MINUTES OF THE REGULAR MEETING OF THE
PLANNING BOARD OF THE TOWN OF MAMARONECK
APRIL 8, 1992, IN THE COURT ROOM, TOWN CENTER

CALL TO ORDER
After allowing the Board members time to review the many substantive
letters at their places, the meeting was called to order by
Acting-Chairman Latona at 8:31 PM.
FURTHER CONSIDERATION OF SEQRA AND SUBDIVISION APPLICATION -
R. Diforio

Block 102 Lots 1 and 181
William Maker, attorney; Nanette Bourne, planner; and Mr. and Mrs.
Diforio were present for this application. Mr. Maker requested that the
Planning Board accept as complete the Draft Environmental Impact
Statement and that the Board schedule the Public Hearing and set the
comment period. Mr. Maker stated that Mr. Trachtman had expressed his
opinion that the document was complete at the last meeting.
Mr. Silverberg defined the parameters for the members. If they felt that
the document had deficiencies, they could ask that they be addressed and
adjourn this application. If they felt that the comments from the public
had addressed the merits of the application, not the DEIS, the members
could accept the document and set down the Public Hearing.
On motion of Mr. Donatelli, seconded by Mr. Jacobson, the Board
unanimously moved to accept the Draft Environmental Statement submitted
in this matter as complete.
On motion of Mrs. Jacobson, seconded by Mr. Donatelli it was unanimously
RESOLVED, that this Board hereby sets Wednesday, May 13, 1992 at
8:15 PM as the date and time for a Public Hearing for SEQRA and for
Subdivision Approval for the application of R. Diforio; and be it

FURTHER RESOLVED, that the Board Secretary is hereby authorized to
publish the Notice of said Public Hearing in the Official Newspaper
of the Town of Mamaroneck.
On motion of Mrs. Jacobson, seconded by Mr. Donatelli, the Board
unanimously
RESOLVED, that the public comment period on the Draft Environmental
Impact Statement on the Diforio application shall be through
Tuesday, May 25, 1992 or ten days following the close of the Public
Hearing.
Mr. Murray entered the meeting at this time.
CONSIDERATION OF SPECIAL PERMIT APPLICATION - Getty Petroleum Corporation
2385 Boston Post Road
Block 505 Lot 415
RJ Snyder of Decker and Company, agents for Getty, appeared. He stated
that the application was necessary because of a change in ownership. The
use will remain the same; no car repairs will be done. The hours will be
7 AM - 10 PM for Monday through Friday, 8 AM - 9 PM on Saturday and 8 AM
- 8 PM on Sunday.
Mr. Trachtman had given his comments by letter which will become part of
the record. He stated that there was no significant impact in connection
with the new signs and that no review regarding site plan was necessary.
On motion of Mr. Donatelli, seconded by Mrs. Jacobson, it was unanimously
RESOLVED, that the Planning Board of Appeals is the Lead Agency
and solely responsible for determining whether the proposed
action may have a significant impact on the environment;
and it is
FURTHER RESOLVED, that this is a Type II Action having
no significant impact on the environment as determined
by New York State or corresponding local law, therefore
requiring no further action under SEQRA.
On motion of Mr. Murray, seconded by Mr. Murray, it was unanimously
RESOLVED, that this Board hereby sets Wednesday, May 13, 1992 at
8:15 PM as the date and time for a Public Hearing for the
application of Getty Petroleum for a Special Permit; and be it
FURTHER RESOLVED, that the Board Secretary is hereby authorized to
publish the Notice of said Public Hearing in the Official Newspaper
of the Town of Mamaroneck.

CONSIDERATION OF SITE PLAN APPLICATION - Clocktower Associates,
3-5 Byron Place
Block 132 Lot 440
Mr. Kathwari, the principal in this corporation, was unable to appear and
had asked that the matter be adjourned to the next meeting.
On motion of Mr. Donatelli, seconded by Mrs. Jacobson, the site plan
application for Clocktower Associates for 3-5 Byron Place was referred to
CZMC for review.
CONSIDERATION OF SPECIAL PERMIT APPLICATION - Village Square Bagels
1262 Boston Post Road
Block 407 Lot 192
John Mercaldi, owner, appeared. He stated that he was opening a retail
bagel store and wanted to provide courtesy seating for his customers.
The bagels will be baked on the premises. Set-up time would be about
one-half hour before hours which will be 6 AM to 6 PM seven days a week.
Mr. Mercaldi stated that the common compactor would be large enough; he
predicts 4 yards a week of garbage. 126 spaces exist in the parking lot
at Village Square shopping center.
On motion of Mrs. Jacobson, seconded by Mr. Donatelli, it was unanimously
RESOLVED, that the Planning Board of Appeals is the Lead Agency

adjourned at 8:55 PM.
