MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD MAY 20, 2020 BEGINNING AT 5:30 PM.
PURSUANT TO THE GOVERNOR’S EXECUTIVE ORDER NO. 202.1, SUSPENSION OF LAW
ALLOWING THE ATTENDANCE OF MEETINGS TELEPHONICALLY OR OTHER SIMILAR
SERVICE:
Article 7 of the Public Officers Law, to the extent necessary to permit any public body to meet
and take such actions authorized by the law without permitting in public in-person access to
meetings and authorizing such meetings to be held remotely by conference call or similar
service, provided that the public has the ability to view or listen to such proceeding and that
such meetings are recorded and later transcribed;

CALL TO ORDER - WORK SESSION

On motion of Councilwoman Fiddelman, seconded by Councilman King, the Work Session was unanimously
opened at 5:30 p.m.
Additionally Present: Town Comptroller, Tracy Yogman and Town Engineer, Rob Wasp
Capital Project Schedule/Financing
The Town Board reviewed the 2020 Capital Project/Bonding Resolutions, as well as an updated Capital
Project listing. The Town Board asked for a review from Ms. Yogman specific to bonding, and it was noted
that the total bond issue will be $3,651,000.00. The Memorial Park project and the Madison Avenue
Intersection Improvements are being deferred until 2021, and due to a gift received, the Town is moving
forward with the furniture replacement at the Senior Center.
OUT OF ORDER
Hickory Grove East Sidewalk Extension
Mr. Wasp presented a design development status memo for Town Board review, in which two alternate
design layouts were presented. Mr. Wasp would like the Board to decide on an option before moving
forward with discussing the project specifics with the homeowners who will be affected. Option 1 would
provide for a 24-foot roadway while option 2 would provide for a 26-foot wide roadway. The Board
reviewed both options in detail. Option 1 is being recommended by the Town Engineer. Councilman King
asked that a final review of the needed width for any emergency vehicles be confirmed. The Town Board
agreed to move forward with the Mr. Wasp’s Town recommendation of option one.
Coronavirus Response- Review of Suspended Laws
Supervisor Seligson gave an update on the weekly municipal call with the County Executive, which included
New York State Comptroller, Tom DiNapoli. Supervisor Seligson noted items of importance from the call. To
date the Hudson Valley region, of which Westchester County is a part, has met 5 of the 7 criteria for phase

1 reopening. The Town will continue to maintain 50% staffing until May 29. The County Executive believes
the region can meet the last 2 criteria within a few weeks. There are 120 children in Westchester who have

contracted the newest ‘kids’ disease. The Town will continue in a State of Emergency, and continue with
the current suspension of laws, for as long as the County remains in a State of Emergency.
On another subject, the Larchmont Village Environmental Committee has encouraged the Village of
Larchmont to ban gas powered blowers completely, noting that the Town may feel some pressure to do the
same. The Planning Board will meet virtually for the first time since the State of Emergency, on June 10.
Review Peddler’s Law
The Town Board reviewed the latest draft legislation to amend the Peddler and Solicitation law.
Three areas are being amended and include permissible hours, reduction in fees and the introduction of a
do not disturb registry. A number of Town Board members objected to the requirement for a ‘no solicitor
sign’ on the residents’ properties.
On motion of Councilwoman Katz, seconded by Councilman King, the Board unanimously agreed to enter
into a closed session to receive advice of Counsel.
ADVISE OF COUNCIL
On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Board unanimously agreed
to resume the Regular Meeting.
Sewer System Assessment Program
Supervisor Seligson spoke of a grant opportunity to develop an Asset Management Program for the sewer
system. This program is designed to see and catalogue every asset of the sewer system, assess its useful life
and alert when service is needed. It has been suggested that the Town apply for this grant through the
National Fish and Wildlife Foundation’s Long Island Sound Future Fund. The grant request is estimated to
be $150,000, with a match that would be covered by work the Town has already completed. The grant
application deadline in June 2, and the Town will work to submit the application. New York State is
extremely interested in municipalities having these type of programs, and the hope is that the Town
application will be successful.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Town Board agreed
to enter an Executive Session to discuss litigation with Save the Sound

Appointment to Boards and Commissions
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Town Board resumed
the worksession.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
7:30 p.m.
Supervisor Seligson noted that the Town Board met for a worksession beginning at five thirty o’clock this
evening.
SUPERVISOR’S SUMMARY REPORT
The Town Board and staff are trying to move forward with regular government activities in spite
the pandemic. We are looking at initiating the update of the Town Comprehensive Plan that was

originally scheduled to begin in March. The consultants, AKRF, are drafting a proposal of how to
begin public engagement during this time. I hope to report on outreach activities soon.
Most Town boards and commissions will resume regular meetings in June although they will
probably be held online via zoom.

The Compost Giveaway Day has been moved to Saturday May 30 from 8 am to 1 pm at Maxwell
Avenue Recycling Center. Cars will line up waiting their turn and people must practice socially
distancing and wear masks. Residents must also bring their own shovel.
The tennis courts at Memorial Park are open for singles play. Please call the Recreation
Department to make a reservation for a court. Also, check out the Recreation Department section
of the Town website to see online recreation programs.
County beaches at Playland and Croton Point will open this weekend.
The Town received 2 federal grants related to the Coronavirus situation. The first grant for the
Ambulance District as a medical provider in regard to Medicare and Medicaid in the amount of
$25,000. The second grant is $108,000 for the Dept. Of Community Services for the Section 8
program.
Thank you to the New Rochelle Runners Club for planning to donate 400 masks to the Town. We
will make them available to the public when the masks arrive.
There is no garbage pick-up this Monday, May 25th due to the Memorial Day holiday.

Finally, I extended the Town State of Emergency through June 13 and all of the suspensions of
laws that are related to the state of emergency were also extended.

The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind
Eney, seconded by Commissioner Katz, the Board of Fire Commissioners was unanimously declared open.

COST OF THE CONSTRUCTION OF IMPROVEMENTS TO
HOMMOCKS ICE RINK, IN AND FOR SAID TOWN, AT A REVISED
MAXIMUM ESTIMATED COST OF $1,753,000.
WHEREAS, the capital project hereinafter described, as proposed, has been determined to be a Type
II Action pursuant to the regulations of the New York State Department of Environmental Conservation
promulgated pursuant to the State Environmental Quality Review Act, which regulations state that Type II
Actions will not have any significant adverse impact on the environment; and
WHEREAS, by a bond resolution dated February 20, 2020, the Town Board of the Town of
Mamaroneck, Westchester County, New York, authorized the issuance of $1,238,000 serial bonds of said

Town to pay part of the cost of the construction of improvements to Hommocks Ice Rink, including planning
and design, and original furnishings, machinery, equipment, apparatus, appurtenances, and incidental
improvements and expenses in connection therewith, throughout and in and for said Town; and
WHEREAS, it has now been determined to authorize additional financing for said capital project;
NOW, THEREFORE,
BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total voting strength of the
Town Board of the Town of Mamaroneck, Westchester County, New York, as follows:
Section 1. The construction of improvements to Hommocks Ice Rink, including planning and
design, and original furnishings, machinery, equipment, apparatus, appurtenances, and incidental
improvements and expenses in connection therewith, in and for said Town of Mamaroneck, Westchester
County, New York, is hereby authorized at a revised maximum estimated cost of $1,753,000.
Section 2. It is hereby determined that the plan for the financing of said specific object or
purpose is as follows:
a) by the issuance of the $1,238,000 bonds of said Town authorized to be issued pursuant to
the aforesaid bond resolution dated and duly adopted on February 20, 2020;
b) by the expenditure of $75,000 other monies authorized to be expended pursuant to said
bond resolution dated and duly authorized February 20, 2020;
c) by the expenditure of an additional $56,000 other monies hereby appropriated therefor; and
d) by the issuance of an additional $384,000 bonds of said Town hereby authorized to be issued
therefor, pursuant to the provisions of the Local Finance Law, SUBJECT TO PERMISSIVE
REFERENDUM.
Section 3. It is hereby determined that the period of probable usefulness of the aforesaid
specific object or purpose is twenty-five years, pursuant to subdivision 12(a) of paragraph a of Section 11.00
of the Local Finance Law, calculated from the date of issuance of the first obligations therefor, pursuant to
the bond resolution dated and duly adopted on February 20, 2020. It is hereby further determined that the
maximum maturity of the bonds herein authorized will exceed five years.
Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York,
are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same
respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay
the principal of and interest on such bonds becoming due and payable in such year. There shall annually be
levied on all the taxable real property in said Town, a tax sufficient to pay the principal of and interest on
such bonds as the same become due and payable.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the
issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds
herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be
prescribed by said Supervisor, consistent with the provisions of the Local Finance Law.
Section 6. All other matters, except as provided herein relating to such bonds, including
determining whether to issue such bonds having substantially level or declining annual debt service and all
matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds,
prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents
for said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in
the name of the Town by the facsimile signature of the Supervisor, providing for the manual countersignature
of a fiscal agent or of a designated official of the Town), the date, denominations, maturities and interest
payment dates, place or places of payment, and also including the consolidation with other issues, shall be

determined by the Supervisor. Such bonds shall contain substantially the recital of validity clause provided
for in section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in
addition to those required by section 52.00 of the Local Finance Law, as the Supervisor shall determine.
Section 7. This resolution shall constitute a statement of official intent for purposes of Treasury
Regulations Section 1.150 - 2. Other than as specified in this resolution, no monies are, or are reasonably
expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the
permanent funding of the object or purpose described herein.
Section 8. The validity of such bonds and bond anticipation notes may be contested only if:
1) Such obligations are authorized for an object or purpose for which said Town is not authorized
to expend money, or
2) The provisions of law which should be complied with at the date of publication of this resolution
are not substantially complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of
such publication, or
3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 9. Upon this resolution taking effect, the same shall be published in summary form in
the official newspaper of said Town for such purpose, together with a notice of the Town Clerk in
substantially the form provided in Section 81.00 of the Local Finance Law.
Section 10. THIS RESOLUTION IS ADOPTED SUBJECT TO PERMISSIVE REFERENDUM.

of $270,000 bonds of said Town, hereby authorized to be issued therefor pursuant to the provisions of the
Local Finance Law.
Section 3. It is hereby determined that the period of probable usefulness of the aforesaid
specific object or purpose is fifteen years, pursuant to subdivision 28 of paragraph a of Section 11.00 of the
Local Finance Law. It is hereby further determined that the maximum maturity of the bonds herein
authorized will exceed five years.
Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York,
are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same

3. Set Public Hearings – Bonding Resolutions – Special Districts
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the following was
approved;
In the Matter of ORDER
The Increase and Improvement of the Facilities of the CALLING
Sewer District No. 1, in the Town of Mamaroneck, PUBLIC
Westchester County, New York HEARING
WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York, has caused
to be prepared a map, plan and report, including an estimate of cost, pursuant to Section 202-b of the Town
Law, relating to the increase and improvement of the facilities of the Sewer District No. 1, in the Town of
Mamaroneck, Westchester County, New York (the “Sewer District No. 1”), being the Town’s portion of the
purchase of a sewer camera truck, including incidental equipment and expenses in connection therewith, at
a maximum estimated cost of $84,350; and
WHEREAS, said capital project has been determined to be a Type II Action pursuant to the regulations
of the New York State Department of Environmental Conservation promulgated pursuant to the State
Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed, as such will not
result in a significant environmental adverse effect and
WHEREAS, it is now desired to call a public hearing on the question of the increase and improvement
of the facilities of said Sewer District No. 1, in the matter described above, and to hear all persons interested
in the subject thereof, concerning the same, in accordance with the provisions of Section 202-b of the Town
Law; NOW, THEREFORE, IT IS HEREBY
ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as
follows:
Section 1. A public hearing will be held in the Town Hall, in Mamaroneck , New York, in said
Town, on June 17, 2020, at 7:30 o'clock P.M., Prevailing Time, on the question of the increase and
improvement of the facilities of Sewer District No. 1, in the Town of Mamaroneck, Westchester County,
New York, in the manner described in the preambles hereof, and to hear all persons interested in the subject
thereof, concerning the same, and to take such action thereon as is required or authorized by law.

Section 2. The Town Clerk is hereby authorized and directed to cause a copy of the Notice of
Public Hearing hereinafter provided to be published once in the official newspaper, and also to cause a copy
thereof to be posted on the sign board of the Town, such publication and posting to be made not less than
ten, nor more than twenty, days before the date designated for the hearing.
Section 3. The notice of public hearing shall be in substantially the form attached hereto as
Exhibit A and hereby made a part hereof.
Section 4. This Order shall take effect immediately.

the Water District No. 1, in the Town of PUBLIC
Mamaroneck, Westchester County, New York HEARING
WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York, has caused
to be prepared an estimate of cost, pursuant to Section 202-b of the Town Law, relating to the increase and
improvement of the facilities of the Water District No. 1, in the Town of Mamaroneck, Westchester County,
New York (the “Water District”), consisting of the Town’s share of the cost of the following Westchester Joint
Water Works projects: a) the rehabilitation of a 750,000 gallon elevated hydropillar water storage tank,
consisting of the replacement of the ladder and climb systems, venting system upgrade and relocation and
upgrade of tank lighting system with LED lights ($576,000), and 2) improvements to the Rye Lake Filtration
Facility, consisting of the construction of a 30 MGD (expandable to 40 MGD) filtration plant ($1,152,000), in
each case including incidental improvements, equipment and expenses in connection therewith, at an
aggregate maximum estimated cost of $1,728,000; and
WHEREAS, said capital projects have been determined to be Type II Actions pursuant to the
regulations of the New York State Department of Environmental Conservation promulgated pursuant to the
State Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed, it has been
determined will not result in a significant environmental adverse effect; and
WHEREAS, it is now desired to call a public hearing on the question of the increase and improvement

to be prepared an estimate of cost, pursuant to Section 202-b of the Town Law, relating to the increase and
improvement of the facilities of the Garbage District No. 1, in the Town of Mamaroneck, Westchester County,
New York (the “Garbage District”), being the purchase of a new 20 yard refuse collection vehicle, including
incidental equipment and expenses in connection therewith, at a maximum estimated cost of $160,000; and
WHEREAS, said capital project has been determined to be a Type II Action pursuant to the regulations
of the New York State Department of Environmental Conservation promulgated pursuant to the State
Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed, it has been
determined will not result in a significant environmental effect; and
WHEREAS, it is now desired to call a public hearing on the question of the increase and improvement
of the facilities of said Garbage District, in the matter described above, and to hear all persons interested in
the subject thereof, concerning the same, in accordance with the provisions of Section 202-b of the Town
