REGULAR MEETING OF THE TOWN BOARD
TOWN OF Mr' MARONE CK, NEW YORE
HELD 'MARCH 15, 1939
At the mown Offices, 158 West Boston Post Road, Mamaroneck, N . Y.
The meeting was called to order by Supervisor icCa11oon
at 8: 00 P . M.
Present : Supervisor McCulloch
Councilmen Bates, Griffin, 14tandeville , Meginniss
Absent : None
The presence was also noted of Town Clerk Payne, Town Attor-
ney Delius, Assessor Smith, Comptroller Luceno and 'sown Engineer
Foote .
The minutes of the meetings of February 15 and March 1 , 1939,
were approved as presented..
The Supervisor asked if there was any one present who .wished
to address the Board.
There being no one, the Board proceeded with the regular
order of business .
Councilman Mandeville stated that there was no report to
make for the Highway Department, as everything is in perfect work-
ing order.
Councilman Bates reported that it would take about another
week_ to complete the sewer construction work at Roxborough Road.
Councilman Griffin reported that the Park Department was
getting ready for the large amount of work necessary during the
sprl_ng of the year.
He presented the regular monthly statements of the 1Velfare
Department for the month of February, 1939, and reported that the
case load. in February, 1939 was 386 as compared with 368 in January,
1939; also that the total expended for relief in February, 1939,
was x'15,895. 33, which included. t[13, 476. 5i for home relief and
,'2, 418.S2 for veteran relief as against X114, 699.43 for January, 1939
which included 812,329. 35 for home relief and J2, 370.08 for veteran
relief. The average cost per individual was $.377 as against 5 . 339
in January, 1939 .
He presented and read the annual report of the ':Welfare
Department for the year 1938.
Following some discussion it was upon motion by Councilman
Mandeville, seconded. by Councilman Bates, unanimously
RESOLVED that the annual report of the Welfare
Department of the Town of 14amaroneck for the
year 1938 be received and filed.
Councilman Meginniss stated that there was nothing to
report on finances .
The Town Clerk presented the following reports which were
received_ and filed: (1 ) The Building Inspector' s report for the
month of February, 1939, (2 ) The 'Town Clerk' s report for the month
of February, 1939; (3) The report of the Mamaroneck Health Center,
Inc, for the month of February, 1939; (4) The report of the County
of -Westchester Department of Health for the month of January, 1939.
The Supervisor stated that in accordance with the action
taken by the Board at its last meeting and in accordance with public
notice duly given, it would be in order for the Board to receive
bids for furnishing summer uniforms for the Police Deoa.rtment . He
thereuaon invited Clair V. Johnson, Chairman of the Board of Police
Commissioners and Chief Yerick, to sit in while the bids were being
opened.
The Town Clerk presented an affidavit of publication of a
notice calling for bids, which was ordered filed.
The Clerk reported that he had received four bids which
the Supervisor thereupon opened. The bids showed as follows;

On motion by Councilman Griffin, seconded by Councilman
Bates, it was unanimously
RESOLVED that the bids and samplesof cloth for
the summer uniforms for the Police Department
be referred to the Board of Police Commissioners
for study and recommendation.
The Supervisor asked if there was any one present who wished
to ad-dress the Board.
Mr. Thomas Tyler appeared on behalf of the New York Good
Humor, Inc , to request that the general ordinances of the Town of
Mamaroneck be amended so as to allow for the purchase of venders'
licenses in the name of the company rather than in the name of the
individual employees . He explained that employees are transferred
and sometimes dismissed and that in each case it becomes necessary
to purchase a new license .
Town Attorney Delius reported that he had conferred with
Yr. Tyler. He pointed out to the members of the Board that the
ordinance in its present form requires that the individual be
examined and approved before the license is issued. He advised
that the Town may lose the opportunity of investigating individual
salesmen if licenses of this type are issued to the companies . He
referred to the other sections of the ordinance which require indi-
vidual licenses an d explained that these licenses are subject to
the approval of the Police Department .
Mr.Clair V. Johnson, Chairman of the Board of Police Com-
missioners, stated that he would like to have the salesmen examined
by the Police Department . He added that the Town should regulate
the number of salesmen by charging the high fee and that the next
thing in importance is to find out who the man is before issuing
the license .
Following further discussion the Board decided to refer
the matter to Town Attorney Delius and the Police Commission for
study and recommendation.
Mr. Hurlbert McAndrew, attorney, appeared on behalf of
➢ erwyn J. Jamieson to request that the Board reconsider the offer
presented by him for an arrangement to settle certiorari proceed-
ings on property known as Section 6, Block 28, Lots 8B and 9,
Tuba McAndrew was granted the privilege of submitting additional in-
formation for consideration and following a lengthy discussion the
Su-pervisor inquired as to the wishes of the members of the Board.
The Board decided upon no change to the action taken at the previous
meeting.
➢ors. Albert B. Liptak appeared before the Board to request
that the Board -reconsider the application for the payment of cer-
tain taxes in the face amount of the lien on property known as
Section 6, Block 26D, Lots 153B and 154.
The Supervisor reviewed the action taken by the Board.
Councilman Griffin advised Fibs. Liptak that he had inspected
the property, that he had also conferred with Mr . Liptak and that
,sir. Liptak could not offer any definite word as to when the taxes
would be paid.

Mrs. Liptak stated that she was prepared to make arrange-
ments to pay $761.40, which amount is the face amount of the liens .
Following some discussion, the Supervisor advised wars. Liptak
that the request would be considered during the executive session of
the meeting and that the Board would advise her by mail.
The Town Clerk read a letter dated March 15, 1939, received
from Henry R. Dillon, Receiver of Taxes, requesting that the Boara
authorize by resolution, as has been customary, the collection of the
state, county, town and district taxes on April 1 , 1939, in fifty per
cent payments.
On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was upon roll call unanimously
RESOLVED, that pursuant to Section 96A of Chapter 60
of the Consolidated Laws as amended, known as the Tax
Law, the Receiver of Taxes and Assessments of the Town
of Mamaroneck is authorized to collect the 1939 State,
County, Town and District taxes, assessments for street
and sidewalk improvements and water rents which become
a lie April 1, 1939, in two partial payments each
amounting to fifty per cent of the total of said taxes,
assessments and water rents;
FURTHER RESOLVED, that the Receiver of Taxes and
Assessments is authorized, and empowered to receive
such partial payments or instalments of taxes, assess-
ments and water rents at any time prior to the sale of
tax liens but subject to the same penalties as are
specified and provided in Section 18 of Chapter 105 of
the Laws of 1916 as amended, for the neglect to pay the
total amount of said taxes; assessments and water rents;
FURTHER RESOLVED, that the acceptance of any such partial
payment or instalment of the 1939 taxes, assessments and
water rents shall not be deemed to affect in any manner
any right of the Town of Mamaroneck under any General or
Special Law to enforce collection of any unpaid balance
of such taxes, assessments and water rents as may remain
due and owing to the Town of Mamaroneck but such rights
and porters shall remain in full force and effect to
enforce the collection of the unpaid balances of such
taxes, assessments and water rents together with interest,
penalties and other lawful charges.
The Town Attorney stated that it would be in order for the
Town Board to designate the newspaper in which the Receiver of Taxes
and Assessments should publish the notice of the collection of the
State, County, Town and District Taxes, Special Assessments and Water
Rents, which levies become due and payable on April 1, 1939.
On motion duly made and seconded, it was upon roll call
unanimously
RESOLVED, that in accordance with the provisions of
Section 26 of the Westchester County Tax Act, The
Daily Times, the official newspaper published in the
Village and Town of Mamaroneck, be and it hereby is
designated as the newspaper in which the Receiver of
Taxes and Assessments shall publish the notice of the
collection of State, County, Town and District taxes,
Special .assessments and water rents; and be it
FURTHER RESOLVED, that said publication be made on
March 21, 1939; and be it
FURTHER RESOLVED, that in accordance with the provisions
of Section 26 of the Westchester County Tax Act, the
Town Board do and it hereby does direct the Receiver of
Taxes and Assessments to mail to each taxpayer of the
Town of Mamaroneck, whose address is known to said
Receiver of Taxes and Assessments, a tax bill for all
taxes, assessments and water rents, the expense thereof
to be a town charge.

The Town Clerk read a letter dated March 155 19391 received
from Henry R. Dillon, Receiver of Taxes, requesting that the Town
Board adopt a resolution recommending to the Receiver of Taxes that
all receipts for taxes paid by check other than certified checks ,
banker' s checks or money= orders, be held for five days after the
check has been deposited..
Following some discussion it was upon motion by Councilman
1,.'a.ndeville, seconded by Councilman Bates, unanimously
RESOLVED, that it be aiid hereby is recommended that
on and after April 1, 1939, the Receiver of Taxes of
the Town of Mamaroneck shall hold for a period of five
days after the deposit of the check all receipts for
taxes paid by check other than certified checks, banker° s
checks and. money orders.
The Town Clerk read a letter dated. Il--larch 15, 1939, received
from Henry R. Dillon, Receiver of Taxes, recommending that a heavy
wire partiition be installed in the tax office, so as to afford ad-
ditional protection in handling the business of the office .
Following some discussion during vahich the members of the
Board expressed their approval, the matter was referred to Supervisor
PJlcCulloch and Comptroller Luceno to arrange for the expenditure ne-
cessary and to report back at the next meeting of the Board.
The Town Attorney stated that he was prepared to make a
report on the matter concerning the request of the attorney repre-
senting Louise Fatton for the cancellation of the 1925 school tax,
sale of 1926, in the amount of ;112.56 on property known as Sec-
tion r , Block 9, Lot 13. He read an affidavit received from the
attorney and displayed original memoranda from the files of the
attorney.
Following a lengthy discussion during which the. members of
_ the Board examined the affidavit and papers submitted, it was upon
_ motion by Councilman i:-andeville , seconded by Councilman Bates, upon
-roll call ( Councilman 1�t1eginniss not voting) unanimously
RESOLVED, that satisfactory* evidence having been
produced that the 1925 school tax on property owned
by Louise Fatten and known as Section %, Block 9,
Lot 13, have been paid, said taxes be and they hereby
are cancelled; and be it
FURTPLR RESOLVED that the Receiver of Taxes be and
he hereby is authorized to cancel all such taxes
and that copies of this resolution be furnished the
Receiver of Taxes, the Comptroller and the property
owner or his representatives.
Comptroller Luceno informed the Board that Public Welfare
Commissioner DeVinne had inquired. about the salary to be paid.
Lester C. Short for his services as veteran relief officer.
On motion by Councilman Bates, seconded. by Councilman
Griffin, it was unanimously
RESOLVED that the salary for the year 1939 of Veteran
Relief Officer Lester C. Short be fixed at the sum.
of !s60. 00 a month, payable monthly commencing with
the first day of March, 1939.
The following escrow agreement was presented. by Comptroller

THIS AGREEMENT, made this 15th day of March, 1939, by
and between THE COUNTY TRUST COIVPANY, a domestic banking corporation,
having its principal place of business at No. 169 Main Street, '1`hite
Plains, Westchester County, New York, party of the first part, and
TOW-IN OF MA117ARONECK, a municipal corporation having its principal
place of business in the Village of Mamaroneck, V'Vestchester County,
New York, party of the second part, NIITYIESSETH-
RESOLVED that contingent liability policy No. CL32116
of the Hartford Accident &:, Indemnity Company coverin
the Town of Mamaroneck against loss on claims for pub-
lic liability and property damage on '01. F. A. projects
be and it hereby is approved, and that same be turned
over to the Town Clerk to be filed.
The Board thereupon went into executive session.
The Board decided to reconsider the application of Mr. and
Mirs. Albert B. Liptak for permission to pay certain tax liens at the
face amount .
Following a lengthy discussion during which the members
of the Board considered among other things the fact that I',Irs. Liptak
had made a definite proposal for the payment of the taxes, it was
upon motion by Councilman Griffin, seconded by Councilman Mandeville,
unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accept payment of the following taxes on the follow-
ing described property, the liens for which are held
by the Town, in the face amount of the liens, provided
payment is made within thirty days-

Following the executive session the Board resumed the
regular order of business .
Councilman ,7eginniss reported that he had presented a re-
presentative of the New York State Retirement System to the employees
of the Town at a meeting held Iviarch 7, 1939. He explained the plan
in detail to the members of the Board and advised that he had re-
ceived a. petition from the employees expressing their willingness
to enter the system.
The members of the Board_ commended Mir. Neginniss upon the
able report presented and it was upon motion by Councilman Mandeville ,
seconded. by Councilman Bates, unanimously
RESOLVED, that the Committee appointed to study
the Ne•rr York State Retirement System as it would
apply to the Town of Mamaroneck be discharged
with thanks .
The Board decided not to enter the State Retirement System
at this time because of the effect that the large contribution as the
To-n' s share would have upon the tax rate.
Councilman Mandeville recommended that Tol,^in Attorney Delius
be requested to look into the law to see if there is some other
method providing for pensions . The Board requested Pr. Delius to do
SO.
At 11; 15 P. M. the Board unanimously resolved to adjourn.
