CALL TO ORDER
The meeting was called to order by Chair Reader at 8:21 PM.
APPROVAL OF MINUTES
On motion of Mr. Negrin, seconded by Mr. Murray, the minutes of the
meeting of March 9, 1994 were unanimously approved.
On motion of Mr. Murray, seconded by Mr. Gonye, the minutes of the meeting
of March 23, 1994 were unanimously approved.
CONSIDERATION - Fresh Water Wetlands and Water Courses Permit - Nantucket
Home Builders (George Braverman) - Lot No. 7 - Fenbrook
Drive - Block 309 Lot 7.
The applicant was not present so the matter was postponed to later in the
meeting.
CONSIDERATION - Subdivision - Bonnie Briar Syndicate, Inc. - Bonnie Briar
Country Club - 808 Weaver Street - Block 201 Lot 19
Adam Wekstein, attorney, represented the syndicate accompanied by
Nathaniel Parish and Michael Weiner of Parish and Weiner, planning
consultants.
The Board had received several memos on this matter from Town staff. Mrs.
Reader, referring to the memo from the Building Inspector, stated that the
proposed lots would not comply with R-30 zoning and that some of the
property would need to be changed to an R-15 Zone. Even with such a
change, 10 of the 71 lots would have less than 15,000 square feet. Many
lack proper depth or frontage. Mr. Silverberg explained that the Building

Inspector has stated that this application does not comply with cluster
requirements under the Zoning Ordinance Section 89-15.
Mr. Weiner stated that his client is requesting that the Planning Board
refer the cluster design application to the Town Board for approval under
Section 278 of the State Law. He stated that the applicant prefers the
cluster design in order to leave open space and to modify and preserve the
eighteen-hole golf course, but that if necessary his client would apply
for a conventional subdivision with 130 lots.
Mr. Silverberg stated that Zoning Ordinance Section 89-15 implements Town
Law Section 278 with specific limitations. The Building Inspector states
the proposed cluster plan does not conform to Section 89-15, and the
Planning Board does not have authorization to override the interpretation
of the Building Inspector. Mr. Weiner stated that the density
calculations were based on an R-30 zone and that the Building Inspector is
discussing lot dimensions in his memo and not lack of density. Mr.
Silverberg pointed out that Section 89-15 addresses lot dimensions. Mr.
Parish requested a copy of the Building Inspector's memo and an
opportunity to respond to it at the next meeting.
Mr. Wekstein asked that the Board declare its intention to act as Lead
Agency and circulate notice to interested agencies. Mr. Silverberg stated
that he saw no problem as long as the applicant was not seeking to start
any time frames running as the issue of the number of lots which could be
created still needed to be resolved. Mr. Wekstein agreed.
Mr. Silverberg stated that by declaring itself the Lead Agency the
Planning Board was not boxing itself in, that no time frame would be
starting and that the Planning Board could still refuse to grant the
application.
On motion of Mr. Negrin, seconded by Mr. Fay, the following resolution was
adopted by a vote of 5-2, Mr. Darsky and Mrs. Harrington opposed.
RESOLVED, that the Planning Board intends to act as the Lead Agency
and be solely responsible for determining whether the proposed
action may have a significant impact on the environment;
and it is
FURTHER RESOLVED, that this is a Type I Action which may have
a significant impact on the environment as determined
by New York State or corresponding local law; and it is
FURTHER RESOLVED, that the circulation of notice to the involved
agencies is directed.

CONSIDERATION - Nantucket Home Builders
George Braverman, builder; Mark Mustacato, architect; and Charles
Elfreich, engineer, were present for the application. Mr. Mustacato
stated that there had been a question about discrepancies in elevations
for the property. It had been determined that the Town's hydrological
study is correct. Mr. Mustacato submitted diagrams showing where changes
to the grade would be made and stated that rip-rap will be added to the
stream bed. There is a culvert in Fenbrook Drive which limits the flow
of water, and this calculation will not change. Mr. Trachtman requested
time to consider the proposed changes in grade, and Mrs. Reader stated
that, in any event, a new Site Plan must be submitted.
On motion of Mrs. Reader, seconded by Mr. Murray, this matter was
adjourned to the next meeting which will be held Thursday, July 21st.
CONSIDERATION - Special Use Permit - Sean P. Hall d/b/a Auto Creations
5 Fifth Avenue - Block 132 Lot 609
Mr. Hall appeared. He stated that he was operating a business to
handwash cars, wax and buff cars, and to install alarms, stereos and
other electronic equipment into cars. The washing is done inside the
building on the right side of the structure. No unusual amounts or types
of waste products are anticipated. The hours would be 8 AM to 6 PM,
Monday through Saturday and 9 AM to 3 PM on Sunday.
On motion of Mr. Negrin, seconded by Mr. Darsky, it was unanimously
RESOLVED, that the Planning Board is the Lead Agency
and solely responsible for determining whether the proposed
action may have a significant impact on the environment;
and it is
FURTHER RESOLVED, that this is a Type II Action having
no significant impact on the environment as determined
by New York State or corresponding local law, therefore
requiring no further action under SEQRA; and it is
FURTHER RESOLVED, that this Board hereby sets Thursday, July 21,
1994 at 8:15 PM as the date and time for a Public Hearing for the
application of Sean P. Hall d/b/a Auto Creations for a Special
Permit; and it is
FURTHER RESOLVED, that the Board Secretary is hereby authorized to
publish the Notice of said Public Hearing in the Official Newspaper
of the Town of Mamaroneck.

Block 305 Lot 903.
At the request of the applicant, this matter was adjourned to the next
meeting.
ADJOURNMENT
On motion of Mrs. Harrington, seconded by Mr. Murray, the meeting was
unanimously adjourned at 10:10 PM.

On motion of Mr. Negrin, seconded by Mr. Murray, the minutes of the
meeting of March 9, 1994 were unanimously approved.
On motion of Mr. Murray, seconded by Mr. Gonye, the minutes of the meeting
of March 23, 1994 were unanimously approved.
