TOWN OF MAMARONECK, NEW YORK
HELD FEBRUARY 15, 1939
At the Town. Offices, 158 "Nest Boston Post Road, Mamaroneck, 1u. Y.
The meeting was called to order by Supervisor McCulloch at
8:00 P . P.r.
Present : Supervisor McCulloch
Councilmen Bates,Griffin, Meginniss
Absent: Councilman Mandeville
The presence was also noted of Town Clerk Payne, Town Attorney
Delius, Assessor Smith, Comptroller Luceno and Town Engineer Foote .
The minutes of the meetings of January 7 and January 19, 1939,
were approved as presented.
The Supervisor asked if there was any one present who wished
to address the Board.
There being no one, the Board proceeded with the regular
order of business.
Councilman Bates reported that the sewer construction work
at Roxborough Road was progressing quite rapidly.
Councilman Griffin presented the report of the Park Commission
and the complete file of correspondence concerning the contractors'
proposals to maintain the parks throughout the unincorporated section
of the town.
Following some discussion it was decided that the Town Clerk
should be directed to pass the report and file around to the members
of the Board for study before taking action at the next regular meet-
ing.
Mr. Griffin presented the regular monthly statements of the
Welfare Department and pointed out that the case load in January, 1939
was 368 as compared with 359 in January, 1938; also that the total
expended for relief in January, ,1939 was 014,699.43, which included
?12,329.35 for home relief and $2,370.80 for veteran retie£ as against
�p16,066.87 for January, 1938, which included 812, 628.28 for home re-
lief and 4p3,438.59 nor veteran relief. The average cost per individual
was $.339 .as against 1.333 last year.
Mr. Griffin stated that with the permission of Mr. Mandeville
he was prepared to submit the report on the matter concerning the size
of signs to be placed on property for sale and for rent in the unin-
corporated area. He reported on the study made by the committee
and displayed several templets cut out of paper to the size of signs
most commonly used. He stated that the committee recommends a
12-inch by 18-incn size as being well proportioned to meet all purposes.
Following some discussion during which the members of the
Board expressed their approval of the 12-inch by 18-incn sign, it was
decided that the Town Attorney should be requested to include this
recommendation with the proposed changes to the Building Code .
On motion by Councilman Bates, seconded by Councilman Nleginniss,
it was unanimously
RESOLVED, that the committee appointed to study the
question concerning the size of "For Sale " and "For
Rent11 signs for property in the unincorporated area
be discharged with tnanks.
Councilman Griffin presented a petition dated February 8,
1939, from the Assessor for the correction of the assessment roll
so as to permit the apportionment of taxes.
On motion bar Councilman Griffin, seconded by Councilman
Bates, upon roll call, the following resolution was unanimously
adopted:
WHEREAS, the Assessor has presented a petition dated
February 8, 1939, for the correction of the assessment
roll for the year 1938, taxes of 1939, pursuant to the
provisions of Section 33 of Chapter 105 of the Laws of
1916, as amended, known as the Westchester County Tax
Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petition for the correction
of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll for the year 1938,

The Supervisor informed the Board that he had had a conference
with the representatives of the three veteran_ posts of the town, and
that the Larchmont Post of the American Legion had suggested that we
do not have a veteran_ relief officer. But the other two posts stated
that they desired to have Mr. Lester C. Short appointed as veteran
relief officer.
The Supervisor stated that the three posts were advised that
before any item for veteran relief would be inserted in next year' s
budget, the Town Board would insist upon a rigid adherence to all of
the requirements as given in the Veteran Relief Law.
The Supervisor advised the Board that much to his regret, it
would be necessary for him to report an unpleasant experience which
occurred in the office on February 14, 1939. Puss Lillian E.
Ravenscroft appeared at the office and requested permission to look
at certain town records, including two cancelled checks which repre-
sented the payment of the purchase price of the so-called pump site.
When the checks were displayed to her, she seized them and started
to leave the office . The Comptroller requested her to return the
checks. She refused to do so and it was necessary to call the
Village of Mamaroneck police. She finally returned one of the checks,
but refused to return the other, and it became necessary for the police
to remove her to the village police court where the authorities pre-
ferred charges.
The Supervisor advised the Board that he had made a trip to
Albany on February 9, 1939, with Town Attorney Delius to attend a
conference of town and county attorneys concerning the constitutional
amendments which became effective January 1 , 1939,
Councilman Piteginniss reported that the Board of Education had
held a meeting and had advised that they have enough money available
to carry on until April 1, 1939.
The Supervisor asked if there was anyone present who wished
to address the Board.
Pair. Fred H. Rubin, attorney, appeared on behalf of the
Dawil Realty Corporation to request that the Board consider the
settlement of the certiorari proceeding affecting property known
as Section 4, Block 35, Lots 1 to 6 and 7A.
Following a report that he had conferred with the Assessor,
the Town Attorney stated. that he recommended the settlement of the
certiorari proceeding instituted by Dawil Realty Corporation to
review the assessment upon a parcel of property in the Town of Mama-
roneck, known as Section 4, Block 35, Lots 1 to 6 and 7A on the basis
of a reduction in the assessment from x$185,000 to $155,000 for the
year 1938.
Upon motion made by Councilman Bates and seconded by Council-
man Griffin, the following resolution was adopted:
WHEREAS, heretofore and on or about the 30th day of
September, 1938, a writ of certiorari was obtained by
Dawil Realty Corporation, owner of Section 4, Block 35,
Lots 1 to 6 and 7A, to review the assessments upon the
premises owned by it; and
WHEREAS, a return to such writ was duly filed by the
Assessor and Board of Review on or about the 15th day
of November, 1938, and no further proceedings have
been taken; and
WHEREAS, the Town Attorney and Assessor recommend to
this Board that the proceedings be settled and dis=
continued upon the reduction of the assessment from
$185, 000 to $155, 000;
NOW, TFEREFORI', BE IT
RESOLVED, that the assessment for the year 1938 upon
property known as Section 4, Block 35, Lots 1 to 6
and 7A, assessed for $185, 000 be reduced to $155,000,
provided the certiorari proceeding now pending in the
name of Dawil Realty Corporation, be discontinued
without costs.
FURTHER RESOLVED, that the Town Attorney is hereby
authorized and directed to sign the necessary stipu-
lation to obtain an order of the Supreme Court pro-
viding for such reduction and discontinuance.
Town Attorney Delius reported that the attorney representing
Elsie 1,1. H. Gaskill had offered to arrange a settlement of the cer-
tiorari proceeding affecting property known as Section 6, Block 63,
Lots 11A, 11B, 23E and 23F.
Following some discussion, the Board decided to refer the
matter to the Town Attorney for study.
The Town Attorney presented four bills, which he recommended
that the Board approve and request the Legislature to enact, in order
to establish and validate the existence of Lighting District No. 1,
Fire District No. 1, and Water Supply District No. 1, and also to
obtain authority from the Legislature to submit to the voters of
Fire District No. 1 the proposition for the purchase of fire apparatus
and the issuance of bonds to pay for the same .
Upon motion of Councilman Bates, seconded by Councilman
Griffin, the following resolution was unanimously adopted:
WHaREAS it is considered desirable to obtain acts of the
Legislature, establishing and validating the existence
of Lighting District No. 1, Fire District No. 1 , and
Water Supply District No. 1 of the Town of Mamaroneck
and also to obtain authority from the Legislature to sub-
mit to the voters of Fire District No. 1 of the Town of
Mamaroneck, the proposition for the purchase of fire
apparatus and the issuance of bonds to pay for same, if
such proposition is adopted by the voters; and
WHEREAS 'in order to carry out such plan, the Town Attorney
has drafted and presented to this Board, enabling legis-
lation which he has submitted to Assemblyman Theodore Hill
for introduction in the Assembly and to Senator Pliny
Williamson for introduction in the Senate; and
WHEREAS it is considered necessary to obtain a request
from the Board of Supervisors and the County Executive
of Westchester County to the Legislature for the enact-
ment of such bills in accordance with the provisions
of Article IX, Section 1B of the Constitution, as amended,
and the joint rules adopted by the Senate and Assembly of
the State of New York, on February 1st, 1939;
NOW, THEREFORE, BE IT
RESOLVED that this Board hereby does approve the follow-
ing four bills, viz:

AN ACT to establish fire district number
one of the town of Mamaroneck and to
ratify and confirm all proceedings heretofore
taken in connection with the creation and
extension of said fire district, and the
levy and collection of taxes in said fire
district .
The People of the State of New York, represented in
Senate and Assembly, do enact as follows-
Section 1 . A fire district having the territorial limits
described in section two of this act is hereby established and
— declared to be a valid and subsisting fire district with all the
powers of a fire district under article eleven of the to-an law and
the name of such fire district shall be fire district number one of
the town of Mamaroneck.
Section 2. It is hereby declared and determined that the
territorial limits of said fire district include the following
described property lying and being in the town of Mamaroneck,
'Westchester county, New York, and outside of any incorporated city
or village, bounded and described as follows-

town of Mamaroneck, more particularly bounded and described
as follovrs-
Beginning at the southwesterly corner of the town of
Mamaroneck, and the southeasterly corner of the city of New
Rochelle and running thence along the southeasterly line of
New Rochelle northeasterly by the mean center line of
Premium Mill Pond and Premium River to a point; thence
northwesterly along the easterly boundary line of New Rochelle
to the southerly line of the Boston Post Road; thence north-
westerly along the easterly line of New Rochelle to the north-
westerly corner of the town; thence northeasterly along the
southerly boundary line of the town of Scarsdale to the center
line of the Mamaroneck River and the westerly line of the town
of Harrison; thence southerly along the center line of the
Mamaroneck River and the westerly boundary of the town of
Harrison to the northerly corner of the village of Mamaroneck;
thence south, southwesterly and southeasterly along the
westerly boundary line of the village of Mamaroneck to Flagler' s
Wharf on Edgewater Point; thence northwesterly across Larchmont
Harbor to the center line of Iliunroe Inlet, between Cedar Island
and the Hommocks and thence northeasterly, northerly and north-
westerly by the center line of East Creek and the westerly boun-
dary line of the village of Larchmont to the Post Road; thence
northwesterly along the easterly boundary line of the village
of Larchmont to the northerly side of the New York, New Haven
and Hartford Railroad right of way, and the northeast corner
of the village of Larchmont; thence southwesterly along said
right of way line and the northerly boundary line of the village
of Larchmont to the northwest corner of the village of Larch-
mont; thence southeasterly along the westerly boundary line
of the village of Larchmont to the Boston Post Road; thence
easterly along the-northerly line of the Boston. Post Road and
the southerly boundary line of the village of Larchmont to the
westerly line of Dean Place, if extended northerly to the
northerly line of -the Boston Post Road; thence southeasterly
along the westerly line of Dean Place and Oak Avenue to Mean
High Water line on the easterly side of Premium River; thence
southerly along the easterly line of Premium River and Premium
Mill Pond which is the westerly line of the village of Larch-
mont, to and across the easterly end of Premium Point to the
waters of Long Island Sound, being all of the town of Mama-
roneck, excluding the village of Mamaroneck and the village
of Larchmont .
Section 3. All acts and proceedings taken by the town
board of the town of Mamaroneck and by the board of supervisors
of Westchester county in relation to the creation and extensions

of the boundaries of a fire district to include the property herein-
above described and the levy and collection of taxes in said district
are hereby legalized, ratified and confirmed.
Section 4. This act shall take effect immediately.

AN ACT to establish lighting district number one of
the town of Mamaroneck and to ratify and confirm
all proceedings heretofore taken in connection with
the creation and extension of said lighting district,
and the levy and collection of taxes in said district .
The People of the State of New York, represented in

Section 1 . A lighting district having the territorial
limits described in section two of this act is hereby established
and declared to be a valid and subsisting lighting district with
all the powers of a lighting district under article twelve of the
town law and the name of such lighting district shall be lighting
district number one of the town of Mamaroneck.
Section 2. It is hereby declared and determined that
the territorial limits of said lighting district include the
following described property lying and being in the town of Ma-
maroneck, Westchester county, New York, and outside of any in-
corporated city or village, bounded and described as follows;

New Rochelle and running thence along the southeasterly

River and the westerly line of the town of Harrison;

Section 3. All acts and proceedings taken by the town
board of the town of Mamaroneck and by the board of supervisors
of IVestchester County in relation to the creation and extensions
of the boundaries of a lighting district to include the property
hereinabove described and the levy and collection of taxes in said
district are hereby legalized, ratified and confirmed.
Section 4. This act shall take effect immediately.
AN ACT to provide for the submission of a proposition
to the voters of fire district number one of the town
of Mamaroneck for the purchase of fire apparatus for
said fire district and, if such proposition is adopted,
authorizing the issuance of not to exceed twenty-two
thousand dollars bonds of the town of Mamaroneck to
provide for said purchase .
The Peo le of the State of New York , represented in
Senate and Assemble, do enact as follows:
Section 1. The town board of the town of Mamaroneck is
hereby authorized to submit to the electors of fire district
number one of the town of Mamaroneck at a special -election a
proposition in substantially the following form:
"Stall fire district number one of the town of
Mamaroneck purchase fire apparatus at a cost not
to exceed twenty-two thousand dollars, such
apparatus to consist of an aerial ladder truck
and a pumper to cost, respectively, not to exceed
thirteen thousand dollars and nine thousand dollars?"
Notice of the time and place of such election, together with a
copy of the proposition to be submitted thereat, shall be published
once in a paper published in the town of Mamaroneck at least four-
teen days before the date of such election and shall be posted in
at least five public places in said district for the same period
of time . Such election shall be held at the present fire house,
Edgewood road, town of Mamaroneck, and the votes shall be canvassed
by three special election officers appointed by said town board. The
vote on such proposition shall be by ballot. To entitle a person
to vote upon such proposition he or she must be a resident taxpayer
owning taxable real property in said fire district.
Section 2. If such proposition shall be adopted, the said
town board may purchase an aerial ladder truck and a pumper at costs
- not to exceed the respective sums of thirteen thousand dollars and
nine thousand dollars for said fire district, and to defray the cost
thereof is hereby authorized to issue bonds of the town of Mamaroneck
in the total principal amount of twenty-two thousand dollars. Said
bonds shall be in the denomination of one thousand dollars each,
shall be signed by the supervisor and attested by the town clerk under
the corporate seal of the town and shall be paid in annual installments
within not exceeding five years from the date of said bonds, the first
of which shall mature not more than one year from the date of said
bonds. Said bonds shall bear a rate of interest not exceeding six
per centum per annum and shall be sold at public sale upon notice
published as provided in section nine of the general municipal law
for not less than par value plus accrued interest . Such bonds may
be in coupon form with the privilege of conversion into fully
registered bonds and may contain a recital that they are issued
pursuant to this act, which recital shall be conclusive evidence
of the validity of said bonds and the regularity of the issuance
thereof. The period of probable usefulness of both the aerial ladder
truck and said pumper is hereby determined to be six years.
Section 3. The bonds authorized and issued as in the
preceding two sections provided shall be a charge upon the town
of INiamaroneck and its full faith and credit shall be pledged therefor,
and the amount necessary to pay such bonds and the interest thereon
as the same becomes due shall be collected from the property within
such fire district. The town board shall annually transmit a
statement of the amount due for the payment of said bonds and the
interest to the board of supervisors of the county, and such board
shall levy such sums against the property liable, and the amount of
such taxes shall be extended against such property in a separate
column of the annual tax roll. Such taxes when collected shall be
paid to the supervisor and by him applied in payment of such bonds
and interest .
Section 4. This act shall take effect immediately.

Attorney and respectfully requests the Legislature
of the State of New York to enact the same, and
respectfully requests the Governor of the State of
New York to approve the same, when so enacted; and

FURTHER RESOLVED that the Supervisor and Town Attorney
are authorized and directed to obtain from the Board
of Supervisors of Westchester County and the County
— Executive, the necessary request to the Legislature,
pursuant to the provisions of Article IX, Section 1B,
of the Constitution, as amended, in the form required
by the Joint Rules Committee in the Senate and
Assembly of the State of New York, to the end that
these bills may be enacted by the Legislature; and

amendments being made by the Legislature of the
State of New York, provided the same do not sub-
stantially or materially alter the provisions thereof.

The Supervisor presented a letter dated February 14, 1939,
received from Senator Pliny W. Williamson, enclosing copies of two
of his bills which had been passed by the Senate, namely Senate Int.
377, Print 389 and Senate Int. 489, Print 506. The letter was
ordered filed.

Mr. Austin K. Griffen, attorney, appeared before the Board
to request that the zoning ordinance be modified so as to allow the
erection of multi-family dwellings on approximately ten acres of pro-
perty owned by the Warranty Realty Company and known as Section 3.
Block 16B. He stated that his client was prepared to sign a contract
for the sale of the land and that the purchaser had planned to erect
dwellings to house two hundred and seventy-six (276 ) families.
Councilman Meginniss inquired about the type of construction
of the proposed buildings.
IEIr. Griffen stated that the plans had not been presented to
him but that he understood that the buildings were to be two and one-
half stories in height and built of brick. He said that he would
be pleased to submit the plans and other information in connection
with the proposed project.
Supervisor McCulloch advised Mr. Griffen that the property
referred to is now zoned in what is known as 'IF" Classification and
that the entire question concerning zoning throughout the Town has
been referred to the Board of Appeals for Zoning. He suggested
that Mr. Griffen present complete information concerning the proposed
project, so that the Town Board may confer with the Board of Appeals
for Zoning.
Mr. Griffen advised the Board that he would present the
necessary information before the next regular meeting of the Board.
Town Attorney Delius reported that he had received from
the Graybar Electric Company, Inc . the revised copies of the
contract for the purchase of the radio equipment for the Police
Department and recommended the approval of the same .
On motion by Councilman Bates, seconded by Councilman
Meginniss, it was upon roll call ( Mr. Griffin not voting) unanimously
RESOLVED, that the contract between the Graybar
Electric Company, Inc. and the Town of Mamaroneck
— for the installation of a Western Electric Police
Radio System in the Town of Mamaroneck, in the
amount of Ih3,880. 00, fifty per cent due and payable
upon completion of installation and the balance due
and payable December 31, 1939 with interest at 6%
per annum, be and it hereby is approved; and be it
FURTHER RESOLVED, that the Supervisor be and he
hereby is authorized to sign the above contract
on behalf of the Town of Mamaroneck.
Town Attorney Delius requested that the Board authorize
him to continue proceedings in connection with the foreclosure
action brought by the County Securities, Inc, against Daisy Belle
Palmer and Jennie May Palmer, and others, as the attorney repre-
senting the defendants has carried the case to the Court of Appeals .
On motion by Councilman Griffin, seconded by Councilman
Bates, it was upon roll call unanimously
RESOLVED, that the Town Attorney be authorized
to continue the proceedings in connection with
the foreclosure action brought by County
Securities, Inc . against Daisy Belle Palmer,
Jennie May Palmer, and others .
The Town Attorney stated that he had received a request
from the attorney representing Louise Fatton for the cancellation
of the 1925 school tax, sale of 1926, in the amount of 5112.58 on
property known as Section 7, B1oc7 9, Lot 13.
Following some discussion the matter was referred back
to the Town Attorney.
Town Attorney Delius reported progress on the matter
concerning the New York, New Haven & Hartford Railroad station
at Larchmont.

The Supervisor requested the Comptroller to present a
complete statement of all moneys expended for -Id. P.A. work, cash on
hand in the banks and accounts receivable .
The Supervisor thereupon submitted the following report
which was upon motion by Councilman Bates, seconded by Councilman
Griffin, unanimously approved;

FURTHER RESOLVED, that all of the above mentioned N. F.A.
projects, representing all such projects sponsored by the
Town of Mamaroneck to date, be approved and the action of
the Supervisor in signing the project applications is
hereby confirmed; and it is
FURTHER RESOLVED, that this resolution shall supersede all
other prior resolutions with regard to the sponsorship of
any and all W. P. A. projects in the Town of Mamaroneck and
the expenditure of money for such projects, and that any and
ail resolutions of this Board sponsoring or approving of any
other U1. P. A. projects are hereby rescinded in so far as
they sponsor or approve 'Ill. P . A. projects other than listed
as aforesaid.
The Supervisor called to the attention of the Board. the impor-
tance of not exceeding the amount of money which is now available for
W. P . A. projects, as the Town will be unable to sell additional bonds
because of the question concerning constitutional amendment No. 1, He
stated that the Comptroller and the Town Engineer had prepared a plan
for the continuance of W. P. A. projects.

The Superintendent of Highways reported that the Labor Depart-
ment of the State of New York had served notice upon him that pneumatic
drills and jack hammers must be provided with an appliance to prevent
dust hazard, as provided in Section 222-a of the Labor Law and unless
such appliance is installed on or before March 1, 1939, the use of such
drills or jack hammers must be discontinued.
The Comptroller reported that there was an unexpended balance
of $1,498. 98 in the Machinery Fund of the highway budget, the same
being carried over from the year 1938.
Councilman Bates moved and Councilman Griffin seconded the
following resolution:
RESOLVED that the Supervisor and/or Superintendent
of Highways be authorized to contract for the pur-
chase of an appliance to prevent dust hazard for a
sum not to exceed $1,300 and to charge the same to
the highway budget of the Town.
A vote taken on the foregoing resolution resulted as follows:

The Supervisor informed the Board that he had received a
request from 14ayor Harry E. Goeckler of the Village of Larchmont
for funds in the amount of $25,000 for materials required during
1939 for VV. P. A. projects now under way in the Village of Larchmont .
He stated that it was impossible to consider this request until definite
word had been received concerning legislation permitting the sale of
bonds for W. P. A. projects.
The Supervisor stated that he had been requested by the Works
_ Progress Administration to approve a supplement to project No. Ma®129-B
for the construction_ of and the installation of a sanitary sewer and
water main in the Petigor Road from Palmer Avenue to Boston Post Road.
He stated that no further sponsor' s contributions would be required,
but that an additional amount of Federal funds was needed.
On motion by Councilman Meginniss, seconded by Councilman
Bates, it was unanimously
RESOLVED, that the Supervisor be and he hereby
is authorized to sign Supplement No. 1 to W. P. A.
Project No. Ma- 129-B for the construction of and
the installation of a sanitary sewer and water main
in the new street from Palmer Avenue to Boston Post
Road, the amount of Federal Funds involved being
$10,185.00.
Following some discussion the Town Engineer was instructed to
notify the Larchmont Development Company, Inc. that additional funds
in the amount of $1,500 will have to be deposited with the Town Comp-
troller in order to complete the sanitary sewer from Palmer Avenue
to or near the town line to serve the new apartments.
The Board considered the letter dated January 30, 1939, which
had. been received from -Wm. E. Thrasher, General Superintendent of
Westchester Joint Water Works, No. 1, at the previous meeting, fur-
nishing an estimate of the cost of a proposed extension of the water
main in Roxborough Road.
On motion by Councilman Griffin, seconded by Councilman Bates,
the following resolution was unanimously adopted:
VVN_F�REAS' an estimate. dated January 30, 1939, has
been received from Westchester Joint Water Works .
No. 1 in the amount of $1,161.85 of the cost of
the installation of 130 feet of 6-inch transite
pipe from Bonnie Briar Lane to Highland Place and
260 feet of 2-inch copper pipe to dead end, Rox-
borough Road;
NOW, THEREFORE, BE IT
RESOLVED, that the 'Westchester Joint [later Works,
No. 1 be and it hereby is authorized, empowered
and directed to install for the Town of Mamaroneck
the water main above described and to charge to the
Town the actual cost of haying the pipe, the Town
to do the trenching, backfilling and paving.
The Supervisor stated that the term of Mr. A. Stirling Smith,
as a member of the Board of Appeals for Zoning would expire on Febru-
ary 19, 1939.
Following a lengthy discussion in which all of the members
of the Board praised Mr. Smith very highly for his part in the work
done by the Board of Appeals for Zoning, it was upon motion by Coun-
cilman Griffin, seconded by Councilman Mleginniss, unanimously
RESOLVED, that A. Stirling Smith be and he hereby
is re-appointed a member of the Board of Appeals
for Zoning to succeed himself for the term of office
beginning February 19, 1939, and expiring February 19,
1944.
On motion by Councilman Griffin, seconded by Councilman Bates,
it was unanimously
RESOLVED, that Town Councilman Edward B. Meginniss
be and he hereby is appointed a member of the Board
of Trustees of the Police Pension Fund to succeed
himself for the term of office beginning January 1,
1939 and expiring December 31, 1939.
The Town Clerk read a letter dated February 15, 1939, received
from Mr. Charles M. Baxter, Jr. , President of The Old Town of Paamaro-
neck Historical Society, requesting that the Town Board appropriate a
sufficient amount to erect six ( 6 ) signs emphasizing the historic
— character of the Town and to be placed on the following thoroughfares:
(1) The Boston Post Road; (2) Palmer Avenue Extension; (3) Weaver
Street ; (4) Fenimore Road; (5) Old White Plains Road; (6) Mamaroneck
Avenue . He also inquired about the Boston Post Road milestone now
at Davenport' s Neck, New Rochelle, on the property of Judge Rutherford.
Following some discussion the Board directed the Town Clerk
to inform Pair. Baxter that much to their regret they can not comply
with his request, as the Town can not afford the expenditure necessary
for the erection of the signs, and that the matter concerning the
Boston Post Road milestone had again been referred to the Town Attorney.
The Town Clerk read a letter dated February 6, 1939, received
from Town Attorney Delius, in which he reported that he had examined
the statutes referred to in the letter of Mr. Charles Heywood, Janu-
ary, lB) 1939. He suggested the following:
"Any change in this statute should be in the form of
an act of the Legislature of the State of New York.
Apparently, Mr. Heywood suggests that the amendment
should provide that this section should not prohibit
the advertisement of any piece of property as being
located in a district or area which bears the name
of a postal district as established by the federal
government.
"if you wish any further action taken in connection with
the matter, will you please advise me . It would seem
to be something that the Real Estate Board might well
consider and act upon, if the statute is to be amended. "
The letter was ordered filed.
The Town Clerk read a letter dated February 5, 1939, received
from Deputy Receiver of Taxes Leo N. Orsino, in which Par. Orsino
stated that he had received an application from Louis H. Pink, Super-
intendent of Insurance of the State of New York, as Liquidator of the

Equitable Mortgage & Title Guaranty Co. , for the apportionment of a
tax lien affecting property known as Section 4, Block 15, on the tax
map of the Town of Mamaroneck, which lien was acquired by the Town
of Mamaroneck at the tax sale held on May 25, 1938.
Following some discussion the letter was referred to Town
Attorney Delius.
The report of the Building Inspector for the month of January,
1939, was received and filed.
The report of the Receiver of Taxes for the month of January,
1939, was received and filed.
The report of the Town Clerk for the month of January, 1939,
was received and filed.
The report of County Transportation_ Company, Inc. , in accord-
ance with the terms of consent granted by the Town of Mamaroneck and
as prescribed in the twenty-fifth paragraph, for the year ending
December 31, 1938, was received and filed.
The report of Mamaroneck Health Center, Inc. for the month
of January, 1939 was received and filed.
At 11:00 P. M. the Board unanimously resolved to adjourn.
