HFLD APRIL 20,1935 At the Town Offices, 118 West Boston lost Road, Hamaroneck, Y. Y. The meeting was called to order by Supervisor LcCulloch at 2 .30 P. Present : Supervisor 'uL'cCulloch Councilmen Bates, Griffin and Leginniss.. Absent: Councilman Brennan. The presence was also noted of Town Attorney Delius who acted as clerk of the meeting. Frederic P. Simonds, of the Board of Assessors presented a petition for the correction of the Assessment Roll in certain particu- lars, and e7plained to the Town Board the necessity for the various corrections which the Board of Assessors requested the Town Board to mare . On motion by Councilman Griffin, seconded by Councilman L'Ieginniss, the following resolution was adopted: UHETRITAS, the Board of Assessors have presented a petition , dated April 18, 1935, asking for certain corrections in the Assessment Roll of the Town cf Hamaroneck for the year 1934-1935, pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916 as amended, in certain particulars , which would definitely appear from the said petition pre- sented to this Board, and 7HEREAS, after hearing Frederic P. Simonds, a member of the Board of Assessors, and considering the matters set forth in said petition, the Town Board deems it just and fair that such corrections should be made ; RF801,71 D, that the following corrections be made to the Assessment Roll of the 'T'own of LIamaroneck for the year 1934-1935 pursuant to the provisions of paragraphs 1 and 4 of Section 33, Chapter 105 of the Laws of 1916 as amended. I'0RTHE'R =H SOL7IED, that the Board of Assessors be instructed to correct the Assessment Roll accordingly , and that the Receiver of Taxes be authorized and directed to issue bills and 'receipts for taxes upon the aforesaid property in accordance with the correc- tions made in this resolutions EURTHFR R71SO VED7 that the Town O?e-rk furnish copies of this resolution to 'he owners of the aforesaid properties, the Receiver of Taxes, the Board of Assessors and the Comptrollers and FURTA=, RESOLVED, that pursuant to Section 33 of Cha-ater 105 of the Lazes of 1916 as amended2 the reduction in the amount of tax upon the several parcels of property due to the corrections upon the .Assessment Roll as made by this resolution, be included in the next levy of taxes made for the various districts in the Town of Hamaroneck affected by such reduction. The Board then discussed with Hr. k'illiarn H. Lawson, and IIr. Gilliam E. Schramek, attorney for certain residents of Larchmont Gardens, the change of route of the County Transportation Company bus line. :o action was taken. The Town Attorney presented to the Board certain applications for cancellation of taxes as folio-is : (1) Application of Angelina and Frank Carpino for cancellation of 1932 taxes on their property , 11 Washington Avenue (Block, Lot and Section numbers not given). The Torn attorney -read a letter from the taxpayers, dated I'Y'arch 4, 1935, stating their reasons for the request; also stating that they had -paid off special street assessments on this property for 1931, 1932, 1933 and 19349 and requesting that penalties be remitted upon the Town tax which is unpaid of record. This application was denied without prejudice to a. renewal of the same if evidence of payment can be produced. (2) application of Lucy V. Doggett for cancellation of school tax for the year 1921, amounting to $60.24, with interest from June 21, 1922, on property known as Section 7 , Block 12 ., Lots 1 and 2. The Town Attorney read a letter from llrs. Doggett, dated I_Farch 15 , 1935., stating her reasons for the request. The Board, declined to grant this application upon the proofs at present submitted, without prejudice to renewal of the application if further evidence can be produced. (3) .Application of I-rs. Raymond (Virginia T.) 11cCabe for cancellation of taxes for the year 1920 on her property known as Section 6 , Block 29 , Lots 3 and 4. 281 The Tow-r Attorney read a letter frori Iirs. McCabe , addressed to Lsr. Silas Clark, stating her reasons for the application, and in which she states that she obtained a title policy from the Westchester Title Company in 1924 insuring the title. The Board declined to grant this application upon the proofs at present submitted, without prejudice to renewal of the application if further evidence can be produced. (4) Application of Seel Singer for cancellation of 1926 taxes on his property known as Section 1, Block 44B9 Lots 37 to 41, inc. — The Town Attorrrey read affidavits of Raymond R. tcGee , attorney for Seel Singer, verified February 18, 1935, and of ",dheeler B. Ganbee 9 attorney for the '=d es t the ster Title 4 Trust C om pa n Y s who closed the tit l e in connection with the sale of this property to Seel Singer; this affidavit being verified February 26, 1935. The Board declined to grant this application upon the proofs at present submitted, without prejudice to renewal of the application if further evidence can be produced. The Receiver of Taxes appeared before the Board and submitted correspondence between himself and Hr. Edward D. Kollock of Boston, Pass. regarding his claim for remission of penalties and interest on taxes for the year 1925-2926 , on property 'known as Section 7, Block 299 Lots 7 , 8, 9 , 10, 11A,15B and 16A, on which action had been taken by the Board at their meeting held on February 2, 1935. The correspondence indicates that lfr. Kollock was not satisfied •,,r;ith the action taken by the Board at its meeting on February 2, 1935, and now desires penalties and interest be rernitted, subsequent to March 27, 1933. _ The matter was referred to the Toy:✓n Attorney to make a further report to the Board.. The Town Attorney also stated that the application heretofore made by Greenbaum, Jolff L Ernst, representing the purchaser of tax lien upon property known as Section 9 , Block 40, Lot 24, being the so-called "Lizzie Boyd Property", in the Village of Sannaroneck, which was referred to him by the Board on Larch 7, 1935, had been considered and stated that he had been able to get these attorneys to increase their offer to compromise the tax liens now owned by the Tovn of 11amaroneck upon this property from one-third to one-half of the amount of the in- terest and penalties. He recommended tentative acceptance of this offer on condition that the lien holders complete their foreclosure and become owners of the property also that the Village, which also holds tar, liens upon the property, make a similar compromise. He reported that the amount of taxes liens owned by the Towns with interest up to flay 1, 1935, amounted to .x1,383.86, and that the 1934-1935 taxes (not yet sold) amounted to ""p168. 51. These he recommended should be paid in full, there being no authority to compromise these for 50b.. The Town Board unanimously approved the recommendation of the Town Attorney. He was instructed to so notify Yessrs. Greenbaum, `llolff �'c Ernst. The Board them discussed the claim of Luigi Leone made through his attorney, Franklin Brooks, for allowance of interest on his claim under a contract made with the Torun of 11amaroneck, dated Harch 13 , 1929 , and which claim the Board approved at its meeting held December 19, 1934. The Board agreed to allow interest upon the amount of this claim at the rate of 55 per annum from the date when its existence was first called -- to their attention i.. e. .Tune 20 , 1934, and instructed the Town Attorney to notify Iir.
