TOWN OF MAMARONECK, N. Y.
held December 18th, 1929.
The meeting was called to order by Supervisor Burton
at 9:15 P. M.

In the absence of Town Clerk Sherman, Justice Leeds acted
as Clerk.
Upon motion, duly seconded, it was voted to dispense with
the reading of the minutes of meetings not yet approved.
The Board considered building applications which had been
laid over, by the Town Board at its meeting held December 3rd, 1929s
and after- due consideration, the following resolution was presented
and adopted:
RESOLVED WHEREAS, the Town Board of t-he Town
of Mamaroneck, has duly advertised pursuant to
law, a public meeting for the purpose of con-
sidering certain applications therein stated,
made under the Zoning Ordinance of the unincorp-
orated part of the Town of Mamaroneck, which
applications are now pending, and
WHEREAS, the said Town Board having Meld said
hearing and both parties having been granted
the privilege of appearing for or against the
granting of certain applications az provided
under the said Zoning Ordinance, and after
due consideration, therefore be it
KESOLVED, that the Town Board of the Town of
Mamaroneck, sitting jointly as a Board of
Appeals and as a Town Board, does hereby
grant the following applications from the
decision of the Building Commission, which
decision is hereby reversed and does hereby
consent to the granting of the following
applications subject in each case to the
specific conditions and safeguards therein
stated.
1. Application No. lWa of Benny Lancia for the approval
of a constructed stairway erected with a one family dwelling and
garage on the south side of Barnum. Road, near Little Farms Road,
provided that said arch is erected not less than 3 feet from the
side lot line.
2. Application No. 141& of Maude J. Mitchell for the
erection of a one family dwelling and garage on the south west
-- corner of Forest Avenue and Valley Roadt provided that the said
Building and garage is erected not less than 20 feet from the
front lot line of Forest Avenue, and not less than 13 feet and
15..5 feet respectively, from the front lot line on Valley Road
and not less than &- feet from the rear lotyiine,, all in accord-
ance with the revised plot plan filed this day.
Mr. Messersmith presented a communication submitting a
deed from B. Levinc and Wife, deeding certain property on Weaver
Street in connection with the sidewalk improvement, to the Town of
Mamaroneck.
The communication was ordered received, placed on file and
upon motion, duly seconded, it was
RESOLVED, that the deed of B. Levin& and Wife
deeding property at. Weaver- Street to the Town
of Mamaroneck for sidewalk purposes, be and the
same hereby is accepted and referred to Mr.
Yessersmith for proper recording: in the County
Register's Office.
The Building Commission requested authorization to pur-
chase the necessary stationery and forms for the year 1930.
Upon motion, duly seconded, it was
RESOLVED, that the Building Commission be
and hereby is authorized and empowered to
purchase the required stationery and forms
for the year 1930 at an expenditure of not
to exceed $50.00.
The Building Commission reported that it is necessary to
have a survey made of the property of Nicholas Leone, situated a t
the corner of Fernwood Road and East. Brookside Drive, which matter
is now before the Supreme Court for adjudication.
Upon motion, duly seconded, it was
RESOLVED, that the Building Commission be and it
hereby is authorized and empowered to expend the
sum of not to exceed $75.00 to have a survey made
of the property of Nicholas Leone situated at the
corner of Fernwood Road and East Brookside Drive.
The Board took up for consideration the plan estimate
and data pertaining to the enlarging and improving of the Joint
Water Works, together with the report of the Engineers upon said
proposed improvement.
After discussion and consideration, it was
VOTED, that when this meeting adjourns it
adjourn to meet Friday, December 20th at
8;:15 P. M. , at the Village of Mamaroneck
meeting rooms to consider and take proper
action upon the plans submitted for the
improvements t the Westchester Joint Water
Works¢ No. I.
The Supervisor requested that a certificate be issued
in the sum of $589,085.80, covering unpaid State,; County, Town and
District taxes for the year 1929.
Whereupon, the following resolution was presented and
upon roll call unanimously adopted:
RESOLVED, Wf='REAS, the Supervisor has received
from the Receiver of Taxes a statement under the
provisions of Section 28 of the Westchester County
Tax Act, on which it appears that the sum of
-- $58,085.80, in State, County, Town and District
Taxes, which were levied an April lst, 1929, was
sti11 outstanding and unpaid= and
WHEREAS, the Superintendent has requested this
Board to authorize the issuance and sale of one
or more temporary certificates of indebtedness
not exceeding in the aggregate said sum of
$58,085.804 being the amount reported of said
Receiver of Taxes to be uncollected and outstand-
ing, and it was further

FOS€ UED-s that pursuant to the provisions-
of the Westchester County Tax Act, the
Supervisor be and he hereby is authorized
and empowered to borrow upon the faith and
credit of the Town of Mamaroneckg the said
sum of $58,085. 80, for which sum he shall
issue in the name and under the seal of said
Town, against the uncolleeted State, County,
Town and District Taxes, levied April 1st, 1929,
against the taxable real property within the
said Town of Mamaroneck, one or more Certific-
ates of Indebtedness each in such denomination
as the Supervisor may determine, not exceeding
in the aggregate the said sum of M pO85.80,
which shall bear interest at: a rate not not
more than Go per annum and shall be made pay-
able at such time as the Supervisor may deter-
mine, but not later than July Ist, 1930. Said
certificates of Indebtedness shall be signed by
the Supervisor and countersigned by the Town
Clerk; and it was further
BESOLVM, that the Supervisor be and he hereby
is authorized and empowered to- dispose of said
certificates of indebtedness for not less than
the par value thereof; and it was further
RESOLVEDO that the Supervisor and Town Clerk be
and they hereby are authorized and empowered to
sign and execute such papers as may be necessary
to effect the sale of said Certificates.
A delegation of petitioners for the creation of a new
Fire Company, was present at the meeting and took up the question
in relation to their petition.

They were advised that Counsel is preparing the necessa:V
legislation to enable the creation of a fire department and action
upon their petition was again laid over.
Upon motion, the meeting adjourned at 10-.45 P. M.
