Present: Supervisor Burton Justices Boyd, Collins and Howell Town Clerk Sherman Counsellor Gamble Counsellor Gamble presented a copy of a communication from Tichols Brothers , who were awarded the contract for the painting work to the Weaver Street Fire House and the Police Station, stating that it would be impossible for them to do the painting work and requesting the withdrawal of their proposal.. The communication was ordered received= placed on file and after discussion, it was, upon motion, duly seconded PESOLVED,.. that the subject matter of painting the Weaver Street Fire House , be laid over at this time , and that the matter of painting the Police Station, be referred to a committee consisting of justices Howell and Leeds, and Town Clerk Sherman, with power to negotiate with the next lowest bidder, and award the work to him, if it can so be arranged, upon the terms and conditions as set forth in the original proposal. A communication from the :leaver Street Fire Company, was received and read, requesting permission to participate in the parade and convention of the Westchester Firemen's Association at Troy, Xew York, on June 18th to 22nd, inclusive , together with the Seagraae Apparatus. The communication was ordered received, placed on file and after due consideration, it was, upon motion, duly seconded RESOLVED, that the ma tter of granting permission to the Weaver Street Fire Company, to use the Seagrave Apparatus, in the parade of the West- chester Firemen 's Association, at Troy, TT. Y. , from June 18th to 22nd, inclusive, be and the same hereby is approved, and permitted, and the Fire Committee be and they hereby- are authorized and directed to arrange and secure the necessary insurance , indemnifying the Town of Vamgroneck from any loss or damage caused by or to said apparatus. The Clerk presented to the Board a letter from the Board of Sewer Commissioners of Sewer District No. 1, of the Town of Mamaroneck, advising the Board that the Commission had opened bids for the construction of ContrLjct No. 17, and that the cost of construction of said contract, including Engineer's fees andother necessary expenses, will be $602,000.00, and requesting the Board to authorize the issuance and sale of Certificates of Indebtedness from time to time as payments become due under said contract in the said sum of :'60,_000.00, all of said Certificates to -:be issued by the Supervisor as provided under the provisions of the Town Law. r Counsel advised the Board that he was familiar with the request and had discussed the same with the Board of Sewer Com- missioners , and that it was in proper form, and that the Town Board was in a position to authorize the issuance of said Cert- ificates so that the work under said Contract would proceed. After discussion, upon motion, duly seconded, it was -" RESOLVED, Wh1FREAS,. the Board of Sewer Commissioners of Sevier District Ho. 1, of the Town o° Mamaroneck, have estimated and reported to this Board the estimated cost of construction of Contract Teo 17, determined as required by law; and -Vd=AS, pursuant to law, the Town Board shall taus€ Certificates of Indebtedness to be issued the same to be a Town charge , the proceeds of which Certificates shall be applied in payment of the cost of construction of said part or portion of such Sewer District as is so requested by said Sevier Commissioners; therefore be it RESOLVED, that the Supervisor:be and he hereby is authorized and empowered, in accordance with the Taw, to borrow upon the faith and credit of the Town of Mamaroneck, the sum of not to exceed $60,000.00 , plus interest which may from time to time accrue thereon, and to issue a temporary Certificate or Certificates of Indebtedness in the amount of not to exceed $60,000.00, plus interest which may from time to time accrue thereon, which shall bear interest at the rate of not to exceed six per cent per annum, payable at such time or times as the Supervisor may fix, not ex- ceeding however, eighteen months from the date hereof, and to sell or dispose of said Certificates of Indebtedness for not less than the par value thereof; and further RESOLVED, that said Certificate or Certificates of Indebtedness shall be in substantially the following form. No. 0 - The Town of Mamaroneck, in the County of Westchester, a Municipal Corporation of the State of Netir York, hereby acknowledges - itself indebted and for value received promises to pay to bearer hereof, or if the same be registered, to the registered holder on the sum of Dollars, lawful money of the United States of America. with interest thereon from the date at the rate of per cent per annum, both principal and interest being payable in lawful money of the United States at This Certificate of Indebtedness is one of an issue of x6010000 of Certificates of Indebtedness heretofore authorized in the sums of having been 'heretofore issued, being issued pursuant to the provisions of the Tovrn Law, constituting Chapter 62 of the Consolidated Laws of the State of Rev., York, Chapter 594 of the Laws of 1926 and Chapter 437 of tim Laws of 1928 of the State of New York, and in strict compliance with the Constitution and Statutes of the State of New York and by -firtue of a resolution of the Town Board of the Town of Iifamaroneck, regularly and lawfully adopted June 7th, 1929. It is hereby certified and recited that all conditions, acts and things required by the Constitution and Statues of the State of rew York to exist, to have happened and to be performed precedent to and in the issuance of this Certificate of Indebted- ress exist, have happened and have been performed and that the issue of Certificates of Indebtedness of which this is one , to- -- gether with :a ll other indebtedness of said Town of Liamaroneck, is within all its debt and other limits prescribed by the Constitution and Laws of this State. IN vVIT177SS V�IETREOF, th- Town of Llamaro -eck, through its Town Board, has caused this Certificate of Indebtedness to be signed by its Supervisor and the corporate seal of said Town to be hereunto affixed and attested by its Town Clerk, and this Certificate of Indebtedness to be dated this day of 192 Attest: Supervisor Town Clerk I further RESOL72D, that the Town of Mamaroneck hereby covenants to pay the principal and interest of said Certificate or Certificates of Indebtedness in theamount hereinabove provided as the same shall become due , by levying assessments on Property of Sewer District I?o. 1 of the Town of Mamaroneck at such time ar times and in such amounts as may be necessary therefor. The Town of Mamaroneck further covenants in case of a default in carrying out the foregoing covenant the said Town will raise by taxing all taxable property in said Town of Mamaroneck from time to time the sum or sums sufficient to pay the prin- cipal and interest of said Certificate or Certif- icates of Indebtedness as the same shall become due. The Clerk presented to the Board a letter from the Bard of Sewer Commissioners of Sewer District No. 1 of the Town of Mgmaroneck, advising the Board that the Coi=ission had opened bids for the construction of Contract 101, and that the cost of const- ruction of said contract, including Engineer's fees and other necessary expenses, will be ; 30,000.00 and requesting the Board to authorize the issuance and sale of Certificates of Indebtedness from time to time as payments become due under said contract in the said sum of $30,000.00, all of said Certificates to be issued by the Supervisor as provided under the provisions of the Town Law. Counsel advised the Board that he was familiar with the request and had discussed the same with the Board of Sewer Com- missioners, and that it was in proper form, and that the Town Board was in a position to authorize the issuance of said Certificates so that the work under said contract could proceed. The Town of hamaroneck further covenants in case of a default in carrying out the foregoing covenant, the said Town will raise by taxing all taxable prop- erty in said Town of Mamaroneck from time to time, the sums sufficient to pay the principal and int- erest of said Certificate or Certificates of Indebtedness as the same shall become due.
