PLANNING BOARD OF THE TOWN OF MAMARONECK
MAY 10, 1995, IN THE COURT ROOM, TOWN CENTER

(Mr. Fay was absent as the one matter to be heard was one from which he
recused himself as he has represented it Alden House Tenants Association
in the past.)
CALL TO ORDER
The meeting was called to order by Mrs. Reader at 8:26 PM.
APPROVAL OF MINUTES
On motion Mr. Darsky, seconded by Mr. Murray, the minutes for April 12,
1995 were approved unanimously.
CCNSIDE RATICSJ OF SPECIAL PERMIT - J.B. Tiptons (Restaurant) - John
Caldararo - 1420 Boston Post Road
(11 Alden Road) Block 409 Lot 131.
Barry Marcus, attorney, appeared with Mr. Caldararo. He stated that the
reopened restaurant and lounge was going to be "upscale", catering to
adults. The interior will be refurbished, and the Board of Architectural
Review has approved the exterior. Mr. Marcus requested a waiver of the
Public Hearing process inherent in the granting of a Special Permit.
Mr. Caldararo stated that he and his associates have been in the
restaurant business for a considerable amount of time, that he has
already hired two chefs and that there will be entertainment at the
weekend. The leassees by verbal agreement will continue the parking
arrangement with Ecco Leasing across the Post Road. Mr. Caldararo stated
that J.B. Tiptons was not part of a chain and that the prospective hours
would be 11 AM to 10 PM during the week and 11 AM to 11 PM on the weekend
for the kitchen and 11 AM to 1 PM for the bar. He claimed that he was
not looking for bar business.

Board members recalled that there were several serious incidents
involving pedestrians at this site. Mr. Darsky stated that he would not
be fulfilling his responsibility as a Planning Board member to not refer
this application to the appropriate agencies and that a month's time was
not an unreasonable delay. Mrs. Reader commented that the Post Road
is a State road.
On motion of Mr. Darsky, seconded by Mr. Murray, the application of John
Caldararo d/b/a J.B. Tiptons, was referred to the Traffic Committee,
Health Department, Building Department and Police Department for review
and comment.
On motion of Mr. Murray, seconded by Mrs. Harrington, it was unanimously,
by a vote of 5-0
RESOLVED, that the Planning Board is the Lead. Agency
and solely responsible for determining whether the proposed
action may have a significant impact on the environment;
and it is
FURTHER RESOLVED, that this is a Type II Action having
no significant impact on the environment as determined
by New York State or corresponding local law, therefore
requiring no further action under SEQRA;
On motion of Mrs. Harrington, seconded by Mr. Gonye, it was unanimously,
by a vote of 5-0
RESOLVED, that this Board hereby sets Wednesday, June 7, 1995 at
8: 15 PM as the date and time for a Public Hearing for the
application of John Caldararo d/b/a J. B. Tiptons for a Special
Permit; and be it
FURTHER RESOLVED, that the Board Secretary is hereby authorized to
publish the Notice of said Public Hearing in the Official Newspaper
of the Town of Mamaroneck.
NEXT MEETING
The next meeting of the Planning Board will be held June 7, 1995.
ADJOURNMENT
On motion of Mr. Darsky, seconded by Mrs. Harrington, the meeting was
adjourned by a unanimous vote 5-0.
