IMETING OF THE TOWN BOARD

held December 27th, 1929.
The meeting was called to order by Supervisor Burton
at 3r-30 P. 21.
Present: Supervisor Burton
Justices Boyd, Howell and Leeds

Counsellor Gamble
Upon motion, by Clerk Sherman, Walter R. Marvin, Jr. ,
Clerk-elect, was invited to take the chair as Clerk, and record
the minutes of the meeting, for which he thanked Yr. Sherman.
Upon motion, duly seconded, it was
RESOLVED, that the minutes as printed for
the meetings of November 12th, 27th, December
3rd , 7th, 12th, 18th and 20th, which have not
been approved heretofore, be and the same here-
by are approved, Justice Leeds not voting for
the adoption of the resolution.
A communication from Mr. Fred T. Wilson, was received
and read, representing the Mamaroneck Lions Club , requesting the
Town Board to approve the draft of a resolution urging the
Village of 11tamaroneck Board of Trustees to adopt the Comprehensive
Plan for the Village of Mamaroneck, which plan was prepared by the
Technical Advisory Corporation.
The communication was ordered received, placed on file
and laid over for further consideration.
A communication was received from the State Department
of Agriculture and BSarkets, in relation to the dog census to be
made in the month. of January, 1930. This communication informed
the Board that an Enumerator must be appointed in the month of
December to take this census, remuneration to be paid by the
County Treasurer at the rate of 20¢ for each dog and puppy listed.
Upon motion, duly seconded, it was
VOTED,, that the communication be received and
placed on file, and an Enumerator appointed.
Upon motion, duly seconded, it was
RESOLVED, that pursuant to provisions of
Section 108 of the Agriculture and markets
Law of the State of New York, that Louis
Stiebel be and he hereby is appointed
Enumerator, whose duty will be to prepare
lists of all owners or harborers of dogs
in the Town of liamaroneck, in the month
— of January,. 1930.
The question of the adoption of the foregoing resolution
was put to a vote which resulted as follows -
Ayes: Burton, Boyd, Howell and Sherman
Not voting: Justice Leeds.

Counsellor Gamble raised the matter of setting aside and
cancelling certain taxes heretofore levied and assessed against the
property now oaaned by the Westchester County Park Commission and/or
County of Westchester, in accordance with petitions heretofore filed
by said Commission.
After discussion, it was, upon motion, duly seconded
RESOUM, WIETREAS, the County of Westchester
acting by the Westchester County Parkway
Commission under the provisions of Chapter
-- 292. of the Laws of 1922 and the Acts amdnd-
atory thereof and supplementary thereto, have
acquired prior to the making up of the Assess-
ment Roll of the Town of P-ramaroneck in the year
192.7 for the joint County and State taxes for the
year 1928, and is still the owner of the parcels
of land situated in the Town of Tamaroneck here-
inafter more specifically described as the same
appear upon the Tax Assessment Hap of the Town
of Mamaroneck; and
VT=REAS, the County of Westchester is the owner
of the aforesaid parcels of land, being a munic-
ipal corporation duly organized and existing under
the Laws of the State of New York, is under the
provisions of Section 4, Subdivision 3 of the
Tax Laws of the State of New York, exempt from
taxation; and
GV?iEREAS, the legality of the Act creating the
Westchester County Parkway Commission in so far
as its property is exempt from tax by the pro-
visions of said Act has been passed upon by the
courts and held to be a valid provision thereof;
and
T=I=AS, the State Tax Commission has advised
the Board of Assessors of the Town of Yamaroneck
that said property is exempt from tax in that the
title to the real estate is now in the name of the
County of Westchester and not in the name of the
Westchester County Parkway Commission; and there-
fore be it
BI,SOLVED, that the Supervisor, Receiver of Taxes
and/or the Board of Assessors be and they hereby
are authorized, empowered and directed to cancel
vacate and. set aside the taxes heretofore levied
and assessed for the respective years of the follow-
ing described parcels of land, respectively, now
owned by the County of Westchester and/or Westchester
County Parkway Commission and to so mark their records
accordingly; further
RESOLVED, that the Supervisor and Board of Assessors
be and they hereby are authorized, empowered and
directed to mark upon the Assessment Roll and/or
Assessment Books of the Town of Hamaroneck the
following property as exempt from assessment and
taxation upon the assessment rolls and the books,
records and all other official records of the Town
of 1damaroneck, so long as the hereafter described
property is owned by the Westchester County and/or
the Westchester County Parkway Commission.

Further
RESOLVED, that the Supervisor, Receiver of Taxes
and/or the Board of Assessors be and they hereby
are authorized empowered and directed to cancel,
vacate and set aside all taxes heretofore levied
and assessed for the years 1928 and 1929 on the
above described parcels of land now owned by the
County of Westchdster, and/or Westchester County
Parkway Commission, and to so mark their records
accordingly.
A communication was received from Mrs. A. H. Howland
of 5 Eden Avenue « Larchmont, N. Y. , reauesting the use of the
Weaver Street Fire House auditorium for the annual bridge party
of the Garden Club of Larchmont, on January 27th, 1930.
Upon motion, duly seconded, the reouest was granted.
Justice Leeds presented a letter f rom George W. Kohloff
of the Larch-mont Post Office recuesti.ng the use of the deaver
Street Fire House auditorium on Sundays January 19th, 1930, for a
meeting of the Westchester County Post Office Carriers and Clerks.
Upon motion, duly seconded, it was voted that the rea_uest
be granted.
The report of the Town Clerk for the month of November
1929, was received and ordered placed on file.
Justice Leeds reported for the Fire House Committee that
repairs had been made to certain broken window panes and he moved
that the report be approved.
Upon motion, duly seconded, it was
RESOLVED,, that the report of the Fire House
Committee regarding broken window panes,
be and the same hereby is approved.
Supervisor Burton brought up the matter of the County-wide
Police telephone-typewriter system, which all the Police Departments
in Westchester County are installing. This system will connedt with
all county police departments and also have connections with New York
and Connecticut police at a cost of about µ36.00 per month. It will
be maintained by the Telephone Company.
Upon motion, duly seconded, it was
RFSOLVFD, that the Police Department of the
Town of Mamaroneck subscribe to the County-wide
Police telephone-typewriter.
Upon roll call., the foregoing resolution *vas unanimously
adontsd.
It was decided that the organization meeting of the new
Town Board will be held on Friday, January 3rd, at 1 P. M. to
organize for the year 1930.
Counsellor Gamble reported that a petitionn had been duly
filed with the office of the 'Town Clerk by the Board of Sewer Comm-
issioners of Sewer District No. I of the Town of Mamaroneck, request-
ing the Town Board to extend the present. boundary lines of Sewer
District No. 1 as now constituted so as to include therein a proposed
extension to be known as Section H,, the specific boundary lines of
which he stated were described in the Petition, but included generally
the Northwest portion of the Town of Mamaroneck along Beaver Street
from the present Northerly boundary line of Sewer District No. 1
on the South to the boundary line between the Town of Lamaroneck

and the Town of Scarsdale on the North, and from the boundary line
between the City of New Rochelle and the Town of Iuamaroneck on the
West to a line approximately 400 feet Easterly of the Easterly side
of Weaver Street as it winds and turns. He stated that the Petitiors
were in proper form, have endorsed thereon the unanimous written
approval of the Sewer Commissioners of Sewer District LTo. 1 of the
Town of Mamaroneck, and were signed by the owners of real property
within the areafn said district to be served by the proposed
extension to the said system representing more than one half in
value of the taxable real property within such area , as appears by
the last preceding completed assessment roll, as is shown by the
Certificate of the Board of Assessors annexed to said Petition,
and in all respects complied with the requirements of the Law=
He further stated that it would be necessary to call a public ineet-
ing to consider said Petition.
After full discussion, the following resolution was, upon
roll call, unanimously adopted.

Board a petition requesting this Board to
extend the present boundary line of Sevier
District. bTo. 1 of the Town of Fdamaroneck,
which is in proper form; and
[WHEREAS, pursuant to law this Board must give
notice of the meeting at which it will act on
said petition= therefore be it
RESOLVED, that a special meeting of this Town
Board be held on January 22,1930 at 3:.30
atclock at the office of the Town Clerk
Eo. 8 Elm Street, Yamaroneck, New York, at u%r_ich
time and place it will meet to act on the aforesaid.
Petition to extend the present Sewer District
No. I of the Town of Yamaroneck, and the
Sewer System contained therein, as now established
so as to include in and make a part of said
district the territory embraced within said
proposed extension which is described in said
Petitions and be it further
RETSOLVED, that the Clerk give due notice
of such special meeting by publishing in the
Daily Times and posting as provided by Law.,
Counsellor Gamble brought up the question of cancellation
of certain taxes for St. Johnts Church, Larchmont and after discussim
upon motion, duly seconded, it was
RESOLVED-, WHEREAS, St. Tohnts Church of Larchmont
has duly presented a Petition to this Board from
which it appears that it was the actual owner from
August 4th, 1922 to date of Lots Eos. 1-2-2-4-26-27
2.8 and 29 in Block 25 , Section I on the Assessment
Paiap of the Town of iamaroneck, although/ the deeds
to said property through inadvertence were not
recorded until September 28, 1928; and
WHEREAS, the Petitioner is a Religious Corporation
-- and alleges in said petition that. it is, and has
been since it became the owner, its intention to
devote the same to and for religious purposes, and
therefore by Law was and is entitled to have said
property marked °Exempt" on the Tax Rolls of the
Toxin of Agamaroneck; and
WHEREAS$ through inadvertence and an error on the
Part of St. John's Church application was not made
heretofore to have said property made exempt; and
WHEREAS, St. Johnts Church of Larchmont, has heretofore
and on April 10th, 1929. ILay 31st2 1929 and September

9th, 1929, respectively duly paid to
The Town of Mamaroneck all taxes due and owing
on said property for the years 1923 to 1929 inclusive ,
including all interest and penalties which had
accrued thereon without the knowledge of St.- Tohn *s
Church of Larchmont, amounting to a total of
qp1301.789 as set forth in the Schedule A Attached
to said petition.- and
=REAS, it seems eouitable to this Board that a
refund should be made to St. John's Church under
_ the circumstances disclosed in said Petition, it
being a. Religious Corporation and entitled to be
exempt in toto from said taxes, therefore be it
RESOLVED, that the Supervisor be and he hereby is
authorized and empowered to refund to said St.
Tob.n's Church of Larchmont, upon the presentation
of'a, claim in proper form in accordance with this
resolution, for the taxes heretofore paid to the
Town of Mamaroneck on said Lot Nos._ 1-2-3-4-26-27
and 28 and 294 in Block 25, Section 1, on the Ass-
essment lap of the 'Town of Mamaroneck for the years
1928 and 1929, amounting to -$397.14, and the amount
of interest, penalties , cost of Redemption and cost
of Sale and Advertising, heretofore paid the Town of
Mamaroneck for the years 1923, 1924, 1925, 1926 and
1928, amounting to $239..64, a total amount of $636.78;
further
I7SOLVED, that the Supervisor. , Receiver of Taxes
and the Board of Assessors be and they hereby are
authorized, empowered and directed to mark upon
their books of record, including the Assessment
Roll of the Town of Namaroneck, the aforesaid lots
to-wit; Lots Nos. 1-2-a-4-26-27-28 and 29, in Block
25, Section 1, 'I=I; T'I from assessment so long as
such property shall bo be owned by St. John's Church
of Larchmont, being property owned by a Religious
Corporation and alleged by it to be intended to be
used for religious purposes , further
RESOLVED, that when and as and if said St. John's
Church of Larchmont shall sell and/or transfer
said property or any part thereof for other than
religious purposes, the exemption herein granted
shall cease and terminate.
Supervisor Burton pointed out that this was the final
meeting of the old Board, expressed his appreciation of the work
of the old Board which he called two years. of constructive work.
He regretted the departure of two of the members, hee6xpressed his
thanks to them and extended to all, his very best greetings.
Upon his motion, it was duly moved and seconded that
a committee be appointed by the Supervisor to prepare suitt le res-
olutions for the retireing members.
He appointed Justices Boyd, Collins and Leeds and Counsellor
Gamble.
Clerk Sherman expressed his appreciation of his 10 years
service on the Board,during what he called the "most constructive
term of the history of the Town". He said he was glad to a lways
help the Town administration in anything he dould do, and he hoped
his successor would call upon him whenever necessary.
Justice gewell expressed his appreciation of his associa-
tions during the past four years and extended his greetings for a
happy and prosperous new year for all.
Upon motion, the meeting adjourned at 4:30 P. M.
