SPECIAL MEETING OF THE TOWN BOARD
TOWN OF MAMARONECK, N . Y.
HELD FEBRUARY 18,1938
At the Town Offices, 158 vilest Boston Post Road, Mamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch
at 10:30 A. M.
Present : Supervisor McCulloch
Councilmen Bates, Mandeville, Meginniss
Absent : Councilman Griffin
The Town Attorney stated that with the assistance of
Charles F. Pink he had prepared certain amendments to the Building
Code in order that the plans for an apartment house to be erected
on the Petigor property might be approved. He submitted to the
Board a form of notice calling a public hearing upon such amendments,
which notice contains the full text of the proposed amendments and
calls for a public hearing to be held on the 2nd of Ic?arch, 1938,
at 8 o' clock P. M.
Upon motion by Councilman Bates, seconded by Councilman
Meginniss, it was unanimously
RESOLVED, that a public hearing be held on
March 2nd, 1938, at 8 o' clock P. M. at the
regular meeting of the mown Board to be held
at that time and that a notice
be published on February 19, 1938, in `"The
Daily Times". The notice is as follows:
PUBLIC NOTICE
TAKE NOTICE- that the Town Board of the Town of Mamaroneck
will hold a public hearing, pursuant to Section 130 of the Town Law,
at the 'Town Offices, 158 West Boston Post Road, on the 2nd day of
March, 1935, at 8 o' clock P. M. to consider amendments to the Build-
ing Code of the Town of Mamaroneck, which Code was heretofore
adopted by resolution dated February 17th, 1937. The proposed amend.-
mentsare as follows:
S. Article 4, Section 3, (Semi -fireproof construction',
Subdivision (a) , to read as follows:
" (3) Multiple dwellings not more than o stories or 70 feet
high, if erected in a 'B' Graduated Height District, as defined
in Article 4, Section lo, of the Zoning Ordinance of the Town of
Mamaroneck duly adopted and amended by resolution of the Town
Board, adopted January 20th., 1937, or as hereafter amended, and as
shown on the Zoning hap which accompanies said Ordinance . "
II . Article 4, Section 4, (Fireproof construction)
Subdivision (a) , to read as follows :
"(a) Multiple dwellings more than 4 stories or 45 feet high,
if erected in a ' C' or ' D' 70 foot Height District, as defined
in Article 4, Section 1e of the Zoning Ordinance of the Town of
Mamaroneck, duly adopted and amended by resolution of the Town
Board adopted January 20th, 1937, or as hereafter amended, and az
shown on the Zoning Map which accompanies said Ordinance .

III . Article 5, Section 10, by adding the following
sentence: "In multiple dwellings the floor area between exterior
or fire-walls of buildings of semi-fireproof construction, shall
not exceed:
2;500 square feet when facing on only one street;
3, 000 square feet when facing on two streets;
31750 square feet when facing on three or more streets,
subject to an increase of 66 2/3 per cent of
floor area, where such dwellings are equipped
with automatic sprinklers.
IV. Article 5, Section 19, to read as follows:
"(a) The Building Inspector when so directed by the 'Town Board,
may modify the requirements of this Ordinance or impose greater
restrictions when the welfare of the public and the interest of the
owner will be promoted by such action but nothing contained in this
section shall be construed to dive the Building Inspector power to
vary anv of the terms of the Zonin, Ordinance or Zoning Restrictions
ntained in the Zoning Ordinance duly adopted. cy the '1'

(b) The Building Inspector may permit the use of any structural
materials for the use for which they are certified by recognized'
authorities for the testing of such materials. 11
V. Article 13, Section 70, add the following sentence,
"The fee for issuing such permit or certificate shall be ''S, and
shall be paid to the Building Inspector.
TAME FURTHER NOTICE, that all persons will be given an
opportunity to be heard.
