HomeMy WebLinkAbout1939_11_01 Town Board Minutes M Councilman Bates re-oorted that an estimate of C°-1,503.73 had been received from the Westchester Joint vVater +forks, big. 1 for the installation of a 6-inch water line 430 feet long in Hudson Place to connect with the residence recently acquired by t;lr. E . P . Vier. Councilman 14andeville inquired as to how many houses the main 'mould ultimately serve . Town Engineer Foote advised that it would serve three or four houses. Following some discussion, Councilman Bates recommended that a 1-inch pipe line be installed and asked that the Town Engineer be instructed to get a new estimate from the dater Company. Supervisor1�_cCulloch directed Tovr : Engineer Foote to make a request for a new estimate and present same at the next meeting. Councilman Griffin stated that there was nothing to report for the !ark Department. He presented the regular monthly statement of the Public Welfare Department for the month of October, 1939, and pointed out that the case load rose from 340 in September to 363 in October; individuals from 1451 to 1541 and total relief expended from '415,056 .43 to 817,194. 96. Among other items food rose from 5�;7,833.29 to 88; 941. 98; shelter from P5, 324.32 to q,i5,380.53; fuel from 833. 75 to $932.23; gas and light from `;;849.47 to 8726. 36 and medical from '4418.48 to : 738. 57 . He explained the charges made by the County Hospital at Grasslands and stated that there were 34 cases from Mamaroneck in the hospital at the time . The Town Clerk read a letter dated September 18, 1939, re- ceived from R. J. Nhitney, Village Manager of the Village of Mamaro- neck, suggesting that the Town Board adopt a permanent name for the new road through the Petigor property between Palmer Avenue and tune Boston Post Road. The members of the Board gave careful consideration to all of the suggestions submitted from time to time by organizations and citizens of the Town. Following a lengthy discussion and upon the suggestion of the Supervisor, it was decided to adoot the name of "Richbell Road€" as the permanent name of the road within the unincorporatea. section of the Town. On motion by Councilman Bates, seconded by Councilman Griffin, upon roll call, it was unanimously RESOLVED, that the new road through the Petigor property between Palmer Avenue and the Boston Post Road, lying within the unincorporated section of the Town, be named "Ricnbell Road", which road is more fully described as follows: ALL that certain parcel of land situated in the Town of Viamaroneck, vVestcftester County, New York, and being more particularly bounded and described as follows: BEGI1vivING at a point on the southeasterly side of — Palmer Avenue, formeriy Grove Avenue, said point being distant 319. 69 feet northeasterly as measured along the southeasterly side of Palmer Avenue, from its intersec- tion he northeasterly line of a parcel of land o n i o -with n belonging to the Town of Mamaroneck and described in Liber 3518, Page 303 of deeds on file in the Division of Land Records of the County Clerk' s Office of West- chester County; thence running from said point of beginning and along the southerly line of said Rienbell Road_ the following courses and distances: S. 400 10' 00" E. 214.65 feet to a point of curve; thence on a curve deflecting to the left having a radius of 1400 feet, a M distance of 156. 92 feet to a point of tangency; thence S. 460 350 20" P. 169.68 feet to a point of curve; thence on a curve deflecting to the right having a radius of 540 feet, a distance of 120.85 feet to a point of tangency; thence S. 330 46+ 00" L. 69.53 feet to the point of inter- section of the southerly side of Richbell Road and the boun- dary line between the Town of Pi;amaroneck and Village of Iiia- maroneck; thence along said boundary line -N. 120 590 2210 11. 155.52 feet to a point on the northerly side of Richbell Road; thence along the northerly side of Richbell Road the following courses and distances : on a curve deflecting to the left having a radius of 600 feet a distance of 58.19 feet to a point of tangency; thence 1V. 460 350 20" W. lb9.68 feet to a point of curve; thence on a curve deflecting to the right having a radius of 1340 feet a distance of 150.20 feet to a point of tangency; thence iv. 400 109 00" W.216. 12 feet to a point on the southeasterly side of Palmer Avenue (formerly Grove Avenue ) ; thence along the southeasterly side of Palmer Avenue on a curve deflecting to the right having a radius of 2299.00 feet a distance of 60. 02 feet to the point or place of beginning. Said portion of Richbell Road in the Town of :� amaro- neck, being o0 feet in width and running southeasterly from Palmer Avenue to the boundary line of the Town and Village of uamaroneck. A letter dated October 10, 1939, was received from Thomas N . Fasso, attorney, requesting another hearing before the Board for further consideration of the application of Frank Guadagnola for permission to operate buses along the Boston Post Road in the unin- corporated section of the Town. Following some discussion the matter was referred to Town Attorney Delius. A letter dated October 27, 1939, was received from ''Xilliam. E. Lyon, Jr. , in which he expressed his desire to appear before the Board and read into the record part or possibly all of his testimony given before the Public Service Commission at a hearing on the ap- plication of the Yonkers Bus, Inc. for certain franchise rights. The members of the Board requested the Town Clerk to advise 1;1r. Lyon that the Town has purchased a transcript of all of the testimony before the Commission; also that while the members of the Board sincerely appreciate his co-operation, they feel that in view of the present condition of his health, it would be in his interest for them to accept the record as received, so that it would not be necessary for him to attend a meeting. The following letter dated October 9, 1939, was received from Charles D. DeVinne, Public Welfare Officer: Town Board Town Offices Boston Post Road Mamaroneck, igew York Gentlemen: I am reporting the relief commitment for the Welfare Department for the first eight months of the year 1939 which is as follows : Public Welfare Department - x'$99,131.43 Veteran Relief Commitment - 18,677. 49 This will leave ;¢20'868.57 unexpended for the Public 1'Pelfare Depart- ment . I estimate that we will spend on an average of x;13, 000. 00 a month in that Department for the next three months . In the Veteran Department, there remains 41,322.51 . Their expenditures will average approximately $2,400. 00 a month. There do not seem to be sufficient funds to carry the Veteran Relief Department through the month of October. Me `�, As I estimate, we shall need approximately X45, 000.00 for tree next three months. By adding the Veteran and the Public Welfare Relief together I find that we have $22,191.00 left to our credit. It looks, therefore, as though there will be a deficit of $22, 909. 00 for this year. I an, of course, speaking in gross terms, not net . This will leave a net deficit of approximately $13,745. 00. This condition was brought about to a great extent by the new ruling of the Works Progress Administration which states that men, having worked for eighteen months continuously, would be laid off. These men can be re-certified after having been off without pay for thirty days which, in a majority of cases, would be approximately six weeks. We have re-certified the men as soon as they become eligible and have succeeded in getting some of them back to work. These lay-off's started in August and will continue until all men who have worked continuously for eighteen months have had a lay off. Until this ruling went through we seemed to be keeping fairly well within our budget appropriation, but have since been thrown somewhat out of stride . A letter dated October 11, 1939, addressed to the Supervisor, was received from Pearl R. iviitcLell, Chairman of the Civic Department of The 'Vomants Club of Larcwnont . She advised that the club was sponsoring a meeting on the consolidation of local government and re- cuested that the Supervisor and members of the Board co-operate by formulating questions which may be used as a basis for discussion. The Supervisor informed the members of the Board that ne had replied to the letter. A letter dated October 27, 1939, was received from the Westchester Lighting Company concerning the agreement dated August 17, 1928, made by the Town of Mamaroneck a o. the Westchester Lighting Com- pany, covering the extension of gas mains in the property known as Maple Gardens . They advised that they would extend the period under which refunds would be allowed for a further term of five years from August 17, 1938. Following some discussion it was upon motion by Councilman Bates, seconded by Councilman tariff in, upon roll call, unanimously RESOLVED, that t e Supervisor be and he hereby is authorized to sign the modification of the agreement between the Town of Lamaroneck and the 'Aestchester Lighting Company, covering the extension of gas mains in the property known as l�iaple Gardens, thereby ex- tending the period under which refunds will oe allowed for a term of five years from August 17, 1938. A letter dated October 11, 1 959, was received from Hen- Dillon, R. Dillon, Receiver o1 Taxes, recommending teat the Board consider the application of Dr. Alfred Lateiner for perriission to pay certain taxes at a reduced rate of interest . Following some discussion, it was on motion by Councilman To- andeville, seconded by Councilman Bates, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept payment of the following taxes on the following described property, the liens for which are held by the M Town, in the face amount of the liens plus interest computed at 6 per cent per annum, provided payment is made within thirty days: Tax Sale Amount of Sec. Upon motion by Councilman I'Landeviile, seconded by Councilman Bates, it tiaras, upon roll call, unanimously RESOLVED, that the Comptroller be and he hereby is authorized to transfer from surplus funds the sum of $100 to defray all expenses in con- nection with the purchase of materials for the construction of a shelter for pedestrians at the corner of Seaver Street and Palmer Avenue . Councilman. Griffin presented a petition dated -November 1 , 1939, received from the Assessor for the correction of the assess- ment roll so as to permit the apportionment of taxes. On motion by Councilman Griffin, seconded by Councilman Bates, the following resolution was unanimously adopted: a'r1EREAS, the Assessor has presented a petition dated November 1, 1939, for the correction of the assessment roll for the year 1938, taxes of 1939, pursuant to the provisions of Section 33 of Chapter 10 of the Laws of 1916, as amended, known as the Westchester County Tax Act; and WHEREAS, after due consideration this Board finds it desirable to grant said petition for the correction of said assessment roll; NO`,V, TREREFORE BE 1T RESOLVED, that the assessment roll for the year 1938, taxes of 1939, which shows property now appearing on the roll as follows: Section Block Lot Owner Land Imp. Total 6 65 50 Jason Radding w 6,250 w 6,250 6 65 50A it 11 5,750 5, 750 Town Attorney Delius read a letter dated October 30, 1939, received from Carroll D. kIcCabe of County Attorney Davidsor_' s office, concerning a strip of abandoned highway property on Weaver Street in front of the George L. Bourne Estate in the unincorporated area. The ---- writer advised that they had just discovered that tine strip, which is to be conveyed to Muir. Bourne, is encumbered by a sewer owned and oper- ated by the Town of Mamaroneck; also that it would be necessary that the Town be made a party to the deed of conveyance. Following some discussion the matter was referred to 'sown Attorney Delius ana Town Engineer Foote . Supervisor vicCulloch informed the Board that in his opinion the new road through the Petigor property was suffering from the con- centration of parking on one side . Following some discussion it was decided that the Town Clerk be directed to send a letter to the Police Department requesting them to make a new arrangement for parallel parking on the west side of the road. It was pointed out that this would be necessary for a short time only, because the garages for the apartments were nearing com- pletion. Councilman Griffin informed the Board that the Village of Larchmont intends to charge non-residents for parking in the space for this purpose on the east side of the railroad tracks at the Larchmont Station. He called to the attention of the Board the possibility that this arrangement may cause a large number of people to park their cars in the space within the Station Park on the Town of laamaroneck side . Following some discussion it was decided that the Town Clerk be directed to request Police Chief Yerick to keep a check on the results on the Town side should the Village of Larchmont follow through with the plan mentioned. Supervisor 2uIcCulloch informed the Board that a magazine article concerning the Town of :eiontelair, iiew Jersey, had given rise to considerable comment in this vicinity. The article stated that iviontclair had refunded its debt and the Supervisor stated that his curiosity had caused him to write the township to inquire as to how it was done. Mvr. B. H. Faulkner, Director of the Town of idontclair, advised that the financing was done a year ago when all of the float- ing debt was refunded at an interest rate of 2 1/8 per cent. The issue was for $960, 000. uir. Faulkner stated that he did not recall the exact wording of the article, but that if it gave the impression that the entire bonded debt was refunded, it was in error. The Supervisor referred to the letter received from Public Welfare Officer DeVinne and following some discussion, it was upon motion by Councilman Bates, seconded by' Councilman Griffin, unani- mously RESOLVED, that the Public Relfare Officer be and he hereby is authorized to continue to provide relief to the home relief and veteran relief cases of the Public vuelfare Department until a further appropriation has been provided for the balance of the year 1939. The Supervisor called to the attention of the members of the Board the fact that the opening of the renovated and enlarged Parish House of St . John' s Church would be held on Nednesday, !_ ovember 15, 1939, at 8; 30 P. Pd. He advised that this was the date for the next regular meeting of the Board and suggested that the meeting be held at 5 P. PF.. so that it might be convenient for the members of the Board to attend the meeting at St. John' s Church. The suggestion of the Supervisor was approved by the members of the Board. The Supervisor advised the Board tnat he had made a trip to County Engineer Sells' office at White Plains with Town Engineer Foote to discuss the troublesome sewage problem of the section which includes Fenimore Road, Avon Road and the Winged Foot Golf Club. He stated that P.?r. Young of the County Sanitary Sewer Conuriission and several su pervisors of the towns within the ramaroneck Valley Sewer District were present . He explained that the sewage line within the Town connects with a line within the Village of Mamaroneck and that during heavy --- storms the line becomes over-loaded, causing an overflow through the manholes at a low point in the village . He stated that the purpose of the visit was to request the County to take over the line and correct the condition. Several of those present at the meeting were opposed to the plan of the County accepting the line because of the fact that they were interested only in trunk lines and consid-eyed this a lateral sewer and also because the cost of any repairs would. increase the sewer tax within the district. The Supervisor stated that he had received a call from ','rir. Harold H. Sharp, concerning a drainage conaition in front of his house on Oxford Road. le advised that during heavy storms the sur- face water drains off' tnrough his property. The members of the Board discussed the question with J4r. Foote and ne recommended tnat a drain be constructed along Oxford Road, Dundee Road and Avon Road to connect with the drain at Rockland Avenue . Following some discussion the entire matter was referred to Yr. Foote with the suggestion that ne prepare estimates for the cost of the construction of the drain as recommended. Comptroller Luceno presented the following financial reports for the period January 1 to September 30, 1939: (1) Statement of Receipts ana Disbursements; (2 ) Statement of Buoget Appropriations ana Expenditures; (3) Statement of Estimated Revenues. He also presented a statement of the Highway Funa as of October 11, 1939. The following monthly reports were received and ordered filed: (1) Report of the Receiver of 'faxes for the month of October, (2) Report of the Town Clerk for the month of` September; (3) Report of the Plumbing Inspector for the month of October; (4) Report of the Mamaroneck Health Center for the month of September; (5) Report of the County of fiestchester Department of Health for the month of Sep- tember. At 9: 30 P . Yri. the Board unanimously resolved to adjourn.
