HomeMy WebLinkAbout1992_07_08 Planning Board Minutes MINUTES OF THE REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK JULY 8, 1992, IN THE COURT ROOM, TOWN CENTER 740 WEST BOSTON POST ROAD MAMARONECK, NEW YORK Present: Sanford A. Bell Gabriel Fay Sal Iacono Norma Jacobson Alan Murray Absent: Jerry Donatelli Edward Gonye Also Present: Steven M. Silverberg, Counsel Gary Trachtman, Consulting Engineer Ellen Morse, Recording Secretary Marci Dustin, Public Stenographer Kazazes & Associates 250 East Hartsdale Avenue Hartsdale, NY 10528 CALL TO ORDER The meeting was called to order by Chairman Bell at 8:25 PM. PUBLIC HEARING - Site Plan Application and Determination of SEQRA - Town of Mamaroneck - 1361 Boston Post Road, Block 411 Lot 169 Mr. Bell stated that Mr. Altieri had notified him that certain changes were being made to the plans and that the Town requested an adjournment to August 12, 1992. No one in the audience had any comments about this matter. On motion of Mrs. Jacobson, seconded by Mr. Murray, it was unanimously RESOLVED, that Public Hearing on 1361 Boston Post Road be postponed until August 12, 1992. CONSIDERATION OF SPECIAL PERMIT APPLICATION - Auto Craftsman 2430 Boston Post Road Block 503 Lot 421 Donald S. Mazin, attorney, appeared. He stated that a new owner is taking over an existing repair business which this Board granted a Special Permit last year. On motion of Mrs. Jacobson, seconded by Mr. Iacono, it was unanimously RESOLVED, that the Planning Board is the Lead Agency and solely responsible for determining whether the proposed Planning Board July 8, 1992 -2- 41:0 action may have a significant impact on the environment; and it is FURTHER RESOLVED, that this is an Type II Action having no significant impact on the environment as determined by New York State or corresponding local law, therefore requiring no further action under SEQRA; and it is FURTHER RESOLVED, that this Board hereby sets Wednesday, August 12, 1992 at 8:15 PM as the date and time for a Public Hearing for the application of Auto Craftsman for a Special Permit; and be it FURTHER RESOLVED, that the Board Secretary is hereby authorized to publish the Notice of said Public Hearing in the Official Newspaper of the Town of Mamaroneck. CONSIDERATION OF SPECIAL PERMIT APPLICATION - America's Chicken 1262 Boston Post Road Block 407 Lot 192 Edward Davidson, attorney, appeared. He stated that the restaurant has opened as a takeout one. The applicant requested 18 seats. The restaurant has a handicapped bathroom. The operators recycle bottles and cans and use the building's compactor for garbage. On motion of Mr. Iacono, seconded by Mr. Murray, it was unanimously RESOLVED, that the Planning Board is the Lead Agency and solely responsible for determining whether the proposed action may have a significant impact on the environment; and it is FURTHER RESOLVED, that this is an Type II Action having no significant impact on the environment as determined by New York State or corresponding local law, therefore requiring no further action under SEQRA; and it is FURTHER RESOLVED, that this Board hereby sets Wednesday, August 12, 1992 at 8:15 PM as the date and time for a Public Hearing for the application of America's Chicken for a Special Permit; and be it FURTHER RESOLVED, that the Board Secretary is hereby authorized to publish the Notice of said Public Hearing in the Official Newspaper of the Town of Mamaroneck. r Planning Board July 8, 1992 -3- CONSIDERATION OF AMENDMENTS TO SERVICE BUSINESS DISTRICT ZONE The Board had questions about requiring companies to wash cars inside a fully enclosed structure and felt that such a limitation would force companies to go out of business. The Board agreed that outside sales should be eliminated and was split 3-2 about washing cars outside. Mr. Silverberg will draft a memo to the Town Board encompassing everyone's view. APPROVAL OF MINUTES On motion of Mr. Murray, seconded by Mr. Fay, the minutes of the meeting of June 10, 1992 were unanimously approved. PROCEDURES After some discussion with Mr. Silverberg, the Board agreed that many cases such as were discussed tonight could be set down directly for a Public Hearing, but that it would like to guide applicants for Site Plan approval.
