REGULAR MEETING OF THE TOWN BOARD
TOWN OF MAMARONECK, NEW YORK
HELD FEBRUARY 7, 1940
At the Town Offices, 158 West Boston Post Road., Mamaroneck, 1, a Y.
5: 00 P. M.
The meeting was called to order by Supervisor McCulloch at
Present ; Supervisor McCulloch
Councilmen Bates, Griffin, Mandeville
Absent: Councilman Meginniss
The presence was also noted of Town Clerk Payne, Town
Attorney Delius, Comptroller Luceno and Town Engineer Foote .
The Supervisor suggested that if' there was no objection
on the part of the other members of the Board, the regular order of
business be suspended in order to hear those present who wished to
address the Board.
Mrs . Howard B. Nichols addressed the Board, stating that the
Council of the Parent Teachers' Association desired the Board to adopt
ordinances, requiring the licensing of bicycles and a test to ce given
by the school authorities upon which the right to obtain such regis-
tration would depend,
Mr. Henry Mendes of the Traffic Committee also addressed
the Board and stated that the Traffic Committee was in favor of an
ordinance requiring registration or licensing of bicycles.
The Town Attorney stated that at the present time, no
authority existed. under State law for the adoption of such ordinances,
but Senator Swartz of Erie County had introduced a bill, Senate int.
533, which would give towns the right to enact ordinances in relation
to the registration, inspection and use of bicycles which, however,
would not involve tae requirement suggested by the Council of the
P. T. A. with regard to tests .
After discussion by tine Board, the following resolution
was moved by Councilman Bates aiia seconded by Councilman Griffin;
WHEREAS, there has been introduced in the State
Senate a bill (Serrate Irz . 533 Senator Swartz)
which would amend Section 180 of the General
Municipal Law and which is entitled "An Act to
amend the General Municipal Law in relation to
the registration, inspection and use of bicycles
and repealing certain provisions cf, article nine
thereof". which would Dive to this Board rower to
ado-Qt ordinances regulating the registration a .0
inspection, as well as the use of bicycles in the
Town of Mamaroneck outside incorporated villages;
and
WHEREAS, such an ordinance has been approved by the
Traffic Committee of the Town of Lamaroneck and the
adoption of such an ordinance is urged by the Mama-
roneck-Larchmont P. T. A. Council;
NOW, THEREFORE, BE IT
RESOLVED, that this Board hereby approves said bill
and requests its representatives in the Senate and
Assembly of the State of New York to use all honorable
means to secure its passage and further urges the
Governor to sign the same if the same be passed by
the Senate and Assembly so that the same may become
a law forthwith and
BE IT FURTHER
RESOLVED, that the Town Clerk be directed to send
a certified copy of this resolution to Assemblyman
Theodore Hill, 2nd District, Westchester County,
Senator Pliny Williamson, 25th District , New York,
Honorable Herbert Lerman, governor of the State of
New York, Senator Swartz, the introducer of the bill,
and. the "Legislative Committee of the Board of Super-
visors of Westchester County.
Mr. Orson A. Raynor, attorney, appeared on behalf of the
Fine Brook :Syndicate to request -permission to nay certain tax arrears
on twelve parcels of land in the Sound Shore Section at a reduced
amount . He stated that the company; had been the recipient in a re-
cent award and that they now had a little money in the treasury arid,
were anxious to make a settlement on the back taxes. He requested
the Board to waive all penalties and interest and settle the +taxes
at fifty per cent of the face amount. He saki that the combined
taxes had run up to a tremendous amount and that the Village of Larch-
mont would probably go along on the same basis for a settlement . also
if such an arrangement could not be completed, the company may have
to abandon the property.
Following some discussion, Councilman Mandeville suggested
that Mr. Raynor leave the list of taxes and such other papers ne-
cessary, so that the Board could study the proposition.
Mr. Raynor did so with the request tnat the Board give the
matter consideration as soon as possible ,
The Supervisor suggested tnat the members of the Board hear
the report of the Town mechanic, mr. Emilio Poccia, on the inspection
of the trucks for which bid proposals were received at the last Board
meeting.
Mr. Poccia reported that he had inspected all models but
the lack International, which was not available. He explained. the
construction of each truck and the use that may be required in Town
work.
Following some discussion Councilman Mandeville suggested
that Mr. Poccia request the representatives of the firms submitting
bids to have the trucks ready for the inspection of the Torn Board
in front of the Town Office building at 11:30 A. M. Saturday, Feb-
ruary 10, 1940. He also suggested that Town Engineer Foote and.
Mr. Poccia be present . The members of the Board agreed upon this
arrangement .
The Town Clerk read a letter dated January 23, 1940, re-
ceived from the Howell Park Association, signed by Mr. G. Y. Fenton,
President, petitioning the Town Board to refrain from the passage
of any ordinance changing the zoning regulations covering the pro-
perty known as the former Sackett Estate and requesting that they
be kept informed of the dates upon which the subject matter may come
up before a meeting of the Town Board or be th.e subject of any public
hearing. The letter was ordered received and filed.
A letter dated January 19, 1940, was received from
Mr. C . C . Merritt, requesting that he be advised as to the filing
of formal applications, dates of hearing, et cetera, in connection
with the modification or re-zoning of the former Sackett property.
The letter was ordered received and filed.
A letter dated February 1 , 1940, was received from the
Village of Mamaroneck, signed by William H. Johnson, Village Manager,
enclosing a purchase order in the amount of $85. 00 for the rental
of nine ( 9) voting machines for the annual village election.
The Town Clerk called to the attention of the 'Board treat
in past years before a new election district was added in the village,
the rental of machines was on the basis of $10.00 per machine; also
that the Village of Larcbmont has been renting machines at the rate
mentioned.

On motion by Councilman Bates, seconded by Councilman
Griffin, on roll call, it was unanimously
RESOLVED, that the Board hereby authorizes the
rental of nine ( 9) voting machines and other
equipment owned by the Town of Mamaroneck necessary
for the registration and the election of the Village
of Mamaroneck at a rental charge of $10. 00 per
machine or a total of $90. 00; and be it
FURTHER RESOLVED, that the Village of Mamaroneck
will arrange for the removal of the equipment and
for the necessary help in setting up the polling
places.
A letter dated January 25. 1940, was received from the
County Transportation Company, Inc. , with the report prepared in
accordance with the terms of the consent granted by the Town of
Mamaroneck as prescribed in the twenty-fifth paragraph of the agree-
ment . The report was ordered received and filed.
The Town Clerk stated that upon the recommendation of the
Commissioner of Public Works of the County of Westchester and the
approval of the Town Attorney a certificate of the Globe Indemnity
Company had been issued, certifying that the bond of Bert C. McCulloch
as Supervisor of the Town of Mamaroneck, Bond No. A304163, in the sum
of $46, 000, which became effective January 1, 1940, is reduced to the
sum of $39, 000 for the period beginning January 1, 1940, and for the
remainder of his two-year term of office .
On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was upon roll call unanimously
RESOLVED, that the certificate from the Globe
Indemnity Company be received., that the Town
Clerk be instructed to file copies with the
proper authorities and that the reduction of
the bond of :Bert C. McCulloch, as Supervisor to
$39,000 for the period commencing January 1
1940 and. ending December 31, 1941, is hereby
approved.
The Town Clerk presented the surety bonds reouired for the
offices of deputy town clerk, deputy receiver of taxes and assess-
ments, public welfare officer and. building inspector .

Griffin, it was upon roll call unanimously
RESOLVED, that the surety bonds covering the above
mentioned positions be approved; and be it
FURT1ER RESOLVED, that the following bonds of said
Turin employees and/or officers be canceled as to
any liability or claim accruing subsequent to
January 1, 1940:

The Town Clerk called to the attention of the Board that
the term of office of Mr. Charles F. Blink as a mer ger of the Board.
of Appeals for Zoning would expire February 19, 1940. The members
of the Board, decided to lay the matter on the table until the next
regular meeting in order to allow time to contact Mr. Mink.
A letter dated February 2, 1940, was received fron
D'r. H. S. Duncombe, Jr. , attorney, requesting on behalf of the
Barkers Trust Company and John W. Ruef, executors of the Last Will
and Testament of J. Clifton Edgar, deceased, permission to pay cer-
tain tax arrears on Section 7, Block 15; Lots 5, 6, 7A at a reduced
rate of interest .
On motion by Councilman Bates, seconded by Councilman
Griffin, it was unanimously
RE SOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and
directed to accept payment of the following taxes
on the following described property, ttie liens for
which are held by the 'Town, in the face amount of
the liens plus interest computed at 6 per cent per
annum, provided payment is made within thirty days:

The following applications for dance hall licenses were
placed before the Board for its approval, namely, Winged Foot
Golf Club, Bonnie Briar Country Club and Larchmont Sports Club.
On motion by Councilman Mandeville , seconded by Councilman
Bates, it was unanimously
RESOLVED, that the above applications for dance
hall licenses be approved.
Mr. Charles P. Collins, attorney, -representing ';i . Valentine
A. Lily appeared and stated that on more mature reflection they had.
decided to return to the Town Board and ask for the re-zoning of the
property known as the former Sackett Lstate and to withdraw their
application for a variance pending before the Board of Appeals for
Zonins.
The Supervisor asked if he would explain the reason for
the chance of procedure .
Collins stated that they thought that if the Board of
Appeals for Zoning rendered an adverse decision on their application
for a variance, it would prejudice their chance before the Town
board for a change in zoning; also that they thought that they had
better legal grounds to stand on in applying for re-zoning. He
continued by stating that this time his client was interested only
in the re-zoning, of the Sackett property. He asked the Board to
treat the oral presentation as a formal application for the change
of zoning and stated that he would file a written request within
a fey days.
The Supervisor advised that it was before the Board and
asked the councilmen as to their wishes concerning a date for a
public hearing, also if the hearing should be on the proposed re-
zoning of the Sackett property alone or should it be for the re-
zoning of both sides of Palmer Avenue or just one side of Palmer
Avenue between Weaver Street and the Village of Mamaroneck boundary
line . He pointed out that there were several problems in connec-
tion with zoning and suggested that it might be well to clear all
at one time: also that the Board of Appeals for Zoning should be
consulted on the arrangements for the hearing, as they have worked
diligently for the past two years on a plan for zoning; for the entire
anincorporated section.

Following some discussion it was decided that the Board
of Appeals for 'Zoning be contacted and that a special meeting of
the Town Board be held in the near future to discuss the matters
Town Attorney Delius presented a letter dated January 26,
1940, received from Edward D. Loughman, Receiver of the Larchmont
National Bank and Trust Company, stating that since 1925 the bark
held a mortgage on the premises owned by Irvin Granowitz and Gertrude
➢ , Granowitz and known as Section 6 , Block 25, Lots 43B,44345,46A
and that in order to convey title of the property to the bank during
the year 1939. On entering into negotiations they discovered a
tax lien for 1928, sale of 1929, in the sum of $168.02 which appeared
to be sold to the Town. He offered, sub ect to the approval of the
Comptroller of the Currency, to settle the tax in the face amount .
Following some discussion, on motion by Councilman Bates,
seconded by Councilman Griffin, upon roll Call , it was unanimously
RESOLVED. that the Receiver of Taxes and Assess-
ments be and he hereby is authorized, empowered
and directed to accept payment of the following
taxes on Section b, Block 25 . Lots 43B, 44, 45
and 46A, the lien for which is held by the Town,
in
the face amount of the lien plus interest com-
puted at 6 per cent per annum, provided payment
is made within thirty days -

FURTHER RESOLVED, that the Town Attorney notify
Mr. Edward D. Loughman, Receiver of the Larc'rmont
National Bank and Trust Company, as to the action
of the Board.
The Town Attorney stated that he recommended the settlement
of the certiorari proceedin`s instituted by Hazel moods laerritt., to
review the assessment upon a parcel of property in the Village of
Laraaroneck, known as Section 9, Mock 11, Lots 5 and 6, on the basis
of a reduction in the assessment from $43,750 to $32 500 for the year
1938, and from $40, 000 to $32, 500 for the year 1939 .
Councilman Bates introduced the following resolution
which was seconded by Councilman Griffin-
WHEREAS heretofore and on or about the 26th day
of September, 1938, a writ of certiorari ,was ob-
tained by Hazel JVcoda Merritt, owner of Section 9,
Block 11, Lots 5 and 6, to review the assessment
for the year 1938, upon the premises owned by her,
and a similar writ was obtained on the 12th day of
September, 1939, to review the assessment for the
year 1939, on the same property; and
WHEREAS, a return to the 1938 'writ was duly riled
by the Assessor and Board of Review on or about the
15th- of November, 1938, and no further proceedings
have been taken, and a return to the 1939 writ was
duly filed by the Assessor and Board of Review on
or about lfovember 15th, 1939, and no further pro-
ceedinws have been taken with the exception of an
order of reference having been entered by the
Supreme Court; and.
WHEREAS, the Town Attorney and Assessor recommend
to this Board- that the proceeaings be settled and
discontinued upon the -reduction of the assessrrient
from $43, 750 to $32, 500 for the year 1938, and from,
($40, 000 to $32, 500 for the year 1969,
NOW THEREFORE, BE IT

pulations to obtain orders of the Supreme Court
providing for sucks reductions and refund of any
excess taxes paid.
On motion of Councilman Bates, seconded by councilman Griffin,
the resolution was adopted by the following vote

Councilman Mandeville reported that work on the garage at
the Town Yard and was complete, also that the Highway Department had
done Good work in sanding all dangerous crossings and hills during
the storms.
Councilman Mandeville presented certain highway claims
approval.
On motion made by Councillman Mandeville, seconded by
Councilman Griffin, it was upon roll call unanimously
RESOLVED, that the following claims filed with
the Comptroller, other than payroll, which are
chargeable against the Highway Budget of 1940,
are audited and payment thereof approved--

Councilman Bates stated that there was nothing to report
for the department of drains and seviers.
Councilman griffin stated that he had expected to present
the regular monthly report of the Public Welfare Department but that
for some unknown reason it was not received.
Councilman 'griffin presented a petition dated February 7,
1940, received from the Assessor for the correction of the assessment
roll so as to permit the apportionment of tapes .
On motion by Councilman Griffin, seconded. by Councilman
Bates, the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented a petition
dated. February 7, 1940, for the correction of the
assessment roll for the year 1939, taxes of 1940,
restaurant to the provisions of Section 33 of
Charter 105 of the Laws of 1916, as amended, known
as the Zestchester Coun.ty Tax Act; and
WHEREAS, after due- consideration this Board finds
it desirable to -rant said petition for the
correction of said assessment roll

Following some discussion, it was on motion by Councilman
Mandeville, seconded by Co'unci 2an Bates, upon roll call, uLianimously
RESOLVED, that the ComptroIler be and he hereby
is authorized to transfer from surplus funds the
sum. of '11150.00 to pay for the rental of equipment
necessary to carry on the project known as the
"undereground Survey"
The Supervisor stated tYiat it would be in order to consider
the application made by i.r. Orson A. Raynor earlier in. the evening
of behalf of the Pinebrook Syndicate .
Following a lengthy discussion, it was decided that the
verbal application made by I'iir. Raynor on behalf of the Pinebrook
Syndicate for permission to pa;: certain tax arrears on holdin .s of
the company in the Torun on the basis of fifty per cent of the face
amount of the tar_ be denied and that the Town Clerk be directed to
advise Pdr. Raynor as to the action of the Board by letter.
The Supervisor re erred to the number o requests for
settlement of tax arrears and suggested that the question concern-
ing, all unpaid taxes be discussed at length at ai early meeting.
He offered to have a complete list of such taxes prepared zor the meet-
ing. The meribers of the Hoard were very mucn in favor of the sug-
gestion of the Supervisor.
The Town Attorney called the attention of the Board to the
fact tnai Constitutional amendments adopted by the Convention of
1938 would creaue a contract as of July lst, 1940 between all members
of the Town Police Department and the Town, with regard to benefit :.
and allowances provided for by Chanter 791 of the Lajas of 1928, as
amended, entitled "An act to authorize the establishment of a police
pension fund and the appointment of trustees in towns within certain
counties adjoining cities of the first class having a population of
1, 000,000 and upwards and to define the powers and duties of such
trustees of said police pension fund", pursuant to which the members
of the police department are required to co-tribute 30 of their
salary annually, which may eventually result in the Torn being re-
quired to raise funds sufficient to place suet a fund on an actuarial
basis with only a 3o contribution from the me r_'Jers of said police
department . He stated further twat bills had been introc_uced by
Senator Seelye, Senate Int. 483, and Assemblyman Babcock, Assembly
Int. 525.1 which would_ allow the Town hoard to close the said pension
fund to new members and re-organize the pension fund upon the basis
of a contribution by the members of the police department of not less
than 45% of the amount required to place tre same upon an actuarial
basis . He urged the Board to approve these bills and indicate to its
representatives in the Senate and assembly of this State , its approval
of these bills .
Hpon motion duly made by Councilman Griffin, and seconded
by Councilman Bates , the following resolution was adopted;
uHLlLTliS, pursuant to Article 5, Section 7 of the
State Constitution, membership in any pension or
retirement system of the State or any civil division
thereof becomes a contractual relationship after

July 1st, 1940, benefits of which shall not
be diminished. or impaired: and
WHEREAS, Chapter 791 of the Laws of 1928 as
amended, has established in the Town of ivama-
roneck, a police pension fund which requires
the members thereof to contribute 30 of the
monthly pay, salary or compensation of its
members and makes mandatory certain benefits
or allowances in case of retirement on account
of superannuation, disability or death u,rt-ich
benefits are by the terms of such statute, payable
to its members and/or their widows and minor
children; and
WHEREAS, the State Pension Fund has been found
to be not on an actuarial basis in view of the
contributions required by said law and other
amounts payable thereto; and
WHEREAS, there have been introduced certain bills
in the Senate and Assembly of the State , known
as Senate Int. 483 ( Senator Seelye) and Assembly
Tnt . 525 (Assemblyman Babcock) both entitled "An
act to provide for the reorganization of municipal
pension and retirement systems and funds which are
not maintained on an actuarial contributory re-
serve basis"; and
WHEREAS , the Town Attorney has stated to this Board
that the passage of the se bills and the si mature
thereof by the Governor, would assist this Board in
placing its police pension fund upon an actuarial
basis in accordance with the provisions of Article 5,
Section 7 of the State Constitution;
NOW, THEREFORE, BE IT
RESOLVED, that this Board hereby approves said bills
and urges its representatives in Senate and Assembly
( Senator Williamson, 25th District, New York and
Assemblyman Hill, 2nd District, Westchester County )
to use all honorable means to secure their passage
and also urges the Governor to sign the same, if
passed, so they may become a law forthwith; and
BE IT FURTHER
RESOLVED, that the Town Clerk be directed to send
certified copies of this resolution to Senator
Williamson, Assemblyman Hill, Senator Seelye,
Assemblyman Babcock, the Honorable herbert H.
Lehman, Governor of the State of hew York, as well
as to the Association of Towns of the State of New
York (Frank 0. tioore, Esq. , Executive Secretary) ;
and
BE IT THEREFORE
RESOLVED, that the Town Clerk send copies of this
resolution to the Supervisors of the Towns of
Greenburgh, Harrison, Eastchester and to the
Legislative Committee of the Board of Supervisors
of the Cocanty of Westchester.
The Supervisor presented the following financial statements
of Westchester point Water works , No, 1, which were ordered filed:
(1) Revised Summary Statement of Estimated Operating Revenues and
Expenses Distributed. to Member L-unicipalities Compared with the Debt
Service Requirements on Their water ponds for the Year 1940; (2 ) Re-
vised Statement of Estimated Operating Revenues for the Year 1940
Compared with Estimates. Operating Revenues for the Year 1939 and the
Actual Operating Revenues for the Year 1939; ( 3) Revised Comparative
Statement of Estimated Cost of Operating the Joint Plater Uorks (Ex-
clusive of Debt Service Requirements) for the Years 1940 and 1939
Compared with the Actual Costs Thereof for the Year 1939,
