HomeMy WebLinkAbout1938_08_06 Town Board Minutes SPECIAL M.EETING OF THE TOuON BOARD TOWN OF M AMARONECK, NEW YORK HELD AUGUST 6, 1938 At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y. The meeting was called to order by Supervisor McCulloch at 12:45 P. M. Present: Supervisor McCulloch Councilmen Bates, Mandeville , Meginniss Absent: Griffin The presence was also noted of Town Clerk Payne and Town Attorney Delius. Mr. Frank Gagliardi, representing Mr. Morris Petigor, made application for permission to enter upon a strip of property 50 feet ' . wide running from Palmer Avenue in a southeasterly direction for the purpose of constructing and paving a 25-foot roadway and its drain- age system. The property had been conveyed to the Town of Mamaro- neck for street purposes by the heirs of Alexander C. Campbell and by Morris H. Petigor and wife . Following a lengthy discussion it was upon motion by Councilman Meginniss, seconded by Councilman Mandeville, upon roll call (the Supervisor not voting) unanimously RESOLVED, that the Supervisor be and he hereby is authorized to sign the following letter: Clark, Gagliardi, Cunningham d Bailey, Esquires Attorneys for Mr. M. H. Petigor Northcourt Building White Plains, N. Y. Gentlemen: This is to advise you that your clients are permitted to enter upon property of the Town of Mamaroneck heretofore con- veyed to it for street purposes by the heirs of Alexander C. Campbell and by Morris H. Petigor and wife, which is a strip 50 feet wide running from Palmer Avenue in a southeasterly direction, for the purpose of constructing and paving a 251 roadway and its drainage system. The permission is given, however, upon the following conditions: (1) That your clients pay the entire cost of materials, labor and any other incidental charges and expenses for such construction. (2) That the work be done in accordance with specifica- tions and plans to be approved by the Town Engineer of the Town of Mamaroneck. (3) That the work be carried on under the general super- vision of the Town Engineer of the Town of Mamaroneck. (4) That your clients will indemnify the Town of Mamaroneck from any and all claims for damage to persons or property during the period of construction of said roadway and the drainage there- for and will obtain policies of public liability insurance to cover such damage to person or property in such amounts and in such form as the Town Engineer and Town Attorney will recommend and ap- prove. Such liability on the part of your client shall continue until the 25' roadway is fully completed and the construction there- of finally approved by the Town Engineer of the Town of Iviamaroneck. Z # y 1 It is understood that nothing contained in this permit shall in any way limit or restrict the right of the Town of Mama- roneck to own and maintain the street known as Campbell Street as conveyed and dedicated to it by the aforesaid deeds.
