The meeting was called to order by Acting Chair C. Alan Mason at 8:12 p.m. APPROVAL OF MINUTES Dr. Mason asked if the Board members had reviewed the draft Minutes of February 9, 2000 and if there were any amendments. There being none, on a motion made by Ms. Aisen, seconded by Mr. Papazian, the Minutes were approved. Dr. Mason read the application as follows: PUBLIC HEARING -FRESHWATER WETLANDS AND WATER COURSES PERMIT -Levine- 10 Evergreen Lane,Block 309,Lot 21(adjourned 6/9/99;7/14/99;8/11/99;9/8/99;10/13/99;11/10/99;12/8/99;1/12/00 to 3/8/00) Dr. Mason advised those present that both parties requested an adjournment, as the Town has made a change in engineers and everyone is agreeable. On a motion made by Ms. Aisen, seconded by Ms. Harrington, it was unanimously RESOLVED, that the Public Hearing be, and hereby is,adjourned to the April 12,2000 Planning Board meeting. Dr. Mason read the next application as follows: PUBLIC HEARING -FRESHWATER WETLANDS AND WATER COURSES PERMIT - Stephen le. Land - 29 Mohegan Road, Block 208, Lot 546 (adjourr.zd 12/8/99;2/9/00) On a motion duly made Mr. Papazian, seconded by Ms. Aisen, it was unanimously Planning Board March 8,2000 Page 2 O RESOLVED,that the Public Hearing be,and hereby is,declared open. The Public Stenographer was present for this meeting and her transcript will become a permanent part of this record. John Slaker,the Landscape Architect that has been working with Mr.Land on the preparation of the plans for his pool,addressed the Board. Since the last meeting he informed the Board that the services of Mr. William Morganroth,an engineer,had been retained to assist them in the design of the drainage system. Percolation tests were performed at the site to determine the ability of the soils to absorb any of the storm water where they would be placing the drainage facility. The only area that was acceptable is at the far back end of the pool towards the north side. Ledge rock was discovered to be about 1 ft.under the service in a lot of areas in the upper area coming toward the street. He stated that Mr.Morganroth went through the Westchester Soil Conservation Service Design Manual for the design of the system. The system is based on the 25-year design storm and it has accounted for all the impervious surfaces plus the additional runoff potential from the swimming pool itself. The pool itself has the ability to contain some of the water in a rain storm,but there would be some runoff. The drainage system has been designed to account for all the new impervious surface and the excess runoff from the swimming pool. Dr.Mason said in reading the calculations it appears that Mr.Slaker is using the top 4 in.of the pool for retention,with which Mr.Slaker agreed. Mr.Capicotto said in some places the pool is not considered an impervious surface. The pool will only have about 4 to 5 inches of space at the top and it has been designed for a 5.7 in.storm. Technically the © pool will hold the first 4 inches and then 1.7 inches will runoff from the pool. Dr.Mason said they are then committed to use that 4 in.as well as other areas,with which Mr.Capicotto agreed. Mr.Capicotto said if the water is pumped off,it will be after the storm is ended. Mr. Slaker said the only other change made is that they added two catch basins to the site,one to the south,one to the north at the west end so that anything that's is picked up in the swale to the south side would be collected in the system and anything that runs off the patios and the terraces on the north side would be picked up. That prevents any flow off the site from the impervious surface. He thinks he has addressed the concerns of the Board. Dr.Mason asked if Mr.Capicotto has reviewed the entire package. Mr.Capicotto said yes. T1 sy reviewed the percolations and the drawings. They had some comments on the earlier version of the drawing which have been addressed on this version. This meets the Town Code and its compatible with the wetlands both with the State and the Town ordinance code. Dr.Mason asked Mr.Slaker to walk the Board through the retention facility at the top,which Mr.Slaker proceeded to do. Mr.Slaker said there is a small detail on the bottom of the sheet that was submitted. He also brought a cut from the catalogue to help the Board understand what these are,and explained what the system will entail. Q Dr.Mason asked if it will all be at the same elevation,with which Mr.Slaker agreed. Mr.Slaker said they are placing about 2 ft.of topsoil over this and there will be plantings all along the back side of the property which will also help any flow that runs off the actual slope itself which will be slowed down by those plantings. That area will not be lawn. Planning Board March 8,2000 Page 3 O Dr.Mason asked about the existing life of the chambers. Mr.Slaker said he is not sure. Mr.Capicotto said it is dependent upon individual circumstances. In this case,if they are providing a sump in those catch basins it should extend the life of the chamber. It is the same thing they use all around the Town,these and catch basins. This is actually providing more surface area. It should further extend the life of this,than if you had a catch basin that would concentrate all the flow in one spot. Mr.Slaker also pointed out and since they are wrapping the stone in the back by the retaining wall with a filtered fabric,it will also help keeping the soil from infiltrating that gravel area. Dr.Mason asked about cleaning the chambers. Mr.Slaker said there are no manholes. It is buried under the soil. Mr.Capicotto said they are shallow enough so that a laborer could do that. Mr.Slaker said they used 2 ft.by 2 ft.regular commercial grade catch basins,rather than small plastic ones that are used as yard drains and tried to get an 18 in.sump in the bottom. Dr.Mason asked the total depth. QMr.Slaker said it is a little over 1'h ft.from rim to invert and another 18 in.below that. Dr. Mason asked if there were any other questions. There being none, on a motion made by Mr. Papazian,seconded by Ms.Aisen,it was unanimously RESOLVED,that the Public Hearing be,and hereby is,declared closed. Dr.Mason said this is a Type II under SEQRA. On a motion made by Mr. Papazian, seconded by Ms. Harrington, the following resolution was unanimously APPROVED: WHEREAS,Stephen Land has applied for a permit pursuant to Mamaroneck Town Code Chapter 114 for the premises located at Lot No.29 Mohegan Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 208,Lot 546;and WHEREAS,this Planning Board has previously determined that the proposed action is a Type II action and that no further review is required under SEQRA;and WHEREAS, the Consulting Engineer to the Town has submitted comments and recommendations in writing regarding this application to the Planning Board;and WHEREAS,this Planning Board has determined,pursuant to Mamaroneck Town Code Chapter 114,that the activity proposed is of a minor nature and is compatible pursuant to 6 NYCRR§665.7; WHEREAS,a Public Hearing pursuant to Mamaroneck Town Code Chapter 114 having been held on February 9,2000,March 8,2000;Q NOW,THEREFORE,BE IT RESOLVED,that this Board makes finds as follows: f Planning Board March 8,2000 Page 4 1. The activity proposed is of such a minor nature as not to effect or endanger the balance of systems in a controlled area; 2. The proposed activity will be compatible with the preservation, protection and conservation of the wetland and its benefits,because(A)the proposed activity will have only a minor impact,(B)it is the only practical alternative,and(C)it is compatible with the economic and social needs of the community and will not impose an economic or social burden on the community; 3. The proposed activity will result in no more than insubstantial degradation to,or loss of any part of the wetland because of the minor impact of the activity and the protective conditions imposed by this resolution; 4. The proposed activity will be compatible with the public health and welfare,because of its minor impact in the controlled area; BE IT FURTHER RESOLVED, that the application of Stephen Land for a permit, pursuant to Mamaroneck Town Code Chapter 114,be and it hereby is granted subject to the following terms and conditions: 1. This permit is personal to the applicant and may not be transferred to any other individual,entity or combination thereof; © 2. All debris is to be removed prior to the completion of the project. 3. Construction must be in accordance with plans submitted,dated last revised 3/6/00,and the requirements of the Town Flood Damage Prevention Code and the Town Erosion and Sedimentation Control Law. 4. Work involving site preparation shall only take place from Monday through Friday between the hours of 8:30 a.m.and 4:30 p.m. 5. A cash deposit or bond for$1,500.00 shall be furnished to the Town by the applicant to ensure the satisfactory completion of the project and the rehabilitation of the affected or disturbed area. 6. This permit shall expire upon completion of the proposed activity or one year from the date of its issue whichever first occurs. Dr.Mason read the next application as follows: CONSIDERATION-RENEWAL/SPECIAL PERMIT-Trader Joe's East,Inc.-1262 Boston Post Road-Block 407,Lot 192 Donald S.Mazin,Esq.,of 1415 Boston Post Road,Larchmont,the attorney for the applicant addressed the Board. He is present requesting renewal of a special permit obtained a few years ago. It is not only a unique high quality grocery store,but a very cordial staff that attends to that. Mr.Mazin said it is an excellent asset to the community and they hope that the renewal will be granted and the matter put on for a public hearing. He asked he be provided with the date and then will send out the notices. He stated that © Doug Carney,the manager,is also present to answer any questions the Board may have. Ms.Gallent asked if the applicant is seeking any changes in the conditions. Mr.Mazin said no changes are being requested. .S a •r'. Planning Board March 8,2000 Page 5 Dr.Mason asked that the matter be set down for a public hearing. Mr.Mazin asked the next meeting date,which is April 12,2000. Ms.Gallent said this matter has to be referred to the Westchester County Planning Board,not to the CZMC. NEXT MEETING The next meeting of this Board will be held on April 12,2000.
