BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION Additionally Present: Tracy Yogman Town Comptroller and Lindsay Luft Assistant to the Town Administrator. On motion of Councilwoman Katz, seconded by Councilman King, the Work Session was unanimously opened at 5:00 p.m. Update/Review – Madison Avenue Traffic Improvement/Drainage Project Additionally Present: Tom Baird of Barton & Loguidice The Town reviewed the two major components of the project 1) “traffic flow improvements including the installation of a traffic signal at the intersection of the I-95 Ramp and Madison Avenue as well as lane realignments to establish left turn lanes” 2) “Drainage Improvements including the installation of green infrastructure to relieve the flooding that occurs along Madison Avenue particularly at the intersection of Madison Avenue and Fifth Avenue.” The Board reviewed a schedule of construction costs and funding sources for each of the project phases. This evening the Town Board is being asked to adopt a resolution of local share, declaration of lead agency, and approval of consulting services for the traffic improvements and for the green drainage improvements. As required by the grant a public hearing will be held at an upcoming regular Town Board meeting. Actual construction is set to begin in 2020 and should be a five month project in 2 phases, with a break in between. TAKEN OUT OF ORDER New Business The Town Board reviewed the Budget Amendments as part of the Affairs of the Town as presented by the Town Comptroller. Review Proposed Local Law to Regulate Drones – US Open The Town Board reviewed the draft legislation and is prepared to set this for a public hearing. Update – Sewer District Consolidation The Town Board reviewed a request for proposals, for a Consortium Sewer System Consolidation Study. The Town of Mamaroneck, City of New Rochelle, Village of Larchmont and Village of Pelham Manor (the Consortium) has been urging “Westchester County to study the concept of a single agency to operate and maintain the entire sewer system.” The County has now agreed to conduct the second phase of the analysis. Ambulance District Fees The Town Board reviewed the fee schedule proposed. The approval is on the regular agenda for this evening. 1 February 19, 2020 Ambulance District Agreements The current agreements between the Ambulance District, MEMS and VAC are due to expire. The Town Board reviewed the agreements which are essentially unchanged, except that the new agreements “addresses the fact that at times the District must provide paid emergency medical technicians to work with paramedics on duty. The District budget provides for paid emergency medical technicians when necessary.” The approval of the agreements is on the regular agenda for this evening. Comprehensive Plan Supervisor Seligson reported that all the selected Steering Committee members have agreed to participate on the committee. On March 18, the Town will launch the Comprehensive Plan and introduce the Steering Committee. In Rem Foreclosure Proceeding Mr. Maker reported that the Town last conducted In rem foreclosure proceedings in 2015. It has been previously suggested that this procedure be conducted during presidential election years to avoid allowing too much accumulation of tax liens. If so directed by the Town Board, Mr. Maker will begin the process. This approval is on the regular agenda for this evening. New Business Supervisor Seligson updated the Town Board on progress she, Councilwoman Elkind Eney and Councilwoman Fiddelman, are making toward finding and engaging a recruitment firm for the Town Administrator position. All are reaching out and gathering beneficial information. Supervisor Seligson noted that she has received correspondence from residents’ of 59 and 60 Maple Hill regarding their displeasure over the new parking regulation. Supervisor Seligson noted a $10,000 donation to the Meals on Wheels program from a Town resident. Councilwoman Fiddelman gave an update on the Housing Authority, noting that the two new members are wonderful. The Authority would like to work on public education of the benefits of low and moderate income housing. Councilwoman Elkind Eney gave an update on the work being done by NYS Assemblywomen Amy Paulin’s Office. The Assemblywoman is heading a committee to renovate certain Metro North Stations to make them, among other things, ADA compliant, and specifically looking at the disparity in funding demonstrated by newer amenities in different LIRR stations. It was noted that the Mamaroneck Station is one station being targeted. Ms. Paulin will be issuing a fact sheet and dispersing it among the communities. Supervisor Seligson reported that she spoke on WVOX yesterday, and was asked to do this weekly, for which she has agreed. On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, the Board unanimously agreed to enter into an Executive Session to discuss employment history of a particular person and litigation with Pepe Automotive. EXECUTIVE SESSION Employment History of a Particular Person Litigation Pepe Automotive On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 p.m., she then pointed out the location of the exits. 2 February 19, 2020 Supervisor Seligson noted that the Town Board met for a worksession beginning at five o’clock this evening, adding this is an open meeting that all residents are welcome to attend. SUPERVISOR’S SUMMARY REPORT The NYS Westchester Senate Delegation held a hearing on the State budget yesterday. I took the opportunity to present and submit comments on behalf of the Town advocating for increasing state aid to municipalities (known as AIM funding), increasing state funding for roads (known as CHIPS funding), excluding from the tax cap municipal expenditures on public infrastructure, including municipal leaders in discussions about impacts and revenues from legalizing marijuana, reforming and updating tax certiorari and supporting the proposed $3 billion environmental Mother Nature Bond Act. I did a radio spot on WVOX radio this week talking about the upcoming Repair Café. The Repair Café is th opportunity to have neighbor volunteers fix beloved items for free. It will be held Saturday March 14 from noon to 5:00 pm at the Mamaroneck Senior Center on the Post Road. The Town along with our partners in the Sewer consortium Larchmont, New Rochelle and Pelham Manor continue to work with the County to advance the study of sewer consolidation. We are looking forward to Phase 2 of the study. th The Town Board will discuss the proposed development for the BLD diner at the Wednesday, March 4 Town Board meeting. Please look for the Town Board packet for specific times. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Board of Fire Commissioners was unanimously declared open. AFFAIRS OF THE TOWN 1. Appointment to Boards & Commissions On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that Carol Miller be appointed to the position of Alternate Member B of the Town of Mamaroneck Zoning Board of Appeals, and BE IT FURTHER RESOLVED, that the foregoing appointments shall be effective immediately upon the appointees taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on December 31, 2020. 3 February 19, 2020 2. Authorization – Engineering Contracts – Madison Avenue Project On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved, RESOLVED, that the Mamaroneck Town Board does hereby approve the contract with Barton & Loguidice to provide professional consulting services for the implementation of the Madison Avenue Complete Streets Traffic Improvement Project, for a cost not to exceed $85,000, in accordance with the tasks in the scope of work outlined in the document letter dated February 10, 2020. Madison Avenue Project Designation of Lead Agency Local Share Green Innovation Grant program On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved, WHEREAS, in order to promote and improve traffic flow on Madison Avenue, particularly at the intersection of the on/off ramps of I-95, the Town is installing a traffic signal and realignment of traffic lanes to provide for left turn lanes, and WHEREAS, the project will enhance the Town’s commitment to sustainability, through drainage improvements utilizing green infrastructure, including the installation of bio-retention systems, new curbing, tree and vegetation planting and porous pavement, and WHEREAS, the Mamaroneck Town Board hereby declares the Madison Avenue Traffic & Drainage Improvements Project to be an Unlisted Action under the New York State Environmental Quality Review Act (SEQRA) and will prepare an Environmental Assessment Form. NOW, THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck has declared itself the lead agency for the coordination of SEQR review for the proposed actions stated above. The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye 4 February 19, 2020 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was approved, WHEREAS, the Town of Mamaroneck completed a feasibility study for the implementation of drainage improvements along Madison Avenue between Fifth Avenue and Myrtle Boulevard to complement a larger overall project for traffic flow improvements and, WHEREAS, the feasibility study identified the use of various methods of green infrastructure that can be applied to improve the drainage characteristics of the area at a total cost of $1.23million and, WHEREAS, the Town has applied for and been awarded a $1million grant under the New York State Environmental Facilities Green Innovation Grant Program and, WHEREAS, the grant awarded to the Town requires a minimum financial match of $111,112 and THEREFORE, BE IT RESOLVED, that the Town Board agrees to provide a local match in the amount of $230,000 utilizing $120,340 of previously received developer fees for public improvements on Madison Avenue and the appropriation of $109,660 of reserve funds transferred from the Part Town (B) Reserve Fund. Resolution - Justice Court Financial Audit Deferred 10. Report of Bids – TA-19-09A Town Center Restroom Renovations On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the following was approved, WHEREAS, on January 16, 2020 the Town publicly opened and read seven (7) bids for Contract TA-19-09A Town Center Restroom Renovations NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-19-09A Town Center Restroom Renovations, to the lowest responsible bidder meeting all the Town’s requirements, BSW General Construction Corp. at a total cost of $408,000, and BE IT, FURTHER RESOLVED, that the Town Board authorizes the transfer of funds as detailed by the Town Comptroller in the schedule below, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. REPORT OF COUNCIL The Town Board Members reported on their various activities and meetings since the last Town Board Meeting. ADJOURNMENT Supervisor Seligson closed the meeting in memory of Jane Orans. Jane was a pillar in our community. She will be remembered for her generously, of which we are all so thankful for.
