APPROVAL OF MINUTES There was no discussion regarding current open minutes.Copies of all outstanding minutes will be sent in the next packet On a motion made and seconded by,it was unanimously RESOLVED,that the Public hearing be,and hereby is,declared open. Ms.Reader informed those present that item number 4 will be heard first because it can be resolved quickly: PUBLIC HEARING-SPECIAL PERMIT/Augie's Restaurant- 2417 Boston Post Road- Block 505,Lot 446, Elliot Pollack appeared to address the Board regarding the issue of the illegal tenant in the upstairs apartment. After some discussion regarding meeting dated,on a motion and seconded,it was unanimously RESOLVED,that the Public Hearing be,and hereby is,adjourned to the April 9,2003 Planning Board. Ms Reader read the next application as follows: PUBLIC HEARING- AMENDED SI1I, PLAN and FRESHWATER WETLANDS AND WATER COURSES PERMIT (tee Construction) -Winged Foot Golf Club- 851 Fenimore Road Block 347, Lot 1 (adjourned 10/9/02;11/13/02;12/11/02;1/8/03;2/19/03) Ms.Reader asked if there was any discussion on that. Jim Hahn,Hahn Engineering,appeared to address the Board. He stated that Mr.Burns and Mr.Greytok made a presentation last month,then went to the Coastal Zone Management Commission and obtained approval with the proviso that we double up basically on the erosion control measures. Ms Reader read the significant paragraphs to the Board from a letter,dated February 27,2003 addressed to Mr. Carpaneto from the Westchester County Planning Board by Edward Buroughs,AICP,Assistant Commissioner: The Board discussed this application,and its findings revealed that there were little or no adverse impacts on the neighborhood or community and therefore voted as follows: Poll Board: Board Member Yes/No/Abstained Marilyn S.Reader,Chairwoman Yes May W.Aisen Yes Robert A.Cohen Yes Edward Z.Jacobson Yes C.Alan Mason Yes Edmund Papazian Yes Marc H.Rosenbaum Yes On Motion made by Mr.Rosenbaum,seconded by Ms.Aisen and unanimously approved,the Negative Declaration as amended. On motion made by Mr.Cohen,seconded by Dr.Mason and unanimously approved,the Amended Site Plan and Freshwater Wetlands and Water Courses permit were approved as follows: AMMENDED SITE PLAN: WHEREAS, Winged Foot Golf Club submitted an application for Amended Site Plan(Tee Construction)Approval for the premises located at 851 Fenimore Road and known as Block 347,Lot 1:and WHEREAS,the Planning Board has been designed lead agency and has conducted and completed proceedings pursuant to SEQRA;and WHEREAS, the Planning Board has reviewed all of the submissions by, and on behalf of the applicant, all correspondence from Town officials,the Consulting Engineer to the Town,the Board of Architectural Review and the Coastal Zone Management Commission and members of the public,and Public Hearings have been held pursuant to notice on October 9,2002,November 13,2002,December 11,2003,January 8,2003,February 19,2003 and March 12,2003. NOW, THEREFORE, BE IT RESOLVED That Amended Site Plan Approval is hereby granted for the application submitted by Winged Foot Golf,subject to all terms and conditims set forth herein: I. General Requirements All site work,landscaping,storm water drainage and treatment systems shall be in accordance with the plans submitted and dated January 27,2003,as follows: II. Special Requirements A. Water Retention and Drainage This approval is subject to fmal approval of drainage plans by the Town's Consulting Engineer. B. Erosion and Sediment Control-(During Construction) 1. Erosion and sedimentation control plans shall be based on the standards presented in the Town of Mamaroneck Soil Erosion and Sediment Control Law. 2. The control plan shall include a construction timetable and an inspection schedule. FRESHWATER WETLANDS AND WATER COURSES PERMIT: WHEREAS,Winged Foot Golf Club has applied for a permit pursuant to Mamaroneck Town Code Chapter 114 for the premises located at Lot No.851 Fenimore Road and Known on the Tax Assessment Map of the Town of Mamaroneck as Block 347, Lot 1 to construct a temporary settling basin and maintenance by dredging Upper Pond;and WHEREAS,this Planning Board has determined,that the proposed action is a Type I action and adopted a Negative Declaration,annexed hereto:and WHEREAS, the Consulting Engineer to the Town has submitted comments and recommendations in writing regarding this application to the Planning Board;and WHEREAS, this Planning Board has determined, pursuant to Mamaroneck Town Code Chapter 114, that the activity proposed is of a minor nature and is compatible pursuant to 6 NYCRR §665.7: WHEREAS,a Public Hearing pursuant to Mamaroneck Town Code Chapter 114 having been held on October 9, 2002,November 13,2002,December 11,2002,January 8,2003,February 19,2003 and March 12,2003; NOW,THEREFORE,BE IT RESOLVED, 1. The activity proposed is of such a minor nature as not to affect or endanger the balance of systems in a controlled area. 2. The proposed activity will be compatible with the preservation,protection and conservation of the wetland and its benefits,because(A)the proposed activity will have only a minor impact,(B)it is only practical alternative, and (C) it is compatible with the economic and social needs of the community and will not impose an economic or social burden on the community: 3. The proposed activity will result in no more than insubstantial degradation to,or loss of any part of the wetland because of the minor impact of the activity and the protective conditions imposed by this resolution; 4. The proposed activity will be compatible with the public health and welfare,because of its minor impact in the controlled area; BE IT FURTHER RESOLVED, that the application of Winged Foot Golf Club for a permit, pursuant to Mamaroneck Town Code Chapter 114, be and it herby is GRANTED subject to the following terms and conditions: 1.Pursuant to the recommendation of the Coastal Zone ManTement Commission to double the filter fabric and hay bales or double protection. 2.This permit is personal to the applicant aid may not be transferred to any other indivilual,entity or combination thereof: 3.All debris is to be removed prior to the completion of the project. Construction must be in accordance with the requirements of the Town Flood Damage Prevention Code and the Town Erosion and Sedimentation Control Law. 4.Work involving site preparation shall only take place from Monday through Friday between the hours of 8:30a.m.and 4:30p.m. 5.A cash deposit or Bond for$5,000.00 shall be furnished to the Town by the applicant to ensure the satisfactory completion of the project and the rehabilitatnn of the affected or disturbed area with erosion control and Freshwater Wetlands. 6.This permit shall expire upon completion of the proposed activity or one year from the date of its issue whichever first occurs. If any one wishes to review an audio tape of the meeting of March,12,2003,it will be available at the Building Department,after the certification is signed by the chairman and filed with the Town Clerk. A building permit is required before any work can begs on the aforesaid application. Ms.Reader read the next application as follows: PUBLIC HEARING- FRESHWATER WETLANDS AND WATER COURES PERMIT (Pond Dredging)-Win ged Foot Holding Corp.- 851 Fenimore Road Block 347,Lot 1(adjourned 10/9/02; 11/13/02;12/11/02;1/08/03;2/19/03) After some discussion,on a motion made and secosded,it was unanimously RESOLVED,that the Public Hearing be,and hereby is,adjourned to the April 9,2003 Planning Board meeting. On motion made and seconded,it was unanimously RESOLVED,that the Public Hearing be,and hereby is declared closed. NEXT MEETING The next meeting of this Board will be held on April 9,2003.
