At the Town Offices, 158 West Boston Post Road, P,.amaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch at
8:15 P. MI.
Present: Supervisor McCulloch
Councilmen Bates, Brennan, Griffin
Absent; Councilman Ifieginniss
The presence was also noted of the Deputy Town Clerk, Miss
Alice Wheelock, Town Attorney Delius, Assessor Smith and Town Engineer
Foote.
The Board noted with regret the absence of Town Clerk Marvin
on account of illness.
The minutes of the meetings of December 30, 1936, January 6,
January 12, January 16, January 20 and January 26, 1937, were approved
as printed.
Mr. Norman McGlashan addressed. the Board to request an
adjustment of taxes for 1929 and 1930 on Section 1, Block 55, Lots 1B
to 4B inclusive and the taxes for 1931 on Section 1, Block 55, Lots 9,
10 and 11A, which are shown as open and unpaid on the books of the
Receiver of Taxes and the liens for which are held by Bonded Municipal
Corporation. He explained at length the difficulties that have been
encountered in trying to settle this matter. He stated that in his
opinion his check for 5Y204. 00, which cannot be identified with any pay-
ment of taxes on the old cash books of the Receiver of Taxes, made up
the payment of the above unpaid taxes and included an adjustment of
a claim of his against the Town for a strip of 16 feet taken from
certain of these lots. This cancelled check for $204.00 and a photo-
static copy of the same, he added, have been lost, but Receiver of
Taxes Dillon has seen the photostatic copy of it.
In this connection two letters dated December 1, 1936, and
February 16, 1937, were received from Receiver of Tares Dillon explain-
ing the matter and recommending the settlement of these taxes if
possible .
After discussion upon motion by Mr. Griffin, seconded by
Mr. Bates, it was unanimously
RESOLVED, that the matter of the unpaid taxes for
1929 and 1930 on Section 1, Block 55, Lots 1B to 4B
inclusive and for 1931 on Section 1, Block 55, Lots 9,
10 and 11A be referred to the Comptroller and the
Assessor with the request that they submit all the
data pertaining to this matter to Glick-Freedman,
the Town auditors, for a report as to whether or not
there is sufficient evidence to justify the can-
cellation of these unpaid taxes .
The Board thereupon recessed the regular meeting to hold the
public hearing upon a petition to create and establish a refuse and
garbage district in the Town of Mamaroneck outside of the incorporated
villages of Larchmont and Mamaroneck, in accordance with the action
taken by the Board at its meeting on January 20, 1937.
The Supervisor inquired if any one present desired to
address the Board in connection with this matter.
A representative of the New York, Westchester 6c Boston
Railway Company addressed the Board to ask whether or not ashes
would be collected from the Larchmont Gardens Station after the
garbage district has been established. The Supervisor assured him that
ashes would be collected and referred the -matter to Town Engineer
Foote for his attention.
There being no other persons present who desired to address
the Board in this connection, the Supervisor declared the hearing
closed.
Town Attorney Delius stated that the Townts bonding attorneys
in connection with the creation of a refuse and garbage district in
the Town outside of the incorporated villages recommended that the
public hearing on the petition be held in accordance with the provisions
of section 3 of the General District Law as well as section 193 of the
Town Law, in order to avoid any question as to the sufficiency of the
hearing. He recommended that a further hearing be held upon the peti-
tion at the regular meeting of the Board on March 17, 1937.
ifr. Brennan introduced the following preambles and
resolution:
WHEREAS, a petition, purporting to be signed by the
requisite number of property owners as required by
section 191 of the Town Law, for the establishment
of a refuse and garbage district in the Town of
Mamaroneck, has been filed in the office of the
Town Clerk of the Town of Mamaroneck on January 20,
1937, and has been duly presented to this Board, and
'NEEREAS, an Order was adopted by this Board on
January 20, 1937 determining that the Town Board
would meet to act on the aforesaid petition on the
17th day of February, 1937, at eight o' clock P. M. ,
at the Town Office, 158 Post Road, in the Village and
Town of Mamaroneck; and
WHEREAS, said Order was advertised in the manner
required for the advertisement of an Order, pursuant
to section 193 of the Town Law, and

public hearing was held on said petition, at which
hearing all persons interested in said proposed
district desiring to be heard were permitted to be
heard, and
WHEREAS, in order to avoid any possible question as
to the sufficiency of said hearing, or as to the
validity of the manner of advertising the notice of
said hearing, this Board deems it desirable to call
and hold a further meeting and hearing upon said
petition. Now, therefore,
THE TOWN BOARD OF THE TOWN OF Iv.AMAROHECK, IN THE
COUNTY OF WESTCHESTER, NEGV YORK, HEREBY RESOLVES as
follows :
Section 1. The following Order is hereby adopted
and approved, and when signed by the members of this
Board present at this meeting, the same shall constitute
an Order by this Board:
The Town Attorney stated that since the work relief project
for the improvement of Sheldrake Lake in Paris District No. 1 of the
Town of Mamaroneck has been very nearly completed, it would be ad-
visable for the Town Board to issue and sell bonds to pay a $15,000
Temporary Certificate of Indebtedness issued in order to purchase
materials, supplies and equipment for this project . He stated that
the total cost of materials would be $10, 000 and recommended that
bonds be sold for this amount, `'5,000 of the certificate of indebted-
ness not having been expended.
The following resolution was offered by Councilman Bates,
and seconded by Councilman Brennan, to-write
WHEREAS. pursuant to Section 5-b of Chapter 782
of the Laws of 1933, as amended, the following
described wrork relief project in the Town of
Mamaroneck has been submitted to and approved by
the (forks Progress Administration, to-wit-
For the Improvement of Park District No . 1
in the Town of Mamaroneck, consisting of the
drainage of the so-called Sheldrake Lake,
the construction of a concrete silt basin,
the reconstruction of the banks of said lake
with the materials excavated from its bottom,
and the reconstruction of a dam;
and
'IrNEREAS, for the purpose of paying the cost of materials,
supplies and equipment for said project, the Town Board
has heretofore authorized and there has been issued a
5515,000 Temporary Certificate of Indebtedness in antici-
pation of a bond issue for said purpose; and
�j"JHEREAS, it is now necessary to issue and sell bonds to
pay the said indebtedness and retire said temporary
obligation; NOuV, THEREFORE, BE IT
RESOLVED, that for the purpose aforesaid, there shall
be issued Ten Thousand Dollars ($10, 000.00) Public
Works Bonds of the Town of Mamaroneck, dated April 1,
1937, of the denomination of one thousand dollars
01,000) each, numbered one (1) to ten (10) inclusive,
maturing in numerical order as follows:
1,000.00 on April 1 , in each of the year 1938 to
1947 both inclusive.
Said bonds shall bear interest, evidenced by coupons, at
a rate not exceeding six (6) per centum per annum, payable
semi-annually October 1 and April 1, and both principal
and interest shall be payable in lawful money of the United
States of America, at the First National Bank of Mount
Vernon, Mount Vernon, New York.with New York exchange.
Said bonds shall be signed by the Supervisor and sealed
with the corporate seal of the Town, attested by the Town
Clerk, and the interest coupons shall be signed with the
fac-smile signature of the Supervisor.
FURTHER RESOLVED, that said bonds shall be issued in
substantially the following form, to-wit:

KNOW ALL MEN BY THESE PRESENTS, That the Town of
Mamaroneck, a municipal corporation in the County of Westchester,
State of New York, hereby acknowledges its indebtedness and for
value received promises to pay to bearer on the first day of April.
19-1 the sum of ONE THOUSAND DOLLARS ($1,000) , together with
interest thereon from the date hereof at the rate of
( ) per centum per annum, payable semi-annually on the first
days of October and April upon presentation and surrender of the
annexed interest coupons as the same respectively mature. Both
principal and interest of this bond are payable in lawful money of
the United States of America, at the

This bond is one of an issue of bonds of like date and
tenor, except as to number and date of maturity, aggregating

and is issued for the purpose of paying the cost of materials,
supplies and equipment for a public works project in said Town
undertaken through and by authority of the Works Progress Administra-
tion of the Federal Government pursuant to and in strict compliance
with the Constitution and statutes of the State of New York, including
among others Chapter 782 of the Laws of 1933, as amended, and is
issued pursuant to resolutions and proceedings of the Town Board of
said Town duly passed and adopted.
It is hereby certified, recited and declared that all
acts, conditions and things required to exist, to happen and to be
performed precedent to and in the issuance of this bond, exist,
have happened and have been performed in due time, form and manner
as required by law, and that the issue of bonds of which this is one,
together with all other indebtedness of said Town, is within every

debt and other limit prescribed by the Constitution and laws of the
State of New York. The full faith, credit and resources of said
Tom of Mamaroneck are hereby irrevocably pledged to the punctual
payment of the principal and interest of this bond according to its
terms.
This bond may be converted into a registered bond in
accordance with the provisions of the General Municipal Law. At
the request of the registered owner, the interest hereon will be
remitted by mail with New York exchange.
IN WITNESS WIEHIREOF, said Town of Mamaroneck has caused
this bond to be signed by the Supervisor and sealed with the corporate
seal of said Town, attested by the Town Clerk, and the interest
coupons hereto annexed to be signed with the fac-simile signature of
said Supervisor, and this bond to be dated as of the first day of
April, 1937 .

than a village of the first class as defined by the
village law shall enact an ordinance pursuant to this
subdivision which shall require a vehicle proceeding
along a state or county highway to stop except at the
intersection of another state or county highway. The
operator of any vehicle which has come to a stop as herein
required, upon entering the main artery of travel, as
well as the operator of a vehicle on such main artery,
shall be subject to the right of way regulations prescribed
by this chapter and shall enter such main arteries of
travel with caution. Signs bearing the word "stopt8 shall
be erected and maintained at or near the curb in every
highway intersecting a designated main artery of travel.
Such signs and letters thereon shall be of such a size
and either so illuminated by street lights or headlights
of approaching vehicles as to be plainly visible and
legible for a distance of fifty feet along such inter-
secting highway.
4. In addition to other powers delegated by this article,
and subject to the 'restrictions thereinafter provided,
the legislative body of any city, town in a county having
a population of more than five hundred thousand, according
to the last federal or state census or enumeration, adjoin-
ing a city having a population of one million and upwards,
or a village of the first class as defined by the general
village lava is hereby empowered to make, enforce and main-
tain such additional reasonable ordinances, rules and
regulations with respect to traffic as special local con-
ditions may require, and to prescribe penalties therefor,
provided proper notices of such regulations be posted
conspicuously in the highways to which such regulations
apply. Subject to this chapter the power now or hereafter
vested in local authorities to license and regulate the
use of public highways for processions and assemblages
shall remain in full force and effect, and all ordinances,
rules and regulations which may have been or which may be
hereafter enacted in pursuance of such powers shall remain
in full force and effect.
The Supervisor stated that because of a special meeting
of the Board of Supervisor on February 25, he might be unable to
attend the meeting of the Association of Towns of the State of New
York to be held on February 24 and 25. He recommended that the Board
designate a councilman to represent the Town.
On motion by 1Nlr. Bates, seconded by 1v1r. Brennan, it was
unanimously
RESOLVED, that in the event that the Supervisor is
unable to attend the meeting of the Association of
Towns to be held in Albany on February 24 and 25,
any other member of the Board who finds it possible
to attend is hereby designated to represent the Town
of Mamaroneck at this meeting.
The Supervisor stated that in accordance with the resolution
passed by the Board at its meeting on February 3, 1937, all proposed.
of. P. A. projects sponsored by any one of the three municipal units
in the Town must be reviewed by the Advisory Board, approved by the
local 'board of the municipal unit directly concerned and submitted
to the Town Board for its approval. He presented for the consideration
of the Board four proposed projects which had been approved by the
Advisory Board and the Village of Larchmont Board of Trustees, as
follows;
1. Supplement to Hartung Street Sewer Project - Village of
Larchmont. Sponsor' s contribution-q2, 402. Total cost -$24,625.
2. Sound Shore Section - Village of Larchmont - Paving of
street. Sponsor' s contribution - $28, 339.75. Total cost458,063.
3. Sound Shore Section - Village of Larchmont - Construction
of sewer. Sponsor' s contricution-$2, 602. Total cost - $7,898.
4. Sound Shore Section - Village of Larchmont- Construction of
water mains. Sponsor' s contribution - $2,158. Total cost-$5, 502.
On motion by III-Ir. Bates, seconded by Mr. Griffin, it was
upon roll call unanimously
RESOLVED, that the four proposed W. P. A. projects
above described be and they hereby are approved;
and be it
FURTHER RESOLVED, that the Supervisor be and he
hereby is authorized to sign these projects.
A letter dated February 10, 1937, was received from Mr.
K. G. Van Sciver, Clerk to the Board of Education of Union Free
School District No. 1 of the Town of Mamaroneck, together with a
resolution adopted by the Board of Education requesting the Supervisor
"to borrow upon the credit of the Town, for the use and benefit of
Union Free School District No. 1, of the Town of Mamaroneck, a sum
not exceeding the amount of unpaid school taxes so reported, pursuant
to the provisions of Section 31 of the Tdestchester County Tax Law. "
After discussion the matter was laid over for further consideration
at the next meeting of the Board.
A letter dated February 14, 1937, was received from
Mrs. A. Stirling Smith of 294 Weaver Street, concerning the noisy
buses used by the County Transportation Company on the route which
passes in front of her home. The Deputy Town Clerk was directed to
call the matter to the attention of the County Transportation Company
and request their comments on the same.

A petition dated February 17, 1937, was received from
Assessor Smith for the correction of the assessment roll so as to
permit the apportionment of certain taxes. The Town Attorney re-
commended approval of the petition.
On motion by Mr. Bates, seconded by Mr. Brennan, it was
unanimously
RESOLVED, WHEREAS the Assessor has presented a petition
dated February 17, 1937, for the correction of the
assessment roll for the year 1936, pursuant to the
provisions of Section 33 of Chapter 105 of the Laws
of 1916, as amended, known as the Westchester County
Tax Act; and
`,idHEREAS, after due consideration this Board finds it
desirable to grant said -petition for the correction
of said assessment roll;

The meeting was called to order by Supervisor McCulloch at

Absent: Councilmen Brennan and Meginniss
The presence was also noted of 14iss Alice Wheelock, Deputy
Town Clerk, Town Attorney Delius, Town Engineer Foote, and Mayor
Edward F. Watson and Trustee Arthur H. Loucks of the Village of
Larchmont.
The regular order of business was suspended in order to
hear those persons who wished to address the Board.
Mr. Woodson Oglesby addressed the Board in connection with
the unpaid taxes on property owned by Leewood Shaw, situated on
Edgewater Point, Mamaroneck. He offered to pay all the unpaid taxes
on this property, on the basis of the assessed valuations as fixed
by the Referee and confirmed by the court in the certiorari proceeding
to review the assessment roll for 1934, tax of 1935, using the Town
tax rate for each year plus 6 per cent interest from the date of sale.
After discussion the matter was laid over for further consideration.
SQr. Alfred Eager discussed with the Board the drainage
condition affecting his property on Valley Road. He stated that a
drain to remedy this situation might be constructed to follow either
of the two following courses: (1) through the property of PaIr. Harold
K. Young, from whom an easement may be obtained at a cost of $323.00
and his own pro-perty; (2) through the same property of Mr. Young and
then into the property of Mr. J. J. Howe approximately 52 or 53 feet,
an easement for which may be obtained at a cost of $250.00 to the
Town. Mr. Eager added that if the Town chose the first plan, he
would grant the Town permission to go through his property. After
discussion the matter was laid over for further consideration.
There being no other persons present who desired to address
the Board, the regular order of business was resumed.
Mr. Griffin presented the report of the Public Welfare
Department for the month of January, 1937. The report was ordered
filed.
The Town Attorney stated that it would be in order for the
Board to adopt a resolution concerning the W. P. A. Advisory Committee
as suggested by the Village of Larchmont at the meeting of the Town
Board on January 6, 1937. He recommended that the resolution adopted
by the Board at its meeting on January 20, 1937, appointing the
Supervisor as the representative of the unincorporated section on the
Advisory Committee, be rescinded and his appointment made a part of
this resolution.
On motion by Mr. Bates, seconded by Mr. Griffin, it was
unanimously*

The meeting was called to order by Supervisor
McCulloch at 8:20 P. M.
Present: Supervisor McCulloch
Councilmen Bates, Brennan, Griffin
The presence was also noted of Town Clerk Marvin,
Town Attorney Delius, Building Inspector Cowham and Victor H.
Stempf, Police Commissioner.
The Supervisor stated that the meeting was called
pursuant to Section 130 of the Town Law to consider the enactment
of certain Ordinances for the Town of Mamaroneck outside of the
incorporated villages, in accordance with notice duly given as re-
quired by law.
The Town Clerk thereupon read the notice and
presented affidavits of publication which were ordered received and
placed on file.
The Supervisor inquired if there was any one
present who desired to address the Board on the subject of the pro-
posed Ordinances.
TJIr. Bernard LeVino of 385 Weaver Street inquired
concerning the provisions of Article 19 relating to Signs and
Sign Boards. The Town Attorney replied that the provisions of
Article 19 are substantially the same as those found in the present
Building Code or Ordinances.
-The Supervisor inquired if there was any other
person present who desired to address the Board in connection with
the proposed Ordinances. No one indicated a desire to speak.
