REGULAR MEETING OF THE TOWN BOARD
TOWN OF MAMARONECK NEW YORK
HELD MARCH 6, 1940
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N.Y.
The meetin was called to order by Supervisor McCullcch
at 8:00 P.M.
Present : Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville
Absent : Councilman Meginniss
The presece was also noted of Town Clerk Payne, Town Attor-
ney Delius and Town Engineer Foote .
The minutes of the meetings of February 7 and February 20,
1940 were approved as presented
The Supervisor suggested that the meeting proceed with
the reports of committees.
Councilman Mandeville reported. that the Highway Department
was busy clearing the Streets of trees and branches as a result of
the heavy sleet and wind storm which swept this area during the past
three days. He commended the department for its work during the storm.
The Supervisor stated that nothing like it had been exper-
ienced in this section in years . Wires were down, leaving large sec-
tions without light and heat . Ice ladened trees and branches blocked
highways and the property loss was very high.
All members of the Board Joined in to praise the following
departments of the town : highways, sewers and drains , fire, police
and park. They alI directed the Town Clerk to write letters to each
expressing, the appreciation of the Board.
Councilman Bates stated that there was nothing farther to
report Of the departmentt for sewers and drains.
Councilman Griffin stated that there was nothing definite
to reoort for the Park Department other than the good work done during
the storm. He added that no recent meeting of the Park Commssioners
had been held .
e presented the report of the Departrrent of Public Welfare
of the To,Tn for the month of February , 1940 and cornpared same with
the report for February, 1939 as follows: case load this year, 430,
last year, 386: individuals this year, 1790, last year, 1580; total re-
lief this years $18,655.23 last year, $15,895. 33; average cost per
case $43. 33 this year, last year, $41 .13, average cost per individual,
$10.42 this year, last year, $10.06; average cost per indivdual per
day this year , $.365, last year $.377
On motion by Councilman Griffin, seconded by Councilman
Bates, it was unanimously
RESOLVED, that the Receiver oi Taxes and Assessments
be and ne hereby is authorized, empowered and directed
to accept payment of the following taxes on the follow-
ing described prorerty, the liens for which are held
the Town, in the face amount of the liens, provided
payment is made ovithin thirty days :

Town Attorney Delius recommended approval of the public
official bond naming Rufus K. Allerton, Treasurer of the Police
Pension Fund, as principal .
On motion by Councilman Mandeville, seconded by Councilman
Bates it was unanimously
RESOLVED , that Globe Indemnity Company Bond
No. A305617 in the renal sum, of $2 , 500. 00, naming
Rufus K. Allerton, Treasurer of the Police Pension
"Fund of the Town of Mamaroneck, as principal, be
and it hereby is approved.
Councilman Griffin introduced the following resolution:
RESOLUTION APPROPRIATING THE SUM, OF $32, 000 TO PAY
A PORTTOD OF THE COST OF PUBLIC IMPROVEMENT WORK RELIEF
PROJECTS IN THE TOWN OF MAMARONECK IN THE COUNTY
$32,000 BONDS OF THE TOWN OF MAMARONECK FOR SAID PURPOSE
RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK
IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows :

Section 1, The sum of $32,000 is hereby appropriated
to pay the portion to be borne by the Town of public
improvement work relief projects in the Tom undertaken
through or by the authority of the works Progress Ad-
ministration of the federal government , or other work re-
lief authority of the federal government , including the
cost of furnishing labor, materials, supplies and equip
ment for such rcrolects and incidental expenses in connec-
-ion therewith, the said public improvement work relief
Projects to include only projects having, a period of pro-
bable userulness of at least ten. (10) years, computed from
March 6, 1940, the date of the adoption of this resolution
and no indebtedness , whether temporary or, permanent, has
been incurred prior to said date to finance any portion
of the cost thereof. To meet said appropriation, bonds of
the Town in an aggregate principal amount not exceeding
$32, 000 shall be issued.
Section 2. Said bonds shall be dated fviarch 1, 1941,
shall mature in annual installments of principal, shall
bear interest at a rate not exceeding six ,per centum ( 6jo )
per annum, payable semi-arunually on the first days of
Diarch. and September in each year, shall be numbered, shall
be in such form and of such denomination, shall be payable
at such place or places, in such specie or other currency,
and shall be sold at public sale in such manner and on
such terms , but for not less than their par value , as shall
hereafter be determined. by subsequent resolution or resolu-
tions of this Board.
Section 3. The faith and credit of said To.vn shall
be and are hereby pledged for the punctual patent of
the principal of and interest on said bonds, and a tax
shall be levied annually on all of the taxable property
in said Town in an amount sufficient to pay tile principal
of and interest on said bonds as the same shall become due .

Section 4. This resolution shall take effect
immediately.

Council.nan Griffin introduced the following preamble and
resolution-
WHEREAS, a resolution entitled: "Resolution appropriating
the sum of $32, 000 to parr a portion of the cost of public
improvement work relief projects in the Town and authori-
zing the issuance of $32,000 bonds of the Town of aamaro-
neck for said purpose ", adopted March 6, 1940, has become
effective . Now; therefore , be it
RESOLVED BY T-HE TOMI''d BOARD OF THE TOWN OF MAMARONECK
IN THE COUNTY OF WESTCHESTER, HEREBY, as follows:
Section 1. For the purpose of temporarily financing
the cost of permanent improvements provided for in said
resolution; in anticipation of the issuance of bonds, the
Supervisor is hereby authorized to issue a Certificate of
Indebtedness of the Town of Mamaroneck in an aggregate
principal amount not exceeding 32,000. Said Certificate
shall be designated "Works Project Certificate of Indebted-
ness".
Section 2. The following matters in connection with
said Certificate are hereby deteriainedt

Denomination- 532,000
Number: A. P . A. #17
Form: Substantially in accordance with resolution
adopted October 4, 1939.
Place of payment :
The Supervisor is hereby authorized to determine all
matters in connection with said. Certificate of Indebted-
ness , the determination of which is not provided, for by
this or saoseauent resolutions, and his signature upon
said Certificate small be conclusive as to such deter-
minations . Said Certificate shall be signed by the
Supervisor, shall have the corporate seal of the Town
affixed thereto and attested by the Town Clerk. The
Supervisor is hereby authorized to sell said Certificate
at public sale or private sale at not less than par and
to fix the interest rate thereof at not exceeding six
per centum (61 ) per annum, and to deliver same to the
purchaser upon receipt of the purchase price, plus
accrued interest from the date of the Certificate to tine
date of delivery.
Section 3. Any instrument issued pursuant to this
resolution shall be a general obligation. of the Town of
Mamaroneck, and the faith and credit of the Town are
hereby pledged for the puntual payment of the principal
of and interest on said obligation, and unless otherwise
paid or paytment provided for, a tax sufficient to provide
for the payment thereof shall be levied and collected.
Section 4. This resolution shall take effect
immediately.

Town Attorney Delius recommended the foliowing resolution
which was on motion by Councilman Griffin, seconded by Councilman.
Bates, upon roll call, unanimously adopted:
WHEREAS, in foreclosure proceedings instituted by
Town against the Coast Develonment Corporation, et al. ,
the referee, duly appointed for that purpose by order
of the Supreme Court, sold to the Town of hamaroneck,
property described as Section 4, Block 11, Lots 7 and
8, on the Assessment Yap of the Town of Mamaroneck; and-
WHEREAS, the said referee has applied to the payment
of certain taxes, assessments and tax liens owned by
and due to the Town of Mamaroneck, together with interest
and penalties thereon to the date of sale, the sum of
$878.20 which taxes, assessments and tax liens are re-
quired to be cancelled by the provisions of Section 54
of the Westchester County Tax Act,
NOW, THEREFORE, BE IT

The Town Clerk presented the contract between the Westchester
Shore Humane Society, Inc . which had been prepared by the Town Attorney
for the year 1940 for the purpose of the capture and impoundage of all
dogs found unlicensed and running at large in the Town of hama.roneck.
on motion made by Councilman Bates, seconded by Councilman
Griffin, it was upon roll call, the Supervisor not voting, unanimously

RESOLVED, that the Supervisor be and he hereby is
authorized, empowered and directed to sign the
contract between the Westchester Shore Humane Society,
Inc. and the Town of Aamaroneck for the year 1940.
The Town Attorney stated that more time would be require0'.
before it woulc be possible to make a complete report on the question
concerning highway and drainage districts.
On motion. by Councilman Mandeville, seconded by Coun.cilman,
Bates, it was upon roll call unanimously
RESOLVED, that the following claims filed with
the Comptroller, other than payroll, which are
chargeable against the highway budget of 1940,
are audited and payment thereof approved.:

Councilman Mandeville stated that at this point he wished
to inform the Board that the Highway Department ' s expenditures to
date were below the budget estimate for the period commencing January 1,
1940. He added that the amount of expenditures was about the same
as last year for the same period.
The Supervisor informed the Board that the Westchester County
Board of Supervisors had authorized the purchase by the County of four
(4) parcels of land along weaver Street. He explained that it was
necessary in order to clear up a condition which remained after the
road improvement was made .
A letter dated Larch 5, 1940, was received from Edward D.
Loughran, receiver of the Larchmont rational Bank and Trust Company;
concerning the 1918 tax lien on the property known as the former
Granowitz property, Section 6 , Elect 25 , Lets 435, 44, 45 and 46A.
He stated that he was in a position to offer to pay the Town of na-
maroneok the face amount of the tax plus accrued interest at the rate
of three per cent ( 3b) .
During, discussion it was pointed out that the Board had.
already granted permission to Mr. Loughman to pay the 1928 tax lien
at a reduced rate of interest. It was decided to direct the Town
Clerk to write Mr. Loughman and advise him that in view of the action
by the Board granting permission to pay the 1923 tax lien at a re-
duced rate of interest, the Board does not feel inclined to make a
further reduction.
A letter dated February 20, 1940, was received from
Clifford B. Radcliffe, Secretary of the Town of Mamaroneck mire
on
Department, listing the nawes of the officers elected at the annual
meeting of the Fire Department held February 19, 1940, subject to
the approval of the Town Board

RESOLVED, that the election of the following
officers of the Fire Department of the Town of
Mamaroneck at the annual meeting of the depart-
ment held February 19, 1940, be and it hereby
is approved:

A letter dated March 1 , 1940, was received from Everett T.
Houghton of Houghton & Company, realtors, requesting information as
to price and terms of sale on the property owned by the Town and
known as Section 9, Block 50, Lot 183. Following some discussion
the letter was referred to Town Attorney Delius,
On motion by Councilman Mandeville, seconded. by Councilman
Griffin, the following resolution was unanimously adopted:
WHEREAS the following described parcel of land in
the Ton of Mamaroneck is located in an area defined
under the Zoning Ordinance of the unincorporated part
of the Town of Mamaroneck, Westchester Country New York,,
as unclassified. to wit :
ALL those certain lots, pieces or parcels of land
situate, lying and being in the Town of Mamaroneck,
County of Westchester and State of New York, known
and designated as Lots Nos. 1,2,3,4, and 5 on a
certain map entitled "Map of Lands Of Frederick
Lorenzen, Esq., being Subdivision of property purchased
from Florence S. Lombaert, situate in the Town Of Mamroneck
BEGINNING, at a corner formed by the intersection of
the northerly side of the Boston Post Road and. the
westerly side of Locust Avenue (now, Winthrop Avenue);
running thence southwrestwardly along the northerly
side of Boston Post Road and along the front lines
of Lots numbered 4, 3, 2 and 1 , as shown on said mar,
112. 33 feet more or less, to the Westerly side of Lot
No. 1; running thence , along said side and
alone the continuation thereof 156.67 feet to the
northerly side of Lot #5 on said made running thence
along said side eastwardly 100.27 feet to the afore-
said westerly side of Locust Avenue (now Winthrop .
Avenue ) running thence southwardly along said side
of Locust Avenue (now Winthrop Avenue ) being the
front lisle Of Lot No. and said easterly side of

and
WHEREAS, the estate of Babel,te Reinstsin, the owner of
said premises, has by its attorneys, Meighan and
Necarsulmer, petitioned the Town Board of the Town of
Mamaroneck by letter dated 'March 6th 19140, praying
that the conditions and. restrictions of said Zonin ,
Ordinance, now applicable to the area aforesaid, be
modified or otherwise released so as to allow the
erection and maintenance thereon, of a gasoline ser-
vice station, as permitted in residence districts
designated `ED" as defined by said Zonin? Ordinance
and in accordance with a certain plot plan showinv
the location of buildings, gasoline tanks and bumps,
and plans showing the front elevation of the buildin-,
which plot and bnilding oian accompanied. such letter:
and
WHEREAS, the Town Board of the Town Of Mamaroneck has
carefully considered the proposed use to which said
area is to be put;
NOW, on motion of Councilman Mandeville, seconded by
Councilman Griffin, it is unanimously
RESOLVED that the conditions and restrictions
of said Zoning Ordinance of the Town of hamaroneck,
applicable to the aforesaid area, be and the same
hereby are modified and released so as to allow the
erection and maintenance thereon of a gasoline ser-
vice station in accordance with such plans which are
hereby directed to be filed with the Town Clerk.
FURTHER RESOLVED that the erection of said. gasoline
service station be subject to the provisions of the
Building Ordinance of the Town of Mamaroneck and also
subject to the provisions of the Fire Prevention
Ordinance of the Town of Mamaroneck.
The Town Clerk informed the Board that a request was received
from the Village of Larchmont for the rental of two voting machines
and other equipment necessary for registration and election.
On notion by Councilman Griffin, seconded by Councilman
Bates, upon roll call, it was unanimously
RESOLVED, that the Board hereby authorizes the rental
of two (2 ) voting machines and other eauiprient ocwned
by the Town of Mamaroneck necessary for the registra-
tion and election of the Village of Larchmont at a
rental charge of $10.00 per machine or a total of
$20. 00; and be it
FURTHER RESOLVED that the Village of Larchxont will
arran-e for the removal of the equipment and for the
necessary help in settin- up the pollin places.
Following some discussion proect , on the Fenimore Road W. P. A.
during which Town Engineern Foote suggested that the town
contract for the removal of stone Town Attorney be authorized to
decided to refer the matter to Town Attorney Delius for a report on
the Highway Law.
Following some discussion, it was on motion by Councilman
Bates, seconded. by Councilman Mandeville, unanimously
Town Attorney Delius informed the Board that attorneys
representing several towns and villages throughout the County were
to hold meetinns on a proposed pension bill in Albany, New York.
R-ESOLVED, that the Town railroad property, it was
represent the 'Town of Mamaroneck at the above
mentioned meetings in Albany concerning a proposed
pension bill and that his expenses in connection
with attending the meetings be paid by the Town.
The annual report of the Supervisor for the fiscal year
ended Decen cer 31, 1930, as submitted to the State Comptroller -was
received and filed.

The report of the Tom Clerk for the month of February
was received and filed.
The report of the Building Inscector for the month of
February was received and filed..
At 9:45 P.M. rile the Board unanimously resolved to adjourn.
Town Clerk
