The meeting wa:s called to order by Supervisor McCulloch at
- 32 :15 P, IL
Present - Supervisor YCCulloch
Councilmen Bates, Griffin, Iieginnies
Absent: Councilman Brennan

ney Delius and Silas S. Clark, Sper. ia l Counsel to the Toren of ITa:m Prone ck�
The Supervisor informed the Board that it 1107T seemed unlikely
that Yaple Gardens, Ina. and/or Joseph Iulercadante would be able to
accept the offer made by the Town of Mamaroneck as set forth in the
resolut-".on adopted by the Token Board at its meeting on December 26 , 1934,
concerning the payment of taxes owed. by PSaple Gardens , Inc, and/or IIr,.
Me-rcadante. He recommended that the resolution passed by the To,,ma Board
on December 26th be rescinded.
To,,=.r Attorney Delius informed the Board that he had been in
consultation with Hr. Yercadante and his representatives and that he
believed it unlikely that the taxes would be paid in accordance v�Tit'h
the offer. He recommended rescinding the resolution adopted on. Decem-
ber 26th.
I(r. Silas S. Clark, Special Counsel to the Town of 11amaroneck.
likewise told the To?-,m Board of his efforts to obtain payment of these
taxes and of his failure to do so, stating that PIr. Mercadante now
appeared unwilling to accept the offer..
The Board discussed the matter at some length.
On motion by 1,Ir. %ieginniss , seconded by Mr. Griffin, it was
upon roll call unanimously
"L'TSOLV4'DE that the resolution passed by this Hoard
at its meeting on December 26. 1934, concerning the
claim of Ilaple Gardens , Inc.. in the total araount
of 7239062. 50 and the -payment of certain taxes and/or
the redemption of certain tax liens by ITapls Gardens,
Inc.. and/or Joseph Yercad.ante be and. it hereby is
rescinded, such rescission to take effect as of the
close of business January 15, 19359 unless in the
meantime Ka-,cle Gardens . Inc, and,/or Joseph± Yercadante
shall have complied with all the terms and conditions
of said resolution adopted by this Board at its meeting
on December 26, 1934.
Receiver of Taxes Dillon addressed the Board to request it to
cancel a tax lien in the amount of $6.. 15 mimed by the To7n , being the
Toirm tax of 1922, sale of 1923, on Section 6, Block 50, Lot 25. He
explained the circumstances in this ease.
On motion by 1:2r. Neginniss, seconded by Mr. Bates, it was
unanimously
RESOLVED, WHITR"TAS, this Board is informed by the
Receiver of Taxes and Assessments that the To*rm is
the holder of a taY lien on what was formerly de-
scribed on the assessment map as Section 6, Block 50,
Lot 25, representing the 1922 Tolrrn tax, sale of 1923 ;
and
