SPECIAL MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK, NEW YORK
( JOINT MEETING INITH THE VILLAGE BOARD OF LARCHMONT)
HELD APRIL 27 , 1940
At the Municipal Hall, Larchmont, New York.
The meeting was called to order by Supervisor McCulloch at
2: 30 P. M.
Present : Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville, Svieginniss
Absent : None
The presence was also noted of Town Clerk Payne, Town Attor-
ney Delius and Town Engineer Foote .
The following resolution was introduced by Councilman
Mandeville , seconded by Councilman Bates:
WHEREAS, the consulting engineer

the Commission and to this Board, that the earth
fill would be preferable and according to his estimate ,
less expensive than the retaining wall; and
WHEREAS, it is necessary to acquire additional land
along the right of way of the New York, New Haven
and Hartford Railroad in the event that earth fill

is used;
NOW, THEREFORE, BE IT
follows :
RESOLVED that this Board approves the acquisition
from the New York, New Haven & Hartford Railroad
Company of a strip of land thirty feet wide and four
hundred forty feet long, along its right of way and
connecting the site with the present dead end of
Byron Place , provided same can be acquired for a sum
not in excess of $2,000. , which additional land it
considers necessary for the proper construction of
the incinerator disposal plant and
FURTHER RESOLVED, that the plans and specifications
be altered so as to eliminate the plan and specifi-
cation for a retaining wall as an alternate to earth
fill south of the upper turning plaza.
A vote taken upon the foregoing resolution resulted as
AYES: Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville , Meginniss
NOES: None
During the discussion on the resolution the members of the
Board reiterated their remarks concerning the site , the same being
included in a resolution adopted at the special meeting of the Town
Board held June 26, 1939.
Following a lengthy discussion on the plans and specifica-
tions , on motion by Councilman Mandeville, seconded by Councilman
Griffin, upon roll call, the following resolution was unanimously
adopted:
WHEREAS, the consulting engineer has presented plans
and specifications for the construction of an incinera-
tion disposal plant; and
WHEREAS, certain plans and specifications have been
approved with some changes by the Larchmont-Mmaroneck
Joint Garbage Disposal Commission;
NOW, THEREFORF, BE IT
RESOLVED that the deatiled plans for the construction
of the garbage disposal incinerator entitled "Larchmont-
Mamaroneck Joint Garbage Disposal Commission Incinerator
Project, Larchmont, New York" and dated April 12, 1940,
by Henry W. Taylor, Consulting Engineer, are hereby ap-
proved with such changes as are necessary to eliminate
any reference to a retaining wall at the south end of
the upper turning plaza and to call for earth fill in
the construction of this upper turning plaza.
FURTHER RESOLVED, that the specifications be approved
with the following changes, additions and. amendments:
(1) Page 2, section 1 General Description.
Eliminate any reference to Alternate No. 2 so far as
it relates to a retaining wall for the upper turning
plaza.
(2) Page 7, section 14 Detailed Specifications . The
specifications are to be completed by inserting the
amount of material to be excavated, in cubic yards and
the amount of top soil to be imported, in cubic yards.
( 3) Page 43-a, Eliminate alternate No. 2 - "Retaining
Wall".
FURTPTE R RESOLVED that this Board approve the following
changes, additions and amendments in the Information to
Bidders and the proposed Contract;
Information to Bidders, page 3, section 12 "State Laws
and Regulations". This section to include a reference
to Section 220-e of the Labor Law of the State of New
York.
Information to Bidders, page 3, section 13 "Lowest
Qualified Bidder". This paragraph to be re-worded
so as to allow the Commission, in its discretion, to
accept any bid which it considers for its best interests
and without regard to which bid is lowest.
Information to Bidders, page 3, section 14 "Time for
Completion". The time for completion is to be stated
to be seven months or two hundred ten consecutive
calendar days .
CONTRACT , page 5, section 11.2 Contractor' s Insurance.
(b) Public liability and property damage insurance .
The contract to be completed by including such amount
of public liability and property damage insurance as
the Commission shall decide.
CONTRACT, page 6, section 11. 5 Wage Rates.
The contract to be completed by including the list
of occupations and rate of wage per hour, certified
by the Labor Department of the State of New York for
all persons to be employed.
CONTRACT to contain provision that the contractor
agrees pursuant to Section 220-e of the 'Labor Law
not to discriminate against citizens of New York State
on account of race or color.

During the discussion on the foregoing resolution Council-
man Meginniss asked Mr. Taylor if to his knowledge the same type of
lift or convever from the platform to the hoppers, as shown on the
plan, had ever been used before .
Mr. Taylor replied that it had not been used before .
Mr. Meginniss stated that in voting in favor of the plans
he was doing so on the recommendation of the engineers.
At 3:45 P. M. the Board unanimously resolved to adjourn.
