Burdick, Recording Secretary CALL TO ORDER The meeting was called to order by Chairman Bell at 8:21 PM. PUBLIC HEARING - Subdivision Application - Julius Silverstein - 5 Prince Willow Lane - Block 333 Lot 1074 Mr. Silverstein and Jefferson Meighan, attorney, appeared. On motion of Mr. Fay, seconded by Mr. Donatelli, it was unanimously RESOLVED, that the Public Hearing be, and hereby is, declared opened. The Public Stenographer was present for this application and her transcript will become a permanent part of this record. On motion of Mr. Fay, seconded by Mrs. Jacobson, it was unanimously RESOLVED, that the Public Hearing be, and hereby is, declared closed. Mr. Meighan and Mr. Silverstein stated that the application had been heard by the Coastal Zone Management Commission on November 3, 1992 and that a new plan showing utility connections and topo lines had been submitted. Mr. Trachtman stated that said plan was conceptually appropriate. Mr. Silverstein explained that before that Board of Health would comment it needed a letter of approval from the Town, and Mr. Planning Board November 11, 1992 -2- Silverberg stated that the approval from the Board of Health must be on file with the Town before the plat could be signed by Mr. Bell. Mr. Bell referred to counsel's memo which stated that for subdivisions the Planning Board had precedence over the Tree Commission. The submission showed which trees would be removed. Several neighbors appeared. They were Walter and Rosemary Berdon, 3 Prince Willow Lane, and Jesse Rothman, 16 Doris Lane. Mr. Silverstein assured the Berdons that the arbor vitae hedge between the two properties would remain intact and explained that, contrary to his plan, he did not intend to construct a pool. On motion of Mr. Donatelli, seconded by Mr. Iacono, the following resolutions were unanimously adopted. WHEREAS, Julius Silverstein has submitted an application for Final Subdivision Approval for 5 Prince Willow Lane (Block 333 Lot 1074) in proper form and complying with all requirements of the Town, other municipal agencies, the comments of the Consulting Engineer to the Town and this Planning Board; and WHEREAS, this Board held a Public Hearing on the application for Final Subdivision Approval on November 11, 1992; NOW, THEREFORE, BE IT RESOLVED, that Final Subdivision Approval is hereby granted to Julius Silverstein pursuant to his application and subject to all terms and conditions set forth below: I. General Requirements All curbs, suitable monuments, water mains, storm drains, sanitary sewer facilities and street trees shall all be installed in accordance with the latest standards and specifications in force at the time work is started in accordance with the approved plan, particularly with respect to the Resubdivision Plan, prepared by Richard A. Spinelli, Surveyor, revised October 21, 1992. II. Compliance with SEQR A. Consistent with social, economic, and other essential considerations of State policy, to the maximum extent practicable from the reasonable alternatives thereto, the action to be carried out or approved is one which minimizes or avoids adverse environmental effects, including the effects disclosed in the relevant Environmental Assessment Form; and Planning Board November 11, 1992 -3- B. All practicable means will be taken in carrying out or approving the action to minimize or avoid adverse environmental effects, including effects disclosed in the relevant Environmental Assessment Forms and addendum thereto and all special requirements and modifications set forth herein. III. Special Requirements A. Erosion and Sedimentation Control - (During Construction) 1. Erosion and sedimentation control plans should be consistent with the Town of Mamaroneck Erosion and Sediment Control Law and consistent with the drawings submitted to the Town of Mamaroneck Coastal Zone Management Commission including the use of hay bales or a sediment curtain along the perimeter of the property bordering on Prince Willows Lane and Doris Road. 2. Erosion and sedimentation control plans shall be approved by the Consulting Engineer prior to commencement of construction. A control plan shall be submitted which shall include a construction timetable and an inspection schedule. 3. Erosion control measures must be installed on the building lot prior to excavation of foundations. B. Blasting All rock removal required in conjunction with the construction of a residence shall be solely by mechanical means and connections for utilities shall be by mechanical means if at all possible. If blasting is required for utility conections, the applicant shall fully comply with the Town of Mamaroneck blasting law. C. Trees Compliance with the Tree Preservation Law of the Town of Mamaroneck is required before a Building Permit shall be issued, and the Building Inspector shall ensure that replacement trees are planted and maintained in accordance with the Town of Mamaroneck Tree Preservation Law. D. Required Documents and Inspections 1. The applicant shall provide one Mylar reproducible set of approved drawings to the Town and one copy to the office of the Consulting Engineer to the Town. The applicant shall submit to the Town one Mylar reproducible and four copies showing the "as-built" conditions for utility and sewer connections prior to the granting of a Certificate of Occupancy for the residence to be constructed. 3. Approval from the Board of Health shall be submitted to the Building Inspector concerning sewer connections prior to filing the plat of the property with Westchester County PUBLIC HEARING - Site Plan Application - Craig Sundahl, DDS - 3-5 Byron Place - Block 132 Lot 440 Dolores A. Battalia, attorney; Lawrence Gordon, the architect; Howard Lieberman, engineer and Dr. Sundahl appeared. Mr. Bell recused himself as his wife practices law with Mrs. Battalia and asked Mr. Donatelli to chair this application. On motion of Mr. Iacono, seconded by Mr. Gonye, on a vote of 5-0-1 with Mr. Bell abstaining, it was RESOLVED, that the Public Hearing be, and hereby is, declared opened. On motion of Mr. Iacono, seconded by Mr. Fay, on a vote of 5-0-1 with Mr. Bell abstaining, it was RESOLVED, that the Public Hearing be, and hereby is, declared closed. Mrs. Battalia stated that a recalculation of the necessary parking spaces had been made and that 14 spaces plus 1 loading area were required. It is not possible to purchase municipal spaces at this time, but Mrs. Battalia stated that the 10 spaces in the lot should suffice as there is meter parking on the street. The parking issue will go before the Zoning Board. This application has been before the Coastal Zone Management Commission and the Board of Architectural Review and approved in both cases. It will return to the BAR for landscaping and signage. Mr. Lieberman described the construction of the oil separator(s) and stated that the maintenance employee for the building could change the collars himself. On motion of Mr. Iacono, seconded by Mrs. Jacobson, by a vote of 5-0-1 with Mr. Bell abstaining, it was RESOLVED, that the construction of a professional building at 3-5 Byron Place will have no significant impact on the environment as Planning Board November 11, 1992 -5- determined by New YOrk State or corresponding local law; and it is FURTHER RESOLVED, that a negative declaration shall be issued. On motion of Mr. Fay, seconded by Mrs. Jacobson, by a vote of 5-0-1 with Mr. Bell abstaining, the following resolutions were adopted. WHEREAS, Craig Sundahl DDS has submitted an application for Site Plan Approval for construction of a professional building at 3-5 Byron Place (Block 132 Lot 440); and WHEREAS, the Planning Board has been designated Lead Agency and has conducted and completed proceedings pursuant to SEQR; and WHEREAS, the Planning Board has reviewed all of the submissions by, and on behalf of, the applicant, all correspondence from Town officials, the Consulting Engineer to the Town, and the Coastal Zone Management Commission and members of the public, and a Public Hearing having been held pursuant to notice on November 11, 1992; NOW, THEREFORE, BE IT RESOLVED, that site plan approval is hereby granted Craig Sundahl, pursuant to his application and subject to all terms and conditions set forth below: I. General Requirements All site work, traffic controls, landscaping, storm water drainage and treatment systems shall be in accordance with and subject to the plans submitted, as follows: Drawing P-1, "Demolition Plan, Vicinity Map, Site Plan, Section and Details," by Lawrence Gordon & Associates, dated 9/18/92. II. Compliance with SEQR A. Consistent with social, economic, and other essential considerations of State policy, to the minimum extent practicable from reasonable alternative thereto, the action to be carried out or approved is one which minimizes or avoids adverse environmental effects, including the effects disclosed in the relevant Environmental Assessment Form; and B. All practicable means will be taken in carrying out or approving the action to minimize or avoid adverse environmental effects, including effects disclosed in the relevant Environmental Assessment Forms and addendum thereto and all special requirements and modifications set forth herein. III. Special Requirements A. Oil Separators The Building Superintendent or other designee shall submit an affidavit every six months to the Building Planning Board November 11, 1992 -6- Inspector that the "collars" of the oil separator(s) of the parking lot have been checked for oil residue or replaced. B. An easement shall be filed with the Town Clerk for the utility lines in the former road bed of 3-5 Byron Place. C. This approval is subject to the applicant obtaining a parking variance from the Zoning Board of Appeals for the five extra parking spaces. D. The design for drainage shall be submitted to the Consulting Engineer to the Town for final approval. E. Erosion and sedimentation control plans shall be based upon the standards presented in the Town of Mamaroneck Erosion and Sediment Control Law. PRESUBMISSION CONFERENCE - Site Plan Application and Fresh Water Wetlands Permit - Winged Foot Golf Club _ Fenimore Road - Block 344 Lot 99. Richard Leahy, a Board member of the golf club, appeared in the stead of Robert Alonzi, course superintendent with the architect, Richard Heine. It is the desire of the club to build a 3,000-square-foot extension to its vehicle storage facility which would include more vehicle storage and an improved employee lunch and locker area. The building will be constructed on an existing macadam area, and extensive landscaping will be done. It is the applicant's intention to conform with environmental standards. Mr. Heine explained his submission to the Board and stated that the Building Inspector had requested the addition of drywells at the new leaders and gutters. Mr. Heine stated that the facility will be accessible to the handicapped and reminded the Board of the fairly recent installation of above-ground gasoline tanks. On motion of Mr. Donatelli, seconded by Mr. Iacono, it was unanimously RESOLVED, that the Planning Board is the Lead Agency and solely responsible for determining whether the proposed action may have a significant impact on the environment; and it is FURTHER RESOLVED, that this is an Type I Action which may have a significant impact on the environment as determined by New York State or corresponding local law; and it is FURTHER RESOLVED, that this matter is referred to the Coastal Zone Management Commission for review. On motion of Mr. Donatelli, seconded by Mr. Iacono, it was unanimously RESOLVED, that this Board hereby sets Wednesday, December 9, 1992 at 8:15 PM as the date and time for a Public Hearing for the Planning Board November 11, 1992 -7- application of Winged Foot Golf Club for Site Plan approval and for a Fresh Water Wetlands permit; and be it FURTHER RESOLVED, that the Board Secretary is hereby authorized to publish the Notice of said Public Hearing in the Official Newspaper of the Town of Mamaroneck. DISCUSSION OF CHANGES IN NEW YORK STATE ENABLING LEGISLATION Mr. Silverberg explained the submission that he had given the Board and discussed the changes which will occur in July to the State law for subdivision approval. He suggested that the Board study the old law in comparison with this new one in order to make suggestions for new subdivision regulations which will need to be written. Mr. Silverberg suggested that the Board be ready with comments by January as the Town Board will need to hold a Public Hearing. COUNTY PLANNING BOARD Claudia Ng, Environmental Coordinator, explained to the Board that the County Planning Commission had submitted to her a set of maps of the Town and a report entitled Patterns for Westchester. She will circulate said report and asks that members give her comments so that she may answer soon. APPROVAL OF MINUTES On motion of Mr. Iacono, seconded by Mrs. Jacobson, the minutes for the meeting of September 9, 1992 were approved. On motion of Mr. Donatelli, seconded by Mrs. Jacobson, the minutes for the meeting of October 14, 1992 were approved as corrected.
