MINUTES OF THE REGULAR MEETING OF THE
PLANNING BOARD OF THE TOWN OF MAMARONECK

CALL TO ORDER
The meeting was called to order by Chairwoman Marilyn Reader at 8:22 p.m.
The Public Stenographer was present for this Meeting and her transcript will become a permanent part of this
record.
APPROVAL OF MINUTES
After some discussion regarding open Minutes,Ms.Reader said to send all drafts of the meetings to May Aisen,
Judy Gallent and Ms.Reader for review. The approval of open Minutes will be adjourned to next month.
Ms Reader said we're changing the format. Rather than doing a synopsis of our meetings, we're essentially
attaching the actual transcript. As the resolutions says at the top that in saying it incorporates the transcript and
anyone has the opportunity to order the transcript.
On motion made and seconded,it was unanimously
Resolved,that the Public Hearing be,and hereby is,declared open.
Ms.Reader read the applications as follows.
1.PUBLIC HEARING- AMENDED SITE PLAN/FRESHWATER WETLANDS AND WATER COURSES
PERMIT(Tee Construction) -Winged Foot Golf Club- 851 Fenimore Road-Block 347, Lot 1 (adjourned
10/9/02,11/13/02,12/11/02,and 1/08/03)

Mr.Burns presented,stating that they were at a disadvantage Jim Hahn the engineer was not present. The Chair
asked if the matter was referred to the CZMC. After further discussion,including proper notice,on motion made
and seconded,it was unanimously
RESOLVED,that the Public Hearing be,and hereby is,adjourned to the March 12,2003 Planning Board
meeting.
2.PUBLIC HEARING-FRESHWATER WETLANDS AND WATER COURSES PERMIT(Pond Dredging)-
Winged Foot Holding Corp.-851 Fenimore Road-Block 347,Lot 1(adjourned 10/9/02,11/13/02,12/11/02,and
1/08/03)
The above matter was adjourned to the next meeting at the request of Winged Foot.
3.PUBLIC HEARING-FRESHWATER WETLANDS AND WATER COURSES PERMIT/HECHT— 4
Adrian Circle-Block 307,Lot 73
James Miller(project Architect)provided the Board with revised plans dated 1/28/03 and 2/7/03. The chair
advised Mr.Miller that in an effort to accommodate Mr.Miller,Mr.Capicotto has to give the Board his fmdings
with respect to the project,the Freshwater Wetlands Permit,whether it's consistent or not with the New York
State Regulations.The chair will recall the case later in the evening after Mr.Capicotto has had a chance to
review the plans.
4.CONSIDERATION-SPECIAL PERMIT/Augie's Restaurant-2417 Boston Post Road-Block 505,Lot 446
Elliot Pollack appeared to represent the applicant this is a transfer of ownership,the Special Use Permit is out of
date and they are there to reapply for a Special Use Permit.The Chair stated it has to be referred to the
Westchester County Department of Planning and the CZMC for a Special Use Permit. The matter is adjourned to
March 12,2003 Planning Board Meeting for a public hearing.
5. PUBLIC BEARING-FRESHWATER WETLANDS AND WATER COURSES PERMIT/HECHT-4
Adrian Circle-Block 307,Lot 73
Mr.Capicotto has written a letter with respect to the Freshwater Wetlands permit. The letter is part of the record.
On Motion made by M. Rosenbaum, seconded by M. Reader the following resolution was unanimously
APPROVED.
The Board felt there was no adverse impact on the neighborhood or community and voted unanimously.
CERTIFICATION
WETLANDS AND WATERCOURSES PERMIT
As Chair of the Planning Board of the Town of
Mamaroneck, I hereby certify that the following is
the Resolution adopted by the Planning Board at
the meeting held on February 19,2003.
WHEREAS,Dr.&Mrs.Hecht("Applicant")has applied for a Wetlands and
Watercourses Permit pursuant to the Wetlands and Watercourses Protection Law of the Town of
Mamaroneck(Local Law 6-2003)Town of Mamaroneck Code,Chapter 114(the"Wetlands Law")
for the premises located at Lot No.4 Adrian Circle and known on the Tax Assessment Map of the
Town of Mamaroneck as Block 307,Lot 73;to construct a family room addition to a one-family
residence and
WHEREAS,this Planning Board has previously determined that the proposed action is
a Type II action and that no further review is required under SEQRA;and
WHEREAS,The Planning Board has adopted a Negative Declaration of environmental
significance,a copy of which is attached hereto;
WHEREAS,the Consulting Engineer to the Town has submitted comments and
recommendations in writing regarding this application to the Planning Board;and
WHEREAS,this Planning Board has determined,pursuant to Mamaroneck Town
Code Chapter 114,that the activity proposed is of a minor nature and is compatible
pursuant to 6 NYCRR§665.7 as well as the Town Law No.7-1986:and
WHEREAS,A Public Hearing pursuant to Mamaroneck Town Code Chapter 114
having been held on February 19,2003;and
WHEREAS,the Board has reviewed application and drawings dated 12/10/02,last
revised 2/7/03,for the above-referenced project;and
NOW,THERFORE,BE IT RESOLVED,that this Board makes findings as follows:
1. The project is within the 100 ft.adjacent area to a Freshwater
Wetlands and is not within the 100-year flood zone;
2. Based on Board review and Board opinion,the activity satisfies
the compatibility tests and meets the aforementioned criteria;
3. The activity proposed is of such a minor nature as not to affect or
endanger the balance of systems in a controlled area;
4. The proposed activity will be compatible with the preservation,
protection and conservation of the wetland and its benefits,
because(A)the proposed activity will have only a minor impact,
(B)it is the only practical alternative,and(C)it is compatible with
the economic and social needs of the community and will not
impose an economic or social burden on the community;
5. The proposed activity will result in no more than insubstantial
degradation to,or loss of any part of the wetland because of the
impact of the activity and the protective conditions imposed by
this resolution;
6. The proposed activity will be compatible with the public health and
welfare,because of its minor impact in the controlled area.
BE IT FURTHER RESOLVED,that the application of Dr.&Mrs.A.Hecht for a permit,
pursuant to Mamaroneck Town Code Chapter 114,be and it herby is granted subject to
the following terms and conditions:
1. This permit is personal to the applicant and may not be transferred
to any other individual,entity or combination thereof.
2. All debris is to be removed prior to the completion of the project.
Construction must be in accordance with the requirements of the
Town Flood Damage Prevention Code and the Town Erosion and
Sedimentation Control Law.
3. Work involving site preparation shall only take place from Monday
through Friday between the hours of 8:30 a.m.and 4:30p.m.
4. The applicant should be required to furnish the Town with a bond in
the amount of$1,000.00 to ensure the satisfactory completion of the
project and the rehabilitation of the affected or disturbed area.
5. This permit shall expire upon completion of the proposed activity or
one year from the dated of its issue whichever first occurs.
REFERRAL-Proposed Local Law known as the"Moratorium on Development along a section of the •
Boston Post Road"Law
William Maker(Town Attorney) addressed this matter,stating that an expert should be retained to see
what types of zoning might be appropriate in the year 2003 as opposed to what was appropriate in 1987.

On a motion made and seconded,the meeting was unanimously adjoumed at 9:10 p.m.
