Carpaneto, Director of Building Michele DiEdwards, Public Stenographer Terranova, Kaza2Ps & Associates, Ltd. 40 Eighth Street New Rochelle, New York 10801 Marguerite Roma, Recording Secretary CALL TO ORDER The meeting was called to order by Chairperson Marilyn Reader at 8:15 p.m. APPROVAL OF MINUTES Ms. Reader asked if the Board members had reviewed the draft Minutes of the August 11, 1999 meeting and if there were any additions and/or corrections. There being none, on a motion made by Mr. Papazian, seconded by Ms. Harrington, the Minutes were unanimously approved, 4-0. Mr. Darsky arrived at this time. On a motion was made by Dr. Mason, seconded by Ms. Harrington, it was unanimously RESOLVED, that the Public Hearing be, and hereby is, declared open. The Public Stenographer was present for this meeting and her transcript will become a permanent part of this record. Chairperson Reader informed those present that a letter, dated August 31, 1999, was received from the Joann C. Rosenstrach, the attorney representing the applicant requesting that the following matter be adjourned to the October, 1999 Planning Board meeting: PUBLIC HEARING-FRESHWATER WETLANDS AND WATER COURSES PERMIT-Goldberg- 10 Evergreen Lane, Block 309, Lot 21 (adjourned 6/9/99;7/14/99;8/11/99) Chairperson Reader read the next application as follows: Planning Board September 8, 1999 Page 2 PUBLIC HEARING - FRESHWATER WETLANDS AND WATER COURSES PERMIT - Grove - 484 Weaver Street, Block 222, Lot 279 Jesse Grove, the applicant, appeared and addressed the Board. Ms. Reader read into the record a memo received from counsel, Judith M. Gallent, dated September 7, 1999, regarding the Freshwater Wetlands permit application for the above-referenced address, which was referred to the Westchester County Planning Board(WCPB), James Mast, for comments. The WCPB had no comment. Dr. Mason stated that there is also a note from the Coastal Zone Management Commission(CZMC). Ms. Reader asked that the record reflect that a letter was received from the CZMC, dated August 31, 1999, stating that it is the opinion of the CZMC that the construction of the roof over the existing deck at 484 Weaver Street neither advance nor hinder the policies set forth in the Local Waterfront Revitalization Plan and accordingly is neither consistent nor inconsistent therewith. Ms. Reader asked if Mr. Grove had anything further he wished to state. Mr. Grove said he did not. Ms. Reader recapped for the public record that there is an existing deck. The application is to enclose the deck with removable screens, with a roof on top, extend the deck slightly,4 ft. to 6 ft., to fill in a notched corner. There will be no other changes, with which Mr. Grove agreed. Ms. Reader asked if there were any other comments or questions from Board members. Ms. Harrington stated for the record that Mr. Harrington had done work for Mr. Grove. That will not have any impact on her ability to make a decision in this matter. Ms. Reader said the record will reflect there was a business relationship with Ms. Harrington's husband. There is no apparent conflict of interest on this particular matter. Ms. Reader asked if there were any other comments or questions from the professional staff that the Board should be made aware of. There being none, Ms. Reader stated that the record will reflect there are no persons present from the public; no one in favor or in opposition to the project. Dr. Mason commented that the neighborhood was noticed,as he resides in the radius notified and received a copy of the notice. Mr. Catalano said with respect to the discussion at the last meeting regarding capturing the water and the discussion about different alternatives, he asked what Mr. Grove has decided to do. Mr. Grove said his preferred solution is to capture the water underneath the deck in two 55 gallon rain barrels. Ms. Reader asked what direction the water will go. Mr. Grove said eventually the water will find its way into the creek. Ms. Reader asked what will direct the water to the barrels. Mr. Grove said the gutters will direct the water into the barrels. Planning Board September 8, 1999 Page 3 On a motion made by Dr. Mason, seconded by Mr. Darsky, the following resolution was unanimously adopted: WHEREAS, Jesse B. Grove, III have applied for a permit pursuant to Mamaroneck Town Code Chapter 114 for the premises located at Lot No. 484 Weaver Street and known on the Tax Assessment Map of the Town of Mamaroneck as Block 222, Lot 279; and WHEREAS, this Planning Board has previously determined that the proposed action is a Type II action and that no further review is required under SEQRA; and WHEREAS, the Consulting Engineer to the Town has submitted comments and recommendations in writing regarding this application to the Planning Board; and WHEREAS, this Planning Board has determined, pursuant to Mamaroneck Town Code Chapter 114, that the activity proposed is of a minor nature and is compatible pursuant to 6 NYCRR §665.7; WHEREAS, a Public Hearing pursuant to Mamaroneck Town Code Chapter 114 having been held on September 8, 1999; NOW, THEREFORE, BE IT RESOLVED, that this Board makes finds as follows: 1. The activity proposed is of such a minor nature as not to effect or endanger the balance of systems in a controlled area; 2. The proposed activity will be compatible with the preservation, protection and conservation of the wetland and its benefits, because (A) the proposed activity will have only a minor impact, (B) it is the only practical alternative, and(C) it is compatible with the economic and social needs of the community and will not impose an economic or social burden on the community; 3. The proposed activity will result in no more than insubstantial degradation to, or loss of any part of the wetland because of the minor impact of the activity and the protective conditions imposed by this resolution; 4. The proposed activity will be compatible with the public health and welfare, because of its minor impact in the controlled area; BE IT FURTHER RESOLVED, that the application of Jesse B. Grove, III for a permit, pursuant to Mamaroneck Town Code Chapter 114, be and it hereby is granted subject to the following terms and conditions: 1. This permit is personal to the applicant and may not be transferred to any other individual, entity or combination thereof; 2. All debris is to be removed prior to the completion of the project. Construction must be in accordance with the requirements of the Town Flood Damage Prevention Code and the Town Erosion and Sedimentation Control Law. 3. The Freshwater Wetlands and Water Courses permit is approved pursuant to the plan dated June 2, 1999, date-received July 13, 1999. The plan must be approved by the Building Inspector before a Building Permit shall be issued. 4. Work involving site preparation shall only take place from Monday through Friday between the hours of 8:30 a.m. and 4:30 p.m. Planning Board September 8, 1999 Page 4 5. A cash deposit or bond for$1,000.00 shall be furnished to the Town by the applicant to ensure the satisfactory completion of the project and the rehabilitation of the affected or disturbed area. 6. This permit shall expire upon completion of the proposed activity or one year from the date of its issue whichever first occurs. On a motion was made by Ms. Harrington, seconded by Ms. Reader, it was unanimously RESOLVED, that the Public Hearing be, and hereby is, declared closed. NEXT MEETING The next meeting of this Board will be held on October 13, 1999.
