Reader, Chairwoman Richard H. Darsky Gabriel Fay Edward Gonye Linda S. Harrington C. Alan Mason Also Present: Steven M. Silverberg, Counsel Gary B. Trachtman, Consulting Engineer Karen Brideau, Public Stenographer Kazazes and Associates 250 East Hartsdale Avenue, Suite 24 Hartsdale, NY 10530 Marguerite Roma, Recording Secretary CALL TO ORDER The meeting was called to order by Chairwoman, Marilyn Reader at 8:16 p.m. Ms. Reader announced to the Board that this would be the last meeting for Mr. Fay, who will be resigning. Mr. Fay has been a member of the Board for many years. She recognized his contributions not only from a practical point of view and because of his experience in real estate, but his theoretical point of view as well, always adding insight and wished him much happiness. APPROVAL OF MINUTES On a motion made by Mr. Darsky, seconded by Mr. Gonye, the Minutes for July 12, 1995 were unanimously approved. On a motion made by Dr. Mason, seconded by Ms. Harrington, the Minutes for August 9, 1995, were unanimously approved. Mr. Fay commented that the Minutes were much fuller in detail and complimented the secretary. A motion was made by Mr. Darsky, seconded by Ms. Harrington and was unanimously approved to open the public hearing. / Planning Board September 13, 1995 Page 2 The Public Stenographer was present for this meeting and her transcript will become a permanent part of this record. PUBLIC HEARING- Special Permit - Citipark Service Center- 613 Fifth Avenue/2 Valley Place - Block 131 Lot 1. Mr. Gubin appeared, representing Citipark Service Center. Ms. Reader stated that she had a letter from Mr. Jakubowski, the Building Inspector for the Town, who has indicated that he has been advised the tanks have been removed and that the striping of the area that is a 4 ft. width along the length of Fifth Avenue has also been completed. Mr. Gubin verified this had been done. Dr. Mason said that it was his recollection this has been a service station for a long period of time where the Blue Bird taxi has been serviced, and asked whether would this continue. Mr. Gubin stated they will continue to service Blue Bird Taxi Service, Inc. and independently owned and operated vehicles, and always have provided for removal of waste and debris, i.e. tires, oil, parts. No gas is pumped, just maintenance of vehicles. Ms. Reader said one of the concerns of Ms. Harrington was there are car parts that are all over and stored and kept on the property near the Fifth Avenue property line. Mr. Gubin stated that he had spoken to the mechanics in charge, and this will be taken care of by being placed in the refuse enclosure and carted away by the agency that takes care of that, Pascab Co., Inc., of the Bronx. Mr. Gubin is occasionally on site. Ms. Reader commented to make it a condition that car parts not be stored on the outside of the building. Mr. Fay questioned what is done with the waste oil when oil is changed. Mr. Gubin stated all the waste oil is taken out by the Safety Kleen Corp., a major corporation, and is recycled. A discussion ensued. Ms. Reader asked for questions or comments from the audience. Ms. Elizabeth Rafalski, 22 Valley Place, said she is familiar with the operation and is very concerned for the safety, especially with the activity from the taxis regarding parking. Mr. Gubin said he or his manager monitors activity each day, and has vehicles removed when necessary. A discussion ensued regarding cars serviced and the number of cars that can be parked at the site. Planning Board September 13, 1995 Page 3 Ms. Reader asked whether there were no parking signs in the area. Mr. Gubin said he wasn't sure, there might be. Mr. Darsky suggested calling the police to ticket illegally parked cars. Ms. Reader said the Planning Board has no authority over parking, but the police can monitor the action. Mr. Rafalski, 20 Valley Place, said he understands that businesses must run, but has objections to the sight looking like a junkyard. Cars are frequently parked on the street making it difficult to enter Fifth Avenue because you cannot see anything. Mr. Rafalkski reported he and his daughter almost had an accident. He presented pictures to the Board. A discussion ensued. Dr. Mason suggested Mr. Rafalski contact the Traffic Commission as they regulate the parking and can reinforce the signage. This should not be ignored. Mr. Darsky stated that Mr. Gubin has acknowledged his desire to be of help in enforcing the rules of parking their vehicles. Mr. Darsky said there are several courses of action. Mr. Silverberg said that if there has been a problem there, a condition can be made that they cannot park any vehicles they are repairing or vehicles that belong to employees in the no parking zone. Mr. Rafalski asked about the traffic of buses in the area, and Ms. Reader said that is a completely separate issue which the Planning Board cannot address. Ms. Reader stated the Board has been shown pictures and presented them to Mr. Gubin for his review. Ms. Reader pointed out picture 33.32(a). A discussion followed. A motion was made by Dr. Mason, seconded by Ms. Harrington and unanimously approved to close the public hearing. There being no further comments regarding this application, upon a motion made by Dr. Mason, seconded by Mr. Fay, the following conditions from the previous permit and the additional conditions were unanimously approved: 1. The hours of operation of the garage shall be 8:00 a.m. to 6:00 p.m., Monday through Friday, and 8:00 a.m. to 1:00 p.m. on Saturdays. 2. Petroleum waste shall be removed from the premises by a properly licensed disposer of such material. 3. The operation shall be limited to servicing corporate vehicles; it shall not be open to the general public. Planning Board September 13, 1995 Page 4 4. There shall be no parking or storage of any vehicle on the 4 ft. wide area along the lengths of the Fifth Avenue boundary and the Valley Place boundary, these areas shall be striped, no parking shall be painted on both the Fifth Avenue and Valley Place sides. 5. There shall be no parking of any vehicles belonging to either the employees or vehicles under service on Fifth Avenue, where the local law provides no parking. 6. All car parts and metal shall not be stored outside the building except in the properly enclosed refuse containers. A motion was made by Dr. Mason, seconded by Ms. Harrington and was unanimously approved granting the Special Permit. Ms. Reader asked the Board to applaud Mr. Fay for all of his service.
