Burdick, Recording Secretary CALL TO ORDER The meeting was called to order by Chairman Bell at 8:17 PM. He announced that the first application - 10 Grand, Inc. - had requested an adjournment in order to answer the questions raised by this Board. 2. Presubmission Conference for Site Plan - New York Video a/k/a Blockbuster Video, 1331 Boston Post Road Block 411 Lot 119 David Neufeld, Andy Fox and Henry Huth appeared on behalf of the application. Mr. Neufeld questioned the need for site plan approval as a lawful use was continuing in the building. This company will take over a part of the building at 1331 Boston Post Road. It operates other similar franchises in Mount Kisco, Scarsdale, White Plains and Port Chester. It will be open from 10 AM to 12 PM and will cater to family business. The Board felt that review was in order because of the location of the store at a heavily-traveled corner near the middle school and the newly-renovated ice rink. Representatives of the two other stores at the property - Competition Bike and Seasons, Too - stated that these stores were busy during the day. Mr. Huth stated that the video store's busiest time was Saturday nights between 8 and 10 PM with 25-30 customers an hour. These customers October 10, 1990 -2- average 5 to 10 minutes in the store. Concern was expressed because the plans for the 37-space Parking lot call for an entrance at the curve on Hammocks Road. Suggestions were made for a stop sign at the curve, for keeping Old Hammocks Road continuously open and for re-routing the traffic. It was also suggested that the bushes be cut, the trees pruned and/or eliminated and the entrance to the lot be moved closer to the intersection at the Post Road. Those in the audience expressing concern about traffic were Carol Baumbusch, Hammocks PTA; Stephen Kronenberg, 66 Howell Avenue; Gail Waxman, President, Howell Park Association; Gordon Oppenheimer, 50 Howell Avenue; Jack Hanmeth and Benson Bieley. Some speakers expressed the fear that the Post Road would become "Central Avenue II" and had questions regarding signs. William Maker, attorney, represented the owner of the building. He stated that the owner wanted to be accommodating. On motion of Mr. Murray, seconded by Mr. Goldstein, it was unanimously RESOLVED, that the Planning Board is the Lead Agency and solely responsible for determining whether the proposed action may have a significant impact on the environment; and it is C FURTHER RESOLVED, that this is a Type II action having no significant impact on the environment as determined by New York State or corresponding local law, therefore requiring no further action under SEQRA. As the applicants were desirous to move their application along very fast, the Board agreed to meet at the site. Thus, on motion of Mr. Goldstein, seconded by Mrs. Jacobson, it was unanimously RESOLVED to adjourn this application to a Special Meeting at 1331 Boston Post Road on Tuesday, October 16, 1990 at 7:30 AM. 3. Consideration of Subdivision Application - M. Raffio Dillon Rd. & Gaillard Pl. Block 504 Lots 345, 347 353 Michael Raffio, architect, appeared on behalf of the application. He want to divide the land on the paper street, Gaillard Place, into three lots. The majority of one lot would be in the Town of Mamaroneck; the two others would be in New Rochelle. The latter two, one of which Mr. Raffio would buy, would have amiss to Gaillard Place and, ultimately, the Town of Mamaroneck. Mr. Raffio had previously appeared before the City of New Rochelle Planning Board which declared itself the TPad Agency. Mr. Hoffman stated that this Board could ask New Rochelle C October 10, 1990 -3- for "interested agency" status or it could declare itself a "coordinated agency". Mr. Ronconi had made an offer of dedication of Gaillard Place to the Town which has not been accepted. Mr. Hoffman stated that Mr. Raffio would have to take this application to the Zoning Board as two of the lots do not front on a public street. A 280 A variance is needed. Mr. Wittner stated that the lots are in a flood plain near a Critical Environmental Area and a State Significant Habitat. Mr. Romeo did not like the idea of the subdivision straddling two municipalities. He suggested that Mr. Raffio could redesign the driveways and access to Gaillard Place so that a very small variance would be required on the lot in the Town. And, okays would be needed only from the Zoning Board, not the Planning Board. MINUTES On motion of Mr. Murray, seconded by Mr. Goldstein, the minutes of September 12, 1990 were approved as corrected.
