The meeting was called to order by Supervisor YcCulloch at
8:05 P. Ir,
Present: Supervisor IlcCulloch
Councilman Bates, Brennan, Griffin, F, eginniss
The presence was also noted of Town Attorney Delius, Iiiss
Alice E. 'Nheelack, Deputy Town Clerk, and Lorton P. Sarfaty, Building
Inspector.
The minutes of the meetings of July 18th and July 23rd were
approved as printed.
The Supervisor stated that in accordance with public notice
duly given by advertisement it would be in order for the Board to open
the bids called for for the purpose of supplying and installing a
modern heating system in the Town Hall which is at present being used
as the 'nea.dcuarters of the Welfare Department. He suggested that the
cost of this work be not allocated to any particular budget item but
that it be left as an "open item" until the end of the year when the
Board would be in a, better position to determine whethar the entire
expense should be borne by the Department of Public Vielfa.re , or whether
a part of the expense should be allocated to another department. The
Board concurred in his opinion.
The Supervisor requested Er-- Griffin as Chairman; of Public
Welfare to open the bids. Hr. Griffin opened the bids which showed
as follows :

In addition to the above bids the three following companies
submitted estimates of the cost of supplying (trithout installing) the
heating units, viz: Delco Company, Fitzgibbons Boiling Company, and
the Holland Furnace Company.
On motion by Fir. Yeginniss, seconded. by Mr. Bates , it was
unanimously
RESOLVED that the bids above received be referred to
Hr. Griffin and Hr. Sarfaty for tabulation and report-
back to this Board.
Hr. Brennan reported on highway matters. He stated that work
had been completed on the present program of surfacing the streets
in the Bonnie Briar Section of Rouken Glen. He also stated that street
lights heretofore recuested by Fair. Hoody had been installed in this
section and were now in operation.
Yr. Bates reported on sewer matters. He stated that he had
conferred with the Westchester County Emergency Work Bureau and that
he expected work on the Knollwood Drive sever project to be started
on August 27th.
He also reported that a claim in the amount of $10 had been
received from Firs. R, S. Hatzel, 206 Iliurray Avenue , Larchmont, for
expenses a-lleged to have been incurred by her by reason of a faulty
drainage condition for which she claimed the Town eras responsible.

Vr. Bates stated that the Board of Education might be liable in this
connection and said he would take the matter up with it.
Hr. Griffin reported on '+Yelfare matters, stating that the
repainting of the Town Hall as a work relief project would commence ,
he hoped, during the following week.
He also reported on Park matters and warmly commended the
Board of Park Commissioners of Park District Igo I for the splendid
plans which the Board had prepared for the cowing year, particularly
- in connection with the proposed improvement of the Weaver Street
Chapel property®
Yr. Hegi.nniss reported on finances. He stated that the Town
owes to the County of Westchester the sum of only $70 ,000 as the
balance of the 1934 State and County tax levy and that this sum is not
due and payable until October.
He also reported that the sum of $115,905.15 had been ex-
pended during the first seven months of this year for Welfare purposes.
He also presented for the first time a new type of financial
statement, namely , a nom-parative consolidated balance sheet as of
December 31, 1933 and June 30 , 1934.
The Supervisor presented his financial statements for the
month of July, 1934, which were ordered placed on file.
On motion of Councilman Griffin, seconded by Councilman
Bates, the following resolution was adopted:
TH^REAS, the Town Board heretofore authorized the
issuance of a Sewer Certificate of Indebtedness in the
amount of $42,500 against total authorized expenditure
for contract r24 in Sewer District No. I which Certifscrate
known as S F-1, was issued and delivered to Sewer District
Yo. 1 and became payable on the first day of July, 1934,
and
WHEREAS, by resolution duly adopted at a Special meeting
of the Town Board held July 23rd, 1934, the Supervisor
new certificate at
was authorized to issue a c e in similar
amount to mature July 1, 1935, and which certificate was
to be known as S F-4, and
WHI'REAS, it appears that Sewer District Yo. 1 has to its
credit from funds collected from the County of Westchester
for the sale of certain trunk sewer lines in the Town c
Kamaroneck, a balance in excess of 4429500 which is avail-
able for the payment of capital obligations against Sewer
District ?o. 1 for which reason it is now deemed advisable
to cancel the said certificate for $42,5009
110W9 TFIEREFORE, BE IT RESOLVED, that the resolution adopted
July 23, 1934, authorizing the issuance of certificate S F-4
for $42, 500 in renewal of certificate S F-1 be rescinded;
and be it
FURTHER RESOLVED, that certificate S F-4 for $429500
dated July 1, 193' now held by Sewer District Igo. 19
be cancelled and that the liability of said certificate
against Sewer District No. 1 be considered as paid, inasmuch
as the proceeds of this certificate were used in the payment
of obligations against Sewer District No. 1.
On motion of Councilman Bates, seconded by Councilman Griffin,
the fol7_oaring resolution was adopted :
'dH7R=nS, an action was heretofore commenced by Samuel
Weinberg against Daniel F. Callahan and others to
foreclose tax liens purchased by Weinberg against property
in the Town of 11araaroneek known as Lots 3g 13, 16 and 11,
Section 9 , Block 129 and

t?d"=RFAS, an answer was interposed by certain defendants
in said action claiming that the sale of tax liens held
by the Tovm, through which the said Weinberg purchased his
liens, was invalid, by reason of which the Town refunded to
Weinberg the amount paid by him to the Town for the purchase
of said liens, which wras done pursuant to a resolution passed
by the Town Board on June 6 , 1934'
WTEREAS, thereafter the defendants moved for the discontinu-
ance of the action, -,which motion was granted with $25. costs
and a judgment entered for the said $25. on the 29th of
-- June , 19349
NOW9 T=,,FCCRF, , BE IT RESOLVED, that the amount of said
judgment in the sum of $25. be paid to said Samuel Weinberg
to be by him applied in satisfaction of judgment obtained.
On motion of Councilman I,`eginniss, seconded by Councilman
Bates, the following resolution was adopted:
kIIIEREAS, it appears to the satisfaction of this Board that
on April 30th, 1928, Ben M orgolius paid. to the Receiver of
Taxes an amount represented by his check sufficient to
cover the taxes and/or tax liens trflnich were sold to the
Town of Hamaroneck on ISay 25, 1927 , affecting Lots 34, 35,
36 and 37 in Section 8, Block 86 , and
WHERREAS, the amount so paid by Ben 21orgolius was credited
upon the books of the Receiver of Taxes against a payment
of the taxes or tax liens upon Lots 35, 36 , 37 and 38 in
said Section 8, Block 86, and
MHTRFTAS, it appears that the credit as against Lot 38 is
erroneous and was done by inadvertance and that the taxes
on said Lot 38 were not in fact paid, but that the amount
paid by said. Ben I1orgolius was intended and did include
the tax against Lot 34,
NOW, TF_7iHHFOR7, BE IT RESOLVED, that the Receiver of Taxes
be authorized and directed to correct his records so as
to shocr the payment of the taxes and/or tax liens for the
year 1926 which were purchased by the Town on May 25, 1927,
as against Lot 34, Section 8, Block 86 , and so as to shown
unpaid the amount of the taxes and/or tax liens for said
year as against Lot 38, in Section 8, Block 86 and that he
proceed fort'lawith to collect taxes against Lot 38 in
Section 8, Block 86.
The Town Attorney advised the Board that it %would be in
order for the Board to designate the newspaper or newspapers in which
to publish the notice required by statute of the collection of the
1934 School taxes.
Chw motion by 1,r. Griffin, seconded by ISr. Bates , it was
unanimously
RESOZVED, that this Board do and it hereby does designate
the Daily Times , a daily newspaper published in the Village
and Tmm of 17amaroneck, and the Larchmont Times , a weekly
newspaper published in the Village of Larehrnont, Town of
liaraaroneck, for the purpose of publishing the notice of the
collection of 1934 School taxes as required by law; and

FURTi^R RESOLVED that said notice be published in said
Daily Times on Wednesday, August 22, 19349 and in said
Larchmont Times on Thursday, August 23 , 1934.
A letter dated July 5, 1934, was received from Joseph F. Curren,
Chairman of the Board of Police Commissioners of the Town of Iarna-roneck ,
tendering his resignation as a member of said Board, to take effect
immediately, on the grounds that he had been appointed counsel of the
Board of Trustees of Union Free School District 17o. 1.
On motion by Mr. IJeginniss4 seconded by Yr. Bates, it ryas
unanimously
RESOLVED that the resignation of Joseph F. Curren as a
member of the Board of Police Commissioners of the Toren
of Ifamaroneck be and it hereby is accepted with regret;
and be it
FURTH= RESOLVED that the thanks of the Toren Board be
and they hereby are extended to Ur. Curren for his
splendid and conscientious services to the Torrn of
Mamaroneck as a Police Cormiissioner and for the rrhole-
hearted cooperation which he has always e tended to this
-- Board and to all associated with him; and be it
FURTHER RESOLVED that the Toren Clerk send. a. copy of this
resolution to 1?r. Curren.,
The Supervisor presented the name of William Preston Palmer,
277 Rockingstone Avenue , Larchmont, for appointment to the Board of
Police Coraissicners to fill the vacancy created by the resignation
of LTr. Curren.
On motion by ivr. Bates, seconded by Yr. Brennan, it was
unanimously
RESOLVED that Lir. William Preston Palmer of 277 Rockingstone
Avenue , archmont, be and he hereby is appointed a rnember
of the Board of Police Corunissione-rs of the Town of Kamaroneck
to fill the vacancy created by the resignation of Ffr. Joseph
F. Curren, and to serve at the pleasure of the Town. Board.
The Supervisor infonmed. the Board that he had. discussed vJith
the Westchester Lighting Company the matter of new rates for street
lighting. He stated that at the time the Lighting Company had agreed
with other municipalities in the County of Tiestehester upon new rates,
a year or- so agog the Ton of LTamaroneck had not been a, party to this
agreement, because it was at that time conducting separate negotiations
rith the Lighting Company, which negotiations have never been completed
He stated further that the Lighting Company had prepared a
proposed new schedule of rates and t ]?G of service , which schedule he
submitted for the consideration of t e Board.
After discussion the schedule submitted by the Supervisor
was referred to the Tovm Attorney and IIr. Brennan for investigation
and _report back to the Board.
A letter dated August 21st was received from Building
Inspector Sarfaty recommending that the Town Board adopt an ordinance
covering the matter of the installation of oil burning equipment. The
letter was referred to the special committee heretofore appointed to
draft a code of ordinances for the Toren.
On motion duly made and seconded it Baas unanimously
RESOLVED that Ilr. Meginniss be added to the special
committee heretofore appointed to draft a code of
ordinances for the Town.
The Deputy Town Clerk stated that the :Board was meeting
today, Tuesday, August 214 1934, being the third Tuesday in August,
in accordance vrith the provisions of Article 66 of the Election Law
for the purpose of designating the place in each election district
in the Town at which the meetings for the registration of voters
and elections and primaries shall be held in the year following the
ensuing first d_ay of October.
On motion duly made and seconded, it was unanimously
RESOLVED that in accordance with the provisions of
Article 66 of the Election Law, being Chapter 17 of
the Consolidated Lams of the State of 1'ew York as
amended, the Ton Board of the Toren of L'iamaroneck hereby
designates the place in each election district in the T08n!
at which the meetings for the registration of voters and
elections and primaries shall be held in the year following
the ensuing first day of October4

The Board thereupon proceeded to sign a certificate to the
above effect.
The Torn Attorney informed the Board that he had received
from Silas S. Clark, the Special Attorney to the Town in the matter
of collecting delinquent taxes, an additional list of Pro-, F.rty owners
together trrith a description of the property o?r. ed by them;who have
paid. no attention to communications in regard to Paying taxes open on
these Pro-oerties, thereby indicating their lack of interest in this
matter. He recommended that these names be added to the list of names
included in the resolution adopted by this Board on June 20, 1934,
whir-- resolution Provided that foreclosure proceedings be instituted

against such of the property owners as Lir.. Clerk deemed advisable.

On motion duly made and seconded it ,Tas unEnimously
RESOLVED that the resolution ado-oted by this Board at
its meeting on June 20, 1934, authorizing the instituting
of foreclosure proceedings against such of the property
ovTiers named in said resolution as Special Attorney
Silas S. Clark deemed advisable , be and, it hereby is
amended by including in the list of property o.rrners
named in said -resolution the following names of property

-- A,M BE IT, FURTHER RESOLVED, that except as 'ne-reinabove
set forth the resolution adopted by this Board at its
meeting on June 20, 1934, be and it hereby is in all
res-oects ratified, approved, and confirmed.
A letter dated August 16th was received from the Board of
Park Commissioners requesting the approval of the Tovrn Board of a
transfer of the sun of X100 in the budget of the Park Department from
the item "Commodities -- Soil, seeds, fertilizer" to the item "Commodi-
ties -- Puchase of equipment, implements and supplies. " The matter was
referred to the Gomntroller with power.
A report was received. from the Building Inspector snowing
the activities of the Building Department for the period January 19
1934 to July 31, 1934 inclusive. The report was ordered placed on
file.
The re_nort of the Town Clerk for the month of July, 1934,
was received and placed on file.
The report of the 'Welfare officer for the month of July,
1934, v,as received. and placed on file.
A letter dated August 5th was received from %,iinnie E. Winant,
66 Garden Road, requesting the installation of a street light in front

of her home. The matter was referred to I~ r, Brennan.
A letter dated August 3rd was received from R. B. ZcFalls
and Company , Inc. , insurance agents for Llaxarell S. IPannes, ovraer of
_property on Fenimore Road near Cornell Street not far from the boundary
line of the Village of Scarsdale. The letter requested that the Tovm
of Mamaroneck execute t�rith the Village of Scarsdale a contract covering
a hydrant located in Scarsdale near the Eannes property, whereby the
Town of L%amaroneck would be granted the privilege of using this hydrant
for fire protection purposes. The matter was referred to the To^m
Attorney.
-A Letter dated July 20th was received from Bassi Freres, Inc.
of Larchmort In -regard to a ditch near their property constituting an
alleged nuisance. The matter was referred to-11r. Brennan.
n letter dated July 30th was received from the Board of
Park commissioners setting forth an estimate of the cost of improving
the 'a c:7,er Street Chapsl property. The matter v,as referred to
Iur� Ileginn ss for consideration in connection vdith the 1935 budget.
A report dated. July 25th was received from Public Welfare
Officer BcVinne regarding a water bill in the amount o= �28.Or sub-
mitted by Ivira J> Bendien, which matter had been referred to the Public
-
Welfare Officer at the meeting of the Tovan Board on June 29th. Hr.
DeV'innc s report denied any liability on the part of the Tovan in resneot
to this claim.
On motion duly made and seconded the re-port of the Public
Welfare Officer was unanimously adopted and the Clerk directed to
notify 11r. Bendien of the Boa'rd 's action.
At 9 :55 P. IL the Board unanimously resolved to adjourn.
