HELD MAY 19, 1937 0-3 If At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y. The meeting was called to order by Supervisor McCulloch at 8:15 P. I+,_. Present: Supervisor LcCulloch Councilmen Bates, Brennan, Griffin, +Ieginniss Absent: None The presence was also noted of Town Clerk '1,1arvin, Town Attorney Delius, Town Engineer Foote, Assessor Smith, Comptroller Luceno, Assistant Attorney Schwartzreich and Building Inspector Cowham. The minutes of the meetings of April 21, April 30 and May 5, were approved as printed. Mr. Brennan reported on highway matters. He stated that the Town had no funds with which to improve a piece of land for additional automobile parking space at LarGI-wont Station, as re- ferred to at a previous meeting, and that the Park Commission would endeavor to do the necessary work if it can provide the funds. He stated that he had examined the drainage condition complained of by P;Ir. James E. Clark of 17 Huguenot Drive, as re- ported at the meeting of itiay 5, 1937, and found it to be a "deplorable condition". The matter was referred to Highway Superintendent Foote. Mr. Griffin reported on park matters. He stated that the present shed used by the Park Department for storing certain - equipment was no longer adequate and on behalf of the Commission requested the Board to provide satisfactory storage space. The Supervisor stated that he believed such space could be found after one of the sheds at the sewer disposal plant has been moved. . Mr. Meginniss reported on finances. He submitted the Supervisor' s financial report for the period January 1, 1937 to April 30, 1937. The report was ordered filed. The Supervisor presented a statement of the bank balances as of 9 A. M. Merritt, realtor, addressed the Board concerning unpaid taxes for the years 1929 to 1935 inclusive on section 6, block 36, lots 1, 1A, 2 and 3, the liens for which are held by the Town. He stated that the Village of Larchmont had agreed to accept payment of the liens held by it with interest at 6 per cent and requested the Town to do likewise. He said that the total amount of tax arrears including interest on this property was practically equal to the price which had been offered for the property, namely, the amount of unpaid taxes with interestedcomputed at 6 per cent plus $100 without the broker' s commission. On motion by Mr. lKeginniss, seconded by Mr. Griffin, it was upon roll call unanimously RESOLVED, IMKEREAS evidence has been presented to this Board that the total amount of unpaid taxes, including interest computed at 6 per cent, on property known as Section 6, Block 36, Lots 1, 1A, 2 and 3, amounts to practically the sale price of the property; and WHEREAS the Village of Larchmont has agreed to accept payment of the tax liens held by it in the face amount plus 6 per cent interest; NO W, THEREFORE, BE IT RESOLVED that the Receiver of Taxes and Assessments be and he hereby is directed to accept payment in the face amount of the liens held by the Town on this property at 6 per cent interest, provided payment be made within thirty days. Building Inspector Cowham addressed the Board to inquire what the Board desired him to do in respect to requiring indemnity bonds in connection with the issuing of blasting permits. He pointed out that the newly adopted Fire Prevention Ordinance requires the payment of the 025. 00 fee for a blasting permit, together with the submission f an indemnity ond in the sum of at least $2 000 the 0 y w , , actual amount of said bond to be fixed by the Supervisor. After discussion the Board directed Sur. Cowham to observe the following procedure: to require every person conducting blasting operations in the Town to obtain a permit therefor upon payment of M the $25.00 fee and to file a separate application for each blasting job which he proposes to do. The Building Inspector shall then inspect the site of the proposed blasting job and determine whether a $I '000 bond is sufficient or whether a larger one should be ob- tained and so report to the Supervisor. If several blasting jobs are being conducted at the same time by the same person, they must all be covered by one or more bonds, the total amount of which bonds must at least equal the total potential liability as estimated by the Building Inspector. Mr. Henry Fournet of the office of Heighan & Necarsulmer, attorneys, addressed the Board concerning an alleged double assess- ment of property known as Section 9, Block S. Lot 6, assessed on the roll of 1935, taxes of 1936, and the roll of 1936, taxes of 1937, for $350. A petition dated May 19, 1937, was received from Assessor Smith concerning this matter which stated that Lot 6 above referred to was also assessed as part of Lot I in the same section and block and that the error arose through an indefinite description of the property on a deed abstract received in his office. He requested the Town Board to cancel the taxes for the years 1936 and 1937 plus interest and penalties, if any, on Section 9, Block 8, Lot 6. On motion by %:Ir. Meginniss, seconded.- by Mr. Brennan, it was unanimously RESOLVED that on the statement of facts set forth above in the petition of the Assessor the Receiver of Taxes and Assessments be and he hereby is directed to cancel on his records the taxes for 1936 and 1937 on property known as Section 9, , Block 8, Lot 6, owned by John F. Kane, the total amount of the taxes being $10.43. Mr. John Baltz of the firm of Ackerman & Baltz, builders, addressed the Board and presented a letter dated May 18, 1937, con- cerning the cost of a house-to-sewer connection made for him by the Sewer Department at 88 Briarcliff Road, which matter had been presented to the Board at its meeting on April 7, 1937. The matter was referred to Mr. Brennan for investigation and report . Mr. Frank Gironda of Larchmont addressed the Board to suggest that if the Town proposes in the future to adopt an electrical code and to license electricians, such licenses should be on a town-wide basis. He urged the Board to hasten to adopt such a code. The Supervisor thanked him for his suggestions. A petition dated May 3, 1937, was received from six owners of property on the northerly end of Madison Avenue where Madison Avenue joins Lafayette Road. The petition requested that that portion of Madison Avenue which extends from the intersection of Lafayette Road to North Chatsworth Avenue be re-named Lafayette Road and that a street sign be placed at the corner of North Chatsworth Avenue indicat- ing this fact. On motion by -Mr. Bates, seconded by Mr. Brennan, it was unanimously RESOLVED that the name of that portion of w".adison Avenue which extends from the intersection of --- Lafayette Road to North Chatsworth Avenue be and it hereby is re-named Lafayette Road; and be it FURTHER RESOLVED that the matter of a street sign be referred to the Superintendent of Highways. A letter dated May 15, 1937, was received from the Larchmont-Mamaroneck Humane Society, Inc. concerning the seizure of dogs running at large. The letter was ordered filed, z A letter dated May 12, 1937, was received from the Board of Education of Union Free School District No. 1 of the Town of Mamaroneck enclosing a certified copy of the budget of the School District for the ensuing school year. G. Van Sciver, Clerk Board of Education, Union Free School District No. 11 Town of Mamaroneck, N. Y. A letter dated May 5, 1937, was received from Board of Education of Union Free School District No. 1, giving notice that the following Trustees of the School District were on May 5, 1937, elected for a full term of three years beginning the first Tues- day in July, 1937, to wit : Mr. Mm. S. H. Hamilton and Mrs. Elizabeth S. Kirchner. The letter was ordered filed. A letter dated Mlay 12, 1937, was received from David Potts, Jr. Post No. 1156, Veterans of Foreign (Jars of U. S. , inviting the Town Board to attend the ;s'iemorial Day observance on Ylonday, vlay 31, 1937. The invitation was accepted with thanks and the Supervisor urged all members of the Board who could do so to attend. A letter dated s'Iay 19, 1937, was received from Public Welfare Officer DeVinne concerning claims of the Estate of Wm. T. Herlyn issued in March, April and 14ay of 1936, which had not been received in time to obtain the State reimbursement. The matter was ordered laid over. A letter dated May 18, 1937, was received from Town Engineer A. J. Foote recommending that the Board appropriate the sum of $300 to obtain the services of a consulting engineer experienced in the design, construction and operation of a garbage incinerator. On motion duly made and seconded it was upon roll calf unanimously RESOLVED that on the recommendation of the Town Engineer the sum of $300 be and it hereby is appropriated for the purpose of obtaining the services of a consulting engineer experienced in the design, construction and operation of a garbage incinerator. W The report of the County Health Department for the month of March, 1937, was received and filed. The report of the Receiver of Taxes for the month of April, 1937, was received and filed. A letter dated May 5, 1937, was received from rhos. J. Wagner, District Superintendent of Schools, Second District, West- chester County, enclosing a copy of an order dated stay 1, 1937, signed by the Commissioner of Education re-districting and renumber- ing the Supervisory Districts of 'Westchester County by reducing them to two in number and placing the Town of Mamaroneck in the Second District, the order to take effect immediately. The letter and order were ordered filed. A letter dated May 15, 1937, was received from Lester Harrisson, President of the Larchmont Community Association, Inc. concerning taxes for the years 1934 and 1935 on property owned by said association and known as Section 1, Block 28, Lots 5, 6, 7 and 8. He stated that the property of the association some 14 or 15 years ago had been declared to be exempt from taxation under a pro- vision of the State Tax Law by the State Tax Commission; that he had never received any bills for the special Yamaroneck Valley Sewer Tax and that, therefore, he requested permission to pay the liens held by the Town on this property, which liens were bought by the Town at the sales of 1935 and 1936, at the face amount thereof, namely, $9. 59 and $2. 58 respectively. On motion by Mr. Bates, seconded by :Zr. Griffin, it was upon roll call unanimously RESOLVED that the Receiver of Taxes and Assessments be and he hereby is authorized to accept payment in the face amount of the liens, namely, $x'12.17, bought by the Town at the sales of 1935 and 1936 on taxes for the years 1934 and 1935 respectively on property owned by the Larchmont Community Association, Inc. and known as Section 1, Block 28, Lots 5, 65 7 and G. A petition dated May 8, 1937, was received from the New York Christian Home for Intemperate Men, -requesting the cancellation of certain taxes levied against this property on the grounds that this property is exempt from taxes. The matter was referred to the Town Attorney. The Town Attorney presented a letter dated Ilay 12, 1937, from Joseph F. Curren, Counsel to the Board of Education of Union Free School District No. 1, requesting the cancellation of a tax for the year 1936, on property known as Section 9, Block 41F, on the grounds that the property is tax exempt, having been dedicated as a highway connecting the Junior High School grounds with the Boston Post Road. The Town Attorney recommended that the tax be can- celled on the grounds that the property is tax exempt. On motion by i¢Ir. Bates, seconded by I: r. Brennan, it was unanimously RESOLVED, that the tax for the year 1936 on property known as Section 9, Block 41F, be and it hereby is ordered cancelled and the tax lien thereon scheduled to be sold on viay 26, 1937, be withdrawn from the sale. Councilman Brennan introduced the following resolution: M RESOLUTION AUTHORIZING THE ISSUANCE OF BONDS OF TNT TOWN OF MAI ARONECK, IN THE AIIOUNT OF $1605000 TO PAY THE PORTION TO BE BORNE BY SAID TOWN OF THE COST OF PUBLIC I1'IPROVEIIIENT WORIS RELIEF PROJECTS IN SAID TOWN . RESOLVED by the Town Board of the Town of Mamaroneck, County of 'Westchester, New York, as follows: Section 1. To provide funds to pay the portion to be borne by the Town of the cost of public improve- _, ment work relief projects in the Town undertaken through or by the authority of the Works Progress Administration of the Federal Government or other work relief authority of the Federal Government including the cost of furnish- ing labor, materials, supplies and equipment for such projects and incidental expenses in connection therewith, bonds of the Town of +Tamaroneck, in the aggregate prin- cipal amount of ?x$160, 000 shall be issued pursuant to the following laws of the State of New York, as amended: Chapter 782 of the Laws of 1933, the Town Law, constitut- ing Chapter 62 and the General Municipal Law constituting Chanter 24 of the Consolidated Laws. Each of said bonds shall be designated 'General Bond of 1937°. Section 2. It is hereby determined_ that the average probable life of the improvements for the financing of which the bonds hereby authorized are issued, is not less than ten (10) years. No. Section 3. Said bonds shall be dated June 1, 1937, shall mature in the principal amount of `515,000 on June 1 in each of the years 1938 to 1945 both inclusive, and $20,000 on June 1 in each of the years 1946 to 1947 shall bear interest at a rate to be determined upon receipt of bids and to be expressed in a multiple of one-tenth or one-quarter- of one percent but not exceeding six per centum (6jo) per annum, payable semi-annually on the first days of June and December in each year, shall be in the denomination of X1,000 each, shall be numbered in order of maturity from 1 to 160 both inclusive, shall be coupon in form, registerable as to both principal and interest in lawful money of the United States of America at the office of the First National Bank of Mount Vernon, N. Y. or, at the option of the holder at the principal office of the Guaranty Trust Company in the City, County and State of New York. Said bonds shall be signed by the Supervisor and the corporate seal of the Town shall be affixed thereto and attested by the Town Clerk and the coupons attached thereto shall be authenticated by the facsimile signature of the Supervisor. Section 4. Said bonds shall be in substantially the following form: UNITED STATES OF AMERICA STATE OF NEW YORK. COUNTY OF WESTCHESTER TOWN OF MAMARONECK General Bond of 1937 $1,000.00 The Town of Namaroneck, in the County of Westchester, a municipal corporation of the State of New York, hereby acknow- ledges itself indebted and for value received promises to pay to the bearer of this bond or, if it be registered, to the person in whose name it is registered, on the first day of June, 19, the sum of One Thousand - - - - - - - - - - - - - - - - -Dollars ($1,000.00) , and to pay interest on such sum at the rate of per centum ( %) per annum, semi-annually on the first days of June and December in each year from the date of this bond until it matures fol upon presentation and surrender, as they severally mature, of the coupons therefor annexed hereto or, if this bond be registered, to the registered holder. Both principal and interest of this bond will be paid in lawful money of the Jnited States of America, at the office of At the written request of the holder, this bond may be converted into a registered bond and such registration shall be entered on the books of the mown, kept in the office of the Town Clerk and the coupons annexed hereto cut off and destroyed and a certificate of such registry shall be endorsed upon this bond by such Town after which the principal and interest of this bond shall be payable only to the registered owner, his legal representatives, successors or assigns, and this bond shall be transferable only upon presentation to such Town Clerk with a written assignment duly acknowledged or proved. The name of the assignee shall be entered upon this bond and such books. This bond is one of an authorized issue, the aggregate principal amount of which is $1605000. , the bonds of which are of like tenor, except as to maturity, issued pursuant to the following laws of the State of New York, as amended: Chapter 782 of the Laws of 1933, the Town Law, constituting Chapter 62 and the General lviunicipal Law constituting Chapter 24 of the Consolidated Laws, and by virtue of a resolution of the Town Board of said Town adopted May 19, 1937. The full faith and credit of said Town of i'amaroneck are hereby irrevocably pledged to the punctual payment of the principal and interest of this bond according to its terms. It is hereby certified and recited that all conditions, acts and things required by the Constitution and statutes of the State of New York to exist, to have happened and to have been performed precedent to and in the issuance of this bond, exist, have happened and have been performed, and that the issue of bonds of which this is one, together with all other indebtedness of said Town of Mamaroneck is within every debt and other limit prescribed by the Constitution and laws of said State. On motion by Mr. Griffin, seconded by Mir. Brennan, it was unanimously RESOLVED, WHEREAS the Assessor has presented a petition dated May 19, 1937, for the correction of the assessment rolls for certain years, pur- suant to the provisions of Section 33 of Chapter 105 of the Laws of 1916, as amended, known as the Westchester County Tax Act; and WHEREAS after due consideration this Board finds it desirable to grant said petition for the correction of said assessment rolls: NOW, THEREFORE, BE IT RESOLVED that the assessment roll for the years 1935 and 1936, taxes of 1936 and 1937 respectively, which show property now appearing on the rolls as follows: Sec . He requested that this be corrected. On motion by Mr. Brennan, seconded by Mir.
