The meeting was called to order by Supervisor t_cCulloch Present: Supervisor _;icCulloch Councilman Bates, Griffin, _vIandeville, iV-eginniss Absent: None Me The presence was also noted of Town Clerk Payne, Town Attor- ney Delius, Assessor Smitn, Comptroller Luceno, and Town Engineer Foote . The minutes of the meeting of November 1, 1939, were approved as presented. The Supervisor asked if there was any one present who wished to address the Board. Mr. E. A. Baum of 44 Glen Road, appeared on behalf of !qrs. Baum to make application for permission to pay certain tax arrears on. a five-foot strip of land known as Section 1, Block 35, Lot 19A, at the face amount . The members of the Board discussed the matter at length with iir. Baum and advised him that it would be necessary for them to deny permission to pay the taxes on the basis suggested. Following further discussion it was on motion by Councilman Bates, seconded by Councilman IUIeginniss, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept payment of the following taxes on Section 1, Block 36, Lot 19A, the liens for which are held by the Town, in the face amount of the liens plus interest computed at 6 per cent per annum, provided payment is :lade witnin thirty days: Tax Sale Amount of Year Year Lien 1935 1936 $ 7, 31 1936 1937 7. 59 1937 1938 8. 05 1938 1939 8.87 Mr. Frank Richelsen of Hillandale Investors Corporation appeared. to request the Board to waive all interest and penalties and to adjust the principal on certain tax arrears on unimproved holdings of the corporation in several sections of the town. He stated tnat they were negotiating with builders witn a view to effecting sales and 'having them build houses; that it is impossible to do so unless an arrangement is made with the Village of Larchmont and the Town of Ivamaroneck for an adjustment of the back taxes. He said that the Village of Larchmont officials had already indicated that they would agree to accept an arrangement to settle the village taxes . Following a lengthy discussion during which ivir. Richelsen was advised that it was not possible to settle on the basis suggested it was on motion by Councilman iciandeville, seconded by Councilman Griffin, upon roll call, unanimously RESOLVED, that the entire matter be referred to the Sunervisor and the Town Attorney for nego- tiations and sower to act on a final settlement with Hillandale Investors Corporation. mr. Howell Perrin appeared and stated that the residents of the unincorporated areahave no access to the water front for bathing, facilities . He suggested that the Town acquire a tract of land consisting of twelve or fifteen acres fronting on what is known as East Creek opposite Flint Park in the unincorporated section near the Village of Larchmont line . Councilman tulandeville pointed out that the property along East Creek does not provide a beach for bathing. Yi,. Perrin suggested that a salt water pool be built and the reniaining portion of the land_ be utilized for playground purposes . Fe stated that he thought the land could be purchased for about 23,000. Councilman !IIeginniss suggested that Mr. Perrin present the plan after the return of prosperity. 11'Ir. Perrin stated that he had appeared. to inquire as to whether or not the State law required the placing of d per cent of the cost of projects in the 1940 budget before a bond issue could be approved. Town Attorney Delius advised that it was not necessary to do so. i'oir. Perrin expressed the opinion that the residents of the unincorporated section would be willing to bear the cost of the pro- ject; also that a movement may be started to petition the Board to hold a referendum in the unincorporated section for such a bond issue . He estimated the approximate cost to each taxpayer for the project. - Councilman Meginniss pointed out that Scarsdale, a resi- dential town, has no water front . Following further discussion the Board decided to lay the matter over for consideration at a time when conditions are more favorable . A letter dated November 27, 1989, received from Mr. Franklin Brooks wits. a pamphlet describing a new reflecting paint for road striping and direction markers, was referred to the r'olice Department . The Town Clerk read a letter dated November 14, 1939, re- ceived from John T. Sugrue, manager of the Suburban Fire-proof Storage Company, Inc. , suggesting that the voting machines be stored in a ware- house. He submitted for the consideration of the Board a rental charge of °51.00 per month per machine . Following some discussion it was decided that the Clerk be directed to advise -ur. Sugrue that the Town Board could not consider the additional expense of warehouse rental for the machines. A letter dated November lb, 1939, received from Chas . N. Sells, Commissioner of Public u'Vorks of the County of ',Westchester, concerning State aid in connection with the removal of snow from State highways was read. He pointed out that the State Comptroller -- had disapproved of the method of reimbursement to the towns and villages and that under these conditions th_e customary agreements between the towns and the county would not be made for the winter of 1939-1940. The letter was ordered received and filed. A letter dated iovember 23, 19:59, was received from J. Sherwood suggesting an ordinance for the control of leashed and unleashed do,_s throughout tine unincorporated area. This and another letter fror,. the County Department of Health with information about conditions in other towns were referred to the Police Department . M A copy of the report of the State Commissioner of Correction dated. November 15 1939, approvixig the Town lock-up was ordered received and filed. A letter dated ieovember 143 1939, was received from John C . Forrar, requesting that the Board consider his application for the appointment of Dog Enumerator for the unincorporated area. The Supervisor asked if there were any other applications on file for this position. The Town Clerk advised that i,,Ir. Forrar was the only one applying for the position. On motion by Councilman Bates, seconded by Councilman Griffin, it was unanimously RESOLVED, that John C. Forrar be appointed Dog Enumerator of the Town of kamaroneck for the year 1940, as required in the Agri- culture and Diarkets Law. A letter dated December 1, 1939, received from the Parent Teacner Council Safety and Healtn Committee concerning the Bicycle Safety Plan, was ordered laid over, pending the recommendation of the Traffic Safety Committee of the Town of Io-Iamaroneck. IV1r. McCulloch informed the Board that mrs. Noodbridge had appeared before the Committee at a meeting held December 5, 193Y. A letter dated November C. Stewart Comeaux, Chairman of t Park Commissioners, setting forth ssion to have the Supervisor sign county-owned property for nursery meat . 28, 1939, was 'received from le Town of lamaroneck Board of the recommendation of the Commi- t lease for the rental of certain purposes for the Town Park Depart- Following some discussion during which the Supervisor pointed out tnat he had arranged with the County for the rental at the rate of QI . 00 annually, it was on motion by Councilman iaandeville , seconded by Councilman Griffii, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to execute the lease by and between the County of Uestchester and the Town of N.amaro- neck covering Parcel 45 and a portion of Parcel 1B, Sheet 9, Pelham-Port Chester Parkway, for a period of one year beginning November 1 , 1939, at the annual rental of $j_. 00, said property to be used as a temporary nursery. The Town Clerk presented a letter dated November 24, 1939, from Er. John rich of Scarsdale Agency, Inc . o« benalf of ivlrs. Alfred LaVoie, Jr. , requesting that the bond given by her deceaseu husband, Mr. Alfred LaVoie , Jr. , in connection with his plumbing license be cancelled, since lie had died. on September 1, 1939. On motion by Councilman Griffin, seconded by Councilman Bates, it was unanimously - pFSOLVED, that the ,luster Plumber' s License No. 3 heretofore issued by the Town of Mamaroneck on August 17, 1938, to Alfred LaVoie, Jr. be cancelled: and be it FJRTNEH RESOLVED, that the bond Royal indemnity Company for the license be also cancelled as of and tnat said company shall not bond for any work done subseque 1939. furnished by the issaance of said September 1 , 1939, be liable upon said .t to September 1, Councilman Leginniss presented a letter dated November 22, 1939, received from lent Builders, Inc. requesting that a parcel of land known as Section 1, Block 6, Lots 34A and 35 be divided in two on the assessment -roll and maps so as to permit the erection of one house at the cost of approximately 125, 000 on one-half; upon the dis- posal of this to build another house on the balance of the remaining lot, all depending upon the Town' s granting relief on certain penal- ties and interest and accrued taxes on the property. They suggested an arrangement whereby they could complete payments to clear the in- debtedness to the Town . Councilman tvleginniss stated that while he did not favor the proposition submitted by the lent Builders, Inc. , he did feel that the Town would profit by a plan which would give some relief to build- ers who come in and improve property. He pointed out that until the property is sold or occupied, they do not require all of the facili- ties provided by the Town. He continued by stating that he had re- ceived calls and had interviewed several builders on the question.. He suggested that Councilman Mandeville with all of his experience in real estate and construction should be appointed to make a study of the question and offer recommendations to the Board'. Following some discussion during which hr. Mandeville made several recommendations, it was on motion by Councilman MeS nniss, seconded by Councilman Griffin, RESOLED, that the application of Bent Builders, Inc. for permission to settle certain tax arrears on Section 1, Block 6, Lots 34A and 36, on the basis set fortis. in the letters dated november 14 and lovember 22, 1939, be denied and that the cor- respondence be turned over to Town Attorney Delius with the suggestion that he discuss the matter with ir. H. K. Ellenbogen, the president of the corpora- tion. On motion by Councilman ,'ieginniss, seconded by Councilman Griffin, it was unanimously RESOLVED, that Lessrs. Glick-Freedman, certified public accountants of new Rochelle, new York, be and they hereby are appointed auditors of the Town of Mamaroneck for the year 1939 at the compensation set forth in the budget, namely, 11,000 . Councilman Leginniss stated that he wished to recommend that the Town enter the New York State Employees ' Retirement System. He explained the plan in detail and pointed out that people in pri- vate employment have protection while the 'Town employees have no protections also that the surrounding municipalities have adopted the plan. Following a lengthy discussion during which Councilman Griffin stated that he was one to urge the adoption of the plan, it was on motion by Councilman ,Teginniss, seconded by Councilman Griffin, RESOLVED: That the Town Board of the Town of Mamaroneck, County of Westchester and State of hew York approve of the inclusion of the officers and employees of the Town of Mamaroneck in the hew York State Employees' Retirment -- System, which system is provided for by Chapter 741 of the Laws of 1920, as amended, being Article 4 of the Civil Service Law and which inclusion, together with conditions of same, is provided for by Chapter 591 of the Laws of 1922 as amended by Chapter 70B of the Laws of 1923, being Article b of the Civil Service Law, with full time service allowance as provided in Chap- ter 140 of the Laws of 1930 and any amendment sub- sequent to 1930 to the said Law, to be effective as of January 1, 1940. The number voting on the resolution was as follows: Ayes: Supervisor McCulloch Councilmen Bates, Griffin, Mandeville , Itleginniss Noes: None The Town Clerk was instructed to notify the State of New York Department of Audit and Control of the action of the Board. Councilman i_+ eginniss presented the following reports for the period January 1 to Diovember 30, 1939, which were ordered filed: (1 ) Statement of Budget Appropriations and Expenditures; (2 ) State- ment of Estimated Revenues; (3) Summary of Receipts and Disbursements. Councilman Griffin stated that there was nothing to report for the Park Department. He presented the regular monthly statement of the Public VVelfare Department of the Town for the month of ilovember, 1939, and compax-ed same with the statement for the same month in 1938. The case load for Noverriber, 1939, was 364 as against 315 last year; in- dividuals 1539 this year and 1256 last year; total relief expended $J_69255.70 this year and 9x"12,247.88 last -year; veteran relief, which is part of the total expended, :1,;2,298.56 this year and y'�i,913. 42 last year; the total expended for food this year was F3'204. 47 and last year g6,159.70; shelter was u5,151.86 this year and $3, 627 .81 last year; fuel was u�1, 131. 64 this year and IU862.32 last year; medical assistance was 5:589. /1 this year and ,' 505. 15 last year; ara the aver- age cost per individual this year was $x. 374 and �'U.354 last year. Councilman Griffin presented a petition dated December7, 1939, received from the Assessor for the correction of the assess- ment roll so as -to permit the apportionment of taxes . On motion by Councilman Griffin, seconded by ,Councilman -- Bates, the following resolution was unanimously adopte ; uVHEREAS, the Assessor has presented a petition dated Decerarer 7, 19395 for the correction of the assessment roll for the year 1958, tales of 1939, pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916, as amended, known as the viestchester County Tax Act; and =REAS, after due consideration this Board finds it desirable to grant said petition for the correction of said assessment roll; NO'�V, THEREFORE, BE IT RESOLVED, that the assessment roll for the year 1938, t^.xes of 1939, which shows property now appearing on the roll as follows: Section Block 4 41A 14 Owner Mr . Section 3. it is nereby determined and declared that the estimated amount of State aid to be received on account of the expenditure of said supplemental appropriation is $'is23, 600. and tnat the local snare of home relief included in said appr-opriatio ., uorrputed as provided by Section 49 of the Public Vi,Telfare Law, is 4,35,400. Section 4. To provide funds to meet the local snare of home relief included in said supplemental appropriation, a Certificate of Indebtedness of the Town of ,'aiamaronecn shall be issued in the principal amount of 435,400. pursuant to the Public Welfare Law. Said Certificate of Indebted- ness shall be designated ``Home Relief Certificate of Ind.ebted- ness" . Section 5. The following matters in connection with said Certificate of Indebtedness are nereby determined: Late : Iecember 7, 1939. Maturity: July 15, 1940 . Interest rate: ® 30,"o per annum, payable at maturity i9uraber: F. R. - l Denomination: X35,400. Forme Substantially in accordance with form adopted October 5, 1933. Said Certificate of Indebtedness snall be signed by the Supervisor and shall have the seal of the ' ol,;n affi.�ed and attested by the Town Clerk. Itie Supervisor is hereby authorized to determine all matters in connection with said Certificate of Indebtedness not determined by this or supplemental resolution, and his signature upon said Certificate shall be conclusive as to such determination. The Supervisor is herebyT authorized and directed to sell said Certificate at private sale at not less than par without advertisement or public bidding, and to deliver same to the purenaser upon receipt of the purchase price -plus accrued interest fro-rn the date of the Certificate to the date of delivery. Section 6 . Any instrument issued pursuant to this resolution shall be a general obligation of the Town, and the faith and credit of the Town are hereby pledged for cne punctual payment of the principal of and interest on said obligation and, unless otherwise paid or payment provided. for, an amount sufficient for such payment snall be inserted in the budget and a tax sufficient to provide -'or payment thereof shall be levied and collected. Councilman Mandeville presented certain highway claims for approval. On motion made by Councilman ?'+'Iandeville, seconded by Council- man Bates, it was, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized, empowered and directed to sign the agreement by and between the Village of Larchmont and the Town of iviamaroneck for the rental of two (2 ) water hydrants on 'Hommocks Road, owned by the Village of Larenmont and to be used by the Town of Mamaroneck for the extinguishment of fire only, the rental charge to be at the rate of !}40. 00 a year. Town Attorney Delius presented a letter dated 1uovember 22, 1959, received from ivtr. Arthur Richards, Village Engineer of Larch- mont, stating that he had been directed by the Village Board to secure a price from the Town Board for the purchase of a strip of land 25 feet wide and 135 feet deep fro.-, the southwesterly side of Lot 28, Block 80, Section 1, which land is owned by the Town. He explained that the purpose of the purchase is to protect the water plant owned by the Village from rock excavating operations which may occur on Lot 28 under some new ownership. Following discussion the members of the Board referred the matter to the Supervisor with. the recommendation that he negotiate for the sale of a 20-foot strip so as to leave a full lot 50 feet wide - also that the method of sale between the 'Town and the Village be the same as that which was used in the sale of the property on Weaver Street by the Village to the Town, namely, on the basis of the assessment . Town Attorney Delius reported that he had conferred with County officials concerning the old riS;ht-of-way of ';leaver Street adjoining the so-called park lot at the intersection of Weaver Street and Palmer Avenue . He stated that he had been informed that they would study the possibility of a transfer of title to the Town and advise hirn at a later date . ir. Delius stated that he had talked with Lr. Thomas il . Fasso , attorney, concerning the application of 'rank Guadagnola for permission to operate buses along the Boston Post Road in the unin- __ corporated section of the Town. IvTr. Fasso informed him that he no longer represented lvir. Guadagnola. P,;r. Delius recommended that the Board consider the plan of appointi.�- a real estate expert to act on an arbitration com- n,ittee for the purpose of completing a settlement of certain actions for the adjustment of assessments on property in the Oriente. Section of the Town. The members of the Board discussed the matter at length and decided to study the plan. Comptroller Luceno presented the renewal of the lease for the premises owned by St . 'Thomas' Church and used by the Town for offices. The terms of the renewal for 1940 are exactly the salve as the terms of the lease for the year 1939. Following some discussion, it was on motion by Councilman S:landeville, seconded by Councilman Bates, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to sign the agreement by and between the Town of lviamaroneck and St. Thomas' Church for the rental of the premises known as 158 West Boston Post Road for the year 1940.
