The meeting vaas called to order by Supervisor McCulloch at
4:45 P. 1.
Present: Supervisor 1cCulloch
Councilmen Bates, Brennan, Griffin, Lleginniss
The presence was also noted of Town Clerk Harvin and Town Attorney
Delius.
The Supervisor stated that the Board was meeting today, Tuesday ,
August 20, 1935, being the third Tuesday in August, in accordance with
the provisions of Article 66 of the Election Law for the purpose of de-
signating the place in each election district in the Town at which the
meetings for the registration of voters and elections and primaries shall
be held in the year following the ensuing first day of October.
On motion duly made and seconded, it was unanimously
RESOLVED, that in accordance with the provisions of
Article 66 of the -lection par , being Chapter 17 of
the Consolidated Lags of the State of Slew York as
amended, the Torrn Board of the Torn of liama-ronec: hereby
designates the place in each election district in the
Torn at which the meetings for the registration of voters
and elections and primaries shall be 'Held in the year
follo,ging the ensuing first day of October:

The Board thereupon proceeded to sign a certificate to the
above effect.
The Town Clerk called to the attention of the Board the fact
that an error exists in the resolution passed by the Board at its meet-
ing on June 5, 1935, concerning the cancellation of unpaid taxes on the
so-called Larchmont Gardens Lake.
On motion by Mr. Griffin, seconded by I:Ir. Brennan, it was
unanimously
RESOLVED, S,'V=h EAS, it has been called to the attention
of this Board that an error exists in the resolution
passed by this Board at its meeting on June 5, 1935,
concerning the cancellation of unpaid taxes on the so-
called Larchmont Gardens Lake , otherwise known as Lake
Sheldrake , described on the assessment maps of the Torrn
of I;Tamaroneck as Section 2, Block 49;

RESOLVED, that the resolution passed by this Board
at the meeting aforesaid be and it hereby is
rescinded; and be it
FURTtLTR RESOLVED, that the following resolution be
substituted therefor, to wit .
RESOLVED, that the unpaid taxes on the so-called
Larchmont Gardens Lake , otherwise known as Lake
Sheldrake , described on the assessment maps of the
To,,%rn of 11amaroneck as Section 29 Block 49 , be and
they hereby are ordered cancelled on the records of
the Receiver of `faxes and Assessments, as follows:
Tax of 1932 - total amount of lien $34. 54
Tax of 1933 - total amount of lien 30.30
Tax of 1934 - State and County 27. 56
School 9. 76
- Penalties & advertising 5. 23
Tax of 1935 - State , County , Town and
District 19. 58

Total 0136.65
The Supervisor reported to the Board that he had approved a
number of `VV-2A projects and stated that he did not consider that his
ap-proval bound the To.�.rn to proceed with the projects in the event that
the Torn Board later decided to abandon them. IIe said that he made this
explanation because the possible final cost of these projects or some of
them might be so high as to make it advisable for the Town. Board not to

proceed with them. lie stated further that preliminary estimates tended
to indicate that it might be less expensive for the Town to put all its
cases on home relief and abandon work relief entirely as it is at present
set up under the lrPA.
The Town Attorney reported on the matter of the 1928 School
Taxes sold in 1929 to the Tovm on Section 8, Block 77 , Lots 6, 7 , 8 and
9 , which matter had been referred to him at the meeting on =august 7, 1935,
with instructions to negotiate regarding a settlement of these taxes. He
stated that he had conferred with ir. Louis Zingesser of Greenbaum, 'Wolff
a Frnst, attorneys for Anna I. Coles and Ralph ?:C. Blood, owners of the pro-
perty, who had offered to pay the face amount of the tax with 12 per cent
__.. penalty but with no interest computed thereon. The Town Attorney recommended
acceptance of the offer.
On motion by K-r. Sdieginniss, seconded by I.Ir. Griffin, it was
unanimously
RESOLVED, that on the recommendation of the Town Attorney
the Receiver of 'Taxes and Assessments be and he hereby
is authorized, empowered and directed to accept the face
amount of the 1928 School Tax with 12 per cent penalty
on Section 8, Block 77, Lots 6, 7, 8 and 9.
fir. !,,.eginniss reported on behalf of the special committee con- '.
sisting of the `'own Attorney and himself to which had been referred at
the meeting: of August 7, 1935, the request of ilrs. Iiargaret :T. hickey con-
cerhing an unpaid tax. He stated that this eras a 1928 tax on Section 1,
Block 54, Lot 11B in the amount of 025.80. After discussion tine matter
was laid over.
The Supervisor presented a letter dated August 15, 19359 written
by Eppstein I'Z Hi-rshfield9 attorneys for I.Irs. Josephine V. Kaufman, the
owner of certain property on Fenimore Road opposite Cornell Street known
as Section 3, Block 1, Lot IA. The letter enclosed a check in the su<n of
x126. 84 being one-half of the tax on this property for the year 1934 which
had been omitted by the Town in error. The letter requested that in cone
sideration of the payment of one-half of this tax, for which I: rs. ==aufman
was in no way liable since she had purchased the property in good faith
before the Town had discovered its error, the Town undertake to provide
herb°:ith adeouate grater service for fire prevention purl-)ores in order that
she might benefit by the "protected" insurance rate .
The Supervisor stated that since firs, l>aufman was not liable
for this tax; he believed the To?:m' should not 'accept _ the -money and that
the matter of fire protection for her property should be considered later.
On motion by Hr. I;Ieginniss, seconded by I,%.r. Bates , it was
unanimously
RFSOLIVED, that the Torn Clerk be and he hereby is
directed to return to lirs. Kaufman her check in the
amount of X126 .84 which accompanied her letter of August 15,
1935, and that he state that the full amount of the tax
on this property is y)253.67 and that the Town Board feels
that it is not empowered to accept partial payment of this
tax; and be it
FURT:-iM2 RESOLVED, that the matter of fire protection for
? rs. -iaufman' s property be referred to I•=r. Brennan.
r. Franklin Brooks, Receiver of the Larchmont Eational Bank
and Trust Company, addressed the Board concerning the 1897 and 1898
taxes on Section 7, Block 10, Lot 21 ( situated at 111 Beach Avenue ,
Larclvnont) and presented a letter dated August 20, 19359 in connection
with the same matter. He stated to the Board that in his opinion the
To=rn was largely responsible for the fact that this tax had not been
paid becuase , owing to the Bray in which the tax records had formerly
been kept, several tax searches had failed to disclose the existence of
this tax and, consequently, he requested a compromise of the amount due ,
namely, ;$126. 54 ( including accrued interest on the tax liens) . He offered
to pay the face amount of the tax liens held by the Town, namely , ,;y39. 75®

on motion by -r. Brennan, seconded by lyr. Griffin, it was
unanimously
RESOvVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to receive payment of the taxes for 1897 and 1898 on
Section 7, Block 109 Lot 21 in the face amount of the
liens thereon held by the Town, namely, w�39.75 without
accrued interest to date .
The Torn Clerk reminded the Board that in accordance !,aith the
law the Board 7;.as required to hold a joint meeting with the Board of

list of rand and trial jurors.
On motion duly made and seconded it was unanimously
RESOLVED, that this Board meet on Tuesday , September 3,
1935 at 8-00 P. 1L?. with the Board of assessors for the
Purpose of preparing a list of grand and trial jurors
in accordance with the law;and be it
URTH_t: RESOLVED, that this meeting on September 3 , 1935,
take the place of the regular meeting of the Town Board
scheduled for September 4, 1935.
At 5-40 P. ? the Board unanimously resolved to adjourn.
