HomeMy WebLinkAbout1936_01_14 Town Board Minutes SPECIAL MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, N. Y. HELD JANUARY 14, 1936 At the Town Offices, 118 'Nest Boston Post Road, Mamaroneck, N. Y. The meeting was called to order by Supervisor McCulloch at 11:50 A. M. Present: Supervisor McCulloch Councilmen Bates and Griffin Absent: Councilmen Brennan and ivieginniss. The presence was also noted of Town Clerk Marvin. The Supervisor stated that in consequence of the action taken by the Town Board at its meeting on January 2, 1936, in relation to the penalties and the taxes on the Larchmont Yacht Club property, based upon the compromised valuation set by the Board at its meeting on November 6, 1935, negotiations had been held with representatives of the Yacht Club. On motion by Mr. Griffin, seconded by Mr. Bates, it was on roll call unanimously RESOLVED, that the resolution adopted by this Board at its meeting on November 6, 1935, with respect to the compromise on the assessed valuation on property owned by the Larchmont Yacht Club known as Section 7, Block 34, Lot 1, be and it hereby is rescinded; and be it FURTHER RESOLVED, that the following resolution be substituted therefor to wit: RESOLVED, WHEREAS, Larchmont Yacht Club heretofore obtained a writ of certiorari from the Supreme Court Ninth Judicial- District, on the 29th day of September, 1934, to review the assessment for the year 1934 upon property owned by it and which is known as Section 7, Block 34, Lot 1. on the Tax Map of the Town of Mamaroneck, and WHEREAS, the Board of Assessors of the Town of Mamaroneck duly filed a return to said writ on or about the 15th day of November, 1934; and WHEREAS, Hon. Walter W. Westall was thereafter appointed referee to take evidence relating to the matters and things put in issue and report the same to the Supreme Court; and WHEREAS, the Larchmont Yacht Club also obtained from the Supreme Court, Ninth Judicial District, a writ of certiorari on the 14th day of October, 1935; to review the assessment for the year 1935 upon its property above described; and WHEREAS, the Board of Assessors of the Town of Mamaroneck duly filed their return to said writ on the 15th day of November, 1935; and WHEREAS, no other or further proceedings have been taken in regard to either of the aforesaid certiorari proceedings which are now pending; and 245 WHEREAS, the Relator, Larchmont Yacht Club, has agreed with the attorney for the Town of Mamaroneck to settle and discontinue the aforesaid certiorari proceedings upon a reduction of Fifty thousand dollars ($50,000) as against the value of the buildings and improvements upon said property as assessed for both the years 1934 and 1935 to wit, the sum of Ninety-three thousand five hundred dollars ($93,500. ) ; and WHEREAS, it appears from the records of the Receiver of Taxes of the Town of Mamaroneck that the State, Town, County and School taxes for the year 1935 as assessed against the aforesaid property have not been paid, NOW, THEREFORE, BE IT RESOLVED, that the assessment for the year 1934 and 1935 upon the property of the Larchmont Yacht Club be fixed as follows: Section Block Lot Land Improvement Total 7 34 1 $255,000 $43,500 $296,500 provided that the certiorari proceedings for the years 1934 and 1935, now pending, be discontinued, and further provided that the State, Town and County, as well as the School_.tax now due to the Town of Mamaroneck for the year 1935 be paid on or before February 1, 1936, with penalties thereon accrued to July 310 1935; and be it FURTHER RESOLVED, that a certified copy of this resolution be furnished to the Board of Assessors, the Receiver of Taxes, and to the Comptroller of the Town of Mamaroneck.
