Burdick, Recording Secretary CALL TO ORDER The meeting was called to order by Chair Reader at 8:20 PM. APPROVAL OF MINUTES On motion of Mr. Darsky, seconded by Mr. Negrin, the minutes of October 12, 1994 were approved unanimously, 5-0, as amended. PUBLIC HEARING - Subdivision - Gila Lourie - 109 Griffen Avenue - Block 305 Lot 903 On motion of Mr. Negrin, seconded by Mr. Gonye, it was unanimously, 5-0, RESOLVED, that the Public Hearing be, and hereby is, declared opened. The Public Stenographer was present for this application and her transcript will become a permanent part of this record. Mrs. Lourie appeared with Eliot Senor of Gabriel Senor, Engineering. At the meeting he distributed a new profile of the driveway and information about pre-built bridges. It is proposed that the driveway cross the stream at its narrowest point, parallel to Griffen Avenue. The bridge for the driveway would be prefabricated and 12 feet wide. It would cross the stream where it is 10 feet wide with a span of 20 feet. Planning Board November 9, 1994 -2- Mr. Senor represented that he had contacted the Army Corps of Engineer and that it had said that the stream in question is out of its jurisdiction. Mr. Trachtman stated that he felt that the plan was feasible from an environmental standpoint, but that more elaborate details such as placement of hay bales was necessary. Mr. Silverberg stated that the Board could make a negative declaration (following its previous Type I action) that night, but that it might not feel comfortable with the lack of certain information on the plans. The missing material included the location of the bridge, direction of ground water and the proposed mitigating measures for the extra water. He remarked that he, Mr. Trachtman and the Board were all at a disadvantage because the plans were not submitted in advance of the meeting. Neighbors Eugene and Jane Kaplan were concerned about the effect of a new house behind their house. Mrs. Reader assured them that the Board would require mitigating measures for the driveway and the bridge. It was noted that a new house would probably require an application for a Fresh Water Wetlands and Water Courses permit before the Planning Board. Mr. Trachtman stated that during construction down spouts, drywells or a swale of gravel were likely to be required. On motion of Mr. Fay, seconded by Mr. Darsky, it was unanimously, 5-0 RESOLVED, that the Public Hearing be, and hereby is, declared adjourned until the meeting of December 14, 1994. PUBLIC HEARING - Site Plan - Winged Foot Golf Club - 851 Fenimore Road - Block 357 Lot 1. Lawrence Gordon, architect, appeared with Russell Pelton, Esq., counsel anda member of the club. On motion of Mr. Negrin, seconded by Mrs. Reader, it was unanimously, 5-0, RESOLVED, that the Public Hearing be, and hereby is, declared opened. The Public Stenographer was present for this application and her transcript will become a permanent part of this record. With more women playing golf, the applicant has found that it has become necessary to add more sanitary facilities. The proposed comfort station will not be placed near the existing one or the clubhouse. Its location will be 400 yards from the stream crossing the golf course. This application was approved by the CZMc and the septic system by the County Planning Board November 9, 1994 -3- Board of Health. The structure will be built of stone which matches the clubhouse and with a slate roof. The proposed ball shelter will be built near the driving range and will also be stone with a slate roof. Mr. Silverberg explained that a computer glitich had caused a problem with providing legal notice to some of the neighbors of the golf course, and he suggested delaying the final vote. On motion of Mr. Negrin, seconded by Mrs. Reader, it was unanimously, 5-0 RESOLVED, that the Public Hearing be, and hereby is, declared adjourned until the meeting of December 14, 1994. REFERRAL FROM TOWN BOARD - Amendment to Moratorium of Cellular Antennaes - Mr. Fay again recused himself from the decision. Mr. Silverberg explained to the Planning Board that the 90 day moratorium declared in August was about to expire. The Town has hired a consultant to aid in its decision. Should new legislation result, time would be required for public hearings. Mr. Negrin stated that he had felt that the original 90 days would be too short. On motion of Mr. Darsky, seconded by Mr. Negrin, the following resolution was adopted unanimously, 4-0. WHEREAS, the Mamaroneck Town Board has previously adopted a moratorium on placement of cellular telephone antennas, and WHEREAS, the Mamaroneck Town Board has referred a proposed extension of the moratorium to this Board for consideration, and WHEREAS, at its November 9, 1994 meeting this Board reviewed the proposed extension and discussed its recommendations to the Town Board; it is hereby RESOLVED, that the Planning Board of the Town of Mamaroneck recommends to the Town Board the adoption of the proposed extension to the moratorium on placement of cellular telephone antennas for a period extending to February 15, 1995 in order to permit the Town to conclude its evaluation and study and to draft and implement such legislation as may be appropriate based upon the study. Such recommendation is consistent with the previous Resolution of this Board dated August 10, Planning Board November 9, 1994 -4- 1994, which recommended adoption of the moratorium in order to allow the Town Board to appropriately review and research issues relating to the concerns of the public with regard to the public health, safety and welfare, the complex legal issues relating to such regulations, the potential impacts upon critical environmental areas of such structures and in particular, the consideration of the potential impacts of such structures on property values, in particular zoning districts, and on the visual aesthetic character of the Town.
