The meeting -has called to order by Supervisor YcCullcch at
8:05 P. A.
Present: Supervisor TcCulloch
Councilmen Sates,., Brennan, Griffin, heginniss.
The presence was also noted of 'Torn: 01erk 1-'arvin and Tot*rn
Attorney Delius.
The regular order of business was suspended in order to hear
those persons present who desired to address the lot.."n Board.
I,4r. Dania! husell of 7dgewood Avenue , Larchaont , addressed the
Board concerning the tax liens held by the !awn on property owned by his
mother, hrs. Fannie Kusell., known as Section 1, Block 55, Lots 31 to K
inclusive , for a, school tax Of 1924 and the ;Mate , County , Toi:^n and
School tan cf 1925. He stated that in Hay , 1927, he had made verbal in-
quiry in the tax office and had been informed. by Santo Lanza, the then
Recei7er of Taxes, that there 7ere no unpaid taxes On this property.
After discussion the matter was referred to the To7n nttorney.
Tire Chief Le Vino addressed the Board concerning national Fire
Prevention 'peek, October 6-12 inclusive . He stated that the _ ire Depart-
ment Ulan to take an active pa7t an_? requested the To7n Board to designate
that meek as Fire prevention ':'deer in the unincorporated section of the
Town of .iamaroneck.
On motion by Tier. Brennan,- sec'and-ed by Yr.„ Griffin, it was
unanimously
RESOLVED, that the week of October 6-12 inclusive be

Fire Chief LeVino informed_ the Board that the Vown Fire Depart-
ment headouarters had been designated by the American Red Cross as a

On motion by hr. Dates, seconded by Yr. ?riff in, it was

Fire Chief LeVino stated +,h?t he desired to acknapiedge publicly
his thanks to Ir. Brennan and hr herola for the cooperation ex tended by
the T_`ir'1_.:7ayr Departmesnt in painting the fire hydrants and in rep ?ring the
base of the flag -pole.

Yr. Brennan 'reported on the complaint received from Bassi Freres,
Inc. concerning the flooding of their Property on the Boston 'host Road,,,
which matter had been referred to him at the meeting on September 3 , 19358

ktr® Brennan reported that he was considering a proposed work
relief project to install a storm -dater drain in Dillon Pa. t to serve.
particularly Cheater Place and LoCan Place. He added that a 21 inch
pipe -as being considered-®.
Yr,_ Brennan submitted a report by Firs Chief Le''ine on the
Scarsdale hydrants located along the :far aroneck-Scarsdale boundary line ,
numbering fourteen in all, with which the Torn of Hamarcneck Fire Depart-
went might make connections in the event of a fire . The hatter 7a.s or-
dered referred back to the lire Department for consideration in connec-
tion with the preparation of its 1936 budget4

tax for the current year in the amount of ' 9® 68 had been levied on

for the same reason that other taxes on this sane property had been can-
celled by the Town Board at its meeting on June 6, 1935, namely , because

The Supervisor reported that the -=fork progress Administration

consideration by the Town had been submitted for approval with the ex-

The Town Attorney reported on the matter of the request of the
Westchester Trustees concerning tar relief, which matter had been referred
to him at the meeting of September 3 , 1935. He stated that he had replied
to them that the Torn had granted no requests under the section of the
law referred to by them.
The Supervisor informed the 30ard that a suggestion had been
made that the State Police be requested to take over the highway patrol-
ing on the Boston Post Road< He requested Hr, Brennan to take this matter
u0 with the ioint committee representing the TO?'"'n and the two Villages
of 7h ch he was a member.

The Town Attorney presented a petition from the Hoard of
Assessors dated September 3, 1935, requesting the apportionment of
certain tares pursuant to Subdivision 5, Section 33, of the West-
chester County Tax Act. The Town Attorney recommended approval of
the petition
on motion by i<ir. Brennan, seconded by Iir. Hates, it was
unanimously
RESOLVED, 7HEREAS, the Board of Assessors have presented
a petition dated September 3, 1935, for the correction
of the assessment rolls for the years 1933 and 1934,
tax years 1934 and 1935, pursuant to the provisions of
Subdivision 5, Section 33, of the Westchester County
Tax Acts and
WHEREAS, after due consideration this Board finds it
desirable to grant said petition for the correction
of said assessment rolls;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment rolls for the years
1933-1934, tax years 1934-1935, be corrected to show
the following property now appearing on the roll as

FURTHER RESOLVED, that the assessment roll for the year
1934, tax year of 1935, be corrected to show the following

The Town Attorney presented an affidavit executed by the Walden
Savings Bank of Walden, Orange County, New York, setting forth that the
Savings Bank had purchased a transfer of tax lien affecting premises
described as Section 9, Block 7, Lot 9, being lien Ho. 2435 of the sale
of 1933 in the amount of $143.72 and had lost it.. The Savings Bank re-
quested that a duplicate tax lien be issued to it in accordance with the
provisions of Section 54 of the Westchester County Tax Law.
On motion duly made and seconded it was unanimously
RESOLVED, that in accordance with the provisions of
Section 54, of the Westchester County Tax Act, the
Supervisor be and he hereby is authorized, empowered
and directed to issue to the Walden Savings Bank of
Walden, Orange Count,, New York, a duplicate of the
tax lien assigned to it by the Bonded Municipal
Corporation, being a 1933 tax lien for the 1932 Town
and School taxes affecting premises described as
Section 9, Bloc'_ 7, Lot 9, bearing the number 2435
in the amount of $143.72.
The Town Attorney presented a letter dated August 27, 1935,
from Silas S. Clark, stating that in connection with his search of the
records of the office of the Receiver of Taxes and Assessments for the
collection of delinquent taxes, he had discovered that there were a
number of tares which represented double assessments, that is, two assess-
ments on the same piece of property. sir. Clark; submitted a list of these
double assessments and recommended that one of the taxes thereon be can-
celled. The Town Attorney likewise recommended that these taxes be
cancelled.

On motion by Mr. lrieginniss, seconded by Mr. Brennan, it
was unanimously
RESOLVED, that on the recommendation of Silas S. Clark
and the Torun Attorney the following taxes be and they

The Town Attorney presented a letter from Silas S. Clark
dated August 27, 1935, concerning an unpaid tax of 1913, sale of 1914,
on Section 5, Block 13, Lot 3, in the amount of ;;3.04. The letter
stated that in 1924 while he was engaged in collecting certain back
taxes for the Town of :Mamaroneck, he, . r. Clark, had obtained from the
then Receiver of Taxes a statement of all the unpaid taxes on the above
described property and had secured payment of the total amount shown as
unpaid on the Town records . In view of the fact that he had so acted
on behalf of the Town, the letter said, Kr. Clark recommended that the
tax of 1913 as above described be cancelled by the Town Board. The Town
Attorney also so recommended.
On motion by cr. c.Leginniss, seconded by 1i.r. Brennan, it was
unanimously
RESOLVED, that on the recommendation of Silas S. Clark
and the TGwn Attorney, the tax of 1913, sale of 1914,
on Section 5, Block 13, Lot 3, in the amount of : 3.04
be and it hereby is ordered cancelled.
The Town Attorney reported that he had been in consultation
with Mr. Frank Fay of Yonkers, attorney for certain plaintiffs in four
certiorari proceedings for the review of the 1934 assessments now pend-
ing in the Supreme Court of `iestchester County. He said that settlements
of these proceedings had been proposed and that acceptance thereof was
recommended by both the Board of Assessors and by himself.
He thereupon presented two petitions from the Board of Assessors
each dated September 17, 1935, relating to three of the four certiorari
proceedings, and requesting the Town Board to authorize the correction
of the assessment rolls in 'accordance with the petitions. He stated that
with
the fourth proceeding, namely, that of the Parkway Operating Company,
Inc . in reference to oroperty described as Section 6, Block 10, Lot 8B
(also known as 1921 Palmer Avenue, Larchmont) was being voluntarily dis-
continued by the plaintiffs provided that the settlements as proposed in
relation to the two other properties owned by the Parkway Operating
Company, Inc. and likewise the subject of certiorari proceedings, as
set forth below, be approved by the Town Board.
On motion by dr. Bates, seconded by -Kr. Brennan, it was
unanimously

RESOLVED, WHEREAS, the Board of Assessors has submitted
two petitions, each dated September 17, 1935, for the
correction of the assessment rolls for the year 1934-
1935 pursuant to the provisions of Subdivision 4 of
Section 33 of Chapter 105 of the Laws of 1916, as amended,
being the ,,,Iestchester County Tax Act; and
WHEREAS , after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment rolls ;
NOW, THEREFORE, BE IT

FURTHER RESOLVED, that in respect to such of those
properties above referred to as have had the taxes
paid thereon, the Town Comptroller 'us and he hereby
is authorized, empowered and directed to refund
excess payments resulting from the above reductions,
in the assessment rolls upon presentation of
proper claims therefor.
