HomeMy WebLinkAbout2019_12_18 Town Board Minutes December 18, 2019 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON DECEMBER 18, 2019, BEGINNING AT 5:00PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION Additionally Present: Tracy Yogman Comptroller and Lindsay Luft Administrative Assistant On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Work Session was unanimously opened at 5:00PM. OUT OF ORDER Proposed Community Solar Agreement Additionally Present: Frank Owens Mr. Altieri distributed a redlined version of the Agreement and an email from James Pochez of Sunlight General outlining the final negotiated items 1. Termination Value 2. Termination Table for Extensions 3. No Alteration of Facility (language) 4. Nameplate 5. Roof Repair Costs. Mr. Owens and Mr. Altieri presented to the Town Board the final negotiated items. The environmental law firm of Sid Paget reviewed the agreement and their comments have been incorporated. This item was moved to the regular agenda for this evening. The next step will be the inspection of the Ice Rink Roof, noting that the agreement states the developer will put up $10,000 toward any necessary roof repairs. The Town can make the necessary repairs or opt out without penalty. Councilwoman Elkind Eney stated that she would prefer no signage be placed at the rink noting the panels. 2020 Preliminary Town and Fire District Budget The Town Board noted that the additional schedules provided by the Town Comptroller were straight forward and need no further discussion. The Town Board reviewed the Capital project Schedule. Supervisor Seligson noted a recent discussion with the Village of Larchmont regarding the Sanitation Budget. Mr. Altieri will prepare a detailed memo outlining these discussions for review at a future meeting. Parking Lot Permits The Town Board reviewed the prepared resolution and moved it forward for approval this evening. Correspondence from Kate Beeby The Town received a letter from Kate Beeby discussing a number of topics including Rock Removal.. Mr. Altieri prepared a suggested review method of the letter for the Town Board. The Town Board noted that a full review of the Rock Removal law would take place after the Land Use Boards have had a chance to review and comment. 1 December 18, 2019 New Business Councilwoman Katz noted that the LMCTV Budget does not have any significant changes in terms of revenue streams, but rather reflects reductions in expenses. Essentially the Budget does not readdress their business model. Councilwoman Elkind Eney stated that the Governor signed the Fire Department law regarding qualifications for chiefs in combination fire departments. Many Departments’ had worked hard to prevent the passage of the law, but unfortunately, our efforts were not successful. Supervisor Seligson received a call from Congresswoman Nita Lowey notifying the Town that $21 million had been awarded to the Long Island Sound Study for restoration of Long Island Sound. Supervisor Seligson was thrilled, as she has been working with Congressman Lowey for 28 years on this funding. Supervisor Seligson stated that she met with Peter Feroe of AKRF and Melissa Kaplan Macy. Supervisor Seligson believes Mr. Feroe is aware that the Town was not happy with the original draft of the scope and that he is aware of what the Town wants and will convey this fully to his staff. Supervisor Seligson is confident that Ms. Kaplan Macy will guide this project effectively. On motion of Councilwoman Fiddelman, seconded by Councilman King, the Board unanimously agreed to enter into an Executive Session to discuss litigation. EXECUTIVE SESSION Litigation On motion of Councilman King, seconded by Councilwoman Katz, the Board unanimously agreed to resume the Regular Meeting. Correspondence from Michael Katz The Town Board reviewed the written comments submitted by Mr. Katz at the last Town Board meeting. The Board agreed that they will not move forward to require leaf bagging, they will place a no littering sign along Boston Post Road, and does not plan to lower the fine for parking in a fire lane. With respect to Burton Road, Mr. Altieri will contact the building management and ask, again, for the installation of a gate, especially in light of the new law eliminating the left turn out of the Trader Joe parking lot. The Town may discuss these issues further with Mr. Katz. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents are welcome to attend. PUBLIC HEARING – (Adjourned) 2020 Preliminary Town Budget and Fire District Budget The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING ADJOURNED TO DECEMBER 18, 2019 PRELIMINARY 2020 TOWN BUDGET and PRELIMINARY TOWN OF MAMARONECK FIRE DISTRICT #1 BUDGET NOTICE IS HEREBY GIVEN, that a Public Hearing will be held by the Town Board and the Board of Fire Commissioners of the Town of Mamaroneck, on Wednesday, December 4, 2019 at 8:00 PM, Town Center, 740 West Boston Post Road, Mamaroneck, New York, to consider the Town’s Preliminary Budget and the Mamaroneck Fire District Preliminary Budget for the calendar year 2 December 18, 2019 commencing January 1, 2020 and ending December 31, 2020. All citizens are invited to attend and provide written and oral comments and ask questions concerning the Preliminary Budgets. The Preliminary Budgets can be inspected by the public from 8:30 AM to 4:30 PM, beginning Monday, December 2, 2019, in the Town Administrator’s Office, Town Center, 740 West Boston Post Road, Mamaroneck, New York. The 2020 Preliminary Budget may also be viewed on the Town’s website www.townofmamaroneckNY.org PLEASE TAKE FURTHER NOTICE, that the proposed salaries of the members of the Town Board are as follows: Supervisor, $39,807 Town Council (4) $6,369 each and the proposed salary for the Town Clerk is $101,566 and the Town Justices (2) $22,070 BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Stephen V. Altieri Budget Officer To be published: Wednesday November 27, 2019 On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Public Hearing was unanimously reopened. Supervisor Seligson asked Mr. Altieri to give a brief overview of the Budget, noting that a full presentation was done at the last meeting, and no comments have been received from the public. Supervisor Seligson asked if anyone wished to comment on the proposed Local Law. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously closed. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was approved, RESOLVED, that the Mamaroneck Town Board does hereby adopt the 2020 Preliminary Town Budget and the 2020 Preliminary Fire District Budget as the final 2020 Budgets. The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye SUPERVISOR’S SUMMARY REPORT December is a busy time of year for Town officials as there are many community holiday events and year end business to take care of. Our most important job is to pass the budget this evening. We will continue the public hearing on the budget and then take action. Other business includes the County Shared Services vote earlier this week. The County has to present a proposed Shared Service report to the State as required by law. I’m happy to report that the Town of Mamaroneck had more shared service proposals than any other municipality. The State has promised to provide matching funds for money save through shared services. Two proposal examples for the Town are purchasing a sewer camera truck with the Village of Mamaroneck and arranging for the School District vehicles to use the Town’s fueling station at Maxwell Avenue. County Legislator Catherine Parker held a County budget public meeting in the Town on th December 7. Steve Altieri and I presented the Town and Sanitation budgets to the Village of Larchmont trustees Monday night. 3 December 18, 2019 WJWW is required by the US EPA to build a water filtration plant in the next few years. It will be a large and expensive project paid for by the three municipalities of WJWW - Town of Mamaroneck, Village of Mamaroneck and Town/Village of Harrison. The proposal is to build the plant on property at WC airport. The manager of WJWW, Paul Kutzy, and I made a presentation to the Board of Legislators Environment, Health and Energy Committee last week on the project. Everyone should have received the Town newsletter with an insert regarding the Love Your Food program in the mail last week. Please refer to the Love Your Food website and FB page to find encouragement and helpful hints on how to reduce wasted food for the holiday season. The Town, along with the two Villages and many volunteer leaders will be helping get the word out about the 2020 Census update. Please plan to respond to the Census form as soon as you receive it. It is most important that we count all residents so we receive the appropriate federal and state funding and congressional and county representation. Each person counted brings approx.. $2,500 a year in funding to the Town. I’ve participated in several meetings reporting the sustainability progress and environmental programs of the Town. It is nice to be recognized for our good work. rd Next week, the week of December 23 is the final week for leaf collection. The last day for set out th is December 27. The holiday sanitation schedule will be announced by the end of the week. It will be on the website and Steve will issue a robo call. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board. Michael Katz addressed the Town Board, seeking comments from the Town Board on his submittal of comments in writing to the Town Board at the last meeting. Supervisor Seligson stated that yes, the Town Board had reviewed his comments and at this time is not interested in moving forward with requiring leaves to be bagged. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Katz, seconded by Commissioner Fiddelman, the Board of Fire Commissioners was unanimously declared open. Other Fire Department Business Commissioner Elkind Eney congratulated the newly reelected Fire Chiefs, Joe Russo, Shawn Hughes and Tom Broderick, and thanked them for their continued service to the Town. There being no further business to come before the Commission, on motion of Commissioner Elkind Eney, seconded by Commissioner Fiddelman, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Set Public Hearing – Mechanical Rock Removal Law Deferred 2. Resolution – Town Parking Lots On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the following was approved WHEREAS, the Mamaroneck Town Board has determined that for budgeting purposes, and greater efficiency the Town Parking Lot Permits should be valid for the Town’s fiscal year (calendar year), and WHEREAS, in order to accomplish this, multiple permit types will be offered that are valid from June 1, 2020 through December 31, 2021, and 5 December 18, 2019 WHEREAS, a nineteen (19) month permit is being offered in order to lock in the permit rate fee and avoid possible permit fee increases for the year 2021, and WHEREAS, a seven (7) month option is being offered which will expire on December 31, 2020, and WHEREAS, no semiannual option will be offered until the permit year January 1, 2022 through December 31, 2022.
