PUBLIC HEARING - SUBDIVISION APPROVAL - Mr. and Mrs. P. McCarthy

On motion of Mrs. Jacobson, seconded by Mr. Murray, it was unanimously
RESOLVED, that the Public Hearing be, and hereby is, declared
open.
The Public Stenographer was present for this application and her
transcript will became a permanent part of this record.
On motion of Mr. Freeman, seconded by Mr. Romeo, it was unanimously
RESOLVED, that the Public Hearing be, and hereby is, declared
adjourned to the meeting of this Board of September 11, 1991.
JonPph DeRosa, Mr. McCarthy's attorney, appeared on behalf of this
matter. He apologized on behalf of Mr. McCarthy for the latter's
absence which was as a result of business. . Mr. McCarthy had asked
Mr. DeRosa to remind the Board that Mr. McCarthy would remain a
neighbor on this street and of the lot in question.
The Town Engineering Department had found siltation in the storm
sewers. It was Mr. Trachtman's opinion that water runoff could be

Joseph De.Rosa, Mr. McCarthy's attorney, appeared on behalf of this

Mr. DeRosa to remind the Board that Mr. McCarthy would remain a
neighbor on this street and of the lot in question.
The Town Engineering Department had found siltation in the storm
sewers. It was Mr. Trachtman's opinion that water runoff could be

controlled by a culvert under a driveway and retention systems such
as drywells on the proposed building lot. He stated that a
condition in the subdivision approval requiring his supervision of
the plans concerning water control should be a sufficient
safeguard.
Mrs. Tolley stated that Mr. McCarthy had been on the agenda of the
July CZMC meeting and that he had not appeared. She stated that
another review of the application was necessary. Donald S. Mazin,
attorney for Mark Ladner of 30 Bonnie Way, stated that Mr. Ladner
had expected to be able to appear before the CZMC concerning this
matter,
Mrs. Latona directed counsel to draft a proposed subdivision
approval for the September llth meeting. Mr. DeRosa agreed to a
"no blasting" condition.
On motion of Mr. Freeman, seconded by Mr. Romeo, this matter was
sent to the CZMC for another review
FURTHER CONSIDERATION OF SEQRA AND SUBDIVISION APPLICATION -
B. Beringer
Fenimore Road and Fez-brook Drive
Block 302 Lot 85
Garrison Corwin, attorney, and Joseph Carducci, a local builder,
appeared with Mr. Beringer . Mr. Corwin stated that the current
driveway easement does not permit utility line installation there.
Mr. Carducci stated that blasting would have to be done; chip
hammer rock removal would be cost prohibitive. He stated that
anyone who did the job would follow the Town's stringent blasting
policies because of insurance requirements and to not risk losing
his license. It was realized that the lot was relatively isolated
and that the house most impacted would be Mr. Beringer's.
It was the consensus that a condition could be put into the
subdivision approval for the Town Enginc�r to monitor the placement
of dry wells or other water retention mechanisms. Mrs. Latona
stated that the sight lines on Fenimore Road were good.
On motion of Mr. Romeo, seconded by Mr. Donatelli, it was
unanimously
RESOLVED, that this Board hereby sets Wednesday, September
11,1991 at 8:15 P.M. as the date and time for a Public Hearing
on the application of Bruce Beringer; and be it
FURTHER RESOLVED, that the Board Secretary is hereby authorized
to publish the Notice of said Public Hearing in the Official
Newspaper of the Town of Mamaroneck.

FURTHER CONSIDERATION OF SEQRA AND SUBDIVISION APPLICATION -
Mr. R. Diforio
707 Weaver Street
Block 102 Lot 181
Eliot Senor, engineer, appeared with Mr. Diforio. Also present
were a number of neighbors who were represented by Robert Pierce.
Mr. Senor stated that the water from the catch basins on the
property drains to Lakewood Drive and then to a catch basin on
Weaver Street. He stated that it had not been determined whether
the coliform counts were fowl or human in derivation.
Alan Mason stated that these counts varied widely and were found in
an ornamental pond on the Diforio property, not in Goodliffe Pond.
He speculated that the counts could come from surcharged sewer
lines which could be detected with dye tests. Mrs. Latona
requested that a test to specify the type of coliform be made. Mr.
Trachtman stated that it was his gut reaction that the water
quality would not be of particular concern.
Mr. Romeo and Mr. Hoffman again asked for specifics about the
ownership of the catch basins and storm sewers in Arrowhead Lane.
They were particularly concerned about maintenance of this system.
Mr. Hoffman stated that a drainage facility maintenance agreement
would be necessary if the system were private. Such an agreement
could allow the Town to maintain the system and charging the owner,
if necessary. He suggested contacting the lawyer used in closing
on the property for this information and stated that an agreement
with respect to the surface of Arrowhead Lane was necessary also.
A similar agreement will be needed for the proposed retention
facility.
There was discussion of placement of storm sewers for the new
lots. Mr. Romeo felt that the plan shown would put a burden on the
owner of Lot No. 1 and liked Mr. Senor's idea of putting these
lines in Arrowhead Lane's bed. Mr. Mason stated that a rapid
relPacv of water from this area exacerbates flooding downstream.
Mr. Romeo disagreed. It was suggested that curbs on the road and
the driveway would divert storm water.
Mr. Senor stated that blasting would not be necessary and that the
owner of one new lot would give an easement to the other lot's
owner relating to the driveway.
Mr. Pierce reminded the Board of the proximity of this land to the
Reservoir and that herbicides, silt and fertilizer would drain into
it. He also stated that this property borders on a Critical
Environmental Area and that the land gets very wet. The neighbors
are also concerned about traffic from two more houses. Mr. Pierce
stated that ingress and eggress from Arrowhead Lane is very
difficult at commuting times. Arrowhead Lane itslf is narrow,
also.

Joseph Messina of 699 Weaver which is at the corner of Lakewood
Lane spoke of the difficulty of traffic buildup. Joan Paley of 705
Weaver Street also appeared. She stated that water can take three
days to drain frum her property.
Mr. Trachtman stated that he needed time to review Mr. Mason's
ideas and Mr. Romeo's suggestions. With their concerns about water
runoff, the members were not prepared to make the SEQRA
determination.
Therefore, on motion of Mr. Freeman, seconded by Mrs. Jacobson, it
was unanimously decided to carry over this matter.
ADJOURNMENT
Mrs. Latona temporarily adjourned the meeting at 10:40 PM and
reopened it at 10:45 PM.
FURTHER CONSIDERATION OF SEQRA AND SITE PLAN APPLICATION -
Ten Grand, Inc.
Boston Post Road and Weaver Street
Block 410 Lots 463, 310,321, 332 & 338
Appearing on behalf of the application were Donald S. Mazin,
attorney; Fred Coleman, architect; Richard Rheaume, engineer; and
Nick Pepe. Mr. Hoffman stated that he had concluded that it was
the right of the owners of the paper street - Ferndale Street - to
use it for vehicular traffic when said owners give permission.
Mr. Mazin stated that the applicant had met with the neighbors who
had agreed to the application as now presented. There will be no
parking on the paper street. Mr. Romeo noted that one portion of
the paper street is owned by the school system. Mr. Hoffman stated
that that part could be blocked off and that the school system
might want to use its portion as a driveway.
Concerning the buffer zone which is required between a commercial
zone and residential zone, Mr. Hoffman stated that said buffer
could be on the residential property also owned by Ten Grand as had
been done recently at a car wash.
Mr. Hoffman stated that the open issues were the parking variance
and coverage variance and an appearance before the Architectural
Board of Review. The variances would be decided by the Zoning
Board before application for site plan approval by this Board.
On motion of Mrs. Jacobson, seconded by Mr. Freeman, this Board
unanimously made a negative declaration under SEQRA.
Mrs. Latona, with the other members consent, directed Mr. Hoffman
to prepare a memorandum to the Zoning Board presenting this Board's
favorable opinion of the Ten Grand application.

APPROVAL OF MINUTES
On motion of Mr. Romeo, seconded by Mr. Freeman, the minutes for
July 10, 1991 were approved as amended.
ADJOURNMENT
On motion of Mr. Murray, seconded by Mr. Romeo, the meeting was
adjourned at 11:20 PM.
