The meeting was called to order by Supervisor McCulloch at
10: 00 A. 191.
Present : Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville, meginniss
Absent : None
The presence was also noted of Town Clerk Payne and Town
Attorney Delius.
Councilman Bates introduced the following resolution:
RESOLUTION AMENDING A RESOLUTION ENTITLED "RESOLUTION
APPROPRIATING TIC SUM OF $100, 000. TO PAY A PORTION OF TIL

TOWN FOR SAID PURPOSE, DETERMINING THE FORM OF SAID BOi�1DS
AND PROVIDING FOR THEIR. SALEP°, ADOPTED BY TEI S BOARD ON
IiiAY 3, 19395 AND CONFIRMI1JG THE A-WARD OF SAID BONDS .
RESOLVED BY THE TOWN BOARD OF THE TO'VVIV OF MAMARONECK,
IN THE COUNTY OF VVESTCHESTER, NEVI YORK, as follows:
Section 1. Sections 1, 2, 3 and 4 of a resolution
entitled: "Resolution appropriating the sum of 4100, 000.
to pay a portion of the cost of public improvement work
relief projects in the Town, authorizing the issuance of
41003000, bonds of the Town for said purpose, determining
the form of said bonds and providing for their sale ". duly
adopted by this Board at a regular meeting held on Niav 3,
1939, are hereby amended to read as follows:
Section 1. The sum of 484,561.83 is hereby
appropriated to pay the portion to be borne by the
Town of public improvement work relief projects in
the Town undertaken through or by the authority of
the ";Yorks Progress Administration of the federal
government; including the cost of furnishing labor,
materials, supplies and equipment for such projects
and incidental expenses in connection therewith, the
said public improvement work relief projects to
include only projects having a period of probable
usefulness of at least ten (10) years, computed from
February 1, 1938 the date of the first indebtedness,
whether temporary or permanent , incurred to finance
any portion of the cost thereof.
Section 2. The sum of 'x;15,438.17 is hereby ap-
propriated to pay the portion to be borne by the
Town of public improvement work relief projects in
the Town undertaken through or by the authority of
the Works Progress Administration of the federal
government, or other work relief authority of the
federal government, including the cost of furnishing
labor, materials, supplies and equipment for such
projects and incidental expenses in connection there-
with, the said public improvement work relief projects
to include only projects having a period of probable
usefulness of at least five ( 5) years, computed from
February 1, 1938, the date of the first indebtedness,
whether temporary or permanent, incurred to finance
any portion of the cost thereof.
Section 3. To meet the appropriation made in
section 1 hereof, bonds of the Town in an aggregate
principal amount notexceeding 4;84,561.83 shall be
issued, and to meet the appropriation made in
section 2 hereof, bonds of the Town in an aggregate
principal amount not exceeding y15,438.17 shall be
issued.
Section 4. Said bonds shall be combined in a
single issue, shall each be designated "General Bond
of 193911 , shall be dated February 1, 1939, and shall.
mature in annual installments of principal as set
forth in the folloAing schedule:

Said bonds shall bear interest at a rate not exceeding
six per centum (6M per annum, payable semi-annually
on the first days of February and August in each year,
to be expressed in a multiple of one-tenth or one-
quarter of one per centum, the exact rate to be deter-
mined by the Supervisor upon receipt of bids, shall be
numbered in order of maturity from 1 to 100, both
inclusive, shall be of the denomination of x'1,000. each,
shall be payable as to both principal and interest in
lawful money of the United States of America, at the
office of the First National Bank of tiount Vernon,
Mount Vernon, New York, or, at the option of the holder,
at the principal office of the Guaranty Trust Company
of New York, in the City, County and State of New York,
shall be coupon bonds, registerable as to principal
and interest , and shall be signed by the Supervisor and
the corporate seal of the Town shall be affixed thereto
and attested by the Town Clerk and the coupons attached
thereto shall be authenticated by the facsimile sig-
nature of the Supervisor. Said bonds shall be issued
pursuant to the following laws of the State of Kew York:
Chapter 782 of the Laws of 1933, as last amended by
Chapter 456 of the Laws of 1939, and the Town Law, con-
stituting Chapter 62, and the General Municipal Law,
constituting Chapter 24, of the Consolidated Laws, as
amended.
Section 2. The said bonds shall be in substantially
the form provided in section 5 of said resolution adopted
May 3, 1939, except that said bonds shall recite that they
are issued pursuant to the laws set forth in section 4 of
said resolution, as hereby amended.
Section 3. The acts of the Supervisor in awarding
said bonds at public sale on MAY 19, 1939 to
A. C. ALLYN and CO1JMPANY, !_NC .
at the price of $100,029.50, said bonds to bear interest
at the rate of one and ninety one-hundredths per centum
(1. 90yo ) per annum, are Hereby in all respects ratified,
approved and confirmed.
On motion of Councilman Bates, seconded by Councilman Griffin,
the foregoing resolution was adopted by the following vote:

The following resolution was offered by Councilman Mandeville
and seconded by Councilman Bates, to-wit:
WHEREAS, on the 19th day of January, 1939, the Town
Board of the Town of Mamaroneck authorized the issuance
of an $8, 100 Certificate of Indebtedness in anticipation
of the issuance of bonds for the purpose of paying one-
-- half of the cost of the purchase of certain land as a
site for the construction of an incineration disposal
plant pursuant to Chapter 430, Laws of 1938, and inci-
dental expenses, and to renew an outstanding certificate
of indebtedness dated 1,1ay 2, 1938 and maturing on
February 2, 1939; and
WHEREAS, said- $58, 100 Certificate of Indebtedness, numbered
L. M. 2, dated February 2, 1939, matures June 1, 1939,
and it is the desire of the Town Board to renew said Certi-
ficate of Indebtedness by the issuance of a new Certificate
of Indebtedness; NO-ID, THEREFORE, BE IT
RESOLVED, that for the purpose of renewing said outstanding
$8,100 Certificate of Indebtedness of said Town, there shall
be issued a Certificate of Indebtedness of said Town in
the principal amount of X8,100, dated June 1, 1939, beari= .
interest at a rate not exceeding five per centum per annum
payable at maturity, and maturing not later than February 1 ,
19409 Said Certificate of Indebtedness shall be signed by
the Supervisor and sealed with the corporate seal of the
Town, attested by the Town Clerk, and shall recite that all
requirements of law have been complied with and shall be
otherwise in such form and contain such recitals as said
officers by executing the same shall determine. Said Certi-
ficate of Indebtedness shall be sold by the Supervisor at
private sale at the lowest rate of interest obtainable at
not less than par.
FURTHER RESOLVED, that the proceeds derived from the sale
of said Certificate of Indebtedness shall be used to pay
said outstanding Certificate of Indebtedness.
FURTHER RESOLVED, that said Certificate of Indebtedness
shall be a general obligation of the Town of Mamaroneck
and the full faith and credit of said Town shall be
pledged for the payment of the principal and interest
thereof.
The question of the adoption of the foregoing resolution
was put to a vote which resulted as follows-

The resolution was thereupon declared duly adopted.
On motion by Councilman Griffin, seconded by Councilman
Mandeville, it was unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign a modification agreement between
the Bonnie Briar Holding Corporation and the County
of 'Westchester relative to building a stone wall
instead of a wire fence on property. of the Bonnie Briar
Country Club, in connection with the widening and
improvement of Weaver Street , State Highway #r19.
