, February 10th, for a card party. The request was unanimously granted. Upon motion, duly seconded, it was upon roll call, unanimously RESOLVED, that the salary of the Auditors for the term beginning January 1st, 1930, be and the same hereby is fixed at the rate of $ 5.00 per day for each day of work, not to exceed 100 days per year. z'7 Upon motion, duly seconded, it was upon roll call, unanimously EffSOLVED, that the pay per diem for the members of the Board of Sewer Commissioners, be and the same hereby is continued as at present. The Supervisor presented the letter which he had spoken of at the meeting on January 3rd, offering for the consideration 6 the Board, certain recommendations relating to the Town government and its affairs. Upon motion, duly seconded, it was =•'SOLVED, that the communication be received spread upon the minutes, placed on file and the recommendations considered.. To the Town Board of the Town of Mamaroneck, New York Gentlemen-- Supplementing my brief communication presented to you at the organization meeting last week, I herewith present for your consideration some recommendations relating to the Town government and its affairs. Water The water supply system of Westchester Joint Water Works No. 1, in which the ' own is part owner, is managed by a Board of Trustees of which your Supervisor is one member. Under the direction of that Board the old water supply -- system of the New York Inter Urban Water Company has been very much enlarged and improved. The new filters, pumps and machinery have been completely installed, and the first stage of the original program of betterment and enlargement of the system has been completed. ' We are now entering upon the second and final stage xf con- sisting mainly of the building of new dams and storage reservoirs and to finance this work a further bond issue will presently be needed. The Town Board has already approved the plan, but under the law we cannot issue our bonds until the bond selling resolution of the Village of Mamaroneck, vehich under the Village Law must lie dormant for thirty days, becomes effective. As soon as the resolution of the Village becomes a ective , which will be within the next few weeks, I trust that we w 1 promptly sell our bonds and do our share towards the completion of the water supply system in the benefit of which we will all share alike. POLICP During recent years the Town has established and developed a police department capable of giving our people the protection to their homes and property to which they are entitled. The super- vision of that department should lie with a Police Commission appoint ed by the Town Board. Under the various statutes adopted from time to time we find four or five distinct plans for the establishment and mainten- ance of a policeforce. Some years ago we had a police commission appointed under- one of these acts. There were three commissioners named by the Town Board, the Supervisor being one of them. The other two commissionerships became vacant and it was called to my attention that under Section 121-A of the Town law, as recently amended, it was my duty as Supervisor to take full responsibility for the police department and to be the sole commissioner. The portion of this section reads as follows: 239 ' The Supervisor of any such town by virtue of his office , shall, notwithstanding the provisions of any other statute, be police commissioner in charge of and control of such police force, sub- ject to the direction of the Town Board. For some time I have felt that the Town Board should have the services of a police commission composed of some of our many capable and interested citizens, who can and are willing to accept appointment as police commissioners, and to this end I have recenw. taken further legal advice , with the result that, notwithstanding the provision of Section 121-A, I believe the police commission with three commissioners can be re-constructed provided the Super- visor serves as one member, and this I am willing to do. ZONING BOARD OF APPEALS With the single exception to which I will hereafter refer, the Town in my opinion has a good zoning ordinance , and which has been upheld under attack, and which appears to be fair and beneficial. I now recommend, however, that we amend our ordinance by eliminating those provisions which require the approval by the Town Board of the action of a Zoning Board of Appeals. There is no need in my judgment, of having two independent Boards pass upon a variance in the case of an individual hardship, and I am confident that my vfews are in line with the best expert judgment on zoning. With the foregoing changes made in our zoning ordinance I recommend the appointment of a Board of Appeals to take charge of this matter. This will save the Town Board considerable time at its meetings which may be devoted to other urgent business, and above all give the property owners the speediest and best manner of getting relief in cases where they are entitled to it. While we have tried to give them this relief through the Town Board in the past and the action of the Town Board has not been upset. in the courts for the reasons above stated, I recommend that these matters be disposed of in the future through a Zoning Board of Appeals. BUILDING CODE In order to make full provision for the regulation along progressive and helpful lines of the great amount of new building which may be anticipated, I recommend the revision of our Building Code and advocate that financial provision for this work be ma in our next budget. In line also with this suggestion, and so thade t our Building Commissioners may have compensation for the services which they are now rendering, and the work which will be expected of them, suitable compensation for their services should be provided and if any legislation is necessary to make this suggestion effective, we should see that such legislation is obtained. As to the other matters referred to in last weekrs com- munication, these were discussed by me before the Town Board at the last meeting and I have nothing further to add at this time.
