HELD APRIL 4TH, 1935 At the Town Offices, 118 West Boston Post Road, Kamaroneck, N. Y. In the absence of Supervisor ILcCulloch the meeting was called to order by Er. Yeginniss at 8:08 P. K. Present: Councilmen Eates, Brennan , Griffin, Yeginniss. The presence was also noted of Town Clerk Iiarvin and Town Attorney Delius., On motion by 1'r. Bates, seconded by ir . Griffin, Ir. Leginniss was unanimously chosen to act as Chairman of the meeting in the absence of the Suoervisor.. The minutes of the meeting of Larch 219 1935, were read by the Town Clerk and approved as read. The report of the Town Cleric for the month of lurch was re- ceived and filed. The report of the Receiver of Taxes for the month of lurch was received and filed. The Town Clerk reported that he had been served with a summons and complaint in the matter•-of Garden Properties, Inc. vs Town Offices, Inc. et al, being a foreclosure of a tax lien on Section 9 , Block 10 , Lot 1B. The matter was referred to the Town Attorney. - - A letter dated April 19 1935, was received from F. H. Bull, Jr. , Trea.s. -Clerk of the Village of Tamaroneck, stating that the Board of Trustees of the village was in accord with the suggestion of cooperation between the Town and the two villages and requesting that it be notified of any arrangements for a joint meeting. The letter was referred to the Clerk to be held until further word has been received from the Village of Larchmont.. A letter dated March 29 , 1935, was received from Mr. F. H. Talmon of 8 Boulder Road, Larchmont, concerning an alleged encroachment by the Town on his property at that address. The matter was referred to a special committee consisting of lir. Brennan, the Town Attorney and Superintendent Lerola. A letter dated March 26, 1935, was received from the Safety Fire Extinguisher Company recommending the installation of two fire extinguishers on each floor of the Town Hall. The Board unanimously directed the Tocm Clerk to purchase four extinguishers as suggested in the letter. A letter dated Larch 25, 1935, was received from Gladys Deutsch of 2 Vine Place , Larchmont, concerning the condition of the surface of that road. The matter was. referred to liar. Brennan. A letter dated Earth 15, 1935, was received from W. F. Gordon of 63 Vine Road, Larcb wont, concerning the condition of an empty lot directly behind his house at that address. Mr. Brennan reported that _ the condition complained of had already been remedied or was in the process of being remedied and the Clerk was directed to so notify Mr. Gordon. A letter adted March 20, 1935, was received from Mr. E. C. Bingham concerning dust and debris blown from the Town garbage dump on to his property located nearby. The matter was referred to iIr. Brennan. A "Fatice of Tentative Special Franchise Valuation and Tentative Rate of Equalization" was received from the Department of Taxation and Finance of the State of Few York and referred to the Board of Assessors with the request that the Board of Assessors report back to the Town: Board how the valuations set forth in the notice compare with those of last year. A letter dated ?L'Tarch 25, 1935, was received from Assemblyman Ralph A. Gamble concerning the randelbaum Bill to exempt aqueduct pro- perty from taxation. The letter was ordered filed. On motion duly made and seconded, it was unanimously RFSOL'T"ED, that the action of the members of the Board in sending telegrams to the following persons in oppo- sition to the Landelbaum Bill above referred to be and _ it hereby is in all respects ratified, approved and confirmed, to wit Assemblyman Ralph A. Gamble State Senator Pliny W. Williamson L?ajority Leader John J. Dunnigan State Senator Samuel Kandelbaum. Frank C. Moore , Executive Secretary , Association of Toms of the State of iaew York A report dated Harch 15, 1935, from the Westchester County Emergency Opork Bureau showing payments made to residents of the Town of Mamaroneck or residents other than the Town of Mamaroneck but who are assigned to the Town_ or County projects for the month of February, 1935 was received and filed. A letter dated March 27, 1935, was received from the Taxpayers Association of the Town of ?Yamaroneck requesting the Town Board, if pos- sible , to act on the matter of collecting taxes in two instalments with- cut penalties on the second instalment or, if that is not legally possibli to endeavor to have this made possible. The Town Clerk was directed to reply that two days prior to the receipt of the letter a statement by the Supervisor covering this matter had appeared in the local press. The Board then proceeded to take up unfinished business which had been laid over or considered in part at previous meetings. -- The Town Attorney reported on the request of Franklin Brooks concerning the unpaid tares of Luigi Leone. The matter was laid over again pending determination of the amount of taxes open on this property. The Town Attorney reported on the request of Franklin Brooks concerning the arrest of E rs. Taicoletta P°erciasepe. He stated that in his opinion there is no liability on the part of the Town in this matter. The Board by resolution unanimously approved his report. The Town Attorney reported on the request of Franklin Brooks concerning property located at 176 Liyrtle Boulevard. He stated that he had informed Yr. Brooks that he should take this matter up with the Board of Assessors. Hr. Meginniss presented on behalf of the Comptroller the state- ment of the cost to the Town of the work relief projects for the period from January 1, 1935 to lZarch 31, 1935. The total obligations of the Town amounted to , 1,701.99. Ur. Griffin reported on the disposition of wood cut by the Park Department. He stated that none of this wood was suitable for kindling purposes and that it had all been burned and the ashes saved for use on the Town parks. The Town Attorney reported on the Benson tax matter and stated - that the claimants had made an offer of compromise which he had rejected because the offer was too low. lir. Brennan reported on the matter of cutting down trees along the highways and stated that this work was being done jointly by the Park Department and the Highway Department. The Town Attorney reported on the matter of the petition of Ifartin Ginaler, attorney for Frank F. Hirshstein, for cancellation of certain taxes on Section 09 Block 39 , Lot 3. 5 On motion by l,:r. Griffin, seconded by '''�r. Bates, it was unanimously RF'SOI,VED, WHETREAS, a petition dated Larch 7, 19359 has been received from Yartin Ginzler , attorney for Frank F. Hirshstein, requesting the cancellation of certain tapes on Section 9, Block 39 , Lot 3 ; and utIREAS, Silas S. Clark, special collector of -- delinquent taxes, has recommended approval of this petition for the reasons set forth therein; and IIM REAS, it appears just and proper to the Town Board that these taxes should be cancelled; YOU, THEREFORE, BE IT RESOLVED, that the following described taxes be and they hereby are ordered cancelled on Section 9 , Block 39 , Lot 3 and that the Receiver of Taxes and Assessments be directed to mark his books of record accordingly, to wit : 1870 Tax on Lot 32, Hap of Grand Park, (Brotin property) ; sold March 18, 1872 to the Town of Mamaroneck for 1000 years- X8.79 1870 and 1871 Taxes on Lot 32, Map of Grand Park (Brown property) ; sold Larch 31, 18739 to the Town of Mamaroneck for 1000 years- 14.01 1871 Tax and 1872 School on Lot 329 Trap of Grand Park (Brown prop. ) sold March 350, 1874 to the Town of Iamaroneck for 1000 years- 10.80 1872 School, .1873 Tax on Lot 32, I1 of Grand Park (Broom property) ; sold October 20th, 1874, to the Town of Mamaroneck for 1000 years- 7.88 Mr. 11leginniss report-ed on the matter of taxes reported to be unpaid on property ovmed by St. John's Church, Larchmont. He stated that the matter was still being investigated. The Tovm Attorney reported on the matter of the proposed esta- blishment of a garbage district. He stated that he believed such a district should be established and that he was continuing to look into the matter. There being no further unfinished business, the Board considered the usual reports. I1r. Brennan reported on highway matters. He stated that the surface of L axwell Street and the so-called "Old Weaver Street" have been improved. He also reported on Fire Department matters, stating that four new tires had been bought for the pumper. Mr. Bates reported on sewers. He stated that the work was progressing favorably on the Rebeau Drive project, although some very h a rd rock had been encountered; that all houses but one on Knollwood Drive had been connected to the newly installed sewer and that the height of the vent projecting from the booster pumping station on Knollvtood Drive had been cut down. Mr. Griffin reported on parks, stating that the spring trim- ming of trees had been comrleted. 259 He also reported on welfare matters. He stated that the total relief disbursements in the month of Larch amounted to $30,434.91 com- pared with `,30, 844.22 in the month of February . Mr. PLeginniss reported on finances and stated that unpaid claims of 1934 and prior years amounted to about $45,000 and that no temporary borrowing pending the receipt of the 1935 taxes had been necessary. The petition of the Board of Assessors dated Lu�arch 21, 1935, requesting corrections in the assessment roll for the year 1935 pur- suant to Section 33 of the Westchester County Tax .Act, which had been presented to the Town Board at its meeting on Harch 219 1935, and ordered laid over, was laid before the Board by Hr. Tseginniss. On motion by ILr. Bates, seconded by Er. Griffin, it was unanimously 1T,SOL"JED, WhEREAS, the Board of Assessors heretofore submitted a petition for the correction of the Assessment Roll for the year 1935 in pursuance of the provisions of Section 33, Subdivision Fourth of Chapter 105 of the Lairs of 1916 as amended; and -lPHEFCTAS, after due consideration, this Board finds it desirable to grant said petition for the correction of said Assessment Roll in certain particulars; ITOW, THFIEFORE, BE IT RESOLTTED, that said Assessment Roll be corrected to show the following: Under Paragraph 4 of the above mentioned section property now appearing on the roll as follo-ws Sec. A letter dated Larch 26, 1935, -.7as received from Hr. H. C'a-rl Holpp of 20 Spruce road, concerning the condition of the roadvtay and other matters. The letter was referred to the Clerk for reply and the matter of the condition of the roadv?ay was referred to the Superintendent of High- stay s. I,?r. Brennan reported that the Tmvrn had been notified by Eir. Frank Eggers, Larchmont postmaster, that a truck operated by the Tovm garbage con- tractor had knocked over a mail box at the corner of Ellsworth Road and Stoneyside Drive and that a vroman automobilist had knoc''ked over another box at ':'Feaver Street and Palmer Avenue. This matter was referred to Hr. Brennan. 7r. IFeginniss reported that Patrolman Paul Euiler had been duly - appointed Lieutenant of Police as a result of standing first in the com- petitive civil service examination held for that position and that he was � g now in charge of the department pending she selection of a chief, for rahich competitive exar?inaticns ;=till also be held. A letter dated Lrarch 28, was received from Barney Epstein of iamaroneck requesting the Town Board to support a plan for tax exemption for new residential construction. The matter was ordered laid over. �� Gh The Clerk reported that he had been served with the complaint in the matter of Elizabeth R. I!Ionahan against the Town of I: ama-roneck seeking 050 ,000 damages because of the death of her son, Thomas F. Yonahan, occasioned by an accident on Palmer Avenue near the intersection of leaver .Street on October 27, 1934® He stated that he had forwarded this complaint to the Town Attorney without first presenting it to the Town Board. The action of the Clerk as above set forth was unanimously approved® At 9 :50 P. K. the Board unanimously resolved to adjourn. Town Clerk I I
