Also Present: Steven M. Silverberg, Counsel Gary Trachtman, Consulting Engineer Bonnie M. Burdick, Recording Secretary CALL TO ORDER The meeting was called to order by Chair Reader at 8:16 PM. CONSIDERATION - Amended Site Plan - New Car Dealership - Alfredo Gulla 2533 Boston Post Road - Block 504 Lot 134. Nicolo Arpaia, architect of Studio Rai, appeared. He demonstrated and explained the differences between the plans approved and as built. Mr. Arpaia stated that because of the elevation differences, it was necessary to add a ramp. At the request of the BAR, the applicant will narrow the asphalt walk at the rear of the building to 2 feet. The light to be installed at the rear, left corner of the lot was moved to adjust to the grade; the BAR approved. Because the parking strip was reduced, the applicant will install a 2-foot larger planting bed next to Saturn Used Cars. Mr. Arpaia stated that they still had not heard fran the State Department of Transportation about using a part of the parking lane for unloading cars. Mr. Darsky felt that to deny this use would be unfair as other dealers in the area use the street for unloading. Should the State deny the use, it was felt that the Town should appeal to the DOT. Seventeen evergreens have been planted 5 feet on center at the buffer, and more planting and ground cover will be added in the Spring. The BAR approved leaving the chain link fence but requested the removal of the barbed wire on top of the fence. Mrs. Reader thanked Mr. Arpaia for his explanations but expressed her annoyance with the applicant's lack of consultation with the Building Department and the Planning Board as problems were encountered. Planning Board March 3, 1995 -2- Although according to Section 8E the Planning Board could waive a Public Hearing on this matter, the members decided to hold one to give neighbors input. Mr. Fay reminded Mr. Arpaia that an amended plan should be submitted. On motion of Mr. Darsky, seconded by Mr. Murray, it was RESOLVED, that the Planning Board of Appeals is the Lead Agency and solely responsible for determining whethAr the proposed action may have a significant impact on the environment; and it is FURTHER RESOLVED, that this is a Type II Action having no significant impact on the environment as determined by New York State or corresponding local law. On motion of Mrs. Harrington, seconded by Mrs. Reader, it was unanimously RESOLVED, that this Board hereby sets Wednesday, April 12, 1995 at 8:15 PM as the date and time for a Public Hearing for the application of Alfredo calla for an Amended Site Plan; and be it FURTHER RESOLVED, that the Board Secretary is hereby authorized to publish the Notice of said Public Hearing in the Official Newspaper of the Town of Mamaroneck. REFERRAL FROM TOWN BOARD - Proposed amendment to Cellular Antenna Law Mr. Fay recused himself from the discussion and left the meeting. Mr. Silverberg explained that the Town Board wanted all cellular phone antenna poles to be examined, not just those over 100 feet tall. The Board felt that all poles should all be inspected each year, not just those with apparent problems. On motion of Mrs. Harrington, seconded by Mr. Darsky, the following resolution was adopted unanimously, 5-0. WHEREAS, the Town Board has referred the proposed amendment to the Cellular Antennas Law to the Planning Board pursuant to Section 89-80 of the Zoning Ordinance of the Town of Mamaroneck, and WHEREAS, this Board is required to make a recommendation to the Town Board with respect to its referral of the proposed amendment to the law, it is RESOLVED, that the Planning Board finds that the proposed amendment to the Cellular Antennas Law is in harmony with the comprehensive plan of Planning Board March 3, 1995 -3- land use for the Town and would be in furtherance of the purposes in Section 89-1 of the Town Zoning Ordinance, and it is further RESOLVED, that the Planning Board requests, however, that the Town Board consider in Section 2, Line 7 changing the word "indicating" to "including" so it is clear that regular reports of inspections are made of the towers whether or not repairs are necessary. On motion of Mrs. Harrington, seconded by Mr. Darsky, the meeting was adjourned at 9:01 PM. Bonnie M.
