At the Town Offices, 158 '.vest Boston Post Road, Mamaroneck , K. Y.
The meeting was called to order by Supervisor H-1cCulloch at
8: 00 P . M.
Present: Supervisor McCulloch
Councilmen Bates, Griffin. Mandeville, Yeginniss
Absent : :Bone
The presence was also noted of Town Clerk_ Payne, Town
Attorney Delius, Town Engineer Foote, Town Assessor Smith, Comptroller
Luceno and Building Inspector Cowltam.
The Town Clerk submitted the minutes of the meetings of
May 18 and June 1, 1938, which were approved as corrected.
The Supervisor asked if there was any one present who
wished to address the Board.
Mr. Robert L. Capp of New Rochelle, I�ew York appeared on
behalf of several taxi operators of the Village of Larc'nmont and of
the Town of 'iamaroneck. He stated that a number of taxi cabs under
the supervision of John Ross were being operatea at low fares between
Mamaroneck and Iiew York City and that they were using space near the
Larchmont Gardens railroad station and the parking area near the
Chatsworth Gardens Anartments as stations for their cabs. He said
that the owners operating with low rates woulddrive the other cab
owners out of business. He asked if the Board could do something
about it.
Mr. Frank Guadagnola of the Town of Mamaroneck also appeared
to ask the same question.
The ,Supervisor asked if the owners operating, at the low
rates were residents of the Town and. if they have hack licenses.
The Tom Clerk reported that applications for hack licenses
had been received from the individual owners who are operating at
the low rates and that the same had been forwarded to the Police
Commission for approval as called for in the General Town Ordinances.
Fie stated that some were residents of the Town and others were not .
The Town Attorney advised that the operators have to meet
certain reo_uirements of the Board of Police Co.rnissioners before a
license is granted and that it is not necessary to be a resident of
the To.,in in order to receive a license .
The Supervisor informed the group that the Town could not
exercise any control over rates charged. He said that he would
check with the Police Department to find out if any of the Town' s
ordinances were being violated by the use of the locations mentioned
as terminals .
..'!r. Frank Guadagnola appeared before the Board to inquire
about his application for a consent to operate buses along a pro-
_ rosed. route on the Boston Post Road in the unincorporated part of
the Town of i,iamaroneck.
The Supervisor informed Mr. Guadagnola that the Town Board
had laid the matter over, pending the action of the Village of La.rch-
mont and the Village of Mamaroneck. He stated that the reason for
this action was that only a small part of the proposed route is in
the unincorporated area of the Town.
Mr. Walter C. Burbank, Larchmont realtor, appeared before
the Board to present a request by Burton C. Idieighan, Jr. , as Trustee
of the Estate of 0Villiam T . ;rood., deceased, that certain property in
the Town of Mamaroneck known as the "Red. Lion Inn" on the Boston Post
Road be used as a roadside furniture shop or store.
Following some d-scussion, it 1nras upon motion by Councilman
Griffin, seconded by Councilman Bates, upon -roll call unanimously
RESOLVED, IVciEREAS, Burton C. Eeighan, Jr. , as Trustee
of the Estate of Arms T. ffood, deceased, has presented
a request that certain property in the Town of Mamaro-
deck known as the "Red Lion Inn" on the Boston Post
Road owrued. by him, novv zoned "F" on the Zoning 11ap
of the TovJn of Mamaroneck and which heretofore and
prior to the adoption of any Zoning Ordinance was
used as a roadhouse or restaurant, be used as a
roadside furniture shop or store;
NOSWJ THEHEFORE, BE IT
RESOLVED, that such request be granted and that the
property bounded and described as follows.
ALL that certain plot, piece or parcel of
land, together with the building thereon, situate,
lying and being in the Town of Tuiarriarcneck, County
of Westchester and State of New York and more
particularly bounded and described as follows.
BEGINNING at a point on the southeasterly side
of the Boston Post Road in said Town, said point
being distant northeasterly 409.72 feet as measured
along said southeasterly side of said Boston Post
Road. from the point of intersection of said south-
easterly side of said Boston Post Road with the
northerly side of Honzmocks Road- running thence from
said point of beginning and through land of the
Estate of William T . .rood on a course south 600 27' 20"
East a distance of 79. 49 feet; thence north 630 289 20"
east a distance of 40 feet more or less to a point in
a line drawn parallel to the southeasterly side of
Boston Post Road and distant therefrom 100 feet, thence
along said last mentioned line and continuing in a
northeasterly direction 100 feet distant from the said
southeasterly side of Boston Post road a distance of
150 feet; thence on a course north 530 12' 00" 1,,7est a
distance of 100 feet to the said. southeasterly side of
the Boston Post Road; running thence along the said
southerl7; side of the Boston Post Road the folloiving courses
and distances; south 3p0 40' 10" west 15 feet south
380 479 10" west 157 .80 feet, south 300 519 20" *est
14.89 feet to the point or place of be.nning, be the said
several dimensions more or less;
together v,.ith the buildings thereon erected may be used
as a roadside furniture shop or store and that a permit
therefor pursuant to .Section 7 of the Zoning Ordinance
of the Town of Mamaroneck is hereby granted.
Mr. Burbank presented an application made by Burton C .
Meighan, Jr. , as 'Trustee of the Estate of 'Nilliam T. 'Wood, deceased,
for permission to use certain property now Zoned ,r r F" he Zonin.on t r
Map of the Town of Mamaroneck for the purpose of erecting thereon
a building to be used as a roadside restaurant or cafeteria.
,i.r. Gerald Campbell, builder, residing in the Tovan of Mama-
roneck, submitted plans, specifications and plot plan for the proposed
building which is of the type or kind generally kno*rfn as "Dutchland" .
