HomeMy WebLinkAbout1938_11_15 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YORK. HELD NOVEMBER 153 1938 At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y. 8: 00 P. M. The meeting was called to order by Supervisor McCulloch at Present: Supervisor McCulloch Councilmen: Bates, Griffin, Mandeville, Meginniss Absent: None The presence was also noted of Town Clerk Payne, Assessor Smith, Town Engineer Foote, and Comptroller Luceno. The minutes of the special meeting of the Town Board held September 26, 1938, were approved as read. The Supervisor asked if there was any one present who wished to address the Board. There being no one, the Board pro- ceeded with the regular order of business. Councilman Bates reported that the work in connection with the repairing of the sewer at Murray Avenue near Maplewood Street was complete . Councilman Griffin stated that the regular monthly reports for the Park and Welfare Departments had been handed in at the last meeting and that there was nothing further to report. Councilman Meginniss presented the following reports: (1) Statement of Budget Appropriations and Expenditures as of Octo- ber 31, 1938; (2 ) Statement of Estimated Revenues for the Period _ January 1 to October 31, 1938; and (3) Summary of Receipts and Dis- bursements for the Period January 1 to October 31, 1938. The Board approved the reports and ordered the same re- ceived and filed. Mr. Meginniss reported that all of the departmental esti- mates for the 1939 budget had been received. He recommended that the meetings for the purpose of considering the estimates with and before representatives of the taxpayers' organizations and indivi- duals as approved at the last Town Board meeting be as follows : the meeting to consider estimates on items which affect the tax rate for the general town to be held on November 25, 1938, at 8 P. M.. and the meeting to consider estimates on items which affect the tax rate in the Town outside of the incorporated villages be held on November 29, 1938 at 8 P. M. The Board approved the recommendation of Mr. Meginniss and agreed that, if necessary, arrangements be made with the Super- intendent of St . Thomas' Church property for space in the adjoining building so as to accommodate all who wish to attend. The Supervisor requested that the regular order of business be suspended in order to hear those who desired to address the Board. Airs. Albert Miller of the Village of Mamaroneck appeared before the Board to make application for the payment of certain tax arrears at a reduced amount. Following some discussion the matter was referred to the Town Attorney. Mrs. W. R. Liptak of Rye, New York, appeared before the Board to make application for the payment of certain tax liens at a reduced rate of interest. She stated that she had not been aware of the fact that it was necessary to pay Town and school taxes on her property located in the Village of Larchmont and known as Section 6, Block 26D, Lots 153B and 154; also that when she purchased the pro- perty, she had not been informed about the town and school taxes and that she had not received any bills until recently. The Board was advised that the town tax office had obtained the address from the village of Larchmort tax office. Following some discussion the matter was referred to Council- man Griffin with the request that he inspect the property and report back to the Board at the following meeting. Mr. George Burchell, attorney, appeared on behalf of Harry A.Rose to make application for the payment of certain tax liens on unimproved property at a reduced rate of interest. Lowery, Commander of Mamaroneck Post No. 90 of the American Legion, appeared" before the Board to inquire about the appointment of a veteran relief officer. He informed the Board that his post and the David Potts, Jr. , Post No. 1156, Veterans of Foreign Velars, had agreed upon the appointment of Lester Short of Mamaroneck. The Supervisor advised 162r. Lowery that he understood the law to read that the appointment of a veteran relief officer was entirely up to the veterans and that the Town Board could only acknow- ledge notice of the appointment. He added that the Board was con- cerned about the compensation, if any, as it would be necessary to include same in the 1939 budget. He also advised Mr. Lowery that no definite work had been received from L rchmo nt Post N o. 347 of the American Legion. Councilman Mandeville reported that the streets of the Town are in good condition and that the work in connection with the re-surfacing of Myrtle Boulevard had been completed; also that he and Town Engineer Foote had prepared estimates of the cost to the Town for the collection of garbage with town-owned equipment . He stated that while there was some question as to whether or not the Town could effect a saving by doing this work, he would recommend that the bid. papers, if any, for a contract should include the follow- ing requirements in the specifications- no motor truck or motor behicle shall be used in performing work under this contract which was manufactured prior to 1936; that the trucks should be equipped with a proper arrangement for the purpose of covering the load; and that all equipment of the successful bidder be exhibited for inspection by the Town Board before the contract is signed. Following some discussion it was upon motion by Councilman Mandeville, seconded by Councilman Griffin, unanimously RESOLVED, that bids for the collection of garbage in Garbage District No. 1 of the Town of Mamaroneck for the year beginning January 1, 1939, be received by this Board at its meeting on December 7, 1938, at 8 P. 1J. ; and be it FURTHER RESOLVED, that notice of said receipt of bids be given by publishing it in "The Daily Times" on November 30, 1938, and in "The Larchmont Times" on December 1, 1938. Councilman Mandeville recommended that some consideration be given to the possibility of requiring licenses for oil trucks being operated in the unincorporated area. He pointed out that licenses are required in some of the surrounding communities. The Board referred the matter to the Town Attorney with the request that the same be considered along with other proposed amendments to the General Town Ordinances. The Board went into executive session with the following representatives of The Old Town of Iviamaroneck Historical Society: is'Ir. Charles M. Baxter, Mrs. 1ft. H. Smith, I'dlr. 1117illiam Fulcher and Mr. Charles C. Ding. Following the executive session the Board resumed the regular order of business. Town Attorney Delius presented the following resolution and recommended that it be adopted. On motion by Councilman Meginniss, seconded by Councilman Mandeville, the following resolution was unanimously adopted: WHEREAS in foreclosure proceedings instituted by the Town against Walter F. On motion by Councilman Mandeville, seconded by Councilman Bates, it was unanimously RESOLVED, shE REAS the Town Board unanimously adopted a resolution on October 19, 1938, cancelling certain taxes and assessments on Section 1, Block 80, Lots 6, 7 and 23; and Ylb# WHEREAS the Special Assessment Fund owed to the General Fund the sum of $3,266.34, representing the following unpaid assessments on Section 1, Block 80, Lots 6 and 7, for the payment of prin- cipal and interest on the bonds issued for the cost of the Myrtle and Madison Avenue Improve- ment, namely: Assessment Tax of 1938 ° 294.85 Assessment Tax of 1937 - Sale of 1938 - 304.94 - Assessment Tax of 1936 - Sale of 1937 - 2341. 43 Assessment Tax of 1935 - Sale of 1936 - 325. 12 � 43266 .34 hoff, THEREFORE, BE IT RESOLVED, that the sum of $3,266.34 owing to the General Fund by the Special Assessment Fund be cancelled, and the Supervisor be authorized to correct toe book records accordingly. Following a lengthy discussion concerning insurance costs and the estimate of premiums for the year 1939 furnished by Edward A. Keeler, it was on motion by Councilman Mandeville, seconded by Councilman Meginniss, upon roll call, unanimously RESOLVED that the Supervisor appoint a committee of three citizens experienced in the insurance business to make a complete survey of the insurance covering the Town of Mamaroneck. The Supervisor appointed the following gentlemen: Mr. Robert H. Goffe, Jr. of the Village of Larehmont; Mr. J. Joseph Rossbottom of the Town of Mamaroneck and Mr. Fred T. Wilson of the Village of Mamaroneck. The Town Clerk read a letter dated November 7, 1938, received from John C. Forrar of 10 VVildwood Road, Town of Mamaroneck, applying for re-appointment as Dog Enumerator for the year 1939. Following some discussion it was upon motion by Council- man iveginniss, seconded by Councilman Griffin, upon roll call, unanimously RESOLVED that John C. Forrar be appointed Dog Enumerator of the Town of Mamaroneck for the year 1939, as required in the Agriculture and Markets Law. A plot plan and application for permission to erect a garage at the corner of Fifth Avenue and Valley Place, which was received from Mary Ronconi, was referred to the Board of Appeals. At 11:30 P.
