The meeting was cailea to order by Supervisor UlcCulloch
at 8:00 P . tut.
Present: Supervisor McCullocii
Councilmen Bates, Griffin, Mandeville , iafeginniss
Absent : None
The presence was also noted of Town Clerk Payne, Town Attor-
ney L'elius, Assessor Smith, Comptroller Luceno, Town Engineer Foote
and Public 'Welfare Officer DeVinne.
The minutes of the meetings of November 15th, December 5th
and December 7th, 195y were approved as presented.
The Supervisor requested the Town Clerk to read the communi-
cations.
A letter dated December 1, 1939 was receiveu Lrom the
Miamaroneck-Larenmont Parent-Teacher Council, signed by Mfrs. Hazel
R. u*loodbridge, chairman of the P. T. A. Council Safety and Health
Committee, advising that at the regular meeting of the Council held
on November 21, 193-e tine following resolution was adopted:
RESOLVED that this meeting ask the Boa.L.d of the
Village of Larchmont, the Village of lviamaroneck
and the Town of cviamaroneck to make some regulation
or provide ordinances for bicycle control of school
children based on passing skill and information
tests given in the schools.
Mfrs. Noodbridge also advised that among those present at the
meeting were representatives from the following organizations: Central
School P . T. A. ; D. A. R. ; bi:urray Avenue School F . T. A. ; Senior High
School F. T. A. ; Chatsworth Avenue School P. T. A. ; Lions Club; Village
of L4amaroneck; League of 'ulcmen Voters; Bike Shop; ivamaroneck Camp Fire;
Larchmont Camp Fire; Police Department-Larchmont; Town Attorney; Police
Department-'Town; Town Comptroller; Girl Scouts; lilamaroneck Avenue
School P . T. A.
A letter dated December V. 1939 was received from the Traffic
Safety Committee, Town of Mamaroneck, signed by henry E. viendes,
chairman, advising that at a meeting of the Committee held Tuesday,
December 5, 1939, consideration was given to the recommendation of the
P. T. A. Council Safety and Health Committee relative to the operation
of bicycles by school children. Also that the following resolution was
adopted:
VFH REAS, the attention of the Traffic Safety
Committee of the Town of lalamaroneck has been
directed to the Bicycle Safety Campaign inaugu-
rated by the PTA Council Safety and Health Com-
mittee providing for
(a) the education of children in the use and
maintenance of bicycles, and
(b) the registration of bicycles operated by
children up to Junior High School age, be it
RESOLVED, that this Committee respectfully recommends
to the Town Board of Mamaroneck that favorable con-
sideration be given to the adoption of an Ordinance
providing for the registration of bicycles operated
by school children who are enrolled in the Elementary
and Junior High School Grades.

Following some discussion during which Councilman oieginniss
pointed out that the General Town Ordinances already included some-
thing with reference to bicycles, the members of the Board decided
to direct the Town Clerk to write letters to the Committees inviting
them to have representatives present at the next regular meeting of
the Town Board for the purpose of holding complete_ discussion on the
matter.
The Town Clerk read a letter from the Commissioner of Public
Works in Westchester County dated December 9, 1939, enclosing a copy
- of a letter addressed to all County Superintendents of Highways by
the Department of Audit and Control of the State of ivew York, dated
December 4, 1939 warning against work done by town forces on private
property.
On motion by Councilman Bates, seconded by Councilman ivieginniss
the communication was referred to the Town Superintendent of Highways for
compliance.
The following applications for dance hall licenses were placed
before the Board for its approval, namely: Loyal Inn, Inc. ,by Mario
Gattoni; Sagamore Inn, by Carmelo Votano; Post Lodge, by a. Waller.
On motion by Councilman Griffin, seconded by Councilman Bates,
it was unanimously
RESOLVED that the above applications for dance
hall licenses be approved subject to a final
inspection and approval of the Fire Inspector
of the Town of biamaroneck.
kr. Harry K. Ellenbogen, representing Kent Builders, Inc.
appeared before the Board and urged a reconsideration of his applica-
tion for a compromise of taxes and tax liens upon property known as
Section 1, Block 6, Lots 34B and 35. He stated that he had appeared
at the last meeting and in the interim had discussed the matter with
the Town Attorney who had, suggested to him that he appear before the
Board and again present the matter upon the basis of a compromised
amount to be paid within not more than sixty (60) days. air. Ellenbogen
pointed to the physical characteristics of the property and the exist-
ing difficulties with respect to the location of buildings upon it and
stated he could pay up to 01,000 in compromise of all taxes and tax
liens to January 1st, 1940.
The Board after considering the matter further denied this
application as made, but it was, upon motion made by Councilman
Meginniss, seconded by Councilman Bates
RESOLVED, that Kent Builders, Inc. , be premitted
to compromise the taxes on Lots 34B and 35, Block 6,
Section 1, in the Town of u amaroneck, by paying the
face amount of all taxes without interest and in
addition the current taxes (1939) both State, Town
and County and School with current penalties pro-
vided such payment be made within sixty (60) days of
the date of. this resolution; and
FURTHER RESOLVED, that this compromise. is made upon
the assurance of the owners that they will improve
the property by building thereon; and
FURTHER RESOLVED, that the Town Attorney notify
Kent Builders, Inc. of the Board' s disposition of
this matter.
The Supervisor asked if there was any one else who wished
to address the Board.
There being no one, he suggested that the Board proceed
with the organization meeting.
The Town Clerk informed the Board that all town officials
elected at the last general election had duly filed their oaths
and undertakings as required in Section 26 of the Town Law.
The Supervisor announced the appointment of Town Councilmen
to the following committees:

Councilman Griffin read and moved the following resolution
which was seconded by Councilman aandeville, and upon roll call
unanimously adopted:
RESOLVED, that in accordance with the schedule set
forth below the following Town officers and employees
be and they hereby are appointed for the term ana at
the salary set forth respectively after their names
and that they supply the bonds or official undertakings
as provided by Section 25 of the Toga-, Law and respective-
ly set forth after their names and that these bonds or
official undertakings as stated shall be approved as to
form by the Town Board and that the surety of such borids
or official undertakings shall be a surety company
authorized to transact business in the State of idew York
and that the expense of such bonds or official under-
takings be a charge against the Town, as follows:

FURTHER RESOLVED, that all appointments are effective
as of January 1, 1940 and that all bonds required in
connection with the appointment of officers or employees
appointed by this Board other than the Comptroller and
Superintendent of Eighways, which bonds shall be for
the term of appointment of the Comptroller and Super-
intendent of Highways respectively, be on the basis
of an annual penalty in the amount set opposite their
respective names.
On motion by Councilman iviandeville, seconded by Councilman
Bates, it was upon roll call unanimously
RESOLVED that the position of clerk to the Assessor
be declared vacant for the present .
On motion by Councilman lutes, seconded by Councilman Griffin,
it was unanimously
RESOLVED, that the three (3) present Police
Commissioners, namely, Victor h. Stempf, Clair V.
Johnson, and John ad`. Luce, be and they hereby are
re-appointed- to succeed themselves as members of
the Police Conmiission of the Town of Mamaroneck to
serve at the pleasure of the Board.
On motion by Councilman Bates, seconded by Councilman Griffin,
it was unanimously

RESOLVED, that Town Councilman Edward B. Meginniss
be and hereby is appointed a member of the Board of
Trustees of the Police Pension Fund to succeed himself
for the term of office beginning January 1, 1940 and
expiring December 31, 1940.
On motion by Councilman Bates, seconded. by Councilman
Griffin, it was unanimously
RESOLVED, that Town Councilman Owen A. v:andeville
be and hereby is appointed a member of the Examining
Board of Plumbers of the Town of Mamaroneck as pro-
.
vided for in the Plumbing Code.
On motion duly made and seconded, it was unanimously
RESOLVED, that Town Engineer A. J. Foote be and he
hereby is appointed a member of the Examining Board
of Plumbers of the Town of' Pamaroneck as provided
for in the Plumbing Code.
The Town Clerk announced that pursuant to Subdivision 10
of Section 30 of the Town Law, State of 1vew York, he had appointed
Miss Alice E. Wheelock as Deputy Town Clerk of the Town of Mamaro-
neck for the term of office ending December 31, 1940.
A letter dated December 19, 1939 from the Receiver of Taxes
and Assessments stating that subject to the approval of the Town
Board he deputizes Mr. Leo 1N . Orsino as assistant to the Receiver of
Taxes and Assessments to perform any and all of the duties of the
Receiver of Taxes and Assessments, including thereamong the duty of
receiving tax money, giving proper receipt therefor in his name and
entering same upon the records and depositing the tax money in the
bank as required by law.
The Board unanimously approved of the action of the Receiver
of Taxes and Assessments.
A letter dated January 2, 1940 signed by Chas. D. DeVinne ,
Public Welfare Officer, including a list of the employees of his
department recommended for the positions set forth was received.
The Supervisor informed the Board that the question had
been raised as to the necessity of having an additional town con-
stable appointed and that upon making inquiry to the department to
which the constable is responsible, tie received the following letters:

I have yours of December 27th regarding the possibility
of having another constable in the Town of blanaroneck. So far
as my court is concerned, up to date things are running smooth-
ly and I have been put to no incon.ve ;ience by the fact that we
have only one such officer.

The Town Clerk presented the surety bonds required for the
offices of Superintendent of Highways, Comptroller, Plumbing Inspec-
tor and Constable .
On motion by Councilman kandeville, seconded by Councilman
Bates, it was upon roll call unanimously
RESOLVED, that the surety bonds covering the above
mentioned positions be approved.
The Town Clerk presented a certificate of the Globe Indemnity
Company, certifying that the bond of Henry R. Dillon as Receiver of
Taxes, bond ho. 292854, in 'the sum of X40. 00, which became effective
January 1, 1938, had been reduced to the sum of 820,000 for the period
beginning January 1, 1940 and for the remainder of his four-year term.
On motion by Councilman Mandeville, seconded by Councilman
Bates, it was upon roll call unanimously
RESOLVED, that the certificate from the Globe
Indemnity Company be received, that the Town
Clerk be instructed to record the same in the
County Clerk' s Office of the County of vVest-
chester and that the reduction of the bond of
Henry R. Dillon as Receiver of` Taxes to `r 20, 000
for the period commencing January 1, 1940 and
ending December 31, 1941 is hereby approved.
Upon motion made by Councilman Bates, seconded by Councilman
Griffin, the following resolution was upon roll call unanimously
adopted:
RESOLVED, that the undersigned, constituting the
Town Board of the Town of ivlamaroneck, 'Westchester
County, iiew York, hereby elect to bring within the
coverage of the Worinnen' s Compensation Law, the
Superintendent of Highways, and that such coverage
be provided for in the policy of insurance carried
with the State Insurance Fund.
On motion by Councilman Griffin, seconded by Councilman
Bates, it was unanimously
RESOLVED, that in accordance with Chapter 465 of
the Laws of 1935, which amends subdivision 1 of
Section 102 of the Town Law, the Town Board of the
Town of Mamaroneck hereby determines to allow and
pay the following town officers or employees in the
amount not to exceed six (6¢) cents per mile for the
use o` his own automobile for each mile actually
and necessarily traveled by him in the performance
of the duties of his office or position:

On motion by Councilman Bates, seconded by Councilman
Iv_andeville, it was unanimously
RESOLVED, tnat the meetings of the Town Hoard be
held at 8 o' clock P. lii. on the first and. third
Wednesdays of each month, unless such day be a
holiday and then on the next succeeding day and
that the place of the meetings be designated as
the Town Office in the Village of Mamaroneck.
On motion by Councilman ivlandeville, seconded by Councilman
Griffin, it was unanimously
RESOLVED, that "The Daily 'Times" of Mamaroneck
be designated as tae official newspaper of the
Town of Mamaroneck for the purpose of publishing
notices.
On motion by Councilman Meginniss, seconded by Councilman
Griffin, it was unanimously
RESOLVED that the following banks and trust companies
in which the funds of the Town of Mamaroneck and its
various districts and departments are now deposited
shall continue to be the depositories of such funds
for the year 1940 upon the same terms and conditions
as now obtain, including security deposits now in
effect;

On motion by Councilman Griffin, seconded by Councilman
Bates, it was unanimously
RESOLVED, that the Town of P;iamaroneck continue its
membership in the Association of Towns of the State
of 14ew York for the year 1940 and tnat the annual
dues of x:102. 00 be paid.
Tne Town Clerk reported that the Town' s insurance broker,
Mr. Edward A. Keeler, 'nad filed all of the new insurance policies
covering the Town against loss for the year 1940.

RESOLVED BY THE TO5"94 BOARD OF THE TO"IM OF MAPLGLMO ECK,
IF THE COUNTY OF tVVESTCIMSTER, MEW YORK, as follows:
Section. 1. To provide a fund to be expended for any
of the purposes for which funds are appropriated in the
annual estimate of the Town for the fiscal year beginning
January 1 , 1940, the Supervisor is hereby authorized to
borrow the sum of $225,000. 00 at one time, or from time
to time, as the money may be needed on the credit of the
Town, in anticipation of the receipt of taxes for said
fiscal year applicable to such purposes. The Supervisor
shall issue a certificate, or certif icates, of indebted-
ness in tae name of the Town in the principal amount of
such loan or loans pursuant to section 117 of the Town
Law, constituting Chapter 62 of the Consolidated Laws
of the State of i�ew York, as amended.
Section 2. It is hereby determined and declared;
(a) The total amount of taxes estimated to be levied
in said Town for Town purposes for said fiscal year, is
X369,337.50.
(b) The total amount of said taxes outstanding and
uncollected, is 4369,337.50.
( c) The total amount heretofore borrowed and out-
standing in anticipation of the collection of said taxes,
is none.
Section 3. The following matters in connection with
said Certificates of Indebtedness are hereby determined:
Date: January 15, 1940
Maturity: N?ay 15, 1940
Denomination: To be determined by the Supervisor.
Interest rate: To be determined by the Supervisor,
but not exceeding six per centum per
annum.
Numbers: To be determined by the Supervisor.
Form: Substantially in accordance with
resolution adopted January 4, 1939.
Said Certificates of Indebtedness shall be signed by the
Supervisor, countersigned by the Town Clerk and snall have
the Town seal affixed thereto. The Supervisor is hereby
authorized and directed to determine all matters in connec-
tion therewith not determined by this or subsequent resolu-
tion, and to sell said Certificates of Indebtedness at
private sale at not less than par, without advertisement or
public binding, and to deliver the same to the purcnaser
upon receipt of the purchase price, plus accrued interest
from the date of the Certificates of Indebtedness to the
date of delivery.
Section 4. The faith and credit of the Town of
Iviamaroneck are hereby pledged for the punctual payment
of the principal of and interest on said Certificates of
Indebtedness and, unless otherwise paid, or payment pro-
vided for, taxes shall be levied on all the taxable property
in said Town in an amount sufficient to pay said principal
and interest.

Town against the Hillside Holding Corporation, et al . ,
the referee, duly appointed for that purpose by order
of the Supreme Court, sold to the Town of Mamaroneck,

19, 20, 211 28, 299 301 313 323 33, 361 37; Section 1,
Block 54, Lot 33, Section 1, Block 70, Lots 1B, 2B,
3B, 4; Section 1, Block 59, Lots 2, 3, 4, 5, 6, 10,
11, 12, 25, 261 15, 165 292 301 310 32, 337 37, 38, 39,
40 and 41, on the Assessment Map of the Town of Mamaro-

WEEREAS the said referee has applied to the payment
of certain taxes, assessments and tax liens owned by
and due to the Town of Mamaroneck, together with
interest and penalties thereon to the date of sale,
.the suns of X4,177.69, which taxes, assessments and
tax liens are required to be cancelled by the pro-
visions of Section 54 of the 'Westchester County Tax
.Act,

The Town Attorney stated that he had been furnished with
proof in the snape of an affidavit made by Silas S. Clark, Esq.
and a photostatic copy of cneck of Silas S. Clark, that a duplicate
payment of X30.33 had been made on August ist, 1935, representing
the lien sold in the year 1929, covering Lots 2, 4 and 16, Block 89,
Section 1; that this matter had been investigated and searched by
the Comptroller and Deputy Receiver of Taxes, who have determined
that this duplicate payment occurred because of the fact that payment
of this lien was included with the payment of others, made on the
date stated by Silas S. Clark, Esq. attorney for Dorothy Lamb, owner
of the lien and plaintiff in an action to foreclose the same, after
judgment in said action had been entered.
Upon motion made by Councilman F,leginniss, seconded by
Councilman Griffin, it was
RESOLVED that the . sum of 030.33 be repaid to `
Dorothy Lamb or Silas S. Clark, her attorney.
The Town Attorney presented two affidavits, one verified
by Peter C. Doern, Jr. , on January 3rd, 1940 and the other verified
by Anna Lennig, verified the same day, and also a certificate of
satisfaction of a tax lien (humber '78) in the sum of ` 142.55 covering
Section 8, Block 103, Lot 2, which was sold by the Supervisor of the
Town to the Bonded ivunicipal Corporation on June 19th, 1935, which
certificate of satisfaction is dated acknowledged December 29th, 1939.
From the affidavits and the certificate it appears that the amount o*'
the lien in question was paid by George K. :tvlahlstedt, at the time the
owner of the premises affected by the lien, to Peter C. Doern, Jr. ,
who as the agent of George uo'. mahlstedt, paid the same to Bonded Muni-
cipal Corporation, and that this corporation forwarded to Peter C.
Doern, Jr. , the original lien and satisfaction on or about the 24th
of April, 1935 . The original "lien and the satisfaction cannot now
be found although an effort has been made to do so by both Peter C.
Doern, Jr. , a is Mrs. Sophia idiahlstedt, the widow and executrix of
George K. i;'iahlstedt, who has since died.
The affidavit of Anna Lennig provides that she will in-
demnify the Town of tiamaroneck against any loss that may be sustained
by the Town in the event said tax lien is ever found.
The Town Attorney then recommended that a duplicate tax
lien be issued in accordance with the provisions of Section 54 of
the Westchester County Tax Act, same to be furnished to the Receiver
of Taxes together with the satisfaction, to the end that this lien
be cancelled.
Upon motion by Councilman Mandeville, seconded by Councilman
Bates, it was
RESOLVED that the Supervisor be and he hereby
is authorized to issue a duplicate of tax lien
number 78 in the amount of X142.55 covering
Section 8, Block 103, Lot 2, sold by the Town
to Bonded Municipal Corporation on the 19th of
June, 1935, to the end that the same may be
surrendered to the Receiver of Taxes together
with satisfaction thereof, executed by Bonded
Municipal Corporation on December 29th, 1939
and the affidavits of Peter C. Doern, Jr. , and
Anna Lennig, both verified January 3rd, 1940,
and cancelled.
FURTHER RESOLVED that the Receiver of Taxes_
upon receipt of such duplicate lien, satisfaction
and affidavits, cancell the lien upon his records.
The Town Attorney stated that he recommendedtne settlement
of the certiorari proceedings instituted by Larebmont 1urseries, Inc. ,
to review the assessment upon a parcel of property in the Village of
Larchmont known as Section 7, Block 3, Lot 1A, on the basis of a reduc-
tion in the assessment from $23,200. to 7$18, 500. for the year 1939.
Councilman 14andeville , introduced the following resolution,
which was seconded by Councilman Bates, and unanimously adopted:
WHEREAS, heretofore and on or about the 27th day
of September, 1939, a writ of certiorari was ob-
tained by Larchmont Nurseries, Inc. the owner of
Section 7, Block 3, Lot 1A, to review the assess-
ment for the year 1939 upon the premises owned by
it; and
WHEREAS, a return to such writ was duly filed by
the Assessor and Board of Review on or about the
loth day of iuovember, 1939, and no further proceed-
ings have been taken; and
WHEREAS, the Town Attorney and Assessor recommend to
this Board that the proceedings be settled and dis-
continued upon the reduction of the assessment from
x:23,200 to X18,500;
NOW THEREFORE, BE IT
RESOLVED, that the assessment for the year 1939 upon
property known as Section 7, Block 3, Lot !A, assessed
for $23,200 be reduced to X18,500, provided the cer-
tiorari proceeding now pending in the name of Larch-
mont Nurseries, Inc. be discontinued without further
costs to the Town of Mamaroneck.
FURTHER RESOLVED that the Town Attorney is hereby
authorized and directed to sign the necessary stipu-
lation to obtain an order of the Supreme Court pro-
viding for such reduction.
Councilman �4andeville stated that there was nothing to
report for the Highway Department.
Councilman Bates stated that there was nothing to report
for the Department of Sewers and Drains .
Councilman Griffin presented a petition received from the
Assessor with a letter from the attorneys representing one of the
owners of the property, explaining the reason for the request.
On motion by Councilman Grif fin, seconded by Councilman
Bates, the following resolution was unanimously adopted;
Mr. Valentine A. Ely of Rye, New York, appeared and sub-
mitted through his attorney Charles P. Collins a plan for an all
year around outdoor public ice skating rink on the five and one-half
acre tract of land fronting on Palmer Avenue and known as the former
estate of the late Colonel uV. Sackett. Tne gentlemen explained that
through a new refrigeration method which has been employed success-
fully in California, it is now possible to have all year around ice
skating in the open. They stated that the purchase of the land had
been arranged and that they were receiving estimates for the construc-
tion of the project.
Councilman _�t2andeville stated that before proceeding further
he wished to inform the members of the Board that it was through his
business office that Mr. Ely had become interested in the property
mentioned and that he wanted to make it clear that he was now acting
as a councilman and that he would be guided as such in any decision
necessary on the application being presented.
Mr. Collins went on to describe the complete lay-out and
stated that the earth in the lower elevation would be pushed up
to form a sort of bowl. The rink and buildings would be sunk to a
level muen lower than Palmer Avenue and the space for parking cars
would be at a point farthest from Palmer Avenue. He said that he
and his client were aware of the fact that the property was in a
section zoned Residential "A!' and trLat they had appeared to inquire
as to the proper procedure in -making application for a variance in
zoning so as to permit the project.
The Supervisor informed the gentlemen that within the Town
government tnere is a Board of Appeals for Zoning and that all matters
such as this should first be presented to that body. He added that
with the consent of the Town Board he would be pleased to arrange a
joint meeting with the Board of Appeals in order to facilitate matters.
He explained that it would be necessary to hold a public nearing on
the application and tnat the law requires the same to be advertised
fifteen days prior to the date for such. nearing.
The Town Board approved the joint meeting and requested the
Supervisor to complete arrangements for same .
Town Engineer Foote submitted a list of N. P. A. project
proposals, which he stated were ready for the Toi i Board' s considera-
tion.
Following a lengthy discussion, it was upon motion by
Councilman Griffin, seconded by Councilman Bates, upon roll call
(the Supervisor not voting) unanimously
RESOLVED that the Supervisor be and he hereby
is authorized to sign the following W. P . A.

FURTHER RESOLVED, that if and when the above project
proposals receive the approval of the Federal Govern-
mert, the same be re-submitted to the mown Board for
final action before work is started.
The Supervisor called to the attention of the Board that in
connection with N. P. A. projects it has been necessary that a Town
Highway Department truck driver give approximately one-half of his
time to servicing the jobs with supplies, that it requires the full
time of one mechanic to look after the equipment used on the jobs and
that a supervising foreman is required on such construction as roads,
bridges, drains, et cetera. Those performing this work are as
follows: George Osborne, truck driver; Thomas eaddock, mechanic; and
James Dimando, supervising foreman.
Following some discussion it was upon motion by Councilman
Mandeville, seconded by Councilman Griffin, unanimously
RESOLVED that the rate of pay to be paid out of
VT. P. A. funds for the work performed by the
following employees be
George Osborne - truck driver - same as Highway
Department rate.
Thomas Maddock - mechanic - same as Highway
Department rate .
James Dimando - supervising foreman - : 10.00 per
day when project is working the
charge to be made against the
project where work is performed.
The following reports were received and filed: (1) Annual
report of the Mamaroneck Health Center, Inc. for the year 1939; (2)
Report of the Plumbing Inspector for the month of December, 1939;
(3) Report of the Receiver of Taxes for the month of December, 1939;
(4) Report oz the Department of Health of "ffestchester County for the
month of 1Vovember, 1939; and (5) Report of zaamaroneck Health Center,
Inc. for the month of `November, 1939.
