Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION Additionally Present: Lindsay Luft Administrative Assistant On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Work Session was unanimously opened at 5:00 p.m. WJWW Budget Presentation Additionally Present: Paul Kutzy Manager, David Birdsall Business and Finance Director and Eileen Feldman Engineering consultant. Mr. Kutzy and Mr. Birdsall gave a visual presentation of the Five Year Joint Capital Improvement Plan 2020- 2024. The presentation detailed the following projects: 1) Rye Lake UV Treatment Facility proposed to be adjacent to the Westchester County Airport 2) Rye Lake Distribution Infrastructure Modification 3) Winged Foot Water Storage Tank Rehabilitation 4) Shaft 22 (Delaware Aqueduct) Chlorination System 5) Rye Lake Filtration Plant – Phase 1 (Engineering/Permitting) 6) Wholesale Customer Meter/Pressure Regulator Vaults (SWW Interconnection #1) 7) Wholesale Customer Meter/Pressure Regulator Vaults (SWW Interconnection #2). OUT OF ORDER Recruitment – Police Department Additionally Present: Police Chief, Paul Creazzo Police Chief Paul Creazzo discussed the current hiring practices and proposed changes. Chief Creazzo is the Town Board approve in advance a salary range, and basic benefits package, whereby the Chief would have discretion to make a preliminary conditional offer to a candidate. The preliminary package would follow all labor contracts. Without this ability for a conditional offer, the best candidates can be lost to other municipalities. The Town Board agreed that this was a beneficial change to the hiring process, but asked that it be approved for 18 months, and not be open-ended. Capital Plan Report and Update Additionally Present: Rob Wasp Town Engineer The Town Board reviewed the open Capital Projects for the years 2014 – 2020, exclusive of Information Technology, which will discussed at an upcoming worksession. It was noted that the list is ‘aggressive’ and the Town will be looking to engage the engineering services of Dolph Rotfeld on a number of these projects to help get them completed. 1 February 5, 2020 Proposal for Outdoor Dining – Billy and Pete’s (formerly Plates) The Town Board reviewed a mock up for a proposed patio attached to the new restaurant Billy and Pete’s. This is the site of the former Plates Restaurant. The patio would sit just off the left side of the building. It would require a lease from the Town. The property where the patio placement is proposed is in Memorial Park. It was noted that the new owners have been discussing joint opportunities with Jill Fisher the Recreation Director. The Town Board was open to the concept, but will need to work on details. OUT OF ORDER New Business Mr. Altieri reported that the Garden Club would like to offer helping hands at the Senior Center. This is a nice and welcomed offer. There was a request to move the April 15meeting to an alternative date. The Town Board agreed to Monday, April 12. The approval will be added to the regular agenda for this evening. The Town Board received an update on the upcoming PGA. Of note is the request from the Fire Department for an honorarium payment to the Fire Department by the PGA. This is in recognition of volunteer services they will provide. Comprehensive Plan The Town Board reviewed the final scope for the Comprehensive Plan and is comfortable with approving the contract with AKRF this evening. Update – Larchmont – Mamaroneck Joint Garbage Disposal Commission As Administrator of the Larchmont - Mamaroneck Joint Garbage Disposal Commission, Mr. Altieri prepared a memo titled Apportionment of Costs Larchmont Sanitation Commission, dated January 27, 2020. The memo discusses alternative ways of apportioning the budget for the Commission. The Village has suggested looking at apportionment from the standpoint of staffing. Two other alternatives are 1) to create a Sanitary District that would levy taxes to finance their operations 2) apportionment based upon the assessed valuations of the Town and Village. During Mr. Altieri’s research, he was made aware of Chapter 139 of the Unconsolidated Laws of the State of New York. Section 16 refers to the apportionment of costs, specifically that “amounts to be appropriated by the respective municipalities shall be determined on the basis of their estimated amount of garbage, metal and refuse collection.” Mr. Altieri’s memo further discusses this type of apportionment and summarizes that “by calculating the individual tonnages of all the materials collected, rather than just garbage, the apportionment will be more equitable. This would also reflect the total effort put forth by the staff of the Commission for the collection of all materials in each community.” Mr. Altieri will have additional financials by the end of February. Additionally, the Town Board would like to discuss with the Village of Larchmont curbside only pick up. Update – Census Supervisor Seligson gave an update on recent meetings, noting that they have been very productive. She and Lyndsey Luft will be meeting tomorrow to further develop the constituent database. Discussion – Larchmont Library Budget/Village Center Usage The Town Board previously met with the Library Board regarding the Library budget. This evening’s packet provided the proposed Library budget and a memo from the Library discussing the use of the Village Center, which is now under the control of the Library. The Town Board is deferred a vote on the Library budget as they await additional financials. Councilwoman Katz noted that she would like to see joint meetings to discuss the Library budget earlier in the Library’s budget process. The Town Board would like to review the apportionment that is the basis for the fee reimbursement formula for the Village Center. 2 February 5, 2020 Westchester County Housing Information – Town of Mamaroneck Supervisor Seligson and Anna Danoy Director of Community Services and Housing recently attended a meeting for Sound Shore communities regarding the Westchester County Housing Assessment. Supervisor Seligson has provided this information to the Town Board, stating its importance for the Comprehensive Plan. This information will be shared with the Comprehensive Plan consultant. On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to enter into an Executive Session to discuss litigation with Weaver Gardens v. Zavaglia, and appointments to Boards and Commissions EXECUTIVE SESSION Litigation with Weaver Gardens v. Zavaglia. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:15 p.m., she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at five o’clock this evening, adding this is an open meeting that all residents are welcome to attend. PUBLIC HEARING – “Addition of Normandy Road to the Streets where Parking is Prohibited on Certain Sides at Certain Times” Law The following Notice of Public Hearing is entered into the record as follows: LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of th New York, a Public Hearing will be held on Wednesday, February 5, 2020 at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following Local law was approved: Local Law No. 3 - 2020 This local law shall be known as the “Fees for Charging Electric Vehicles only” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: On January 22, 2020, the Town Board passed Local Law No. 1-2020 which created section 219-40 of the Code of the Town of Mamaroneck. Section 219-40 promulgated the rules for determining places on the public streets and within Town-owned parking lots where only electric vehicles can be parked. This local law creates the method for establishing the fee for charging electric vehicles at the electric charging stations where only electric vehicles can be parked. Section 2 – Amendment of a current section of the Mamaroneck Code: Section 219-40 of the Code of the Town of Mamaroneck hereby is amended by adding the following subdivision D thereto: D. From time to time, by resolution, the Town Board shall establish the fee for charging an electric vehicle which is parked in a parking space designated by the Town Administrator as parking exclusively for electric vehicles parking. Section 3 – Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of those parking spaces where parking is reserved exclusively for electric vehicles. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: 9 February 5, 2020 This Local Law shall become effective upon filing with the Secretary of State. On motion of Councilwoman Katz, seconded by Councilman King, the following was approved WHEREAS, the Town of Mamaroneck Vehicle and Traffic Chapter 219, § 219-40 stipulates that from time to time, by resolution, the Town Board shall establish the fee for charging an electric vehicle which is parked in a parking space designated by the Town Administrator as parking exclusively for electric vehicles parking. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby set the fee for charging an electric vehicle parked in a parking space designated as parking exclusively for electric vehicles at $0.30 per kwh. The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye SUPERVISOR’S SUMMARY REPORT I have received many email comments from residents since the last Town Board meeting regarding the presentation to build a mixed use residential building at the site of the BLD diner. We are collecting the comments, all of which will be shared with all the Town Board members, and holding them for the record. The developer did formally submit the application the day before yesterday. Each Town Board member will receive a copy of the formal application tonight. The next step will be for the Town Board to decide if we will consider the zoning change as requested in the application. If we decide to consider the request, we would then refer the application to the Planning Board for review. If we decide not to consider the zoning change, we will inform the applicant. We have not and will not discuss the decision th tonight, but we plan to discuss it at our Wednesday, March 4 Town Board meeting at 8:00 pm in the Courtroom. There was big news from the County last week in their Food Waste Study Report. The County plans to pick up food waste from each municipality starting in September 2020. In addition, they plan to host a pilot compost site in Valhalla as a demonstration opportunity, and they plan to build a compost facility, most likely a bio digester in the next several years. This is a big step forward in the collection of food waste and should have positive impacts on the Larchmont Mamaroneck Garbage Commission program. We held an important 2020 Census Update information meeting in the Town last week with speaker Norma Drummond, the commissioner of Planning for the County. She made an excellent presentation about the importance and need for a complete count of all residents. We had a good crowd of about 40 residents and elected officials who will reach out to educate and assist people with the Census. The most efficient way to complete the Census is online. You will receive a letter in the mail with a code designated to your household. Go online and use that code to complete the Census. You can complete the Census online at the libraries or Town Center. If you do not or cannot complete the Census online, you will eventually receive a paper census to fill out. Remember, the Census numbers will determine our representation in the House of Representatives, County Board of Legislators, and the federal, state and county financial aid we receive. 10 February 5, 2020 th I had the pleasure of presenting a proclamation to my neighbor, Iris Freed, in honor of her 100 birthday celebrated at the LAC with her Hope Community Services friends. I had the opportunity to th speak to the 9 grade OCRA class about my position and the Town of Mamaroneck. All of us are so pleased to have civics back as part of the school curriculum. I also had the pleasure of speaking to the Daisies, 5 and 6 year old girls, about recycling. They surprised me with their knowledge and interest in the subject. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner King, the Board of Fire Commissioners was unanimously declared open. AFFAIRS OF THE TOWN 1. Appointments - Boards and Commissions SUSTAINABILTY COLLABORATIVE On motion of Councilman King, seconded by Councilwoman Fiddelman, it was RESOLVED, that Elizabeth Radow be reappointed as Member D of the Sustainability Collaborative, said term to expire on December 31, 2022, and BE IT, FURTHER RESOLVED, that Michelle Lewis, be reappointed as Member E of the Sustainability Collaborative, said term to expire on December 31, 2022, and BE IT, FURTHER RESOLVED, that Stephen Moser, be reappointed as Member F of the Sustainability Collaborative, said term to expire on December 31, 2022, and ZONING BOARD OF APPEALS On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, it was unanimously RESOLVED, that Arthur Wexler be reappointed as Member D of the Zoning Board of Appeals, said term to expire on December 31, 2024, and BE IT FURTHER RESOLVED, that Arthur Wexler shall serve as Chairperson of the Zoning Board of Appeals for the year 2020. BE IT, FURTHER RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law. 2. Authorization – Contract for Housing Inspections – Section 8 Program On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the Contract with CVR Associates, for a period of two years commencing March 1, 2020, to perform inspections of Section 8 units within the Town of Mamaroneck, currently occupied or intended to be occupied by residents whose Section 8 vouchers are managed by the Town of Mamaroneck. Salary Authorization – Highway Department On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby appoint Dean Vacchio to the full-time position of Laborer in the Highway Department at an annual salary of $51,932, effective February 6, 2020. Authorization – Contract AKRF - Comprehensive Plan On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby accept the proposal from AKRF, Environmental, Planning, and Engineering Consultants, for Comprehensive Plan consulting services, for a lump sum of $170,000, invoiced monthly based on a percent complete basis, subject to review of form of Contract by the Town Attorney, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. Authorization – Stipulation of Settlement – Weaver Gardens On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was approved, WHEREAS, the Town and its Building Inspector are defendants in litigation entitled “Zavaglia et. at. v 144 Weaver Street, LLC et al.” that is pending in the Westchester Supreme Court under index number 57835/2018, and WHEREAS, this litigation involves the operations conducted at the Weaver Gardens located at 144 Weaver Street, and 13 February 5, 2020 WHEREAS, a settlement of that litigation has been presented to the Town Board for its consideration, and WHEREAS, the Town Board has determined that entering into this settlement is in the best interests of the Town. NOW THEREFORE, BE IT RESOLVED, that the Town shall settle the litigation entitled “Zavaglia et. at. v 144 Weaver Street, LLC et al.” that is pending in the Westchester Supreme Court under index number 57835/2018 on the basis of the SETTLEMENT STIPULATION AND ORDER that has been presented and considered by the Town Board, and BE IT FURTHER RESOLVED, that the Attorney for the Town, the Town Administrator and the Town Building Inspector hereby are authorized and directed to sign the SETTLEMENT STIPULATION AND ORDER on behalf of the Town.
