At the Town Offices, 118 West Boston Post Road, Mamaroneck, N.Y.
The meeting was called to order by Supervisor EcCulloch
at 5:10 P. H.
-- Present : Supervisor McCulloch
Councilmen Bates,Brennan, Griffin and Meginniss
The presence was also noted of Kiss Alice E. Wheelock,
Deputy Town Clerk, and C. D. DeVinne, Public Welfare Officer.
Upon motion by Mr. Bates , seconded by Hr. Brennan, it was
unanimously
RESOLVED that no meeting be held by this Board at its
usual time , the first Wednesday in July, said day being
the Fourth of July and a legal holiday; and be it
FURTHER RESOLVED that the next regular meeting of the
Board be held on Wednesday, July 18th, at the usual
hour and place.
The Supervisor informed the Board that an amendment to the
General Tax Law passed at the 1934 session of the Legislature and
which with the approval of the Governor became Chapter 313 of the
Laws of 1934 on April 279 1934, permitted the Town Board to authorize
the Receiver of Taxes to collect the 1934 School taxes in partial
payments. He recommended that the Board so act.
Upon motion by liar. Meginniss, seconded by Mr. Bates, it
was unanimously
RESOLVED pursuant to Section 96a of Chapter 62 of the
Laws of 1909 as amended, that the Town Board of the Town
of Mamaroneck does hereby authorize and empower the
Receiver of Taxes of the Town of Mamaroneck to collect
the 1934 taxes for the Union Free School District #1 of
the Town of Mamaroneck and/or assessments which become
a lien for school district purposes on September 1, 1934,
and which become due and payable on September 1, 1934,
pursuant to the provisions of Chapter 105 of the Laws
of 1916 as amended, known as the "Westchester County
Tax Act", in partial payments and to accept from any
taxpayer the aforesaid 1934 School taxes and/or assess-
ments so levied for the year 1934, in two partial pay-
ments and/or installments, consisting of a first
installment of fifty per centum and a second installment
of fifty per centum, in the following manner:
The first installment of fifty per centum of such
taxes and/or assessments shall be paid at the time and in
the manner and subject to the same penalties specified
and provided in Section 18 of Chapter 105 of the Laws of
1916, as amended, for the annual collection of School
taxes and, providing the first installment shall have
been so paid as hereinabove provided or shall be paid
- - at the same time , the second installment of fifty per
centum of such taxes and/or assessments shall be paid

penalties on the total unpaid balance as spe cified and
provided in said section 18 of Chapter 105 of the Laws
of 1916.
Nothing herein contained shall prevent the payment
of the second installment of the aforesaid 1934 School
taxes and/or assessments at any time prior to January 319
1935.

Nothing herein contained shall prevent the payment
of any installment of such taxes and/or assessments after
the time limited herein for the payment of installments
without penalties subject to the penalties provided in
said Section 18 of such Chapter 105 of the Laws of 1916.
FURTHER RESOLVED that the acceptance of any such partial
and/or installment payments of such 1934 School taxes as
herein provided shall not be deemed to affect in any
manner any right of the Town of Mamaroneck to enforce col-
lection of the unpaid balances of taxes and/or assessments
which may remain due and owing to said Town in any general
or special Act but such rights and powers shall remain
-- in full force and effect to enforce collection of the
unpaid balance of such taxes or tax liens together with
interest s P g
penalties and other lawful charges.
The Board unofficially expressed itself in favor of
permitting the Receiver of Taxes to accept partial payments for or
on-account-of any tax liens held by the Town but took no record
vote thereon.
The Supervisor informed the Board that following informal
discussions had by him with various members of the Board he was
negotiating with the Village of Mamaroneck in an effort to obtain
permission to dump garbage , swill and refuse from the Unincorporated
Section of the Town on the dump maintained by the Village on Harbor
Island; that he had conferred with Village authorities and at
their request an agreement covering this matter had been preareds

in which agreement, among other things , the Town undertakes to
supply such clean fill as may be necessary to cover the garbage,ete.
dumped by the Town. He requested that the Board approve of his
action in this matter and of the proposed agreement which he pro-
ceeded to read to the Board.
Upon motion by Mr. Griffin, seconded by Par. Bates, it
-- was unanimously
RESOLVED that the action of the Supervisor as above
described in negotiating with the Village of Mamaroneck '
for permission to use the dump on Harbor Island for the
dumping of garbage , swill and refuse from the Unincorporated
Section of the Town be and it hereby is approved; and
be it
FURTI-TER RESOLVED that the proposed agreement between the
Village of 'Mamaroneck and the Town of Mamaroneck covering
this matter and running until October 11,, 1934, as presented
by the Supervisor be and it hereby is approved.
The Supervisor informed the Board that certain changes in
the matter of Workmen 's Compensation and Employers ' Liability
insurance covering persons engaged in Emergency Work Relief projects
had been instituted by the State Temporary Emergency Relief Admini-
stration. He recommended that these changes be investigated
thoroughly by the Town in order that the duties and obligations
of the Town in respect to such insurance be made perfectly clear.
Upon motion duly made and seconded it was unanimously
RESOLVED that this matter be referred to Mr. Brennan
and Mr. C. D. DeVinne for investigation and report back
to the Board.
The Supervisor stated to the Board that he had been in
consultation with the County Emergency Work Bureau and that the
Bureau was willing to reconsider the Tax Plops Project and the Building
Cubage Project in the Town of 'Mamaroneck as a work relief measure.
These projects, he said, had previously been under consideration
by the County Bureau but had not been approved. He pointed out that
the County will pay for all labor costs, provided the Town pays for
the cost of supervision, supplies, etc.

The Supervisor presented a letter dated June 29th from
Engineer A. J. Foote submitting a proposition to the Town Board to
cover the cost of supervision and also of materials, equipment and
supplies needed in connection with these projects.
Upon motion by Mr. Bates, seconded by Mr. Griffin, it was
unanimously
RESCU ED that subject to the approval of the Tax Maps and
Building Cubage projects by the County Emergency Work
Bureau, 'Engineer A. S. Foote be and he hereby is appointed
supervisor of these projects in accordance with the terms
and conditions of his letter dated June 29th addressed to
the Supervisor; and be it
FURTHER RESOLVED that Mr. Foote furnish such equipment,
office supplies , materials, etc. as may be required, like-
wise in accordance with the terms of said letter dated
June 29th,;' and be it
FURTHER RESOLVED that the Supervisor be and he hereby is
authorized to contact the mayors of the Villages of
Larchmont and Mamaroneck with a view to setting up similar
projects in their respective communities.
A letter dated June 27th was received from the Village
of Mamaroneck giving notice that the Board of Engineers for Rivers
and Harbors is halding a hearing on July 17th for the further
consideration of the proposed improvement of Mamaroneck Harbor and
requesting that, if possible , Supervisor McCulloch represent the
Town of Mamaroneck at that hearing.
Upon motion by Mr. Bates, seconded by Mr. Brennan, it was
unanimously
RESOLVED that on the request of the Village of Mamaroneck
Supervisor McCulloch be and he hereby is designated to be
the representative of this Board at the hearing to be held
at v7ashington, D. C. on July 17th by and before the Board
of Engineers E in rs for Rivers and Harbors for the further

consideration of the proposed improvement of Mamaroneck
Harbor; and be it
FURTHER RESOLVED that Mr. McCulloch 's proper and necessary
expenses in connection with attending this hearing be and
they hereby are made a proper Town charge.
A letter dated June 21st was received from Building
Inspector Sarfaty giving an estimate of the cost of labor and materiah
required to repaint the exterior of the Town Hall now occupied by
the Welfare Department. The cost of materials was given as $225
and the amount of time required for labor was given as 1200 hours
with no estimate of the cash value of this time.
Upon motion by Mr. Griffin, seconded by Mr. Bates , it was
unanimously
RESOLVED that the repainting of the Town Hall in accordance
with the estimate of Building Inspector Sarfaty, as set
forth above , be and it hereby is authorized and approved;
and be it

FURTHER RESOLVED that the cost of the materials of this
project be charged to the appropriation account of the
Department of Public Welfare , subdivision "Relief Program",
subject to the approval of this project by the Temporary
Emergency Relief Administration as a work relief project
whereby the entire labor cost will be borne by the
Temporary Emergency Relief Administration.
Three letters, as follows: (1) dated June 8th from
Dominic T. IaIartino, 767 Forest Avenue , Larchmont; (2) dated
June lath from G. D. Schor, Sr. , 765 Forest Avenue , Larchmont;
(3) dated June 15th from J. H. Guthrie, 607 Prospect Avenue ,
Hamaroneck, in regard to Lots 64 and 652 Block 16, map of
Colonial Park) were received with reference to a surface water
drain alleged to encroach on the properties of these three letter
writers on and near Forest Avenue. This matter was ordered referred
to Town Attorney Delius.
A letter dated Tune 12th was received from the Board of
Park Commissioners requesting the approval of the Town Board for a
transfer in the budget items of the Park Department for the year
1934.
Upon motion by Yr. Yleginniss, seconded by Mr. Brennan,
it was unanimously
RESOLVED that in accordance with the request of the Board
of Park Commissioners the sum of $100 be and it hereby is
transferred in the 1934 Park Department budget appropria-
tion from "Commodities — Soil, Seed, fertilizer" to
"Current Charges — Compensation and Liability" thereby
reducing the first mentioned item from $600 to $500 and
increasing the second mentioned item from $260 to $360.
A letter dated June 18th was received from George J. Mulcahy,
180 Palmer Avenue, Larchmont, in regard to the sale of confections by
the "Good Humor" representative at the corner of cleaver Street and
Palmer Avenue adjacent to his residence. The letter was ordered
referred to the Clerk for reply to Mr. Mulcahy.
An undated letter was received from 11. L. Leone , President
of the Italian American Independent Club of Larchmont, protesting
the steady employment of single men at the Larchmont Station Park.
The letter was ordered referred to the Clerk for reply.
A letter dated June 9th was received from J. Bendien in
regard to a bill in the amount of $28.07 for water used at 35 Fayette I
Street while the premises were rented on the order of the Department
of Public Welfare. The matter was ordered referred to Public Welfare
Officer DeVinne for investigation and report back to the Board.
A letter dated June 17th was received from John H. Irwin
of New York City in regard to his property at the corner of Weaver
Street and a Myrtle Boulevard. The matter was referred to Mr. Brennan

for investigation and report back to the Board.
A letter dated June 26th was received from the Receiver
of Taxes in reference to the 1933 State , County, Town and District
and School. Taxes on Section 8, Block 51, Lots 60 to 69 inclusive ,
setting forth the following statement of facts, viz; prior to the
y 1934 tax sale statements of the unpaid 1933 taxes on these lots had been
prepared showing State , County, Town and District taxes and penalties due in the amount of $54.46 and 1933 School Taxes and penalties due
in the amount of $73.04, that a Home Loan had been granted to the
owner of this property, namely, Ralph Gironda, and that a check had
been received from the Home Owners Loan Corporation in the amount of
$127.50, being the total of the open taxes for the year 19339 but
that this check had been received subsequently to the sale and hence
interest was due on these taxes in the amount of $2. 54. The Receiver
of Taxes recommended waiving this interest on the grounds that an
attempt at collection might imperil the loan from the Home Owners
Loan Corporation.
On motion duly made and seconded it was unanimously

RESOLVED that on the recommendation of the Receiver of
-- Taxes and on the statement of facts as set forth by him
above , this Board do and hereby does agree to the waiving
of the interest in the amount of $2.54 on the 1933 State,
County, Town and District taxes and the 1933 School taxes
on Section 8, Block 519 Lots 60 to 69 inclusive, and be it
FURTHER RESOLVED that the Receiver of Taxes be and he here-
by is authorized, empowered and directed to cancel this
interest. and to mark his books of record accordingly.
Highway Superintendent Itlerola presented to the Board the
annual Agreement for the Expenditure of Highway Moneys for the Year
1934. The agreement included one Special Improvement as follows:
(+A) On the road commencing at boundary line of the Village
and Town of Mamaroneck and leading to north to Griffen Avenue which
constitutes the boundary line of the Town a distance of 1.4 miles
there shall be expended the sum of F12VTIT THOUSAND DOLLARS for the
--- following kind of improvement, type Penetration IEacadam. Width of
surface metal IS' Thickness 3 of lv" Tra-o Rack.
The expenditures as agreed upon are as follows:

On motion gul� made and secQnaed the Board unanimously
approved the agreemen a above presen 'e and each member of the
Board thereupon signed the agreement.
At 7:00 P. I1. the Board unanimously resolved to
adjourn.
