HomeMy WebLinkAbout1936_12_02 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, NEW YORK HELD DECEMBER 2, 1936 At the Town Offices, 158 West Boston Post Road, Namaroneck, N. Y. The meeting was called to order by Supervisor McCulloch at 6: 25 P. M. Present: Supervisor McCulloch Councilmen Bates, Brennan, Griffin, Meginniss. The presence was also noted of Town Clerk Marvin, Town Attorney Delius and Town Engineer Foote. The minutes of the meetings of November 11 and November 18 were approved as printed. Mr. Bates reported on sewer matters, saying that the con- struction of the sewer in the Carleon Avenue Extension has been completed. ialr. Griffin reported on the matter of the expiration of the terms of office of the Torun constables, which matter had been referred to him at the meeting on November 18, 1936. The Board took no action on his report. I;4r. Griffin reported on welfare matters, stating that in the month of November there were 279 relief cases and a total expenditure of X10,775 compared with 263 cases in October at an expense of $9, 680. The Supervisor informed the Board that he had been notified of a change in the W. P. A. policy of employing labor whereby no _.. new cases will be added to the rolls, but re-instatement will be possible for those who were at one time on the rolls and subsequent- ly l l f them. y Mr. Meginniss presented a letter from William Preston Palmer, a member of the Police Commission, dated November 30, 1936, submitting his resignation as a member of the Police Commission effective immediately, on the grounds that he had moved outside of the Town of Mamaroneck. Accompanying the resignation was a letter from Mr. J. H. King, Chaixnian of the Board of Police Com- missioners, expressing the regret of the Board at the resignation of Mr. Palmer and acknowledging his excellent services to the Town while on the Board. On motion by Mr. Meginniss, seconded by Mr. Brennan, it was unanimously resolved WHEREAS, Mr. William Preston Palmer, a member of the Police Commission of the Town of Mamaroneck since August 21, 1934, is moving from the Town of Mamaroneck to a neighboring, community and has accordingly submitted his resignation as a member of the Police Commission; NOW, THEREFORE, BE IT RESOLVED, that the resignation of Mr. Palmer be accepted with great regret; and be it FURTHER RESOLVED, that this Board hereby extends to Mr. Palmer its regrets that he is leaving this community; and be it FURTHER RESOLVED, that this Board hereby extends to Mr. Palmer its most sincere thanks and appreciation for the splendid work he has done as a member of the Police Commission, which work included the devoting of a great deal of time to the preparation of the new police regulations, and a constant interest in and attention to the duties of his office. The Supervisor suggested of 50 Vine Road for appointment to vacancy caused by the resignation appointment of Mr. Herold would be the Police Commission. the name of Mr. PJiatthew G. Herold the Police Commission to fill the of Mr. Palmer. Herold of 50 Vine Road be and he hereby is appointed a member of the Board of Police Commissioners of the Town of Mamaroneck to fill the vacancy created by the resignation of Mr. William Preston Palmer; and be it FURTHER RESOLVED, that this appointment take effect immediately upon Mr. Herold' s qualifying as required by law. The Town Attorney stated that it would be in order for the Board to authorize the renewal of x40,000 Works Project notes which mature on December 4, 1936. Councilman Bates introduced the following preambles and resolution: RESOLUTION AUTHORIZIiVG TTHE PROJECT NOTES (PENDING THE PURPOSE OF RENEWING A LIKE ISSUANCE OF $405000 WORKS ISSUANCE OF BONDS) FOR THE AMOUNT OF SUCH NOTES . WHEREAS, a note of the Town of Mamaroneck in the amount of 520,000, issued pursuant to the provisions of Chapter 782 of the Laws of 1933, as amended, and by virtue of a resolution adopted by the Town Board June 3, 1936, appropriating the sum of s�20,000 for materials, supplies and equipment for works progress administration projects in the Town of Mamaroneck, and numbered ;UFA - ,#1, matures December 4, 1936, and WHEREAS, a note of the Town of Mamaroneck in the amount of 420, 000, issued pursuant to the provisions of Chapter 782 of the Laws of 1933, as amended, and by virtue of a resolution of the Town Board adopted September 1, 1936, appropriating the additional sum of $20,000 for materials, supplies and equipment for works progress administration projects in the Town of Mamaroneck, and numbered WPA - #2, matures December 4, 1936, and WHEREAS, the holders of said notes have agreed to renew the same. Now, therefore, it is hereby RESOLVED BY THE TOWN BOARD OF TIE TO'WNT OF MAMARONECK, IN THE COUNTY OF itESTCHESTER, NEW YORK, as follows: Section 1. For the purpose of renewin a 920,000 note authorized by a resolution entitled: 'Resolution appropriating the sum of $20,000 for materials, supplies and equipment for works progress administration projects in the Town of Mamaroneck, and providing for the issuance of notes (pending the issuance of bonds) for said purpose, " duly adopted June 3, 1936, which note was dated June 4, 1936, and matures December 4, 19362 and also for the purpose of renewing a note of 420, 000 authorized by a resolution entitled: "Resolution appropriating the additional sum of $20,000 for materials, supplies and equipment for works progress administration projects in the Town of Mamaroneck, and providing for the issuance of notes (pending the issuance of bonds ) for said purpose, " duly adopted September 1, 1936, which note was dated September 4, 1936 and matures December 4, 1936, the Supervisor is hereby authorized to issue temporary notes of the Town of Mamaroneck in an aggregate principal amount not exceeding $40,000, pursuant to Chapter 782 of the Laws of 1933 of the State of New York, as amended. Each of said notes shall be designated °tWorks Pioject Note 41. Section 2. The following matters in connection with said notes are hereby determined: Date: December 4, 1936 Maturity: March 4, 1937 Denomination: 5$20,000 each. Numbers: VVPA - 3 and WPA - -4 Place of Payment: VVPA - 3 First National Bank of Mount Vernon, Mount Vernon, N. Y. VVPA - 4 The Chase National Bank of the City of New York. The Supervisor is hereby authorized to determine all matters in connection with said notes the determination of which is not provided for by this or subsequent resolutions, and his signature upon said notes shall be conclusive as to such determinations. Said notes shall be signed by the Supervisor, shall have the corporate seal of the Town affixed thereto and attested by the Town Clerk. The Supervisor is hereby authorized to sell said notes at public or private sale at not less than par at the best interest rate obtainable, not exceeding six per centum (6%) per annum, and to deliver the same to the purchaser upon receipt of the purchase price plus accrued interest from the date of the notes to the date of delivery. Section 3. Said notes shall be in substantially the following form: N0 . UNITED STATESOF AMERICA STATE OF NEW YORK COUvtY OF '11iVESTC11ESTER TOWN OF MA!,aRONECK WORKS PROJECT NOTE. The Town of Ia7amaroneck, in the County of Westchester, a municipal corporation of the State of New York, hereby acknowledges itself indebted and for value received promises to nay to the bearer of this note, on the day of , 19 , the sum of DOLLARS ($ ) with interest thereon from the date hereof at the rate of ner centum ( %) per annum. Both principal and interest of this note are payable at in lawful money of the United States of America. 4 This note is issued pursuant to the provisions of the Town Law, constituting Chapter 62 and the General Municipal Law, constituting Chapter 24 of the Consolidated Laws of the State of New York, as amended, and Chapter 782 of the Laws of 1933, and by virtue of� a resolution duly adopted by the Town Board of the Town of Mamaroneck on , 19 , for the purpose of providing funds for highway, drainage and sidewalk improvements . in the Town, conducted as works progress admihistration work relief projects. IT IS HEREBY CERTIFIED AMID RECITED that all conditions, acts and things required by the Constitution and Statutes of the State of New York to exist, to have happened and to be performed pre- cedent to and in the issuance of this note exist, have happened and have been performed, and that the issue of notes of which this is one, together with all other indebtedness of said Town, is within every debt and other limit prescribed by the Constitution and Laws of said State: and the full faith and credit of the Town of Mamaroneck are hereby pledged to the punctual payment of the principal and interest of this note, according to its terms. Any note issued pursuant to this resolution shall be a general obligation of the Town of Mamaroneck, and the faith and credit of the Town are hereby pledged to the punctual payment of the principal of and interest on said obligation, and unless otherwise paid or payment provided for, a tax sufficient to provide for the payment thereof shall be levied and collected. Section 5. This resolution shall take effect immediately. On motion of Councilman Bates, seconded by Councilman Brennan, the foregoing resolution was adopted by the following vote: AYES: Supervisor McCulloch Councilmen Bates, Brennan, Griffin, Meginniss NAYS: None A letter dated December 1, 1936, was received from Nary Keefer, owner of property known as Section 6, Block 41, Lot 6, requesting that she be permitted to pay the tax of 1905, sale of 1906, in the amount of $8.15, the lien on which tax is held by the ---- Town, in the face amount thereof without interest. On motion by i'ir. !aIeginniss, seconded by Mr. Griffin, it was upon roll call RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept payment of the tax of 1905, sale of 1906, on Section 6, Block 41, Lot 6, in the face amount thereof without interest, provided payment be made within thirty days. The Town Attorney advised the Board that in view of the appointment of Mr. Luceno as Comptroller, which appointment was made at the meeting on _November 18, 19362 it would be in order for the Town to return to its former practice of requiring two signa- tures on Town checks. On motion by Mr. Meginr.iss, seconded by Ur. Brennan, it was unanimously _ RESOLVED, that the resolution adopted by this Board at its meeting on November 4, 1936, providing that but one signature, namely that of the Supervisor, would be sufficient on all checks drawn upon accounts in banks, trust companies 0 r savings banks heretofore named as depositaries for Town funds, be and it hereby is rescinded; and be it FURTHER RESOLVED, that all checks drawn upon accounts in banks, trust companies or savings banks heretofore named as depositaries for Town funds shall bear two signatures, namely that of the Supervisor and that of the Town Comptroller. The Town Attorney informed the Board that subsequent to his report to the Board made at its meeting on November 18, 1936, concerning the proposed new Town ordinances, he had completed work on the proposed new Building Code or Ordinance and suggested that said code or ordinance be also considered at the public hearing to be held on January 12, 1937. On motion by Mr. Griffin, seconded by Mr. Brennan, it was unanimously RESOLVED, that the resolution passed by this Board at its meeting on November 18, 1936, setting the date of January 12, 1937, as the time for a public hearing by and before this Board on certain proposed new ordinances be and it hereby is amended so as to add to the list of proposed new ordinances to be considered at that time the proposed new Building Code or Ordinance as prepared by the Town Attorney; and be it FURTHER RESOLVED, that the public notice to be published in the newspapers on December 17, 1936, be amended to the same effect. The Town Attorney reported that a lawyer representing the residents of 'Iffoody Lane had notified him that said residents desired Woody Lane to be accepted as a public street and had offered a deed to said street to the Town. This deed, he said, appeared to be in proper form and called for a 50-foot street. The matter was re- ferred to the Town Engineer for investigation and report. The report of the Receiver of Taxes for the month of November was received and filed. The report of the Welfare Office for the month of November was received and filed. The report of the Building Inspector for the month of November was received and filed. The report of the County Health Department for the month of October was received and referred to the Public Welfare Officer. A letter dated November 16, 19361 was received from the State Department of Agriculture and Markets notifying the Board that a dog enumerator must be appointed in the month of December. A letter dated November 30, 1936, was received from IdIr. John C. Forrar of 10 VVildwood Road applying for the position of dog enumerator, which position he has held for several years. The Town Clerk stated that Mr. Forrar' s services as dog enumerator in the past have been -very satisfactory. On motion by Pair. Griffin, seconded by Mr. Brennan, it was unanimously RESOLVED, that Mr. John C. Forrar of 10 VVildwood Road be and he hereby is appointed dog enumerator of the Town of Mamaroneck pursuant to the provisions of Section 108 of the Agriculture and Markets Law. A letter dated December 1, 1936, was received from the Bank Clerks ' Co-operative Building and Loan Association of New York City requesting that all penalties and interest on taxes on property known as Section 4, Block 27, Lots 1B and 2B, be waived. The matter was referred to the Town Attorney. A letter addressed to the Supervisor and dated November 21, 1936, was received from Yr. Edward. Ely Hoxie, requesting permission to erect a screen for the projection of stereopticon pictures at the public hearing to be held on the application of vlorris H. Petigor for the re-zoning of his property. The date of said hearing is December S. 1936. The Clerk was directed to reply that the notice duly given of the public hearing does not provide for any discussion of extraneous matters and that hence it would not be in order for him to display lantern slides in connection with his Civic Center project. The Supervisor stated that in accordance with notice duly given, it would be in order for the Board to open the bids for the contract for the removal from buildings in the Town of Mamaroneck and for the disposition of swill, garbage, ashes, etc. of said buildings for the period beginning January 1, 1937 and ending December 31, 1937. The Clerk reported that he had received two bids, which he proceeded to open and which showed as follows: Antonio Lopreato & Gabriel Sganga $10,900 Lorenzo D' Onofrio & Angelo DeFalco 11,000 Town Engineer Foote stated that Nessrs. Lopreato and Sganga, the present contractors, have rendered good service during the year. On motion by Mr. Griffin, seconded by Mr. Bates, it was unanimously RESOLVED, that the contract for the removal from buildings in the Town of Mamaroneck and for the disposition of swill, garbage, ashes, etc. of said buildings for the period beginning January 1, 1937 and ending December 31, 1937, be and it hereby is awarded to the lowest bidders, namely, Antonio Lopreato and Gabriel Sganga, at the price bid by them, namely, $10, 900; and be it FURTHER RESOLVED, that the Town Clerk return to the unsuccessful bidders their bid check. The Supervisor stated that it would be in order for the Board to consider the proposed 1937 budget . Mr. Meginniss stated that the departmental estimates in writing of the amount of expenditures for the fiscal year beginning January 1, 1937, had been submitted by the various department heads and discussed with them. The Board thereupon proceeded to consider these estimates item by item. On motion by Mr. Bates, seconded by Mr. Griffin, it was upon roll call, the Supervisor not voting, RESOLVED, that the sum of 118,000 which has been collected during the year 1936 by the Town on account of tax arrears and is in excess of the estimated revenues for that purpose as included in the 1936 budget be utilized and applied as estimated revenue in the 1937 budget.
