Burdick, Recording Secretary CALL TO ORDER The meeting was called to order by Chair Reader at 8:24 PM. APPROVAL OF MINUTES At this time in the meeting, the proper quorum was not available for approval of the August minutes. PUBLIC HEARING - Fresh Water Wetlands and Water Courses Permit - Terence and Jane Toal - Empty lot on Fenbrook Drive - Block 309 Lot 6. On motion of Mr. Negrin, seconded by Mr. Murray, it was unanimously RESOLVED, that the Public Hearing be, and hereby is, declared opened. The Public Stenographer was present for this application and her transcript will become a permanent part of this record. Mark Mustacato, architect, appeared with Mr. Toal. He stated that they had appeared before the Coastal Zone Management Commission which had requested calculations concerning the runoff. Plans had been revised and were circulated to this Board at the meeting. Mr. Mustacato questioned the need for setbacks with the circular driveway, but it was concluded Planning Board September 8, 1994 -2- that the Building Inspector would interpret this question and deal with it at the time he reviews house plans. Mr. Trachtman stated that much of the information requested by CZMC was material for an erosion control permit, not the Fresh Water Wetlands Permit. He stated that the circular driveway would require more erosion controls than usual. Marc and Elaine Prager of 9 Fenbrook Drive were in attendance. They stressed their concerns about new houses in the neighborhood creating traffic hazards and, most particularly, about blasting. Dr. Prager was anxious about the building of retaining walls close to his property effecting his 200-year old oak trees. He was also concerned about the effects of flooding particularly since during a storm last winter the street had flooded badly. In response to questioning by Tom Haynes of 12 Fenbrook Drive, Mr. Mustacato stated that he was required to provide no increase in runoff of water from the property. Water will run off the property, but there will be no additional runoff. Mr. Trachtman explained that percolation tests would have to be performed as part of the permitting process. The neighbors were assured that this Board and the CZMC had known that proposals were being made for the two adjacent properties. Mr. Mustacato stated that he hoped that rock excavation could be accomplished by chipping, but, should blasting be necessary, the Town has extremely strict monitoring procedures. Mr. Negrin requested Mr. Mustacato to address, at the next meeting, the effects of the retaining wall on the west side of the Toal property on the Pragers' oak trees. Mr. Trachtman requested more specific flooding information about last winter's flooding from Dr. Prager. On motion of Mr. Negrin, seconded by Mr. Murray, it was unanimously RESOLVED, that the Public Hearing be, and hereby is, declared adjourned until Wednesday, October 12, 1994 at 8:15 PM. Mr. Silverberg told the applicants and neighbors that submissions for the meeting packet must be handed in to the Building Department by Tuesday, October 4th. APPROVAL OF MINUTES On motion of Mr. Murray, seconded by Mr. Negrin the minutes of August 10, 1994 were approved as corrected. Planning Board September 8, 1994 -3- FURTHER CONSIDERATION - Subdivision - Gila Lourie - 109 Griffen Avenue Block 305 Lot 903 Elliot Senor, surveyor, appeared with Mrs. Lourie. He submitted a new, third plan showing a second bridge over the Sheldrake River as Mrs. Lourie had been advised that selling her own piece of property would be difficult with a neighbor's driveway running so close to her house. This third plan takes into account the trees and crosses the stream at its narrowest point. A downstream neighbor, Jane Caplan of 7 Split Tree Road, appeared. She was concerned about the subdivision's effect on her property but was reassured that the review process would protect it. Mr. Silverberg suggested that the County be consulted again and that the Army Corps of Engineers be contacted as it needs to know about bridges over navigable rivers. On motion of Mr. Gonye, seconded by Mr. Negrin, the subdivision application was adjourned to the Meeting of October 12, 1994 for further consideration. CONSIDERATION OF AMENDMENT TO SITE PLAN - Town of Mamaroneck Fire District No. 1 - Fire House - 205 Weaver Street - Block 123 Lot 329. Appearing with Administrator Altieri were the architects, John Sullivan and John Fry; Deputy Fire Chief Mirabella and Richard Tortorella, Chairman of the Building Committee. Mr. Altieri explained that the Town had run into unanticipated money problems and was, therefore, scaling back the project. Mr. Sullivan explained that about 2200 square feet had been removed - approximately 700 per floor. The wing facing Edgewood Avenue would be made smaller; no rooms will be eliminated, but everything would be "tighter". Fire apparatus will be housed in the same way, but the entrance, elevator and staircase will be relocated. Mr. Sullivan stated that since his firm's Board appearances, it had added additional planting and changed the location of some trees with input frau the Beautification Committee. Locations of drywells will remain the same, and the same enclosure for trash and the generator will be built. Mr. Altieri requested that this Board waive the Public Hearing for the amendment. The members agreed as the plan was being reduced, therefore, having less impact. On motion of Mr. Negrin, seconded by Mr. Murray, it was unanimously, 5-0, RESOLVED, that the Planning Board is the Lead Agency and solely responsible for determining whether the proposed action may have a significant impact on the environment; and it is FURTHER RESOLVED, that this Board finds this matter to be an Unlisted Action under SEQRA with no substantial environmental impact and directs the filing of a Negative Declaration. Planning Board September 8, 1994 -4- On motion of Mr. Murray, seconded by Mrs. Harrington, the Board unanimously, by a vote of 5-0, adopted the following resolution. Wes, the Town of Mamaroneck Fire District No. 1 has submitted an application for Site Plan Amendment for a Fire House alteration located at 205 Weaver Street and known on the Tax Assessment Map of the Town of Mamaroneck as Block 123 Lots 329; and WHEREAS, the Planning Board has been designated lead agency and has conducted and completed proceedings pursuant to SEQRA; and WAS, the Planning Board has reviewed all of the submissions by, and on behalf of the applicant, all correspondence from Town officials, the Consulting Engineer to the Town, and members of the public; and WHEREAS, the Board makes findings of fact as follows 1. There will be a smaller footprint of the building than originally approved. 2. There will be less impact on the environment and on the surrounding neighbors. © NOW, THEREFORE, BE IT RESOLVED, that Site Plan Approval is hereby waived under Section 66A-8E2 of the Town Law for the application submitted by the Town of Mamaroneck Fire District, subject to the following condition. This approval is granted subject to approval by the Board of Architectural Review ADJOURNMENT On motion of Mrs. Harrington, seconded by Mrs. Reader, the meeting was unanimously adjourned at 10:22 PM.
