HomeMy WebLinkAbout1940_02_20 Town Board Minutes SPECIAL MEETING OF THE TOWN BOARD TURIN OF MAMARONECK, NEW YORK HELD FEBRUARY 20, 1940 At the Town Offices, 158 West Boston Post Road, Mamaroneck, N® Y. The meeting was called to order by Supervisor McCulloch at 2:30 P . M. Present : Supervisor McCulloch Councilmen Bates Griffin Manddeville Absent - Councilman Meginniss The presence was also noted of Town Cleric Payne, Town Attor- ney Delius Comptroller Luceno and Torn Engineer Focte . The minutes of the meetings of January 3 and January 19 1940 were approved as presented. The Supervisor suggested that the meeting open with the reports of committees. Councilman Mandeville stated that he wished to praise the Highvvav Department for its work in clearing the streets of the town during the recent heavy snowstorm. He added that a number of resi- dents had talked with him about it. The Supervisor informed the Board that several letters and telephone calls had been received., connnending the department on its work. He suggested that the Town Clerk be directed to send a letter to the Superintendent of Highways, A. J. Foote, and the em- ployees of the d.epartment, expressing the appreciation of the Board for the splendid co-operation in carrying out this work, and that a Copy of same be posted on the bulletin board at the town yard. The members of the Board directed the Town Clerk to do so . Cooncilnian Bates stated that there was nothing to report for the department of drains and sealers. Councilman Griffin stated that there was nothing to report for the park department . He. presented, the report, of the Department of Public Welfare of the town for the month of January, 1940 and pointed out the follo.riing; that the case load was 421; number of individuals on relief was 1768 total relief expended was 19, 930.86, of which $2,670. 50 was for veterans' relief and $1,232.75 for medical relief; also that the average cost per individual was 11.28 and that the average cost per individual per day was $1388. The Supervisor informed the Board that forty (40) men had been laid off W. P . A. work in the town and that one hundred (100) more were scheduled. to receive slips as of Larch 1, 1940. He pointed out that most of the workers reside in the town and. that lay-offs would Five furthrer increase to relief costs. He stated that the town had virtually exhausted its W.P.A. projects and. that more would have to be approved if the one hundred. and forth (140) workers were to be kept on the W. P . A. payrolls and off the relief rolls . He added trat the quarry project was the only proiect working and that that also would be closed vrithin a short time . Following a lengthy discussion covering all of the pro- posed projects it was decided that one . the proposed project for storm water drains in Rockland Avenue ; Avon Road, Dundee Road and Oxford- Road, be presented. for approval at this meetin and that the others be laid on the table for consideration at ar early date. on motion by Councilman Mandeville, seconded by Councilman Bates, it was unanimously 867 RESOLVED, that the necessary funds be provided to start the following W.P.A. project, which the Supervisor was authorized to sign on Janu- ary 3, 1940: Oxford Road. Storm Drain Total estimated cost $17,691.00 Total estimated Federal contribution 10,723.00 Total estimated sporsor's 6,968.00 Approximate cost to Town 4, 900. 00 Following some discussion on highway and drainage matters the Board requested. the Town Attorney to stndy and recommend to the Board whether or not it was oossible and desirable to create such districts . The following resolution was offered by Councilman Mandeville and seconded by Councilman Bates, to-wit. WHEREAS, Chapter 430 of the Laws of 1938 authorizes the village of Larchmont and. the Town Board of the Town of Mamaroneck, acting for and on behalf of Refuse and (sarbage District No. 1 of the Town of Mamaroneck jointly to construct and maintain an incineration disposal plant and to severally issue bonds or other obligations to defray, their respective portions of the cost thereof, on the basis of a payment of fifty per cent thereof by the Village of Larcbmont and fifty per cent thereof by Refuse and Garbage District No. 1 of the Town of Mamaroneck; and WHEREAS, in accordance with said Act the Village of Larcbmont and the Town Board of the Town of Mamaroneck, acting for and on behalf of Refuse and Garbage District No. 1 of the Town of & Mamaroneck have heretofore . agreed upon tentative plans for jointly constructing maintain- in and operating an incineration disposal plant for refuse and garbage collected from the Village of Larch- mont and Refuse and Garbag District No. 1 and WHEREAS, by said Act the mayor of the Village of Larch- mont and the Supervisor of the Town of Marnaroneck are appointed a joint board of control to be known as the Larcbmont-Mamaroneck Garbage Disposal Commission and are authorized and empowered to agree upon final plans and specifications for the construction of such incineration disposal plant, including also the ac- quisition of such lands, easements, and rights in land necessary therefore, and the construction of roads thereto, which plans are subject to the approval of the Board of 'Trustees of the Village of Larchmont and the Town Board of the Town of Mamaroneck; and WHEREAS, certain land necessary for the construction of said incineration disposal plant has been previously acquired pursuant to the option obtained by the Larch- mont-Mamaroneck Garbage Disposal Corwnission at a total cost of $14, 000: and WHEREAS, incidental expenses in connection with the acquisition of said land, including engineer' s and architect' s fees and the cost of issuing bonds, amount ` _ to 53, 500 making the total cost of acquiring said land amount to $17,5O0 and WHEREAS, it is the desire of the Town Board to issue bonds in the amount of $8750 to pay one-half of such costs, including the payment of an 8,100 Certificate of Indebtedness of said Town issued in anticipation of bonds; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of 1,iamaronec1,::, New York, as follows : Section 1. That there shall be issued $8,750 Incinerator Site Bonds of the Town of Mamaroneck, New York, of the denomination of $1, 000 each, except bond numbered 1 for 11750, dated January 1, 1940, numbered from 1 to 9, inclusive, maturing in numerical order in the amount of $750 on July 1, 1940 and $1, 000 on July 1 in each of the years 1941 to 1948, inclusive , and bearing interest at a rate not exceeding five per centum per annum, payable semi-annually July 1 and January 1 evidenced by interest coupons to be thereunto attached. That said bonds shall be signed by the Supervisor and attested by the town Clerk under the corporate seal of the Town, and the interest coupons shall be signed with the facsimile signature of the Supervisor, and both principal of and interest on said bonds shall be payable in lawful money of the United States of America at First National Bank of Mount Vernon, in Mount Vernon, New York, with New York ex- change . Section 2. That said bonds shall be issued in sub- stantially tune following form, to-wit : UNITED STATES OF AMERICA STATE OF NEW YORK COUNTY OF WESTCHESTER TOWN OF MAMARONECK INCINERATOR SITE BOND No. 9 M The TOWN OF MAMARONECK, a municipal corporation of the State of ilew York, hereby acknowledges its indebtedness and for value received promises to pay to bearer on the first day of July, 19 the sum of Dollars ($ ) , together with interest thereon from the date hereof at the rate of per centurn per annum, payable semi-annually on the first days of January and July upon. presentation and surrender of the annexed interest coupons as the same respectively become due . Both principal of and. interest on this bond are pavable in lawful money of the United States of America at the in New York, with New York exchange . This bond. is one of an issue of bonds of like date and tenor, except as to number denomination and date of maturity, and is issued for the purpose of paying part of the cost of acquiring land for an incineration plant and incidental expenses, pursuant to and in strict compliance with the Constitution and statutes of the State of ivew York, including among others the Town Law, eneral Municipal Law and Chapter 430 of the Latins of 1938, and acts amendatory thereof, and is issued pur- suant to proceedings of the Town Board of said Town duly had and taken in all respects authorizing the same. It is hereby certified, recited and declared that all acts, conditions and things required to exist, to happen and to be performed precedent to and in the issuance of this bond, exist, have happened and have been performed in due time form and manner as required by law and that tine issue of bonds of which this is one, together with all other indebtedness of said Town. is within every debt and other limit prescribed by the Constitution and laws of the State of New York.The full faith and. credit of said Town are hereby irrevocably pledged for the punctual payment of the principal of and interest on this bond according to its terms . This bond may be converted into a registered bond in accordance with the provisions of the general municipal Law. If this bond be registered, the interest hereon at the request of the registered owner will be remitted by mail with New York exchange . Eastern Standard Time, on the 11th day of March, 19405 for the purchase at not less than par and accrued interest of $8,750 Incinerator Site Bonds of said Town, of the denomination of $1000 each, except bond numbered 1 for $750, dated January 1, 1940, maturing $750 on July 15 1940, and $1, 000 on July 1 in each of the years 1941 to 1943, inclusive , and bearing interest at a rate not exceeding five per centum per annum payable semi- annually January 1 and July 1. Bonds will be in coupon form and may be converted into fu11y regis- tered. bonds, and are general obligations of the Town payable primarily from taxes against property within Refuse and garbage District No. 1 of said Town, but if not paid therefrom, all the taxable property within the Town will be subject to the levy of unlimited ad valorem taxes to pay said bonds and interest thereon Each bid must be for all of said bonds and state a single rate of interest therefor. Unless all bids are rejected. the award will be made to the bidder complying with the teams of sale and. offering to pur- chase said bonds at the lowest rate of interest, not exceeding; the rate above specified, stated in a multiple of one-quarter or one-tenth of one per centum per aiinum, without reference to premium, provided, however, that if two or more bidders offer to purchase saia. bonds at the same lowest rate of interest 'then such award will be made to the bidder offering the highest premium. The right is reserved to reject any or all bids. Each bid must be enclosed in a sealed envelope addressed to the undersigned Supervisor and marked on the outside "Proposal for Bonds " and must be accompanied with a certified., or bank, or trust company check to the order of the Town of Mamaroneck for $175 as a good faith deposit to secure the Town against any loss resulting from the failure of the bidder to comply with the terms of his bid. Do interest will be allowed on the amount of the good faith deposit . Said bonds are issued for the purpose of paying part of the cost of acquiring land for an incineration plant , and incidental expenses, pursuant to the Town Law, General Municipal Law and Chanter 430, Laws of 1938, and acts amendatory thereof. The approving opinion of - essrs. Dillon, Vandewater & Moore, Attorneys of New York City, will be furnished to the purchaser without cost . FINANCIAL STATEMENT The assessed valuation of the property subject to the taxing power of the Town is $83,124,521.00. The average assessed. valuation of the real estate of said Town, subject to taxation as determined by the last com- pleted assessment roll and the four preceding assessment robs of said Town, is $82, 543 596.00. The total bonded: debt of the Town, including the above mentioned. bonds, is $4,291,5750. 005 of which amount $673.000.00 is water debt . The population of the Town (1950 census ' was 19, 040. The bonded debt above stated does not include the debt of any other subdivision having power to levy taxes upon any or all of the property subject to the taxing power of the Town. The fiscal year commiences January 1. The amount of taxes levied for each of the fiscal years corimencing January 1, 1937, January 1, 1938, and January 1, 1939, was respectively $1,139,3110.00, $1, 340,716.00 and $1,268,943.00 The arount: of such taxes uncollected at the end of each of said fiscal years was respectively $127,348. 00, $131, 108. 00 and $117, 322. 00. The amount of such taxes remaining un- collected as of the date of this notice is respectively $29,564.00, $45,576.00 and $101,167. 00. The taxes of the fiscal year cornxrencin ; January 1, 1940 amount to $1,327,528. of which none have been collected. A detailed report of essential facts will be submitted to any interested. bidder. Section 6.. That when said bonds shall have been duly executed the same shall be delivered to the purchaser upon payment of the purchase price to the Supervisor and the receipt of the Supervisor shall be full acq'u.ittance to said purchaser who shall not be -- oblized to see to the application of the purchase money. Section 7. That all resolutions and parts of resolutions heretofore adopted_ to the extent that they are inconsistent herewith be and the same hereby are rescinded and repealed. 00. 89 Section. S. That it is hereby, determined that the period of probable usefulness of the purpose or object for said bonds are authorized to be issued is at least fifteen years. Section 9. That this resolution shall take effect irnmediat6ly. He asked the members of the Board as to their sriishes in raving, representa- tives present at the meeting. On motion by Councilman Griffin, seconded by Councilman Bates, on roll call , the Supervisor not voting, it was unanimously RESOLVED, that Supervisor McCulloch, Town Attorney Delius and Comptroller Luceno be and. they hereby are authorized to represent the Town of Mamaroneck -- at tree public hearing before the joint Senate and Assembly Committee on the Seelye-Babcock pension bill to be held. February 21, 1940 in Albany, fvenr York: and be it FURTHER RESOLVED, that they represent the Town at the annual meeting of the Association of Towns of the State of New York to be held at Albany on February 21, 22 and. 23, 1940, and that they be reimbursed for their expenses for the entire trip from Town funds. The supervisor stated that he believed that all had had an opportunity to go to the town yard Saturday, February 10, 1940. to inspect the trucks offered by the companies submitting proposals. He asked what the pleasure of the Board was in the matter. Councilman Griffin stated that his personal impression was that he liked the Mack International truck. He added that he did not think the town could go wrong on the Mack truck, as the company has been building nothing but trucks for years. He continued by stating that while the town's mechanic Mr. Poccia favored the Dodge truck because of a heavier frame, he felt that the Mack was of better construction because its total weight was greater than the Dodge truck Councilman Bates stated that becuase of lack of knowledge of the construction of trucks, he felt that he would inclined to follow the recommendation of the town's mechanic, whom he termed an expert Councilman Bates stated that through his experience with trucks he found the Mack International to be a better piece of equipment The supervisor asked the difference in price as listed in the bid papers and stated that for the following reasons he favored the Dodge truck: 1) the matter had been referred to the chief mechanic of the town by this Board for his opinion and he had expressed his opinion as favoring the Dodge truck; 2) the price was somewhat lower and 3) a local dealer was involved Following some discussion, it was on motion by Councilman Mandevilie, seconded by Councilman Griffin, RESOLVE, that the Supervisor be authorized to purchase the Mack International truck at the price set forth in the bid papers submitted.
