The meeting was called to order by Supervisor McCulloch at
Present: Supervisor McCulloch
Councilmen Bates, Brennan, Griffin, Meginniss
Absent: Done
The presence was also noted of Town Clerk Yarvin, Town
Attorney Delius, Assessor Smith, Town Engineer Foote and Assistant
Town Attorney Schwartzreich.
Mr. Brennan reported on highway matters. He stated that
he and Superintendent of Highways Foote had completed their inspec-
tion of Town roads.
Tar. Neginniss reported on finances. He stated that prepara-
tions are under way for the compilation of the 1938 budget requests.
The regular order of business was suspended in order to
hear- A. Ackerman who addressed. the Board concerning the application
of Gilbert Merenda for the construction of a sewer at the `stub" end
of Edgewood. Avenue from the intersection of Judson Street . He stated
that irr. Merenda himself would install a sewer for a total length of
65 feet for the sum of °`:110.00 if the Town would waive its require-
ment that he carry blasting insurance . Engineer Foote stated that
this insurance requirement should not be waived and that the amount
of insurance carried should be J�5,000. After discussion it was upon
motion duly made and seconded unanimously
RESOLVED that upon the receipt by the Town
from Mr. ivierenda of the sum of X110.00 the
Town will construct the sewer from the "stub"
end of Edgewood Avenue to Kr. Merenda' s
property line, a distance of 65 feet.
I:ir. Bates reported on drain matters, saying that Henry W.
Taylor, the consulting hydraulic engineer recently engaged by the
Town to prepare a study of the storm drain conditions in the hurray
Avenue-Glenn Road area, had completed a report and was desirous of
meeting with the Town Board to discuss the matter. The Board
unanimously resolved to meet with Hr. Taylor in executive session on
Wednesday, October 27, at 7: 30 P . ra.
The Town Attorney presented a petition signed by the re-
quisite number of property owners, petitioning the Town 'Poard to
create an extension, designated as Section "IFF, to Sewer District
No. 1 of the Town and constructing a sewer system therein. Attached
to the petition was a certificate dated October 11, 1937, signed by
Assessor Smith, certifying that the assessed value of the real pro-
perty owned by said. petitioners is in excess of 50 per cent of the
total of the assessed value of the property included in said pro-
posed extension and further that those persons who have signed said
petition are resident owners of property aggregating more than 50
per cent of the assessed valuation of all the property within the
proposed extension owned by resident owners. T'ne petition, together
with the Assessor' s certificate, was received and filed.

be expended for the proposed sewer system to be con-
structed in said extension, together with a map and plan
prepared by A. J. Foote, Civil Engineer, Larchmont, Ivew
York, entitled: "Proposed Extension of Sewer District
No. 1 to be Designated Section ' I' as amended", showing
the boundaries of the proposed extension, a general plan
of the proposed sewers to be constructed therein, in-
cluding all outlets and the terminus course and the
profiles of each proposed sever or drain, and a schedule
showing the manner in which said sewer system will
connect with and drain into trunk sewers of the West-
chester County Sewer Commission (Pdamaroneck Valley Sewer
District ) has been filed in the office of the Town
Clerk o-O the Town of ll4amaroneck on October 20, 1937,
and has been duly presented to this Board. Now, therefore,

follows:
Section 1 . The following order is hereby adopted
and approved, and when signed by the members of this
Board present at this meeting, the same shall constitute

WHEREAS, a petition purporting to be signed by the
requisite number of property owners as required by
Section 191 of the Town Law, petitioning the Town Board
of the Town of laamaroneck to create an extension,
designated as Section ' I' , to Sewer District No. 1 of
the Town of ivamaroneck and to construct a sewer system
therein, said petition describing the boundaries of the
proposed extension and stating the maximum amount to be
expended for the proposed_ sewer system to be constructed
in said extension, together with a :rap and plan prepared

same is intersected by the easterly boundary line of
Section E. of Sewer District No, 1 and running thence ;
northeasterly along the northerly boundary line of

corner of the Rouken Glen Subdivision thence southeasterly
along the easterly line of said subdivision and the
westerly boundary line of the "Bill Estate" to the

the Town of r,iamar•oneck, wholly outside of any in-
corporated village, and
WPIEREAS, the estimated amount to be expended in
constructing and completing the improvements proposed
is 81001000. Now, therefore, it is hereby
ORDERED as follows :
At the regular meeting of the Town Board to be
held on the 17 day of November, 1937, at eight
o° clock P . M, . at the Town Offices, 153 west Boston
Post Road, in the Village and Town of Paiarriaroneck, the
Town Board_ of the Town of Sviamaroneck will meet to
consider the said petition for the extension of Sevier
District No. 1 of the Town of Mamaroneck, lying in
the said Town of '_ amaroneck, outside of the incorporated
Villages of Larchmont and Mamaroneck, and to hear all
persons interested in the subject thereof concerning
the same .

Section 2. A copy of such Order- together with a
certificate by the Town Clerk showing the date of the
adoption of the same shall be published at least once
in each of the three weeks immediately preceding the
week in which said hearing is to be held in the"Daily
Times", a newspaper printed and published in the
Village and Town of Mamaroneck and circulating in the
proposed extension of Sewer District No. 1, (there
being no newspaper actually published within the
boundaries of the proposed extension) , and said news-
paper is hereby designated as the official newspaper
of the Town for the purpose of such publication.
Certified copies of said Order shall also be posted in
five of the most public places within said Town, four
of said places to be within the boundaries of the
proposed extension of Sewer District Io. 1 at least
twenty-one days prior to the date set for said hearing,
and certified copies of said Order shall again be
posted in the same number of public places in said Town
and in said proposed extension not less than ten nor
more than twenty days before the date of said hearing.
A certified copy of said Order shall also be mailed
on or before the day of the first publication thereof
to all public service corporations the names of which
appear on the latest completed assessment roll of the
Town, such notice to be mailed to the principal office
of the corporation unless such corporation shall have
filed with the Town Clerk a written request designating
some other address for the purpose.
Section 3. This resolution shall take effect
immediately.
On motion of Mr. Brennan, seconded. by ivir. Griffin, the
foregoing resolution was adopted by the following vote:

Upon motion duly made and seconded it was upon roll call
unanimously
RESOLVED that a copy of the Order dated October 20,
1937, referred to in the foregoing resolution be
published in The Daily Times on October 27, ivovember 3,
and ivovember 10, and that five certified copies thereof
be posted on October 27 and November 5, in accordance
with Section 2 of the foregoing resolution.
A certificate verified on the 20th of October was received
from the Receiver of Taxes and Assessments, stating that the amount
of uncollected taxes for the State, County and Town levy for the
year 1937 is t?157, 906.67. The certificate was ordered filed.
The Supervisor stated that it would be necessary for the
Town to borrow the sum of $150, 000 in anticipation of the receipt
of unpaid State, County, Town and Town District taxes for the fiscal
year beginning January 1, 1937 that he had received three offers to
purchase a certificate of indebtedness in this amount and that the
lowest and. best offer received was that of the First `+ational Bank
of 'Mount Vernon, offering to pay 1 per cent for a certificate of
indebtedness dated November 1, 1937, and maturing July 1, 1938.
N.r. Isieginniss introduced the following resolution:
RESOLVED BY Thy TOj'Y BOARD OF THE TO'�VNT OF MAMARONECK,
IN TIC COUNTY OF 11FESTCEESTER, NEW YORK, as follows:
Section 1. In anticipation of the receipt of unpaid
State, County Town and town district taxes for the
fi c ryetr beginning Januar 1 1037 and ending December 31,1937
�a ° pay eto° 1asC°onft�r��a Pry amount of unpaid
State and County taxes, and (b) to meet the lawful ex-
penditures of the 'Town and of the town districts under
the appropriations for said year, the Supervisor is
hereby authorized and directed to issue the certificates
of indebtedness of said Town in the ag-gregate principal

of 1916 of the State of New York, as amended.

The Supervisor is hereby authorized to determine all
matters in connection therewith not determined by this
or subsequent resolution and his signature upon said
Certificates shall be conclusive as to such determina-
tions . Said Certificates of Indebtedness shall be
signed by the Supervisor and countersigned by the Town
Clerk and shall have the corporate seal affixed thereto.
The Supervisor is hereby authorized and directed to sell
said Certificates at private sale at not less than par,
without advertisement or public bidding, and to deliver
the same to the purchaser upon receipt of the purchase
price, plus accrued interest from the date of the
Certificates to the date of delivery.
On motion of Mr. Meginniss, seconded by Mr. Bates, the
foregoing resolution was adatted by the following vote:

The Town Attorney reported that in accordance with the action
taken by the Board at its meeting on October 6, he had received from
the Larchmont Tennis Club, Inc. a written statement from the Larchmont
Gardens Company, giving the tennis club permission to operate on the
premises located at 102 Harmon Drive, Larchmont . He stated that he
had inspected the permission and approved it and that the Town Clerk
could therefore proceed to issue the necessary dance hall license .
The Town Attorney made his report to the Town Board in
connection with the letter from E . Peter Hathvon, dated September 27th,
19375 asking that consideration be given to the compromise of certain
taxes upon property owned. by Helen H. Rathvon known as Lots 41, 42,
43, Section 9- 2 Block 105.
After considerable discussion, the Board referred the matter
back to the Attorney and the Comptroller for computation of the amount
of taxes upon these lots , based on assessed valuation reduced to the
value reported by the referee in certiorari proceedings for the years
1933 and 1934, taxes of 1934 and 1935, and a reduction of assessed
value for the years 1936 and 1937 on the basis of a settlement of
certiorari proceedings now pending, which were brought to review the
1935 and 1936 assessments on those lots together with lots 38, 39 and
40, also owned by Helen H. Rathvon, upon the basis of figures submitted
by ir. Rathvon in Paragraphs 3 and 4 of his letter.
A letter dated October 20, 1937, was received from Piiclnnes
and Gamble, attorneys for Ideal R. Andrews, owner of property on
Edgewater Point, Mamaroneck, requesting leniency in the matter of tax
penalties for their client . After discussion the request was denied.
The Town Attorney reported on the proceeding brought by
the Ninged _Foot Golf Club to review the assessment for the year 1936,
taxes of 1937, placed upon their property. He stated that the Referee
had submitted his findings which allowed the club no reduction at all
on the assessment placed on the land and a total reduction of 17, 500
on the assessment placed on the buildings. He recommended that the
Town Board move to confirm the Referee' s report .
On motion by Mr. Meginniss, seconded by Mr. Brennan, it
was unanimously
RESOLVED that the Town Board direct the Town Attorney
to move to confirm the Referee' s report in the
certiorari proceeding brought by the Winged Foot
Golf Club to review the assessment for the year 1936,
taxes of 1937, placed upon their property.
The Supervisor declared that the Winged Foot certiorari
action "was a very involved legal battle of great importance to
the Town" affecting as it did a. large amount of unimproved acreage
He said that the Town Attorney deserved a vote of appreciation for
the very real victory which he won for the Town.
On motion by Mr. Griffin, seconded by Mr. Meginniss, it
was unanimously
RESOLVED that the compliments and the thanks of
the Torn Board be and they hereby are extended
to John L. Delius, Town Attorney, upon the
very signal victory won by him in the Winged Foot
certiorari proceedings.
Mr. Delius thereupon thanked the Supervisor and the Town
Board_ for their words of praise .
The Town Attorney reported that he had made a careful
study of the law relating to oeddling with particular reference to
magazine subscription solicitors and that in his opinion such
solicitors were not to be considered as peddlers inasmuch as they
merely took orders and subsequently shipped the goods from outside
of the State and that therefore they would not be required to obtain
peddlers licenses as issued by the Town Clerk.
A letter dated September 25, 1937, was received from Ellen
Cullen concerning the matter of taxes on property known as Section 2,
Block 10, Lots 315 32 and 33 owned by John Cullen. The matter was
referred to the Clerk for further investigation.
A letter dated October S. 1937, was received from Public
7jelfare Officer DeVinne concerning the request of Mrs. Filomena
Notarangelo for a reduction in the assessed valuation of her pro-
perty, which matter had been referred to him and Assessor Smith at
the meeting on October 6. A report from Assessor Smith was also re-
ceived concerning this matter.
After considering the two reports the Board unanimously
decided that it could do nothing to assist i� rs. Notarangelo.
A letter dated. October 13, 1937, was received from Meyer
Kurz of rloody Lane, concerning his previous request that the Town
Board take title to this dead end street .
Upon motion by Mr. Bates, seconded by Mr. Griffin, it was
unanimously
RESOLVED that the Town Board hereby agrees to
accept Woody Lane, a dead. end street, as a Town
highway without reference to the one-foot reserve
strip at the end of the street, upon the presentation
to the Town Attorney and. his approval of a deed con-
veying the title to the Town.
A letter dated October 8, 1937, was received from the County
Health Department enclosing a summary of the activities of the depart-
ment for the year 1936 . The letter and sum-nary were ordered filed.
A letter dated October 18, 1937, was received from
T. Roosevelt Allen requesting the installation of at least one street
light on Lafayette Road (formerly part of Madison Avenue) .
The Board unanimously authorized the installation of one
100 candle-power light on this street, the exact location of the
light to be determined. by Mr. Brennan.
A letter dated October 9, 1937, was received from the County
Engineer concerning the matter of securing to the Town the benefit
of a State contribution in the amount of x;50.00 per mile for the
removal of snow from State highways.
Town Superintendent of Highways Foote recommended that the
Town authorize him to enter into an agreement with the Cous_ty Engineer
in the form prescribed, as was done last year, in order to secure to
the Town this benefit . He stated that the total mileage of State
highways outside of the villages in the Town amounted to 2.76 miles.
On motion by Mr. 3rennan, seconded by kr. Bates, it was
unanimously
RESOLVED, that the Town Superintendent of Highways
be and he hereby is authorized to enter into an
agreement with the County Engineer for the purpose
of securing to the Town the benefit of the State
contribution for the removal of snow from State
highways .
The Town Clerk reported that in conformity with the action
of the Town Board in directing him to encourage the practice of
safety amon Town employees, he had arranged with the Westchester
County Chapter of the American Red Cross for the holding of a course
of instruction in first aid and accident prevention. The course would
take twenty hours and would be taught by a competent professional
teacher. Further, that he had arran-ed that most of the members of
the Town police force and representatives of the highway, sewer, park
and other departments attend the course. Further, that the first
meeting of the course was 'held on Saturday, October 16, 1937, at
which a total attendance of t,:,A7enty-three persons was reported in ad-
dition to the presence of two representatives of the State Insurance
Fund.. the carriers of the Town' s workmen' s compensation insurance .
Further, that these representatives of the State Insurance Fund had
informed him that the Town of IViamaroneck was the first town in West-
chester County, if not in the state of New York, to have first aid
instruction given to the representatives of departments other than
the police and fire departments. He said that the reason no repre-
sentatives of the Fire Department were present at this course was
because they have all previously received such instruction.
A letter dated September 24, 1937, was received from Mrs.
fuilliam E. Doggett, 3 Cherry Avenue, LarcHmont, offering to pay 6 per
cent interest on a tax lien 'held by the Town.
On motion by Mr. Me-inniss, seconded by ,Ir. Griffin, it
was unanimously
RESOLVED that the offer of Mrs . 'Tdilliam E .Doggett,
to pay a tax lien held by the Town, representing a
tax for the year 1921, on property known as
Section 7, Block 12A, Lots 1 and 2, in the face
amount of the lien plus interest to date at 6 per
cent, be and it hereby is approved.
The Supervisor reported that three purchasers of tax liens
at the sale held on Pray 26, 1937, had failed to complete their
purchases by paying the 75 per cent of the amount bid which was pay-
able within ten days after the sale and recommended that a re-sale
of such liens as remain unpaid be held on November 24, 1937 at 10 A.Y.
He stated that he had exhausted every means at his command in an effort
to induce these purchasers to pay up.
On motion by _-Mir. ivieginniss, seconded by lVir. Bates, it was
unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to proceed with the re-sale of the tax
liens above referred to; and be it
FURTHER RESOLVED, that the publication of the
notice of such re-sale be made in The Daily 'Times
of Mamaroneck on November 3, November 10 and
November lr and that the posting of copies thereof
be done as required by law.

Two estimates dated October 8, 1937, were received from
Westchester Joint 'Hater Works, Sao. 1 of the cost of installing 885
feet of .rater main through the Engelsted property from Rockland
Avenue , opposite Avon Road, to Little Farms Road. One estimate in
the amount of 2';1,157. 37 was for installing 6-inch Transite pipe .
The other estimate in the amount of x,1, 223.60 was for installing
6-inch cast iron pipe . In either case all trenching and backfilling
would be done by the Town. The Town Engineer stated that he re-
comlended using Transite pipe and the Supervisor stated that P:4-r. Thrasher
of the Water '^':`orl;s made the same recommendation.
On motion duly made and seconded it was unanimously

RESOLVED, that the Westchester Joint Water Works,
do. 1 beIand it hereby is authorized, empowered
and directed to install for the Town of lAamaroneck
the water main above described and to charge to the
Town the actual cost of layin.g the pipe, the Town
to do the trenching and backfilling.
A petition dated. October 20, 1937, was received from the
Assessor requesting the correction of the assessment roll for the
year 1937, tax of 1938, in certain respects as more fully set forth
below. All of the corrections requested by the Assessor were for
the purpose of permittin_ the apportionment of -taxes and involved
no change in the total assessment except for the last item which was
requested because of an error in transferring the assessment from
the buildin^ permit cards to the roll.
